We've applied for the IR-1 visa, but so far we've only sent off the I-130 form and are waiting (and waiting!) for our NOA2. I didn't file joint taxes with my wife as I still live in the UK until we get the visa processed.
 
I'm just scared of the possibility of them denying us the visa on this basis and ending up back at square one.




I'd doubt they would deny you just for that. Although, getting a joint or co sponsor could help since your wife does not have much income history to show she can support you both.

Ok. Well you can't give them what you don't have. If she's never filed taxes not much you can do except as you said, provide pay stubs as evidence and a letter would be good. As to what to put for the forms...either leave the box blank and explain perhaps in your cover letter or put NA. The requirements for that are different for every form.

As long as you enter the USA on the spousal visa after the 2nd anniversary, you get the IR1.  With your timeline, it'l be worth it- less fees and paperwork later.

Cairo is notorious for lengthy AP and I'm wondering what happens if we get AP and it ends up going long enough that we are married two years. Our two year anniversary is this upcoming Christmas. Up until we got an interview date CEAC said "at NVC" even after our case being complete for 5 months. The next update should be "in transit" Then "ready" for the interview. That is assuming your case is complete.

Whenever I have gone back to the CEAC site I have been able to look at the DS-260 and change the information entered. So maybe you can resubmit? Definitely call the NVC. Do not rely on an email. It took 60 days for them to let me know my address had been updated from an email inquiry.

So from what I've read, your case is now moving to the next stage. If you and your wife are not familiar with the NVC process, start reading the NVC filers threads. You can easily search for them by month and year. 5 months is actually quite good for i-130 approval. The NVC is slower than usual right now but try to get all your documents submitted as soon as you can and triple check everything. Best of luck.

Often it is just 30 days. Although with the NVC being backlogged you might be waiting longer. Hope it goes through. Expedites can be tough to get.

Yes I meant the i-864! Sorry about that!

I would call the NVC about the tax thing. It is possible it is a mistake. I thought ours was too, then I realized I used a different form than usual so where I got the income number was different.

I received a checklist form the NVC for my form I-864 and I don't understand some of what they want from me.
 
They state that the income I entered doesn't match my most recent tax form. I just double checked and it absolutely does.
 
They also say that I didn't prove that I have a US domicile. That is correct, I don't. I live overseas with my wife. Is that not allowed? Can I just put my parents' address or something?
 
The last part I understand, but didn't realize was necessary. For my wife's I-864a form, they said she didn't submit her IRS tax returns for the past three years. I was supposed to submit her three most recent foreign tax returns. I hope they're easy to get... taxes work a bit differently here.
 
Has anyone that has gone through similar issues give me some insight on how to proceed? Thank you :)








1. What form did you use for your taxes? The 1040 and the 1040ez or 1040a require different boxes to be used to show current income on the i864a. I got a checklist for that too. The official instructions for the i864a explain that more.

There is a thread on what type of evidence you can use to prove US domicile. It doesn't matter that you live abroad, you need to prove ties you have to the US still.

3. I'm not quite sure why they even want your wife's taxes if she is not the USC. Sorry, can't help with that one. I didn't submit anything regarding my husband's income or taxes.

Only USCIS can revoke the underlying I-130 petition, not DoS. DoS will return the file to USCIS and state their reasons for why they believe your I-130 approval should be revoked. USCIS will either agree with DoS' recommendations and send you a Notice of Intent to Revoke (NOIR), or disagree, re-affirm your approval, and send it back to the NVC.

If USCIS decides to issue a NOIR you will have an opportunity to rebut the negative points that USCIS have decided.

You should file a FOIA request in order to obtain a copy of the case file from the embassy which will tell you why they denied the visa.

It will take around 6 months for USCIS to decide what action they are going to take. You should strongly consider retaining an immigration attorney experienced in these sorts of cases, or at the very least consult with them.

My husband has his interview on September 1st at 730am. His fingerprints were taken promptly after him entering the embassy but then had to wait an hour before being interviewed. The consular officer was an American man who spoke Arabic. He treated my husband poorly from the start and told him his English sucked. The interview lasted only 30 minutes. Asked how we met, where I went to school and did I graduate, the names of my family members, very basic questions. The CO told my husband at the end he believed he was not telling the truth because of our language barrier and gave him a paper requesting our chat logs from Facebook since that is how we commonly communicate. My husband tried to show the CO more evidence he had brought with him but he refused to look at it. Simply told my husband "I want more" in a rude tone and ended the interview.

We submitted 50 pages of chat logs that spanned our entire relationship. They requested his passport on September 10th so I thought all was fine. I emailed Cairo to confirm they got his passport. They told me they had but the case had been sent back to USCIS for re adjucation and to contact USCIS for the status.

I am unemployed (for the last 16 months) but I hope to be employed soon. If I get a co-sponsor to help me for the affidavit of support can I have them "removed" at a later date after I get steady employment again or are they responsible for the whole 10 years no matter what?

No that is not enough. He will need around $18,000 to qualify. However, assets or a cosponsor may be used to fufill the requirement.




Hello Im new to all this Visa Journey so bare with me! Im wondering about a co sponsor. I dont make enough myself to sponsor him so I have to have a co sponsor. My co sponsor makes about 40000 for a family of 4. What kind of information will they want to see income? Would W2s be enough?? (He is not self employed) Or would there be another form for his employer to fill out??

Montreal, where you'll interview, the only consulate that does immigrant visas, is VERY strict about domicile - meaning the USC establishing or re-establishing domicile in the US prior to the immigrant beneficiary. Go on over to the Canada region forum. Do not have a 'wait and see' attitude, you can lose precious months.

Thank you...yes, I've read up on this, about domicile. My wife is already registered for school and she has all of the docs for this. Her mom will also be writing a letter confirming that we will be sharing a home with her and we'll be paying x amount of dollars. I love this site...I wouldn't have known to do any of that, if not for VJ!

I called them and they advised that that will take til end of April. I'm anxious and trying to estimate when your interview can be scheduled? Hello all! Just wanting some advice on using assets for I-864, as my wife (USC) lives with me in Vancouver and hasn't been working for last 2yrs (she's written a book and currently looking for agents). Our file was received by NVC on Apr 1 but nothing received from them yet.

I'm trying to get all my docs/info together, so I have some questions about the I-864: we'll be relying on assets but I've read some posts about it and people seem to indicate assets have to be in an account. However, on top of savings and checking accounts, I-864 also asks for real estate and investment net values. If I use all 3 sources, then we are more than 3 times poverty line.

So anyone here rely solely on assets AND was able to use real estate and investments? I just want to make sure I don't come to the interview assuming this is fine, then tell tell me that I'll need a joint sponsor, as I don't want any delays. Thanks.

I'm just having a look at the DS 230 and everything seems straight forward, except for item 35 asking for dates of all US visits. Do they really want every single visit??? I live in Vancouver and cross the border for simple things like picking up packages or getting gas. Or do they just want visits where we flew and passports were stamped? If not, my list will be about a page long.

I'm preparing for the processing of my approved I-130 by NVC (just received my case # today), so gathering the necessary documents. I took a look at my birth cert (which my parents had) and it seems that my "place of birth" on there is different from my passport and marriage cert.

Passport and Marriage Cert says "Manila, Philippines" but Birth Cert says "San Isidro, Nueva Ecija" (which is about 1.5hrs north of Manila). As I was going by my CDN Passport and Marriage Cert, which I had on hand at the time, I put "Manila" as my place of birth on the I-130 and G-325A.

Will this be a problem and if yes, what will I need to correct it? Thanks.

That's what I would do...if the new ones weren't being processed yet, sending in the old one would make sense. But as confirmed by NVC, along with other people on here, they're processing the new ones now. Good luck!

Hello everyone I am just curious which form is people using I am about to send my AOS out and I seen a topic on here that some where panicking about which form to use the old version of the I-864 or the new one? Now I know the old one will be expiring soon I think on the 23rd of this month if I send out the old one next week will there be a chance they will use it? Or  should I figure they might not touch it or a person get to it really for a couple of weeks? Just a bit nervous don't want to send out the wrong version and they delay our paperwork? Thank you for any advice it is appreciated.
 


Yes, there's a delay right now in NVC processing the new I-864. I sent the new form on May 7 and still has not been processed, as NVC is waiting for Dep't of State to tell them how to process (this is how NVC explained it to me).

Nevertheless, your're right, the old I-864 is expiring on June 24; so if you send the old one in, there's a chance that it is expired by the time NVC is processing it. At that point, you'll have to send in the new form and the rest of your documentation again. OR you take the chance of sending in the old one and perhaps it's processed before expiry, then lucky you!
