It also says to file it at a different location than what I was instructed to file it at.  It says the Lewisville Lockbox in Texas.  But I filed at the Vermont Service center because that's where I was instructed.  I would deff. check to see if you're supposed to send it to the Lewisville or somewhere else.

Strange.  The information on the example forms and the guides are different.  It says its different for the two visas but actually it is not.  You're supposed to fill out the one you're filling out.  I'm sorry for the confusion.  I was looking at, I guess, a not updated example form.  Unfortunately, I caused you some confusion because sometimes the links are old... You're good to go.

Are you applying for the K1 or the K3?  Because you're filling out the K3 form right now.  There is an I-129f for the K3 and an I-129f for the K1.  They're different...

Is an I-94 the form I fill in on the plane before landing ?? if so do I use this one for I-129f we will send next week as I arrive in 3 days.


 

If the question asks if your fiance is currently in the U.S., then put the details of the current visit.  

 

An I-94 is used for when you apply for SSN.  I don't believe it has any other purpose.

We are currently filling out our i-129f and just need to clarify a couple things.

We have lots of blue edit boxes that we don't need to fill out I.e prior spouse etc. Do we leave them blank ?

Also question 15a under about alien spouse, if we send the petition in while fiance is visiting do we fill this part out as he will of left US when its delivered ?

Thanks more question may come as we need to get it correct first time.

Just put NONE or N/A.  Some leave them blank but from my experience, it's best to clarify and just put NONE or N/A.

it isn't against any law to visit the US with a pending petition if you have a tourist visa or are from a VWP country, which the OP is from. The only time it's illegal is if you enter the country illegally

Use your return ticket and letter of employment as evidence that you'll return to your country.  Any other documentation that proves you have ties to your country.

 

It is a long process.  But at leastyou have the opportunity to apply witht he VWP.  Some countries don't....Found out the hard way.  Be prepared to wait months though if you are not accepted though when you apply for the VWP...  There's always that chance. :(

it is NOT against the law to visit with a k1 pending, you either misunderstood or you were given the wrong information. The OP is from a VWP country and doesn't need a visa

To the OP: you can visit but it will ultimately be up to the cbp officers discretion if they allow you in with a pending k1. Make sure you bring proof that you will be returning to your country. They want to make sure you won't attempt to marry and stay and adjust status

 

There wasn't a misunderstanding.  Technically it IS against the law because Russia is not a country that participates in the VWP.  

 

I did just give the OP a link answering his question.  He can try to get it, because his country participates in the VWP but you're right: its up to the CBP officer. 

Good advise about bringing proof.  That'll have a lot to do with if it is accepted.

Hi all, 

 

I have a couple of questions really before we send our petition. 

 

1. Can i visit my fiancee (petitioner) in the US while a petition is in progress ? do i need to take anything when traveling 

 

2. Can i go to a US bank with $340 and get a cheque made for sending with the K-1 ? Fiancee has no chequebook.

 

3. A bit confused on the convictions part of the K-1, it seems to be aimed at abuse, My fiancee has a DWI at the moment and on probation and no other drug/drink offences. do i tick no on the 3 convictions questions ?

 

4. Do we only send the K-1 i-129f form and a cheque to start with ?

Answer 1. My fiance and I tried to get a tourist visa for him so we could visit my family in the U.S. for the holidays but were denied because the consulate told us it is against the law for him to issue a visa while we are in the K1 process.  But I don't know if that is true for all cases.

 

Answer 2. You should write a personal check.

Advise.  You should follow the instructions completely and don't cut corners otherwise you risk being issued an RFE, which lengthens your wait time.

Hi there,

 

I am planning to sponsor my fiance to come to America in March 2015.  I have been researching the requirements for financial support, and I would just like to clarify something.  With the part-time job I have now, I am able to slightly exceed 100% of the federal poverty guidelines.  However, I can't meet the 125% requirement.  We have someone (non-family member) who is willing to be a co-sponsor.  I know that the government requires 100% for the I-134 (before entering the U.S.) but 125% for the I-864 (after entering the U.S. and getting married).  My question is, should we have the co-sponsor fill out the affidavit of support before he comes to the U.S., or can we just wait until after he comes, since I am able to exceed 100% of the poverty guidelines now?

 

All and any help is greatly appreciated.

If a person is still legally married, but already in the ending stages of divorce, meets and falls in love with another person, and becomes engaged to them before their divorce is complete, but only files the petition after the divorce completes: how would that effect the validity of their engagement in the I-129f petition process?  Would their I-129f most certainly be refused? 

 

Just curious.

AOS is even more expensive than filing the I-129f.  Having a baby is even more expensive than that combination.  I highly suggest waiting on the baby, unless he is making excellent money.  

 

As far as getting started, if you can afford a lawyer to do all the work for you, go that route.  Otherwise, use the GUIDES.  mmmmmmuch luck to you!!!!

You must also have met with your fiancé(e) in person within the last two years prior beginning the K-1 Visa petition process (filing the I-129F).  But I guess he means he met her in person, not that they just met as strangers.  The 2014 throws me off, that's all.

For starters, I hope you met 2013, not 2014....not enough time has elapsed.  Anyway, my fiance hadn't met both of my parents, just my mom and everything was okay.  The only time any question was brought up about my or his family was at his Interview in Moscow.  They simply asked how each family felt towards our relationship.  We answered that they supported us with all their hearts. Michele, I'd like to share my experience.

 

I've lived with my fiance in Russia for nearly five months.  Back in November, we went to the Embassy to interview for a B2 tourist visa.  We wanted to visit my family for the holidays, and then return to have his interview for the K1 visa.  We were denied.  We were told that it would be against U.S. laws for him (the consulate) to issue my fiance a visitor visa because we are in the K1 visa process.  

 

It made no sense to me at the time because we would never stay in the U.S. on a visitor visa, when we are going through the K1 process.  It would ruin the whole process.  So why couldn't we go for a holiday visit?!  Did the consulate really think we would have stayed?  I think its ridiculous because that would mean the K1 would be ruined...

Hello Everyone, 
 
I have applied for my wife IR-1/CR1 spouse visa. It was approved from USCIS in Nov 15th 2013 then i received NVC number in Jan 15th 2014. I have completed DS 260, DS 261 and send the civil docs (like 2 photo, Marriage and birth certificate and passport copy) and I-864 with the pay check, 3 yrs tax return and W2 and 6 months of paycheck. As per the NVC, they received all my docs on 02/07/14. Does anyone know how long does it take to complete the applications, send it to US embassy in India and when will we hear abt the interview date ( can we re-schedule the interview date to bit earlier date ex- if the interview date is on  03/06/14 then can we re-schedule to 02/28/14 or not).

It takes about a month or so for case complete. Times vary on getting appointments after that. Read previous posts to get an idea of timelines, that's what they're there for. And for your last question, read the post just before yours lol.

Ya, I was a March filer, and we tended to ask the most questions, or had the most people on this forum.  Feb I-130 filers had about 85 pages of comments/posts, and March had about 315.  LOL.

Well, I Skyped with my wife tonight, and she called the embassy in PI while we were talking.  They confirmed they received our case from NVC, and she asked if we could get an earlier interview.  NVC scheduled our interview for March 10th, but the nice lady on the phone moved us up to February 25th.  We didn't ask if there had been a cancellation or why they moved us up, just happily accepted and here we are.  

 

Dwheels, you can change our interview date on the list I guess.

They really are taking their time mailing my case to the embassy.   Kept looking online to see it change status to "transit" or "ready".  Nope still at NVC.  I even called and they told me "The online status is unreliable.  Your case is currently in line to be mailed to the embassy and you have interview date March 3rd..." ect...   Less than 3 weeks away and it hasn't been put in the mail yet.headbonk.gif   

 

Ya, I think the weather delayed them.  Mine also took about 1.5 - 2 weeks to mail.  They finally sent it off this week.  Hopefully yours will also be sent soon.  

My wife also plans on calling the embassy when the package arrives, to see if she can get an earlier appointment.  Most people have said that only the fiance visa applicants can call and get an earlier appointment, BUT the lady she talked to yesterday said that she could (and she emphasized it was a CR-1).  So I guess we'll just wait and see...

Checked CEAC website, and our case now shows "In Transit," and I called NVC to confirm and they said our case was shipped out on Feb 7th.  I haven't seen any information on the DHL website yet, but I'll check later.  Like everything else, their website doesn't always update immediately either.  The last package I saw leave NVC to Manila was dated Feb 4th (right before the bad weather up there).  So I'm sure I'll see something tomorrow.  

 

My wife did her medical at St. Luke's already and she's good to go.  They didn't have the TDAP shot available though (for tuberculosis vaccine I think), but she was told she could get that from her regular doctor and just take the proof to the embassy interview.  So now we just sit back and wait until March 10th...  Four more weeks!!!  (And hopefully it doesn't take TOO long for the visa to be ready, so she can come "HOME" soon after that!)

My wife went and got her medical today, but they were out of tetanus shots, and the medical people told her she'd be fine, that she'll just have to get the shot when she gets to the USA.  Has anyone else had an experience like that?  Any similar examples, etc?

Hey dwheels76, how can I find out about what comes after my husband arrives, just thinking ahead here, I know that we will need to pay the $165 after he receives his visa, and then wait for his green card to arrive, but what about getting his social security card and is there any other info we need before adjusting status? Sorry for the run on sentence.... smile.png

 

And how long does it take to get a SSN?  Does that take a few months also?  Or is that longer?  Or does it come with green card?  (assuming $165 is paid right away)

Unfortunately people see a few fluke quick approvals out of thousand and thousands likely done to make USCIS averages better, and think that's how it's going to be for them.  It is erroneous thinking and is only going to aggravate you.

 

They don't tell people when their case will be adjudicated because they don't know, and even if they did, they still wouldn't tell you, because then if for whatever reason it didn't happen in that timeframe people would just freak the ###### out on them.

 

People who just filled in November and forward should be far less antsy in the pantsy and expecting approvals any day now.  Expect 5-6 month wait.  If it comes sooner, then goody.

 

I don't know why but this cheered me up in a weird way, these 3 1/2 months don't feel so terrible when you think of it like that. Seeing others early gets pretty upsetting but I didn't really take in the fact that its a small fraction (even if it seems like the majority, anecdotal evidence and all).

Hi Devy and Lynette, I'm just curious about how you went about writing your senator. I saw that you thanked Trisha on the instructions, but I can't seem to find in this thread where she mentioned how or what I'm supposed to write to my senator. 

 

I'm an October filer, so it's only been 4 months for me. It's still very frustrating because it does seem that you're either approved early or 6+ months down the line :( I want to do anything possible that I can to make things go faster. I can't file a request yet since we don't pass the processing time until March 15th, but I would love to know if there is something else I can possibly do. Calls to their customer service never get me anywhere past "you're not past approximated processing time, sorry".

 

I've been checking up on y'all August folks waiting on NOA2 for a while, very happy to see you get yours. I really hope Trisha's comes in soon.
