hello to all,

i am the intending immigrant and my wife is the primary sponsor

Her current and last 3 years income does not match with the poverty guidelines.so, we used her father as a joint sponsor (who signed I-864)

now turned in to deep, her mother and father filling their tax returns jointly and their son is dependent on him. in addition, my wife's father became an additional sponsor (signed i-864) 4 years before for some relatives (number:3) and now they all r LPR. originally primary sponsor was grandfather at that time.

 

my question is,

if we using my wife's father as a joint sponsor bt the house hold size goes to 7 

> him

>his wife

>son

>3 family member who were sponsored earlier

>ME

 

her father current and past income would not match with the poverty guidelines for 7 household members ($44,512).

we r planing to use their house as a assets. house is owned by him and the recent net value is about $1,35,000 but  they r paying every month installments to bank for the house. There is no loans on home.

 

SO, how much net price would be counted in this situation ??? how to evaluate the house net price !!!!

which type of documents needed by her father.

A person qualifies based on their current income, so based on what you write above, your wife qualifies for a household of two without any help from others.  It is a common mistake to think one must have qualifying income for all the past years.  It's also a common mistake to confuse last year's income with current income.

 

If your wife has a job now, with $23,000 in income, she qualifies for a household of two.  Use her current income where it asks for current income and document that with a current pay stub.  Then correctly indicate her income from the past three years where asked. 

 

Your wife's brother is your brother inlaw, not your son in law.

which documents she needs from her job to show her current income ?? she has her employment letter.

Any kind of written letter from the job is required to ask ??? she is working  in a wells fargo bank

Probably won't work.  For using cash assets to qualify, the Consular Officer wants to see several months of bank statements showing the cash has been there for a while.  Six months would be good.  You've got to stop looking at this like meeting the minimum is going be enough.  This is a judgment call for the Consular Officer.

 

Your petitioner is always the primary sponsor.  If the petitioner qualifies, they are the ONLY sponsor.

As in my case  3 years before ,my father in law sponsored 3 persons also my mother in-law is filling taxes together + their son (my son in-law) is dependent on them 

if they become my joint sponsor the total house hold size would be 7 and their 2013 income is $27,000 (jointly feeling) which is under the poverty guidelines for 7 people

what is the other options available for me??? advise me please

my wife changed her job recently. so,her 2013 tax returns is addition of previous work(5 months)+ current work (7 months)

but in this current job her annual earning is 23,000 which is fix and may be above it 

Is there any way we can use this things in our case ???

Carefully read the I-864 instructions when it comes to using assets, your alternate option is unlikely to be accepted.

sorry i read all the instructions carefully  for I-864

my wife's annual income( $13,208) for recent 2013 year + Her Uncle will give her $20,000 to deposit in her savings account

so the total income will be counted as $13,208 +$ 6666 (20,000/3) = $19,874 m i right ??? after that my wife will qualify as a principle sponsor for me???

poverty guidelines shows 2 household size income = 19,387

 

and what type of documents she will needed from the bank. Ex: last few months statements is kk

Your FIL's household count would be 5 in this scenario, here's the breakdown:

  • him
  • your MIL
  • the two people he already sponsored
  • you

 


this is a very tough situaion for us bec for 5 house hold members my father in-law  income never meet the poverty guidelines :( :(

can i choose the other option i want to tell u :

my wife annual income for 2013 years is $13,600 and she has cash balance in her account some thing like $10,000 

can i use only my wife as a primary sponsor ??? (not including her father and mother )

NVC will count her personal assets to meet poverty guide lines ???(poverty guide lines in our case for 2 house hold member is $19,387 )

Her annual income( $13,600) + personal bank balance ($10,000) assets will be little bit more then the poverty guide line

Wrong,

 

Your father in-law is a joint sponsor.  Second, he needs to also complete an I-8864.  Your mother in-law would complete an I-864A.

I get that I left of the "in-law" part and wrote part of my answer as if the OP was the petitioner.  However, his wife is the primary sponsor, her father the joint sponsor and her mother is her father's household member.  NOBODY is a co-sponsor on ANY I-864 EVER.

 

The OP, sadly is not reading the I-864 or it's instructions but is trying to get spoon fed the information on how the three Americans are supposed to complete forms in his behalf.  Read the instructions first.

Your father's household size does not include you.  He is not your household member.  He is the joint sponsor.  His household will include himself, his spouse, any "dependent children" and any immigrants previously sponsored that are NOW green card holders.

 

You and your parents would only count as part of the same household if you were his dependent on tax returns (most recent) of if you were combining income.  HE does not need to combine income with you, so will not.

 

You are the immigrant on all forms.

You need two I-864 forms.  One from your wife and one from her father, then one I-864a from the mother.  This is the only way the father's household size can accurately and reliably be stated.  I-864 is for combining income or for joint filing spouse.  Your father is not combining income with your wife, so he needs his own I-864 and will serve as joint sponsor, not "household member".

hey i am a little bit confuse about the affidavit of support
my wife is a main sponsor(she is sponsoring me) , she filed I-864  for me and her father (my father in-law) is our co-sponsor so, he filed I-864A . rght???

my wife is living with her family under the same roof
now the question is that my father in-law and mother in-law filling their tax returns together and in the tax transcript the total gross income is the addition of their both incomes !!!! 

how much income my father in-law has to write in the I-864A form from the tax transcript   ???
Is there any other documents i have to gather from my father in-law side to shows their individual annual income??? ex:W-2 
or i have to also include my mother in-law as a co-sponsor and file another I-864A by her ???

It is unfortunate that your fiance was denied his visa. I understand your frustration about ilegal immigrants, people on welfare and so on but it doesn't make it one notch unfair the drug use. I believe that we are in a process where we need to be in our best behavior, aether we are in our country or not. Drug use is drug use no matter what. Unless you have a prescription from a Dr then I would think otherwise. I believe we shouldn't judge not criticize others when drug use no matter what is bad. Drugs are as wrong as those "Ilegal Immigrants" and others are. Just my personal thought.

Husbands interview is on May 2 and we scheduled his fingerprinting and biometrics for May 1 becasue the india embassy said it needs to be a day prior to interview.

We still havent recieved our interview letter email yet tho, should i call NVC??

Yes, Ive been calling NVC every other day it seems just to see if I get a different answer.

 

Waited all this time, don't have patience anymore.

 

I submitted my husbands PCC with the civil documents since my husband got everything certified.

 

I hope we hear back soon, and they could get a interview set for march.

 

Do you know what documents they need to take to the delhi embassy?
