congrats! ours took past 7 months as well.
1. no worries, my case also never got updated online n still says 'received and pending'. dont worry about that online status site anymore.

2. national visa center is where your application is being sent from csc. they will then forward it to the foreign's country's embassy.

3. you will receive a letter in the mail from nvc (or the USC will) and then you will receive a letter from the foreign country's US Embassy. you can start working on Packet 3.

time it takes varies. check out my timeline (as well as others filing from your beneficiary's country) to get a rough estimate. interviews usually take a couple months at least from submission of packet 3.

dont risk it. I have a friend who did this and his wife got banned from the US for 5 yrs. he got a lawyer but it didnt help. 5 yrs later he tried to appeal the decision and she got an additional ban (was either 5 or 10 additional yrs, cant remember). he eventually moved to her country as he has dual citizenship. dont risk it!!

You will need to wait til you reach 6 months after ur noa1, then you can write your congressman and senator. you are still within a normal waiting time. I know its hard not knowing anything and seeing others get approved n you have nothing. you can call uscis, but i honestly dont think it will do any good (never helped me at least). I waited 7 months for our noa2 (219 day after our noa1). I got it i the mail one day n never had a touch (update) on my case online or an email. So, the answer u dont want to hear is the one you need, to just wait...til at least your 6 month mark..which would be april 10. Sorry for your pain, i know, i remember the feeling, its torture! hello, as a fellow Christian, I would like to encourage you in love that God wants us to obey the laws. A legally binding wedding is valid not only in the government's eyes but in God's eyes. a ceremony by itself (without being legal) is not valid in God's eyes. As long as you are legally married by the government, you are married in God' eyes. the ceremony is important to you, i understand, but it is important you do things legally. Living together after you are legally married is perfectly fine...I'm sure your family will realize you arent living in fornication, as you will be married. We who are applying for the K1, are in a different situation then other couples marrying citizens, and hopefully your family will understand this. We each visited each other once after getting engaged (and once each before that ). My British fiance didnt have much trouble getting through either time, they asked him Qs, and he said he was visiting, but he never said he was visiting his fiance...they didnt ask WHO he was visiting.

I just went out to UK this month and i stood in line to talk to them (i was praying!) and it was my turn, he as asking me why i was there n i said to visit. He said, visit anyone in particular? DOH! i couldnt lie, so i said my fiance...i was gibbering-gabbering a bit cause i do that when i'm nervous. He asked if i had my return plane receipt. No, i didnt. DOH! He asked how long i was staying there, and when i was returning to work at home and i answered him. (I had no evidence of any kind!). He just kinda looked at me (i was praying in my head like crazy) and he handed me my passport and let me on through. I didnt realize til i got through that i was drenched in sweat! haha, i was so nervous! But God allowed me to find favor with this guy. thank u Lord!
Next time (well if there were a next time). I would bring return plane ticket receipts and maybe a letter from work haha. God is good!

Hi everyone... I would have searched for the answer to this topic if I could find a search bar to do it with, but would rather not scroll through the hundreds of topics simply hoping to find the answers to my questions... I will make this as simple as possible to answer! :D

Background: My fiance is a Polish citizen... with that being said, she has lived in Italy for a few years, Australia for over a year, and now resides in London where she has been for a total of 6 years... We recieved our NOA2 on august 8 2012 (2 months ahead of the 5 month average) and it has already been directed to the embassy in London (should arrive this week)... We were caught off guard by the quick timing and are now scrambling to get the police certificates in order... I just found out that it takes 30 working days to get Fingerprint-police certificate from sydney whereas the standard one takes 15... I would be very disappointed if the certificates are to be handed in with the packet #3 info because that will significantly delay her interview date... we are going to italy in september and will get that one taken care of at that time... Australia seems to be the difficult one time wise.... any input would be appreciated even if it is not directly related to the questions I have listed below

My questions:

1. Do the police certificates get turned in with packet # 3 to the Embassy, or does my Fiance bring them to her interview?

2. Just to be sure, does anyone here know FOR SURE whether or not my Fiance needs the fingerprint based police certificate from Australia? Takes considerably longer than the other options but it seems from my research that this is what is needed

3. does anyone have any advice that may aid us in getting the australian police cert quicker?

It usually wont fail you.... all the proof you need is your intuition.... there is no other "PROOF" so to speak... 7 denied tourist visa's has even got my gut telling me his intentions aren't "PURE"... That's a lot of failures, and a K1 seems like the only option for him after so many desperate attempts.... how did you meet? online?

I used a lawyer for the I-129 petition.... he was a good guy..... but as someone said on here earlier its probably an assistant filling it out anyhow! ... I wish I didnt use one though.... I was in a hurry and he wasnt.... as others said as well The lawyers have you fill out forms with all the info anyhow, and then fill out the real forms with that info... visa journey site along with the form examples on here would have saved me a lot of money and I would have had the application in to USCIS a month earlier or more than the lawyer submitted it... I do recommend filling the forms out on you computer in PDF format though.... that way if you fill out a section improperly you can just change it without filling in the whole form by hand again... It also looks much cleaner when typed as opposed to handwritten... I declined to use the lawyer any longer once we received our NOA2. That is when I realized that I could have done the whole thing myself in the first place.... Just be thorough and make sure you understand what you are filling in.... It feels good to know that you have an understanding of the process as you go along rather than just being confused when your lawyer tries to explain. Visa journey is really a great site.... read up and do it yourself..... save the money for the lawyer! you will need it for something else along the way! guaranteed! haha! good luck! keep asking questions and you will be fine!

Hi I am finishing up my I-134 for my Fiancee to take to her interview in London...

some background...

my income comes from a industrial/commercial property in CA that I own and manage (50/50) with my sister. Sometime after the financial crisis in 2008 we lost our long time tenants. Our building was vacant for a year. in January 2011 we were fortunate enough to rent it out again, but we took no personal income from it in order to rebuild emergency funds that we depleted while we had no tenants, pay real estate brokers, and to make improvements to the building. Starting in january of this year(2012) we started to take personal income again. I have proof of consistent income from january through the present time in the form of bank statements and property managers statements which show money coming in and where it goes... It will show that I am to be payed 30k+ this year and for the remainder of the lease agreement from current tenant. There is a business account under our business name that shows a substantial amount as well in place for emergencies regarding the building (all of which is accessible personally by my sister and I should the need arise)... lastly I have a personal savings of approx. 20k. The building itself is worth a substantial amount with a minimal mortgage.... The property as an asset alone should put me in the clear as far as the affidavit of support form.

So my question is:

If i was to not hand in a personal W2, but include the following documents, should my fiancee be ok as far as the interview goes?

1. show my current proof of income showing 30k potential for this year and the remainder of the lease
2.my current savings account with $20k
3.my current business account with $30k
4.proof of ownership of building (as an asset)
5. reputable real estate brokers estimated opinion of value statement for the property
6. the businesses tax return for 2011 showing consistent income despite my sister and I not taking personal income from it in 2011
7. property managers notarized letter with signature stating the accuracy of provided documents from her about buildings income and my sister and I's personal income(she has been with us for 10 years)


I know its a lot of info, and that is exactly my worry.... I dont want to hand in too much, but I dont want to include too little either.... I am so very confident about everything else I have done in preparation for this but this is stressing me out.... the CO is not expected to be an accomplished accountant as well!!! haha!!!

Hi everyone.... I just found out some information that may/may not affect our visa journey in some way... on the DS156 I wrote in my fiancees "National insurance number" in section 14 that asks for "National identification number", which is not something that even applies to her!!! I have already sent this in to US embassy in London with the other forms including the DS-2001...Since it is an online form with the special barcode I am hesitant to fill it out again with the proper info and send it in or have her take the revised copy with her to interview.... Does anybody have any insight into whether or not it is ok to fill this form out again with the proper info on that one question, or is the form sent electronically with new bar code when you do? Will it interfere in any way with our submitted form? Will it interfere with our process at all?

I definitely understand that the I-864 is completely enforceable against sponsor. When you say that the liability is minimal, could you please elaborate a bit?

This is what I am trying to answer... Is my mothers potential risk equivalent to losing $10,000 - $20,000 or $100,000 - $1,000,000... What are some of the potential high dollar public charges?

can your wife with adjusted status legally and easily seek these benefits falling under the "public charge" umbrella, or would it have to be done with fake documentation? If it's illegal for her to receive them, then how would she apply "successfully" for such things?

My fiancee is a HARD WORKER... She has always worked, and is very well put together mentally. I don't feel she would even let herself use these services if she left me. I believe she would legitimately seek employment no matter where she was living, or what she was doing... Obviously I cant be sure about future circumstances, or that she is indeed the angel :innocent: I think she is!!!...haha!... This is like the government asking me to"swear on my mothers life"!!! Thats messed up! I could not live with myself if my mother was held responsible for my actions if it would significantly decrease her Livelihood/assets.

Hi everyone, I thought this may be a interesting post concerning something I have a question about...

I I have high hopes that My fiancee will be approved at her interview. I feel that my financial situation(I-134) will be excepted, but if not I have decided to potentially ask my mother to co sponsor if they do not accept me as sponsor. I plan to send her with my personal docs, and if they say its not sufficient, have her introduce my mothers info as replacement...

She has offered, and I am hesitant to allow her to do it, because I am a mature adult and don't like the thought of my mother being legally responsible for my actions... or my wifes actions. That is a responsibility I would prefer to take myself...

My question is: As far as becoming a "public charge" is concerned, what are the largest risks to the co-sponsor financially? ... Meaning what things are considered public charge, and what kind of devastating potential does becoming a co-sponsor carry financially etc...? My mom has significant assets I dont want to risk...

Any horror stories?


Also what is the possibility of her placing a large enough amount in a joint bank account for support as opposed to co sponsoring?

Any thoughts or insight is appreciated as I have to take action on this quick. Interview is in 11 days

Hi...

I am sending my fiancee in London My I-134 and supporting evidence... I am also sending my mothers I-134 with supporting evidence as a backup just in case.

My question is : If my I-134 is denied, and my mother is chosen as the sponsor during my fiancee's visa interview on 10/25/12, can I again try and sponsor her with my own I 864 by submitting it at AOS... The reason for the question is because my 2011 tax return shows a loss... my 2012 tax returns will be well over the 18,900 to qualify me as her sponsor...

I would like to leave my mom out of it if they will let me

Help me out there...anyone...or two..or more.

Ok, my NOA2 was approved July 1, 2010...tried to be patient and waited to call NVC till today (July 12, 2010)...talked to this nice man who informed me that USCIS had requested my packet returned to them...no stated reason!!! My heart is racing by this time...almost wished I hadn't called. Anyway, he said not to worry that sometimes it happens and is usually because some paperwork was left out of packet...Told me to contact USCIS in a couple of days and they should be able to tell me the reason for the return...

Are you kidding me? I was on the phone to USCIS immediately who of course told me that they couldn't give me any more information than what I am able to see online until a full 30 days after the approval date. Well, according to the USCIS website, it still shows RFE status from June 29!!!

Has this happened to anyone else??? Help....

Hello everyone---you guys are the best ever and I need some info...

We have had a long process with USCIS having misplaced some of the original petition after a completed RFE...long story short, I had to call headquarters in Washington DC to get anyone knowledgeable to figure it all out and further...straighten it all out...

In the meantime, my original approval (noa2) was due to expire in a matter of days...original dates were July1 - October 31....I received a letter from USCIS stating that my petition had been revalidated for an additional 4 months...September 23 -- January 22, 2011.

NOW HERE IS THE INTERESTING PART...my fiance received a letter from the embassy in London essentially wanting to know if he was still interested in pursuing the petition....He has composed another letter confirming his intent to marry once in the US and forwarded it back to the embassy...I suppose that once they have received it, they will now move forward with sending the infamous package 3....

What do you think dear friends? Anyone had this happen to them?

Thank you both for your reply. Kinda confused about "K2" . Our original i129f included the children as well as fiance. On that petition, we listed the children as residing with my fiance in london. We made efforts to secure the children in london on visitors visas since petitioning the british for permanent status would take too long...anyway, the visitors visa were denied and it is time for my fiance to begin the process at the embassy in london.

I just hope that the process wont take too long because the children are young and need to be with their father. Mother is out of picture.

Thank you in advance...I appreciate everyone's advice that has had similar experience...Feeling so alone right now and very down about the process.

The story is this...Filed fiance visa app in April 2010...alot of snaggs later we are finally at the embassy in London :thumbs: When we originally filed our petition we listed my fiance's 2 children as residing in UK...as we were expecting to have them in London on visitors visas to be able to complete the medical and interview...well, just heard that their visitors visas were denied to the UK...they are now stuck in Nigeria...

Our petition includes the children to come to the US...not sure what we are to do now...I thought that my fiance should move forward with his own medical and interview with now listing the childrens residence in Nigeria on the DS-156,156K,157, 230 part 1, etc.....

It is my understanding that we will be able to get the children to the US within a year of my fiance's own K1 visa...

I am hoping that the US wont think that we were being dishonest and now reject our petition since we first stated the children were residing in the UK...really weren't trying to be dishonest...fiance has sole custody since August 2010...

Any thoughts please...Has anyone applied for children and got them later? what about from another country?

want them all to come together....children are 7 and 4...also would cut expenses...Want to have the children's interview before July to allow for visas and getting airtravel all before August 8th

Hello there. The saga continues...

Fiance was grilled at interview, I was there! Thank God...really. Anyway finally approved after resubmitting police certificate. Now case transferred to another embassy to process the children who are residing with relatives in another country....DOS stated that case transferred via "Registered Diplomatic Pouch"...they also stated that it could take up to 12 weeks for it to reach the embassy....

Time is of the essence as my fiance's passport and visa will expire on August 8....

ANYONE out there know of the Registered Diplomatic Pouch???

You all are my help and I appreciate any info....

Yes, my fiance was approved in UK...but children's case to be processed in Nigeria....so case is being transferred to Nigeria and an interview will be set for the children.

Hello everyone....

somehow the link to download forms from the US embassy Nigeria site is not working...

Can someone or a million please send me a working link to the interview forms...that would be the forms included in the "Interview Preparatory Packet (K1 and K3). The embassy info on this site lists the following forms needed for the interview...DS-156, DS-156k, OF-167, and I-693....Have been able to find all those forms EXCEPT...OF-167....cant find it anywhere....don't even know what it is...

All help would be appreciated,

Well our hopes are this is the last hurdle to jump...Interview for the children went well but DNA testing requested...scheduled for 18th...

Anyone with experience in this? How long for results to get to embassy and MOST IMPORTANTLY...is appointment set for return to embassy to process the visa...??? Help...

USCICS won't accept any things unless they asking for. You should repare a copy: when USCIS asking for you submit. If USCIS approves without asking, you still need to submit it to HCM consulate in VN when they send out paper to compete. The last thing is bring your original paper to the interview.
