So before I ask my question I think I should give you some background information....

 

- Married in Japan 2002

- Applied for greencard in 2005, whole process was expedited and took less than a month because at that time I was active duty military

- Moved to US in 2005 and received 10 year greencard same year

- Daughter born in US

- 2006 discharged from military - moved back to Japan

- 2011 I moved back to US, wife stays in Japan

- 2012 I return to Japan for summer visit

- April 2013 my son in born in Okinawa

- May 2013 reapply for greencard (I130 petition) because since she had been out of the states for over 2 years her greencard was no longer valid

- June 2013 I visit Japan, file for my sons American citiizenship and passport - receive both the same month

- August 2013 I return to US, I leave wife and 2 US citizen children behind in Japan

- Oct 2013 still waiting!!!

 

So from reading on here it could take up 17 months just to get my I-130 petition approved!  That?s nuts!

Anyways, Japan is a VWC so does anyone know if my wife could come stay with my for a awhile while we wait for the I130.  I would hate for her to get turned around at the border with both of my kids.  That would be a really traumatic event for my whole family ? plus a huge waste of money. 

But I just don?t think I can wait another 11 months ? this is crazy!

If you submitted absolutely no supporting documents whatsoever then a straight denial is a distinct possibility. You should hope to receive an RFE instead, or even a Notice of Intent to Deny, both of which would allow you to submit supporting documents.

 

Let?s hope that I get a RFE or a NOID, I don?t think my marriage can survive the wait if I have to start over from scratch.    Its good to know there is still hope.

So guys need some advice here, I am totally freaking out and want to know how screwed I am....

 

 

In my rush to get my wife over here I filed the I130 without the supporting documents.  This was back in May, I received notice of receipt so I know USIC accepted the petition.  I am still waiting for them to approve it.

 

 

So when it comes time for approval - are they just going to throw it out and make me start over or are they going to ask for the supporting documents?  I been waiting for my wife and 2 kids for way over 6 months now - I would hate for all that waiting would have been for nothing.

My wife is also in Okinawa waiting for me. I have 2 children With her both of them are US citizens. Been married since 2002. You would think it would be a no brainer with USCIS. But no been waiting since May to have my I130 approved. Just get ready to wait, it's going to at least a year for her to be able to move to the USA. Sucks, but there is really no shortcut t of it. Just submit you paperwork and then sit back and wait.

My fiance is currently in Naval and has not been feeling well for a little while. I am on very tight finances because of being unemployed for wayyyy too long and I am trying to figure out how much to send her so she can go and get checked out. She is very shy and doesn't want to ask around. She is also a bit afraid to see a doctor. Anybody have any help??

From My understanding the EWI form has to be filed in the beggining. I would assume that if a form was required they wouldn't wait 7 months to denie it or ask you for another form. I think under your case a lawyer would probably be a better choice just because of all the different possible outcomes of the EWI your going to face.

Of coarse right after I backed out I saw the forum just below the k3 entitled IR1 CR1. Just goes to prove I didn't look hard enough.

I work for the airlines and visit my wife on a regular bases. Our goal is to have her live here as quickly as possibly but also be able to go down to visit her family. I read some information on the IR1 CR1 but I'm still a little confused as to which one works the best for me. From my understanding the CR1 takes longer for her to go back to Peru and to work or am I reading that wrong?

Someone mentioned to me in an e-mail about doing a CR1. I looked up in the terms section of the site and also did a search and didn't find anything. What is it?

I'm getting close to sending the papers in. I'm just really frightened as I've heard that most of the applications are turned down and you have to pay and start over again. I'm about to translate the papers into English, do they need to be notarized? Also should I turn in ALL the papers even if they are not required until later? I know my taxes aren't due at the beginning but should I send that anyways?

My wife is Peruvian. Right now were hung up on if we should change her name now or wait until she gets to the states. Also because of the latin' herritage she has four names. All of which are important to her and have meaning withen the family so she doesn't want to give them up. I'm the only son to pass my family name. I would prefer not to hyphonate our last names or combine them. With all the traveling and signing I do It's just impractical. We were married in Peru and we are working on the K3 right now if that makes any difference.

Can she have four names?

Should we change it now or wait until she comes to the US?

Any suggestions?

Making that notation "Intent to do K-3" MAY get the I-130 held back by USCIS and the I-129F forwarded to NVC for K-3 when approved.

Wait for NOA2 for I-130 and I-129F and see, then contact NVC about 2 weeks later to see if I-130 got sent to NVC, if so then ask them to send you the I-864 packet, and keep the CR-1 process moving through NVC.

If I-130 is NOT sent on to NVC, you can file an I-824 t USCIS requesting counselor processing of the I-130.

IF the two petitions run their course, and it looks like CR-1 may catch up to K-3, you may contact DOS and/or consulate and request K-3 interview to be postponed, and when CR-1 gets sent to consulate, then contact DOS and/or consulate and request the K-3 interview be changed to CR-1.


I should wait for the NOA1 and NOA2 from the I130, Then File the I-129F, Wait for NOA1 and NOA2. If it says it was sent to the NVC then notify USCIS NVC That we will not be filing for the K3 but CR1 instead is that correct? Then if it was NOT sent to NVC then to just continue with the I-864 packet?

Because the CR1 doesn't require the I129F do we need to send it in anyways?

It states Cr-1/Ir-1. Interviews are normally very quick--less than 10 minutes. Most wonder after the interview 1) why they worried so much and 2) I really just forked over $$$$ for hotels and airfare/food for this?? They normally ask very basic questions--how you met--what ur spouse does for work, what ur plans are? Very basic. Now if ur have been born in a country not friendly to the USA or lived in one for an extended amount of time, the questions will probably still be basic, but they may "review" ur case longer, so not a fast turn around in getting ur visa!


After reading a bit more posts, "basic" is what I was getting, but just wanted to make sure. I guess it's the practical guy in me that thinks surely, there has to be a reason why US wants personal interviews, especially after all of the documents that has to be provided. But nonetheless, if it must be done, I'd prefer that it's basic. Just sucks having to fly to Montreal, get a hotel, spend money on food, etc. But bright side, never been to Montreal so might as well take advantage of it.

We have a Case Completed email from NVC today. Yeh!!! :dance: What happens next?


Congrats! I took a look at your timeline, as my case was received by NVC on Apr1...I noticed that it took them about 3 months to complete your file: was this because of just normal and current processing times on their end, or you took your time in sending them required info/fees, or a combo of both?

Reason I ask is I'm just trying to estimate how long my file will take to be processed by them. I'd be curious to know what your interview date will be, when you get that date. Thanks in advance for any info!

We had our interview today in Montreal.
We were done by 8:35h.
The interviewer lady asked 3 questions and she said congratulations, you are approved. Welcome to the US.

She asked my husband how we met ( weird because he's the petionner)
She asked if it was our 1st marriage
And finally if i had lived outside of Canada at any point.

A lot of people were turned around at the door because they had cell phones and bags. So for the people waiting for an interview, leave everything in your hotel room or your car and bring only your paperwork. Good luck!

I went to the SQ police station in my town ( i live in Quebec). Also took like 10 minutes... But i didn't need fingerprinting.


Does one have to wait for instructions from NVC before getting the police certificate step started? I'm just trying to get as much done as possible, rather than waiting for the instructions, so that it'll all be ready for when I receive the letter from NVc.

I've read a couple of posts about proving domicile (my wife is petitioning me but she lives with me in Canada)...question is do I send that into NVC with all her income/assets documentation or just bring with me to the interview?

Any word on your file going to the consulate yet? 
We sent our I864 and DS260 on the 6th and we don't have our NVC email yet. 


You haven't even received the email indicating that your documents were received?!? If so, that's an awful long time...did you at least get the generic auto-email from NVC (this gets sent out automatically anytime you email them something)? If you got that auto email, I would call NVC and check in. If you didn't get that auto email, then your email didn't go through. I submitted all of my docs on May 3 and received the "we've received your documents and it takes 20 days to process..." email on May 7.

I checked with NVC yesterday and there's a delay in processing my I864 as I used the new one. Apparently, Dept of State didn't tell NVC how to process this document, so NVC is just waiting for DoS to advise them.

I was looking into that myself by comparing timelines. It looked recently like a lot were completed and sent to the embassy within 2 weeks. At least that is what I gathered from timelines. 
 
We just sent our documents to NVC as well- how long did it take for you to receive the email? 
 



I sent all documents to NVC last Friday and received the receipt email this morning. I'm hoping it doesn't really take 20 business days to complete the case.

Yeah, I called NVC and they said it won't do any good sending in the old one, due to exactly what you said, they'll have to keep the file open anyway until the new one is processed. Frustrating. I thought I was doing a good thing by sending in the new form, but in hindsight, not the best thing. My worry was that by interview time (which would have been after the old form expired), Consulate was going to make a big deal about reviewing an old/expired form. Hope they process soon!
