Waivers (I-601 and I-212) and Administrative Processes (221g)trying to find out waiver status or how long it takes
QUOTE (ellestar723 @ Jun 3 2009, 09:10 AM) <{POST_SNAPBACK}>
Hi. I am hoping someone can help me. I had submitted both the I-601 waiver and I-212 waiver thru Montreal. They forwarded it on May 7th. I am trying to find out who they forwarded it to, they only communicate thur email and I am still waiting for a response. I am trying to check on the status. Does anyone who they forward it to. Also, does any know what the chances are for them approving waivers. My wife tried showing extreme hardship, but I am still wondering how likely they are to grant me this waiver. Any help would be appreicated. Thanks Al

I suppose at the most it would help if you had a definition of "caution" and "final warning" to bring with you. The embassy does not necessarily see things entirely in black and white and does consider all circumstances. The very fact that you were given a warning is testament to the fact that the police did not think it serious enough to press charges. Anyway, I think you will be fine. Write a concise account of the circumstances. It was such a minor thing.

Yeah, but the definition of moral turpitude is pretty clear. Does battery even qualify? I am probably missing something.

yes it does. here is a list. http://britishexpats...ad.php?t=559272.

Australia and New ZealandAustralian federal police check!?
I see you are in AU which I didnt see before... you need the fingerprint check as I said before... since I am not sure exactly where you are from, sort through the following to find specifics.... here is the info direct from website """ http://travel.state....l?cid=8957#docs """ :

Police Certificates - All Australia

If you reside outside Australia

Applicants who live overseas should refer requests to the Australian Federal Police. Applicants are required to apply for a police certificate based on a name and fingerprint check. Police clearances issued on the basis of only a name check will not be accepted. More information is available on their website at: http://afp.gov.au/ or via e-mail at vetting@afp.gov.au.

If you reside in New South Wales

Make an appointment, and then appear in person to be fingerprinted at your local police station. You must pay the fee of AUD175 (subject to change, please check the current fee with the police) and complete an application form, which the police will forward to:

NSW Police Department, Criminal Records Section, Level B3 NSW Police Headquarters, 1 Charles St, Parramatta, NSW 2150. Tel: (02) 8835-7888.

Please find further details on the New South Wales Police website.

If you reside in Queensland

Check with your local police station if you need an appointment, then go in person to be fingerprinted. You must pay the prescribed fee of AUD146.70 (subject to change, please check the current fee with the police) and complete an indemnification form required by the Queensland Police Department. You must then forward the fingerprints, completed indemnification form, and payment to:

Inspector of Police, Information Bureau, Miscellaneous License Section, GPO Box 1440
Brisbane, QLD 4001. Telephone: (07) 3364-6854.

Please find further details on the Queensland Police website.

Return of police certificates for NSW and Queensland residents

For NSW and Queensland residents, your police record will be sent directly to the U.S. Consulate in Sydney by the police department, and the Criminal Records Section will notify you that this has been done. If you do not receive this notification within 3 weeks of your application, we strongly recommend that you ascertain the status of your records by checking at the police station where you initially made your request.

If you reside in the ACT

Check with your local police station if you need an appointment, then go in person to be fingerprinted. You must also pay the prescribed fee. Current fees can be found at the AFP web site. You must also complete an indemnification form required by the Australian Federal Police. This process normally takes a minimum of 15 working days, after which the results are posted to the applicant. You must then bring the results to your final visa interview at the U.S. Consulate General in Sydney.

Please find further details at the AFP web site.

If you reside in Western Australia

If you reside in Western Australia, you must request a national police certificate based on name and fingerprints from the Australian Federal Police (AFP). Check with your local police station if you need an appointment, then go in person to be fingerprinted. Your fingerprint card, fees and application should be sent to the AFP for processing. For current fees to be paid to the AFP, please refer to their web site. This process normally takes a minimum of 15 working days, after which the results are posted to the applicant. You must then bring the results to your final visa interview at the U.S. Consulate General in Sydney.

Overseas applicants must apply directly to the Australian Federal Police (AFP).

The AFP can be contacted at (02) 6202-3333 or through their web site.

If you reside in Victoria

Victoria Police provide a Police and Fingerprints Records Search. Appointments can be made by phoning 1300 881 596. Further information is available from:

Email: publicenquiryservice@police.vic.gov.au

Web: http://www.police.vi...Document_ID=274

If you reside in Tasmania

Criminal History Services provides a National Police History Record & Fingerprint Check, but you must be residing in Tasmania to apply. Residents of other states should direct enquiries to the police service of the state or territory in which they reside.

Applicants are required to submit copies of 3 different types of ID with their application form, and must attend their local police station to take fingerprints. The fee for a National Police History Record & Fingerprint Check is AUD120 (subject to change, please check with the police directly) and the average turnaround time is 3-4 weeks for a fingerprint check.

Please find guidance and application forms on the Tasmanian Police web site.

If you reside in the Northern Territory

A fingerprint check is AUD120 (subject to change, please check with the police directly) and the turnaround time is 4 weeks for fingerprint checks. The fingerprint check will include disclosable traffic convictions and criminal records held by the Northern Territory and most interstate police jurisdictions. Applicants must visit their local police station with their ID. Please call ahead to check if you need an appointment.

Please find guidance and application forms from the Northern Territory Police, Fire and Emergency Services at: http://pfes.nt.gov.au/

If you reside in South Australia

National Police Certificate & Fingerprint Checks (NPC) will only be prepared for those people who reside in South Australia. Residents of other states should direct enquiries to the police service of the state or territory in which they reside.

The standard timeframe to process a NPC is between 2-15 working days. The fee for a National Police Certificate & Fingerprint Check is AUD142.50 (subject to change, please check current fee at SA Police website).

Australia and New ZealandAustralian federal police check!?
hey matthewK.....

yes you need to do the police certificate with fingerprints... I would just get inked fingerprints from local police (call first to make sure they provide this service)..... print out form from AFP website and complete it.... send it in with your fingerprints.... takes about a month (my fiancee just did this...she lived in AU for a year but lives in London). there is the option to take live scan digital prints, but it really doesn't make much difference.... the point being that "yes you need the fingerprint police certificate." have them post it back to you and bring it with you to the interview at embassy....

hope this helps

Australia and New ZealandAUSTRALIAN POLICE CERT: EXPEDITED???
I must admit, that this is way better news than I expected..... I will call for sure... thanks so much for your responses!.... It's funny in a way because I am an optimist ... I try and keep a good attitude towards things no matter what, even if my frustration gets the best of me at first I settle down and my good attitude returns... In this situation my attorney told me to expect 5 months minimum and likely more... I had accepted this as fact and was ready to deal with it and instead our NOA2 arrived and our application was sent through NVC to London embassy in less than 3 months... before I had even been able to make arrangements for police certificates etc (we needed 4 of them:Poland, Italy, Australia, and UK)... so suddenly after we got NOA2 i felt that we would still need another 2 months because of Australias time frame.... But optimism pays off once again!!!!!! Thanks again for your responses..... This is great news!!!!

Australia and New ZealandAUSTRALIAN POLICE CERT: EXPEDITED???
Anyone here ever had any luck with expediting an australian police cert? My fiance and I recieved our NOA2 in just less than 3 months..... good news right?!?!.... well almost... I am sending in all our info and fingerprints to Australian Federal Police on monday, and the estimated wait time for processing is 30 business days.... so 6 weeks.... it kind of puts us back on the old schedule :( ... anyhow I was wondering if anybody has requested police cert from Australia, and if it came quicker than 6 weeks or if they managed to have it expedited by paying a higher fee.....

thanks in advance for any responses!

USCIS Service CentersJULY FILERS FROM CSC
Hi guys -
I know it is difficult being separated from your loved one(s) and waiting is a trial. But hang in there!!!

Also - I just called the USCIS (800) 375-5283. I had no luck after trying to go through the automated system prompts (press 1 for X press 2 for XX and so on). When entering the 10-digit receipt code, the recording kept repeating I did not enter enough digits?! So I called back and did not push any buttons and ended up speaking to a live person (get the name and the ID # for your records). I was told that for my case--received July 25, 2012 at California Service Center -- they are slightly behind in processing. They are currently processing July 12, 2012 applications.

So hope this information helps. It's progress, however incremental :)

Good day to you all.

socal, glad to hear everything got straightened out. the ladies from Davao are the best.

Hi Roy and Yazi,

Yes I agree that Davao ladies are great! Roy do you remember when Yazi received her visa from Delbros, did they have instructions for her not to open the package when they delivered the visa?

When was she able to open the package?

Will the package be open during the CFO class?

How did she confirm that the information on the visa is correct?

Please let me know,

Waivers (I-601 and I-212) and Administrative Processes (221g)Calling all under Administrative Review US Embassy Manila

Eddie,

That's weird that they ask you for a hotel receipt. Anyways, aside from the receipt, what other requirements did they ask you to submit? Just relax and wait for the visa. You can check the case number also at delbros if your fiancee have paid the delbros. www.delbros.com

Hi louchiw,

They asked my fiancee to have me submit an explanation about the girl name on my hotel receipt. I sent them the explanation that the girl name on my hotel receipt is the person who works the front desk at the Marco Polo Hotel, so I sent and faxed them the explanation I also had the Marco Polo Hotel fax them the explanation that the girl on the receipt is one of their employees and that she works at the front desk.

She did pay delbros and they also have her passport, I guess we just have to be patient and wait until they release her visa, but it's very frustrating that it would take so long to verify a name check.

Thanks,
Eddie

AR is Officially over for me & my Fiance.
Thanks for all the support here.

Hi Madison Man,

How long did it take for the AR investigation? My fiancee is also on AR for some dumb thing?

Well now I found out that there might be a sight delay with her visa because the interviewing consular wanted to check a hotel receipt I submitted for evidence when I visited her with in the past two years. They wanted me to send them an explanation of the girl name on the receipt. So I sent the US Embassy an email, FAX and also had the Marco Polo Hotel fax them the explanation.

The hotel (Marco Polo Hotel in Davao City) printed the name of the girl who took my reservation right underneath my name. Looks like this:

Eddie blah blah
Name of Girl who took my reservation
My address

I can see that this would look like this girl is with me by the way they printed out the hotel receipt. But that's how they printed out the hotel receipt! mad.gif

Have you heard of any cases where they had to investigate a name on a hotel receipt?
And do you have any idea how long the US Consulate will take to investigate this?

Thanks,
Eddie

I am under AR for 3 months and 10 days now since my interview. They required me to submit a copy of my previous Adjustment of Status from previous K1 visa but unfortunately, the copy is being requested and the turn over time is forever so I sumitted a letter of explaination on Aug 28, 2006. I've made numerous call to US Embassy Manila but they said, it is still under review.

Can Anyone help me regarding my case?

IMBRA Special TopicsIMBRA

There's a forum for IMBRA:

http://www.visajourn...p?showforum=126

You'll get an IMBRA if you filed prior to March 6, 2006.

Post March 6, the new I-129F included the section for disclosing any potential criminal history (petitioner).

Jen

Actually that is not really true, as I filed my 129f in May and the IMBRA paperwork was still not part of the application. I just received my RFE for IMBRA a couple of weeks ago. The 129f that is available now does have it, but they just started including it in June or July. :)
