hi anyone, i found out that the minimum income to spnosor my wife is $16,500 a yr.

my question is, how many years does the US embassy and the Foreign Embassy look at i heard they need the last 3 yrs; however,i do not meet the income req. in 2004

2002 = 12,000
2003 = 20,000 +
2004 = 14,000
2005 = 20,000 +

Greetings everyone. This is my first post, but I have been a lurker on the forums for a couple of months now. I decided today to finally register to reach out to a community that shares the same blessings/hardships of the Immigration Procedure.

A Little background of me before I get into the root of my concerns:

I am a 3rd year college student who will be graduating in December 2010. I will be 24 years old this month on the 29th. At the moment, I am with the girl I am eventually going to ask to marry me, but she is in China whereas I am in California. We met for the first time in February when i was studying and working abroad in Japan in 2007-08. We are very serious about our relationship and cannot stand being so far away from each other. I go visit her every chance i have, usually winter/summer intersessions. My goal is to bring her to California by the time I graduate and start working on my career.

Right now, I just landed a job teaching SAT to high school students for Kaplan, and I will begin training and working February 2010. I also plan on being a US census taker for the coming summer. I also have a high chance of landing a summer internship at one of the "Big 4" accounting firms (my school has very good connections with them).

Now, with all the logistics aside, I have a few specific questions about our chances, choices, and time frame of our situation.

Before I start, I have checked through many of the forums and threads about the various questions I have had. Most of them were answered easily in previous threads and guidelines, but I am at the point of refining my knowledge and information regarding my situation. With that in mind, please guide me with experiences or a threads I have yet to have find to answer some of my questions.

First and foremost, is the money invested in a fiance immigration attorney well worth it? I have heard/read many differing opinions about utilizing an attorney to handle all paperwork. At the moment, I am leaning towards hiring an attorney to mediate the immigration process. If I decide to hire an attorney, does anyone have any recommendations for an attorney in the Los Angeles/Orange County area?

Second, will prior visa rejections of my girlfriend (US student visa was rejected one year ago) affect our chances of approval? She was accepted to an English Language School and legitimately had the money to attend, but the student visa was still denied.

Third, will having a sponsor (parents) lessen chances of a visa denial? I only ask because if i file for a k3/CR1 visa, my income tax paperwork for 2010 will be referred to, but I am not 100% sure that i will meet the minimum requirement (>$18,213) with the jobs, internships, government work for 2010. I will also be a full time student until I graduate (6 classes). I am planning way ahead, but this is just habit.

Fourth, Is the K1 visa a much preferred choice over K3/CR1 based on my situation? I have weighed both sides, but I am still divided.

I haven?t been on this in a while.. well not much since I got my Green Card back in October shortly after in November I started working!.. for the first time in a year!

I didn?t get the exact job I wanted but it?s turned out to be quite decent. I?ve ended up working for the government :o . In fact I just sort of got promoted or a pay rise or both.. I?m still not sure? I?m assuming that?s what ?bumped up? means over here :lol:? In fact they are sending me across the country to train and then take over administrating staffing system. It's all a bit too mad!

The wife and I intend to head back home for about 10 days around mid May. Anyone know of any good travel deals out there at the minute :huh: ? We?re in central Florida, Orlando/Sanford and have been searching for a flight into Dublin, Shannon or even Belfast. It?s a pity Aer Lingus stopped flying into Florida I came in last year for like 188EUR can?t find anything better than $700 return from Orlando at the minute. This will be my first time back in a year and a half, I?m looking forward to it!

Ugh, this is fast turning into another nightmare of paperwork. I was born after January 1983 (just!) and from what I can tell they want my full birth certificate and my MUM's full birth certificate. Both she and I only have our one original copies of our birth certificates. So it looks like I will need to have her send off to get a copy of mine and her birth certificate. Plus I'll need to be sending off for more marriage certificates as we only have 2 left after having to submit it once or twice for AOS/my greencard.

All I want is to renew my passport and change it from my maiden name to my married name. UGH! So stressful. Looks like it is easier to prove you are s British citizen by naturalisation as they only require your naturalisation certificate!

Am I reading things wrong? Do I need to be sending these things into them? If I do will I get them back. Or will I have to call the undoubtedly expensive helpline? And then there comes the headache of whether or not I need a countersign! *pulls hair out*

I believe there are some DR people going through the process right now, I would recommend checking out General Discussion area, and checking out the Latin America, Mexico & the Caribbean section under regional discussion to find others going through DR.

To the best of my knowledge it really does take a year from when the embassy gets your papers to schedule an interview for you. They're that backed up.

correct, you do NOT need I-134 notarized.
correct, you only need to list income...just leave blank the other lines (like savings, assets, etc,) since you are not using those n do not need to.
It is recommended you have your W2 for past 3 years (so, '06, '07, '08).
Save pay stubs maybe for a month or two up to the interview. (they want as current as possible to prove u still work there). some ppl provide the last 6 months of pay stubs, but i think this is overboard.
Letter from your employer.
Tax transcripts for past 3 yrs (06'-08).
You may not need all that, but you might, so thats what i'm sending my SO. thats pretty much it!

oops, i didnt realize this was the Asia forum. Well, it may be the same there as for UK. Hope somebody will correct me if i'm wrong, but i gather its pretty similar at most embassies.

I need to know what I need to have to show the border police when I get off the plane in Manchester. I'll be staying for 2 1/2 months.
I have our NOA1, passport, 2 credit cards, $2,500 in the bank an 500 on me in cash, deed to the house,a letter from SS stateing how much I get every month, my birth cert. is there anything else I need to insure entry ? I'm so nervice



I came to London to stay with my Fiancee on June 29th of this year for 3 months (I am leaving on oct 2nd)... I chose NOT to get a return ticket in case I got word about k1 visa that required me to be home sooner or anything else.... I just wanted my trip to be open ended and flexible... I had no intention of staying longer than 3 months, and had already been here 3 times this year for varying times, all less than a month and my first trip being 1 week in jan/feb..... anyhow, when I flew into Heathrow in June, as soon as I told the border/passport agent that I didn't have a return ticket they held me up for 4 hours (starting at 10:30 pm while my Fiancee waited in airport waiting area for me)!!! I was frisked, my luggage checked thoroughly including documents etc... I was interviewed by an agent and kept in a locked room for 3 hours.... I told my complete and truthful story... I showed proof of $10,000 in the bank... after running my interview info past the supervisor they finally let me go with a special stamp in my passport and a stern warning not to stay over 6 months...

So my thoughts to you is to MAKE SURE YOU HAVE A RETURN TICKET!!!!!! The agent said to me that if I had had a return ticket in the first place they probably would have just let me go right through!!!! Your deed to the house will help as well to show your intentions to return home... I am not trying to scare you, but rather drive home the importance of a return ticket when traveling abroad!

Hi everyone.... this is a post to update those people in London waiting for an interview date... our packet 3 and DS 2001 were sent to London embassy and received by them on sep 20th (signature required)... I called department of state today when I got back to CA from 3 months in London to see if it had been logged... The gentleman said all of our stuff had been entered into system and we are waiting on an interview date. I did not put a wedding date on our cover letter but did say that I have flight plans on november 8th to return to London and make plans to move my Fiancee back to the states soon after that. That may or may not have helped to speed things up... I must say though that I am quite satisfied with them logging our info in less than 2 weeks!... I will update and let everyone know when interview date is set so it may give an idea of what to expect...

anyhow... hope this helps! I am excited to see what happens and when we will be booked for interview.

Embassy received my packet 3 on September 20th, 2012.. My Fiancee's interview date was just confirmed over the phone today by "Department of State" after the monday holiday for "Columbus Day" here in the states... It is scheduled for October 25th, 2012... She sent all of her required forms in together along with the DS-2001... her medical was completed and results received 4 days prior to receiving our packet 3. I checked with DOS on Wednesday October 3rd for the first time and they said all of our forms were logged and we were eligible for an interview date. I waited until today to call, so the interview may have been scheduled the day after my first phone call 5 days ago or so.

The only thing we did that may, or may not, have influenced the time frame is that we detailed on the cover letter my travel dates back to London on November 8th to hopefully help her pack and await her visa.

Hi,

One final post before my Fiancee heads to her K-1 interview at London embassy on the 25th of october.

I am self employed. I own/rent/manage an industrial/commercial property in a 50/50 partnership with my sister. We have had this for around 10 years. This property has been successfully rented out for all but one of those years by only 2 tenants. Our first tenants abandoned the building a year or so after the financial crash in 08... the building was vacant for approx. one year and then we were lucky enough to find a quality tenant who has been there 2 years and plans to stay for at least 5 years(they have put their own money into the building to make it the way they wanted it)... during the time we had no tenants I loaned a large sum of personal money to the business with intention to pay myself back which I am currently doing. My sister and I also did not take income for 2 years to payback some of our expenses... Aside from additional funds I take monthly to pay myself back for the loan I made, my sister and I take identical income from the monthly rent with the rest going towards the building and in our business account.

So that is the back story... My personal and business tax returns show a loss for 2011 due to lost income from the previous year, and having to pay our brokers, and make improvements to building for new tenants... I have sent a bunch of stuff with my fiancee in support of the I-134... these things include:


1. proof of business/building existence and ownership

2. Partnership agreement showing my 50/50 partnership with sister

3. Monthly statement from property manager showing incoming amount of rent collected, outgoing funds to business account, and outgoing funds to my sister and I personally. It also shows outgoing funds to me for Loan payback.

4. a yearly statement from our property manager showing all funds coming in and going out. This shows all check #'s written to my sister and I since january 2012.

5. A loan payment schedule from our property manager detailing the monthly payments to me for the next 48 months

6. A signed and notarized letter from our property manager stating that she has worked for us for ten years. In this letter she says that the statements that I have handed in from her as proof are indeed legitimate and truthful. She explains how she makes the income checks to us monthly, writes me the check for my loan, and places the rest in the business account. Lastly she explains that the current tenants have always payed on time and that they have expressed intent to extend their lease and have room to grow. She gave her contact info as well.

7. Copies of each check from personal online banking that I have received since january 2012. I started to receive the loan checks in august 2012.

8. business account statements from january-september showing account balance and balance average, and shows the checks that have been received.

9. personal savings account statement showing $17,000

10. A brokers opinion of value of the industrial property I own jointly with my sister... Without disclosing the amount, my half of the property value is worth plenty(even with small mortgage) to qualify me by assets alone, but I am not sure if the fact that I own it with my sister will make it so that it doesn't qualify.

11. I-134 form stating an income of $31,000 per year as of January 2012. This is made up of my personal Income from rental and 4 years of monthly loan payments back to me.

12. Lastly I have included my original 2011 personal tax return showing loss because I took no income for 2 years... and a copy of my 2011 business tax return showing a loss as well despite the fact that it shows incoming monthly rent checks.



THIS IS MY QUESTION: If the property I own is not accepted as an asset, do you think they will accept the overkill amount of stuff I have sent in with my fiancee as proof my income without the tax returns weighing too heavily...



Thanks for any replies... I just want things to go smoothly for my Fiancee with as few doubts as possible.... I am super confident about everything else but I am afraid about I-134 and my tax returns

I am filling out the I-134 form to try and sponsor myself, and then having my mother as a backup... She is a sure thing as a sponsor with either income or assets...

I will try anything to not have my mother be a sponsor... she is retired and I dont like the idea of her being responsible for "my" responsibilities!


I have recalculated my yearly income since my last post, because I left a significant chunk out of my calculations (splitting the surplus in the business account between my sister and I at the end of each year). I am self employed... I own/rent/manage an industrial property with my sister. Out of the past ten years we had just over one year without a tenant in our building (mid 2009-end 2010) due to the economy taking a dump on everybody in 08'... My tax returns for the past 2 years will show a loss ( due to lost rent, and improvements to building for new tenants)...

my personal 2012 tax return will show my annual income as 43k with no loss now that my sister and I have regathered ourselves and our business... If i was to calculate, and project my years salary as the period between August, 2012 and August, of 2013(at current monthly income) I will show 50k per year due to increased income that started in August 2012... I am sending 6 years of tax returns, both personal and business, and a tax projection for 2012(professionally done by quality accountants) to show that I was earning upwards of 50k a year, except the 1 1/2 year time period after our old tenants abandoned the building in 09' ... It will have been re-rented for 2 years this december with a 5 year lease. My income will increase every year due to the rents being increased each year (written into the lease contract)... I am trying to throw plenty of documents their way to show that my loss of income was based on the economy crash... I want to be able to show the CO (thankfully they know where to look on the returns, so it should be easy for them to verify) that I have a history of significant income, and 30k in savings despite the problems we had for that short span. I will include 10 months of deposited checks showing income, savings bank statements with 30k, monthly statements/notarized letter from my property manager with explanation and documentation of monthly cash flow. I will also include basic documentation of the value of my building (High value, with very low mortgage ) just to show it as a significant asset...

Even with all of this I feel my 2010-2011 tax returns are going to screw me over! aaaaahhhhhh!!!


Any thoughts on my "revised income along with six years of tax returns" scenario would be appreciated.

Hi everyone... Think I may be using my mother as a co sponsor for backup... she consulted an attorney who told her that she needed the I864 as a cosponsor for the interview...I think he has mostly japanese clients though... may simply be what Japanese US embassy requires for interview.... As far as I remember, with all the stuff I have read, London embassy just requires separate I-134 forms for both sponsor and co-sponsor... which is correct?

I can see her point. I would feel the same. I think it will be fine to black out. If she wants her info to go straight to the embassy, she can do that too. Seal it up and include a cover page that it is in support of name, case, etc. Some people send it to the beneficiary sealed up with " to be opened by consulate official only" written on it. I don't share my financial info with my own children so mailing overseas to a future relative that I don't know very well would bother me too. Don't take it personally. Some of us just keep our business private. In fact I wouldn't even be a sponsor except to my husband.


I agree Nich-Nick... My mother is taking a huge step for me... Thats why I am hoping to pass as sponsor by myself! Fingers crossed! All info has been fedexed to my Fiancee as of tonight!

Does anyone know if she can black out these details and still have her I-134 info be accepted for cosponsorship???

Household goods and personal effects of an immigrant are not charged. Customs and Border Protection website is where you want to search. CBP.gov

If shipping, the customs form 3299 goes with the shipment. That's for unaccompanied goods. Tell her to inventory each box she packs. Her items are supposed to be owned by her more than one year. Most things will pass for that. Ten identical items with tags wouldn't, if you follow my drift. She has five years to bring her household goods so Mum can ship some later, or she can do a shipment next time back.

Stuff in your suitcase doesn't use that form. I called Houston airport CBP before we left the UK with six pieces of luggage between us to ask if there were any special rules, valuations, or inventories they would require. He said just to fill out one green form they hand out on the plane for both of us, and write "household goods" on the back. No list or values.

Of course if you buy something in the duty free shop or a teddybear at the Harrods airport shop, then those would be itemized and valued because they are new items. It would almost make you look more honest to add a couple of gifts so they know you know the rules, ya think?? I think it's $100 worth of gifts non-residents can bring and $800 worth for Americans before duty is imposed.

Look up all those specific numbers because I'm kinda going on memory to give you an idea of how it works.



Funny you should mention Harrods, as that is where my Fiancee has been working for over 2 years... I was there every day from july-october picking her up... If I never see that place again I will be fine with that ! haha.....

I am jumping the gun here a little bit because my fiancees interview is not until next thursday... I have a question about shipping her things vs travelling with them..... My fiancee has a lot of expensive hand bags, shoes, and clothes due to working in the fashion industry.... I am wondering if she will be charged any extra fees for shipping those things to the US... Same thing goes for the items we plan to bring in our luggage to minimize shipping costs. Does the K-1 visa allow her to wave these taxes or???

Hey there...

Wondering if anybody had a "less than desirable" interview experience on oct 25th... My Fiancee said the guy who conducted her interview gave her a super hard time about the tourist visa she applied for and was denied in january.... It was to come see me and her sister In New York.... Not only did he grill her, he had a total attitude... most the experiences I have read from London Embassy were completely positive!..... I know it's their job to be thorough, but the attitude was a surprise !

Anyhow she was given her visa, which we are super happy about...but she left with a bad taste in her mouth in regards to the experience....

She was asked for I-134, but none of my supporting docs or tax returns (self employed)...

I will find out more and try to write up a review in the next day or 2...

I would be anxious to hear if anyone else had this guy at 8am for their interview, and if he had the same attitude...

thanks a lot... It wasnt completely smooth, but it was successful! The interviewer gave her a hard time about the tourist visa she was denied in January to see me and her sister.... Hi everyone. I have been reading all over the United Kingdom and k1 forums for the answer to this question, but now I fear I have read tooooooo much. haha! Because the answers say so many different things... In my cover letter I explained that we would like an october interview date because I (US petitioner) plan to fly back here to London on november 8th to fly to Poland (hopefully soon after I arrive) to visit my fiancees family before we leave for the US. She had her medical on september 11th and so everything needed by embassy should be in place. With that being said, my questions are as follows:


1. My packet 3 and DS-2001 forms were received today by the embassy in London. I know this because I had them signed for. I am so confused as to when my Fiancees interview date will be set because there are so many answers from so many different dates during this year that appear on these threads.... is there anybody that has recent experience with the London Embassy that can relay their experience between the Embassy receiving these forms, and having their interview date set.

2. Also can you please share your recent experiences/knowledge about how far out the interview date is/was from the point they received their interview date. I have seen people say 1 week or one month+... I have also seen people that claimed to get the interview date they requested?

The most important thing is that you have a return ticket....and your prrof of being able to support yourself while there... If you show them that they most likely wont care about the rest... If you dont show them a return ticket(itinerary/receipt) they will put you through hell... I arrived at Heathrow in late june with intention to leave in 3 months, but wasnt sure exactly when... so I didnt buy return ticket... Long story short, I was held for 4 hours, interviewed, fingerprinted, photographed, luggage searched, documents checked... they eventually let me through, but it was not an experience I would like to have again!!!

Hi everyone... I have just received the final instructions link from the embassy after paying my fee and sending in all required documents. My Fiancee has also completed medical... everything was supposed to be in place as far as I was concerned and then upon reading the final instructions i get this excerpt from their web page:

"Translations: All documents not in English must be accompanied by certified English translations. The translation must include a statement signed by the translator that state that the translation is accurate, and sworn to before a Notary Public."


everything I had read before simply said certified translations required in english for all documents in other languages... I had her birth cert translated in the US by a reputable company, her polish police certificate translated in Poland by a translator registered with the ministry of justice in poland, and I am just sending off her police cert from Italy when I encountered the above quote!!!!! I am about to explode!!!! these translations arent cheap by any means... around $100 us except for the one I had done in Poland..... Now it seems I may have to do this all over again! My issue being that they werent seemingly sworn to by a notary public!

can anyone tell me their experiences with translations and the US embassy in London???????

My fiancees medical was september 11th ...our forms were sent in with DS 2001 on september 20th...we received interview date on oct 5th for october 25th... My Fiancee is at interview as I am typing this (october 25th at 8 am)..... So it can be pretty quick!

we never received a packet 3 or an embassy letter either.... Had to use VJ forums to find out about the webpage with all of the instructions... I completely relate to the comment about the studying for visa more than school... I guess we do it out of love and longing to be with our Fiancee's..... I wish I would have had a passion like this when I was younger to push me through school... Rarely have I been this focused on something! :)

thanks a lot.... good luck to you as well!... We are so excited now... can't believe we came this far!!!! I was stopped in Heathrow on june 29th for almost 4 hours.... I was interviewed, fingerprinted, photos taken, bags thoroughly checked, locked in waiting room... all while my fiancee waited for me at arrivals... I had chosen not to buy a return ticket since I intended to stay for 3 months and wanted to leave the option to come home earlier if need be.... they didn't like that at all!!! :) I told my entire story truthfully, showed them I had enough money to support myself, and explained I didn't intend to stay at all... I just wanted to spend some solid time with my fiancee to make sure we could live together well and were as compatible as we thought!:) (thankfully we were! haha!).... anyhow, after giving me a hard time for hours they let me go... I was pretty emotional thinking they wouldn't let me come there anymore!!!! thank god! Lesson learned! ALWAYS BUY A RETURN TICKET!!! When I return on November 8th I am overloading myself with proof of the visa and our return ticket itineraries! Good luck to everyone! Wish I could be in London on the 25th for support!!! Assuming all goes smoothly, I can't believe my fiancee will be coming home with me in November!!! WOW!!!

Hi everyone... Embassy received my packet 3 on September 20th, 2012.. My Fiancee's interview date was just confirmed over the phone today by "Department of State" after the monday holiday for "Columbus Day" here in the states... It is scheduled for October 25th, 2012... She sent all of her required forms in together along with the DS-2001... her medical was completed and results received 4 days prior to embassy receiving our packet 3. I checked with DOS on Wednesday October 3rd for the first time and they said all of our forms were logged and we were eligible for an interview date. I waited until today to call, so the interview may have even been scheduled the day after my first phone call 5 days ago or so.

The only thing we did that may, or may not, have influenced the time frame is that we detailed on the cover letter my travel dates back to London on November 8th to hopefully help her pack and await her visa.
