The title says it.

She lives in California. I live in England. We are applying for the USA K1 fiancee visa. We want to end up in california.

Can she stay in england on a 180 day visa whilst the k1 goes through?
Are there any interviews that she needs to go to and therefore would miss?

Can anyone see any problems with this plan?

Weird.. I live in California and my fiance is named Paul and lives in England. Is your fiance's name Jenny? laughing.gif

LOL. No it isn't but Jenny does sound very nice smile.gif

Your journey is interesting as i t may be a template for mine. We met online in May 2008 and have met twice in U.S. She is coming here to "that sacred isle" in April. We are currently filling out the I-129F and in the midst of the land of procrastination Doh! We are gettig through it though.

So it has taken 7 months from NOA1 to NOA2. Is this typical? Did you have any comebacks asking for more information?

Another question, and i dont want t get too personal, so please tell me to bog off if so, but there is something about finances and income that the U.S. citizen has to fill out. Now my fiancee does not earn much and it is my savings that will sustain me (with her) early on and then my job should sustain us all once i get one out there. I am in I.T and yep, i know the job market isnt great in California at the moment, but greens hoots adn all that smile.gif.

So the question is, does her finances have a big impact on whether we get accepted or not, and secondly, is there anywhere i can state our plan of me having a large deposit before i come over to get married? The reason i ask because is this is similar to your circumstances in may be an even better template.

Thanks in advance

And nice to meet you smile.gif

wow, guess May is a great month for American women to meet English Pauls! laughing.gif 7 months is a bit longer then normal. Most people get approved in 4-5 months, but there are always people who wait much shorter or much longer. Impossible to say unfortunately.

I think others answered your Q regarding finances, its up to the US citizen to prove support but she can get a co-sponsor.

We put a wedding date of July 11, but for travel date we put "immediately upon receipt of visa" or something like that. We're starting to regret not just making up some day to travel! Jon's calling the embassy tomorrow to see whats really going on.

That might be why then! We put travel date of June 9 and our interview is May 19. So they might be waiting to give you a late June interview. Sven wants to be here for my college graduation on June 13, so that's why we asked for something so far ahead of our wedding! We wouldn't have done it without what we felt was a good reason. But I think if you call them and explain you don't want to be arriving right before the wedding, they will probably work with you.

I dont think travel dates have anything to with it. We left the dates part blank and got our interview pretty quick. But I could be wrong. Give them a call! =)

United KingdomPlan B anyone? (K1)
QUOTE (Bob and Patricia @ May 13 2009, 12:42 PM) <{POST_SNAPBACK}>
Patricia and I were discussing this the other day and neither of us really had an answer. I'm sure we're not the only ones that have considered this, so we'll throw it out to the collective group.

Is there a Plan B for anyone seeking a K1 visa? I assume there is some sort of appeals process and we can certainly get my Congress critters involved. But what after that? Is a K3 a valid option? At what point do you decide to live outside the US or throw in the towel completely and be miserable the rest of your life? (The idea of life without Patricia is impossible for me to even comprehend)

I posted this in the UK thread because we're interested in the opinions of others that are in a common situation as us.

Please note this is question is hypothetical and grew out of some idle chat the other evening. We're quite secure in the merits of our petition and have no doubt we'll join the May approval list when our time comes.

Thanks for reading this,
Bob and Pat

My guy and I have talked about this since we have a reason we could be denied. If so, if waivers fail, i may end up moving to England (after much prayer). Yes I think the K3 is a valid option (anyone correct me if I'm wrong). If I have to move there, well, will cross that bridge when we come to it. I rather stay here in the US but I couldnt live without my love. So, kinda seems like I'll find out what country I will live in come interview day!! blink.gif

Just the Beneficiary's passport.
The way I got my head around it was to see it this way. When the case gets to the embassy the petitioning part of the process is over and it moves onto the visa application part. The visa application is made by the non USC so the emphasis then is on them as the applicant. All documents to do with identification are to do with them. The petitioner's role seems mainly to supply the affidavit of support and financial documents.

got it! seems i'm doing so much cause i'm sending him all the evidence like our pics together, emails, cell bills, receipts, etc cause i keep all that and he's...well, a guy! just waits for instructions from me laughing.gif So i'm just going overboard. You don't need any of the originals that you sent with I-129F. Don't go overboard with sending extra information as they probably won't ask to see any of it, a few chat logs and e-mails and most recent boarding passes should suffice. Concentrate on the I-134 and supporting evidence for that as that is what they will be most interested in.

Ok, thanks so much! Thanks for the tip, I was planning on printing out tons of emails and chat logs, guess a few will work better haha, how many ink cartridges can I go through? tongue.gif Yes, I'll be very meticulous with the I-134. =)

You are a girl after my own heart! Lists, files, organization, I get well into it myself! Can I ask what type of folder you put all this in? Also, how did you organize all the little evidence things like receipts, boarding passes, etc, all those pieces of paper (i'm sending my so the originals so its just tons of little pieces of loose paper?). Paperclips?? For the I-129f I just had photocopies n had it all out in 8.5 x 11 paper. thanks!

A tip from me smile.gif :

PB&JAM: I organized all the boarding passes and receipts by paper clipping them and then putting them in separate little paper bags (I have a lot of Hallmark bags). I sorted them by date, so for each trip, the set of evidence is in one little paper bag ( the size of a greeting card envelope). I then labeled the hallmark paper bags with the trip and date and then put it them altogether in one of the tabs of the expandable file-folder we are using that contains all the rest of the interview documents, in the tab marked: Evidence of trips. You can use: zip-lock bags, paper-bags, or envelopes to put them in. And I put all the documents in an expandable file folder with tabs, so everything is easily accessible without jumbling up all the papers.

Great idea! Makes sense! I'll use envelopes. Expandable file folder would be perfect. Great...thanks! Can't wait to get this all done!

Well, my daughter and I have just got back from our medicals and I have to say, as a medical professional, that I have never experienced such rubbish treatment, people can knock the NHS as much as they like, but in all the hospitals I have worked at the standard is far superior, and all this set me back £270! Perhaps if the staff at Bentinck Mansions didn't have a guaranteed income from visa medicals they would actually offer a standard of care that meets the minimum recommended by the governement. Blatent breaches of the Data Protection act, lack of care regarding female dignity, abrupt receptionist, and unsanitary equipment in the medical room itself, sad.gif all in all an unsatisfactory experience.

@_@ Don't get me started on the receptionist...or that "gender check". I had no idea that was coming and didn't request a female doctor, but I was lucky enough to get one. As reassuring as the lady was being, it was hardly a comfortable experience. As for the equipment, I guess I wasn't paying attention because you go in there assuming it's all top-notch, considering the price you pay. It's good to hear an assessment from someone who's been working in the field and can look over it with a more professional eye.

Hi there, my fiance and i wondered the same thing, if you look above the actual checklist it says: "a notarized statement of your intent to marry". So that is the letter of intent. Not sure what they mean by notarized? Its just new letters of intent with updated dates and signed.
If anyone else knows if we have to get them notarized, please comment...but i never heard that before, think its just our letters signed with current dates.
Yes, only need to check the boxes that pertain to u! Best wishes!

Laura + Tom, sorry for whatever u are going through! rose.gif

I remember reading on the embassy website that a notarized statement is required if the NOA2 is more than 4 months old at the time of the interview. I don't know if they stick by their requirement that the statement actually be notarized or not though. Regardless, hopefully your interview will be before your NOA2 expires.

yep, you're right. i went back n reread the checklist thing and it says: "Note: If more than 4 months has passed since the petition was approved, you will be required to furnish a notarized statement of your intent to marry within 90 days of your arrival in the U.S."

Yep you need an updated, notarized intent to marry if your NA02 has expired. Just go to a bank & they will notarize it for you.
PJ&Jam, I don't think yours will have expired though. You've got until end June right? I wouldn't worry about it.

Thanks for the welcome guys. smile.gif

I'm just so glad to be out of VSC!!! I know there are potential for few more delay but hopefully noting as long as 200+ days (I sincerely hope not).

BTW, I got my British police certificate last year and it took the whole of 3 days to arrive smile.gif. Let's just hope I get to interview stage before it expires smile.gif. Would be just my luck.

Welcome! Nice to get out of the 6 month + club eh?

Best wishes Moira! this is so exciting! you're so blessed to be able to be with your love finally!

Bob and Patricia, thinking of you as well, you guys will do brilliantly! i know this is very nerve wracking! U guys will sail through...if u got a clean record. we were going to approved til the CO saw the past criminal record n had to stop the interview, otherwise would have been a piece of cake!

Hope everyone is doing well! x

Thank you so much guys!! I'm getting teary just reading all your sweet messages! You guys are all super n your comfort means so much!! heart.gif. We're gonna try n forget it for the weekend, let it sink in, then get to work on it next week.

I like that Bob n Pat, "fill out your forms and get your man here!" yes! thats what i need to do. Its only gonna be 4 more months n $500, but doesnt matter, all that matters is being with my best friend n love of my life.

On a positive note, at least the interview is over n i'm not sick to my stomach anymore haha.

Thanks guys! Wish I could give u all a big hug! rose.gif

thanks guys! talked about it more with paul, the CO just made it seem like we have a few papers to fill out n it has to be sent to DHS. he gave paul the forms we need to fill out, he's sending some for me to fill out too, plus we need letters of extreme hardship. we submit those n then Embasy will contact us with what to do with his passport.
i'll post over in waivers tomorw. havent been to bed n its after 5am. i'll need a bit of time to recover, and need sleep. nerve wracking day ended in me bawling my eyes out. i'll be ok. we'll get through this. thanks everyone! =)
sorry to be the bummer of the group! sad.gif

Bad news guys.
"your visa has been denied under section 212(a)(2)(a)(1) of the immigration act A waiver of the applicable is available."

I dont know what this means, my fiance told me: "I dont qualify for automatic approval its up to homeland security to approve me a waiver, only this time we both have to write letters explaining why a denial would cause extreme hardship, more forms to fill, $538 to pay, at least 15 weeks more to wait, "

We are eligible for a waiver but have to prove extreme hardship.

I am utterly heartbroken and crushed. He cannot even visit me til we get approved or denied. I am gutted! I dont know what to do! I cant be with the man i love?? I'm in tears...... Sorry to break the lucky may streak! sad.gif sad.gif sad.gif

PB&JAM, I totally agree with you, I could not sleep one wink the night before and the day of my fiance's interview. My head was constantly racing with thoughts (not to mention pulse and heart rate shooting sky-high) and then when my fiance called with the good news, it was like I finally landed on a pile of hay after catapulting in the air for so long laughing.gif
Can't wait to hear of your approval soon!!! good.gif good.gif

Yes Marm!! Heart racing, thoughts going crazy, all day....cant concentrate at work. My friends/coworkers are like, 'relax, you'll be fine". haha, easier said then done! i know they dont understand tho.

Well, Paul is there and must be interviewing now! His interview was at 8am, and it 8:37 there now, so he might be with them now! I may not find out til he gets to work later. its 12.37 am my time. i'll probly be up til 5 am or more waiting. I'm just gonna keep praying and put it in God's hands, nothing I can do now. I'll let u guys now! thanks everyone!! heart.gif
