I know that year 2 and 3 are optional for the I-864. If I send the transcripts only will this be sufficient or do they want all or nothing? W-2 are packed in the basement and we are remodeling so it's a huge inconvenience to pull them out.

Hello VJ people,
I was married in May of this year on the 17th and I filed the petition I-130 on July 18th got my NOA1 on Aug.4th 2014 then mailed out the I-129F on Aug 28th priority mail and have not gotten any thing as yet is this normal? also I am watching the Vermont status of our petition and it goes from 49 to 50 to 52 can some one please explain this process to me. How long do I have to wait for a reply for the I-129F?

USCIS goal processing times are usually 5 months. It is highly unlikely you will receive a response from the i-129f. Since the i-130 is usually approved before or at the same time the i-130 is what moves forward to the NVC.

Once you receive an NOA 2 your case will be forwarded on to the National Visa Center (NVC). At the NVC you will submit an online visa application, and an AOS and IV package. You will need original documents such as a birth certificate, military record or exemption if applicable, marriage certificate, and a police certificate. Also, be advised you will need to provide certified translations of any documents not in English or at least most embassies I know of want that. So there's a quick snapshot of the next step for you. Pretty sure that does not apply to Consulates. I thought you said it was due to communication issues?


We know the consular officer had issues with our language barrier but we have not received an actual declaration of the reason for refusal. FOIA requests can be made to get the case file I just don't know how exactly.

Hey everyone,

I was wondering if anyone here has any experience making a FOIA request for a case file from a visa interview. My husband was interviewed 9/1/14 in Cairo. We a were put into AP and they requested more proof of relationship. We submitted it and then they wanted his passport so we thought all was well. I got an email our case was being sent back to USCIS on 9/11/14. My husband and I are both very frustrated that we still don't have a reason why it was denied even after getting the official letter saying it was being sent back and USCIS would contact us shortly. We can speculate but I want to know so we can prepare to reply to NOIR if that is the case. Any tips would be appreciated. The instructions for FOIA requests are very vague and I don't even know who I would send it to.

I completely understand why there is a backlog. I have been there during major civil unrest. I know the embassy gets closed a lot.

People saying to request an expedite, we already did that and the embassy denied our request when we first got to the NVC. What grounds do I have to request another?

Hey girl. Here is the email address I use consularcairoiv@state.gov <-----------Is that the same one you use? I would keep bugging them a bit :D According to my timeline, we only waited 173 days for our interview compared to some I have seen over 400 days.

 
Nevermind. Just noticed you said NVC STILL has your case. Why in the world is that????????? Ours was forwarded FAST from NVC to Embassy. Who knows I guess. This whole process is weird and every case different




I called and talked to them. They told me to expect a long wait and it will stay at the NVC until the interview is scheduled. I think K1 visas are handled differently than the IR-1s.

It still a wait for K1's maybe 4  to 5 months but if you look at the wait its still very long for them. Everyone I have been following K1 or otherwise getting interview under 4 months is an expedite. Sorry.
 
And no matter the embassy K1's always get interviews sooner they have less processing then we do. From NOA1 to interview is less than 8 months for most.



It basically just sucks for all of us. It does make sense that K1s are processed faster though.

I guess we shall gear up for another 4 months and hope we may get it sooner!

Thanks for all the replies. We are married, just to clarify.

We got an expedite for USCIS. But were denied at the embassy for an expedite on his interview.

I called the NVC and they told me our case was complete and just waiting for an interview. If the wait is 6-8 months, why are people I know doing K1 instead of the IR1-CR1 getting interview days faster?

Our case was complete at the NVC on March 13, 2014. Got an email saying it was waiting for an interview to be scheduled. It has been 4 months and we have heard nothing. CEAC still says at NVC. Does the NVC forward the case before an interview appointment can be made? Or does it sit at the NVC while you wait for it? I'm getting worried that something has gone wrong.

Hello,  i finally spoke with the NVC this morning and i got the invoice number to be able to log in online. Now i am about to fill the DS 261 form but it indicated that it is advisable to put a US address for mail delivery, i am actually living in South Korea. And again, the DS 261 form is all about me right? cos it shows my surname and first name already in the form when i logged in. Please kindly put me through more on how to fill the DS 261 form.
 
Also, the affidavit of support fees is not available to make the payment but the IV fees is only showing NOT INVOICED and can't be clicked/selected for payment. Do i have to complete the DS 261 form before the AOS and IV fees can be paid?

The DS261 is filled out as whomever you want to receive mail and other information about your case. Commonly the US citizen (petitioner) is selected because of having a reliable mailing address in the US for any important documents or communication. But, you can definitely have it be yourself and put your mailing address as where you are living in SK.

Correct on having to submit the DS261 before you can pay the IV and AOS fees. Once your DS261 is submitted the NVC will make it so you can pay those fees and submit the DS260.

I would recommend printing out all the confirmation pages from the CEAC site or saving them to your computer.

They gave us the case number but the i never even thought of asking for the invoice number since they kept saying that we will have everything in the emails sent to us. Can the invoice number also be given on the phone just like the case number? I thought they give the invoice number later or it will be in the emails they said it was sent or something. I am just confused. Hope to hear from you soon. Thanks

I believe you can get the invoice number over the phone. I waited for the emails so I'm not sure. The NVC does make mistakes in sending out their emails. I got a checklist from them for my husband's case and it didn't actually have any instructions. So we waited 30 days just for them to fix that. I would definitely keep calling until you get the email or try to get the invoice over the phone so you can get started on all the paperwork.

I called last week, and they told me I should hear back by May 2014. I am March filer sad.png

 

You are a March 2013 filer.  If that is so then that is a 14 month processing time!  #######, I am so confussed!!!

 

I was told the entire process from intial filling of the I130 to the day that my wife joins me in the US would talke a total of 12 months. 

 

Now I am reading that I130 processing time is take 14 months!

 

And who did you guys call?  When I called USCIS they would answer any qestions on processing time

#######! I can't believe it takes that long. I was spoiled the first time I did this. The whole process from start to finish took less than a month. I was in the military then, so they expedited my paperwork.

Hello everyone, I am in a similar situation.  I filled my I130 in May, 2013.  According to the USIC website my I130 has been in intial review ever since May 20th.

 

My question for the forum is - How long does this entire process take?  How long, on average, will take before my wife can join me here in the US?

 

Any feedback I can get would really help me out, I been freaking out for like 5 months now, called USCIS couple times already but they wont answer any of my questions.
