IR-1 / CR-1 Spouse Visa Process & ProceduresNeed some insight on both processes: IR1/CR1 and K3

Hi fellow members.

Newbie question again. I have been reviewing the info on this website forums since the past couple of weeks and am curious as to what percentage of people who apply for IR-1/CR-1 also apply for K3 visa simultaneously?

Seems like most people who contribute to the website are doing both but I wasnt sure and hence the question.

Do you folks recommend filing for K3 also? Please advice because I am soo confused.

Regards
a confused member.

My guess is one would get K3 visa about two months before IR-1/CR-1 processing in India if there are no delays in I-129F processing e.g. IMBRA. Just my guess..

Up side of K3 - your spouse would be with you sooner, up side of IR-1/CR-1 - you don't have to worry about AOS, EAD etc.

IR-1 / CR-1 Spouse Visa Process & ProceduresAnybody Knows?
My wife got her visitor visa to Canada last month. We got the visa in the mail on the 10th day from day we mailed application to LA consulate. If you are in LA area you may want to go there and apply in person - you may get the visa the same day. Check out there web site.

I got assigned the immigrant visa interview date on Oct. 10. (Finally.... in Montreal. So excited!!) The question is i will have to get a visitor visa to Canada first , does anybody know how long it takes to get the canadian visa? The canadian consulate in Los Angeles says it takes 8 weeks ( ) i am so worried about if its true, i am not gonna make it on Oct. 10

IR-1 / CR-1 Spouse Visa Process & ProceduresFiling taxes before spouse gets here
I had the same situation this year when I filed tax for 05. After talking to my accountant and calling IRS, I filed as 'married filing sepeartely' and wrote spouse's SSN as 'unknown'. A couple of months back we amended the return to married filing jointly. I had figured this would be less painful than trying to get ITIN - one has to submit copies of IDs (passport etc) for the non-resident applying for ITIN and these have to notarized by a US notary. To get that done my wife would have had to go to the nearest US consulate which is 5 hours away.

Since the first of the year is almost here, what have some of you done about filing taxes before your spouse gets her/his SSN?

I have thought about just filing single and doing an adjusted return after my wife gets here sometime this spring just so I could get my refund early and also have the latest tax return for her interview. I could also go to the trouble of getting her an ITIN but I don't know if it would be worth it since she should be here sometime mid-Spring.

Or I could just file an extension and wait until she is here. There will be no penalties since I usually get a refund every year.

Thanks to everyone for their advice/tips!

K-1 Fiance(e) Visa Process & Procedureswhy people need to file 2 case same time?
gurdip,

I am not sure what you read but you only file one of the two - K1 if not married or K3 for a spouse.

AV

Hi there, I read alot of post on this site, which people first file I-129f K1 petition, and as well they file I-130 K3 file, why is that?
isnt the K3 petition u can file only when you are married, and if you married then why need to file K1 petition as well? or u able to file both same time?

I am pretty sure they don't work on the weekends but I think the systen gets updated on the weekends as well and shows updates on those days. Our EAD was updated to approved on July 4 and last touch on AOS was on Oct 7, Sat.

Middle East and North Africaintervew ..
My husband received the same on his 1st interview for his K3. He was called 12 days later to return on April 30th for his 2nd interveiw. It went pretty well from what he told me. She told him that the Visa was approved, he was given a green paper and told to come back on Friday to pick up the visa. BUT!! On his way out, he was stopped by the security guard and told to go back. He goes back to the woman who says "SORRY but I can't give you the visa today" then takes his green paper and give him another white one that also is checked with "OTHER" but reads that it needs AP and they will call when it's complete. The woman told him that they would call in 1 week. I'm trying to keep positive while they keep us going on this roller coaster.

I called the DOS the day after his 2nd interview and the woman I spoke to said they were running the securtiy check on him and that could take a few days to a few months. She said if he is not called this week to call the DOS back to get status.

Hope this helps!!

Good Luck!! kicking.gif

Our interview went a lot like Okidoki's.

Here is our story:

My fiance's interview was April 28, 2008. He was interviewed by a blonde woman with glasses. She was very nice and asked him only a few questions. She also asked him to sign the form DS-156K swearing that he will marry within 90 days.

In the interview she asked him for emails for the past 2 years, and he let her see them. She told him that she would keep them to review.

She also gave him a form that stated "This office regrets to inform you that it is unable to issue a visa to you because you have been found ineligible to receive a visa under the following section(s) of the immigration and nationality act.", but on this form what is checked is "other" and written beside it is "we are reviewing the documents provided during your interview. We will contact you when our review is complete."

Has anyone else received similar forms? Does this mean a visa will be issued? blink.gif helpsmilie.gif

Any advice, comment, or thought would be most appreciated. Thank you smile.gif

Hi there,

I'm still trying to figure all this out. My husbnd was told his was approved today, then on his way out he was told to go back to see the lady who then said she was "sorry" and took back the green paper and gave him back his passport.

She handed him another white paper (will find out what that says later tonight) but she then told him that the paperwork was going to Washington. Is it safe to assume that this is for security checks?

I"m wondering because if it were not approved, it looks like it would have been returned to the USCIS. There is a difference right? I don't mean to be a pest but as you can imagine we are are very anxious about his Visa being approved.

Thank you all for your input.

IR-1 / CR-1 Spouse Visa Process & Procedureswhite 221g
Desigal is right the color doesn't matter. My husband received the white 221g on April 15th. He was called by the Consulate on April 28th and was told to bring documets from the beginning of our relationship on April 30th. After that interview, he was told all looked good, as it turns out, he was put on AP for which I believe is the Security Check smile.gif (AT LEAST I HOPE SO)

On Friday May 9th, I received an email from the Consulate saying that the AP was complete and "they would contact him by phone shortly regarding his application" I can only hope it's a good sign. Just supply them with the items they are requesting and BEST OF LUCK!! biggrin.gif

IR-1 / CR-1 Spouse Visa Process & ProceduresPay stubs showing 'single' and tax filing ?
Hi - I linked to this thread from a separate posting. I'm trying for the filing comparison of joint vs separate. TurboTax Deluxe suggests the same as well. The thing is, TurboTax is asking for information on Community Property as I'm in the state of California. So I'm confused on top of confused. Hubby has been in the UK since Feb-2012 so technically, all his property has not been in the state of California and wouldn't count?

Also, for either option joint or separate, hubby will be asked for SSN / ITIN. New rules went into place dealing with the W7 where the IRS will only accept original documents or certified copies of documents (like passport to prove identity) and the processing time is 8-10 weeks. With payment for NVC fees just posted to my bank account, I'm hoping there will be a request for all original documents soon. So go with certified copies of the passport for the ITIN? Or would that be just creating unnecessary paperwork? My timing with everything is  since I waited until filing taxes to think of the SSN/ITIN? :bonk:

IR-1 / CR-1 Spouse Visa Process & ProceduresPay stubs showing 'single' and tax filing ?
Hi everyone -
After getting the NOA back in January, today I received a letter indicating the NVC case number and notice to pay the Processing Fees before the I-130 petition can move on.

In preparing for the next phase, I have copies of my 2011 tax return, 2011 Tax Transcript as well as the most recent pay stubs and pay stubs going back to 3 months (in lieu of an employment letter). My question goes to the pay stubs because toward the top, there's a box reading FW and ST for Federal Withholding and State Withholding and both indicate 'S 01' which I'm guessing is SINGLE and the allowance taken from the W-4. I'm aware that the pay stubs are to show income at or above 125% of the Federal poverty level, but will the 'S 01' designation put things in jeopardy? I'm really hoping that's not the case as the 'S 01' is a clerical error. I'll have to check with Payroll tomorrow AM to see that they do have my updated W-4 and if they can make adjustments.

Thoughts?

Oh, and also a tax filing question: I am the US citizen and hubby is the foreigner (Non-Resident Alien sounds so sci-fi). Is there a good rule of thumb on how to file taxes with a foreign spouse without diving too deeply into Publication 54? Just 'married, filing separately'? I have no worldwide earned income and he has no US earned income to report and is without a SSN or ITIN (waiting on that visa interview). :help:

Thanks.

IR-1 / CR-1 Spouse Visa Process & ProceduresCR1 pre-interview jitters - questions!

Sooo?hurrah! The CR1 visa interview for my husband is scheduled for 10-May-2013 at 09:00 at the American Embassy/Consulate in London!!!

Of course we've got jitters and are going through everything and then going through them again. Some questions:

1) Evidence to support a bona fide relationship
We didn't have any documentation to show joint ownership/property, lease of tenancy, or co-mingling of financial resources as per the instructions on the I-130. The only item I included (I'm the USC) was an 'Affidavit LetterRegarding Sincere Relationship' which told of our "story" and referenced included photo collages showing our travels together, along with Skype chat logs and email/instant messages. Will this be a problem as there was not a follow up RFE? The only other items I can think of sending to my husband before the interview is a copy of my life insurance showing him as the beneficiary or credit cards showing him as an authorized user? Anything else?

2) No wedding or wedding photos

We've looked over the interview questions from the UK consulate reviews and did a trial run through some of the questions. My husband is a bit concerned over the lack of traditional wedding ceremony and wedding pictures. Per Colorado Statute, the marriage can be solemnized by the parties to the marriage so our wedding was very simple: just signed papers at the kitchen table! ohmy.png As this is out of the ordinary, what can we do if asked for additional 'proof'? We've only got a picture snapped right after signing the marriage license. Our thought process was that the visa application would take a lot of time and money and we'd rather have a Big Wedding/Celebration Ceremony after the stresses of the visa process. So include anything related to this wedding/celebration: invitations, bookings, reservations, etc.

3) Passport style photos:

The NVC letter lists that 2 passport style photos were received but then there's a reminder to bring passport style photos? Does this mean take extra just in case?

4) UK embassy airport style security and lugging huge binder of supporting evidence

Because of #1 and #2, there is a full binder showing how we spent our time together. But as backpacks or suitcases are on the 'Do Not Bring' list, can he hand carry the binder through to the consulate?

5) SSN

Fingers crossed husband is approved - The DS-230 part II questions 43a and 43b was completed. Does this mean that my husband doesn't have to resend an application for a SSN?

Thank for the time in reading this long list!

K-1 Fiance(e) Visa Process & Procedurespls help.. confused
Hi SanFran,

My fiancee recently finished her interview at the Manila US Embassy Feb 7, 2007 and was approved, now we are waiting for her passport and visa to be delivered to Davao City (should take 4 to 5 days to process the Visa and then 5 to 7 days for delivery).

I remember when we received our NOA2 letter (I was in the Philippines at the time Nov 21 - Dec 17, 2006) so I couldn't verify that NVC had sent me a letter back home in California. When I returned home to Cali she received a letter from the US Embassy stating that it would take up to 180 days before we were scheduled a Medical Exam and Interview. It took approximately 10 days for the Manila US Embassy to receive our packet from NVC.

However, our situation was a little different, since my fiancee applied to request for an early appointment. Her request was granted and they scheduled us for an Early Medical Exam and Interview and didn't have to wait 180 days. She actually received the early appointment date before she received the standard letter stating 180 days wait to be scheduled an appointment.

Early appointment: http://manila.usemba...v/wwwh3227.html

You will have to wait to receive the standard letter from the Manila US Embassy and should tell you that it takes 180 days to be scheduled an Medical Exam and Interview.

We didn't have to call the US Embassy in Manila to make an appointment, they sent us a letter and again this is for a K1 Fiancee Visa. The reason that I know is that I actually tried to make an appointment using the online VisaPoint application and paid $10, just to find out that when I started to fill out the application it didn't have a selection for K1 visa's, but had other types of visa's available. So I spent $10 for nothing. K1 Fiancee Visa's have to wait for the US Embassy to send you a letter of scheduled Medical Exam and Interview.

Online VisaPoint: http://philippines.u...v/wwwhvpnt.html

I was also confused when I read that section: http://manila.usemba...v/wwwh3024.html

***************************************************

Starting 01 November 2006, ALL nonimmigrant visa applicants must use the online Electronic Visa Application Form (EVAF) or DS-156 Form. The EVAF is free of charge, will speed up the processing of visas, and reduce waiting time. It is also easy to use because it is the same application form that is currently used, except it is online.

Handwritten or typed visa applications will no longer be accepted by the Nonimmigrant Visa Unit in Manila. If applicants do not have an EVAF on the day of their scheduled interview, they will have to reschedule their interview through the Call Center or through the VisaPoint™.

I hope this helps.

Good Luck,

K-1 Fiance(e) Visa Process & ProceduresCatch-22?
Hey Guys,

Was having some dinner... I can handle the truth... Take it easy on me.... Not to worry..

I have not sent in the application yet so no Fraud has been committed. Thanks for the replies...

1. I concur on the Mom's death issue... My Fiancee is somehow convinced that the Embassy is going to check this and cause a problem... Seems like either way the possibility of them checking is very small, but I agree the truth is always the better option.

2. On the signature issue... It seems like a signed scanned copy should be sufficient... But there I go using common sense. I was hoping it might be an easy shortcut and save some time, money and effort.

Thanks for the info.

K-1 Fiance(e) Visa Process & ProceduresCatch-22?
Hello,

:help: Just completed my initial application, but am having a problem with a possible Catch-22.

Question 1. My fiancee's Mom died in January of 2006, but in the interim her father has not filed the necessary papers to register the death with the government. So although she has been dead for 18 months, a check of Russian records might do not show it. (She verified this with a friend of hers from the Moscow Police) So the question is what do I put on the G325a? The truth is that my Fiancee's mom is dead. However, if I put deceased and they check the official record it will look wrong. Her Dad is living far away in southern Russia and probably wont even get to these papers until late October. A. Do they check this information? B. If they do and found a discrepancy, what are the conequences? C. Can she just explain this at the interview? Any help with this? I'm gonna try and call the Embassy to see if they can help with this question.

Question 2. I signed the G325a for my fiancee out of convenience. Did my best to replicate her signature. :secret: Is this a major deal? From reading posts here I know the mantra of always being truthful, but am I courting serious heartache if I do it this way? Also, is it possible for me to send her the completed form, have her print it and sign and scan it and send it back to me via email? Or does the G325a have to have her ACTUAL signature?

I'll tell you after reading posts on this board, I think I am so paranoid that some pinhead is going to derail my life and our happiness because of some bureaucratic BS. And why do people in CA have to put up with wait times over twice as long as Vermont??? Sheesh!

Thank you all for your help!

K-1 Fiance(e) Visa Process & ProceduresDoh! I Forgot to Send the Check!

I never said your ideas were like science fiction, just unrealistic given that it IS USCIS that we are talking about! Don't get me wrong, I'd like things to be different/better, particularly since I did just file my I-129f and better systems would benefit me! In aswer to your points:

1. I have no idea, but I expect that its because they accept paper applications, not electronic ones and don't want the hassle of wrong credit card #s and rejected credit cards payments. Using merchant services costs big bucks, and frankly as a self-funded arm of the government, they likely can't afford it!

2. Yes, I have. So you're suggesting a ticket be printed and enclosed in the packet? Interesting, but again the merchant services processing fees, I suspect, are the biggestdeterrent for this option.

3. Another saying from my Dad, "There's the way we want things to be, and then there's the way that it is." Evolution in USCIS is extremely slow and we won't see it in out K1 processing, or even AOS. Maybe for the 10 yr greencard....but I can guarantee you I'm not holding my breath. I accept it as I have no other choice but to do so.

I checked a source online and Visa/Mastercard processing fees range from 1-5% of each transaction. I would think the US government could negotiate a "preferred" rate of 1-2% and simply roll that into the most recent astronomical fee increase. FedEx, UPS and even the US Postal Service barcode and scan millions and millions of transactions every day... c'mon.... It's just not that hard if they were truly interested in serving the customers. At FourHundredandFiftyFive dollars per application, I cannot believe they can't factor in electronic payment and a bar code system to track people's application packets. Those two items should be at a MINIMUM.

I mean, who knows, maybe somewhere they have some master plan to join the 21st Century.... I'm not holding my breath either... and I will have to "acccept" my $285 kick in the nads for my failure to enclose the check, but with these fee increases, they have NO excuse to fail to modernize their broken, crappy system.

Jaseball,

Right on my brother! Power to the people. And you are right, to imagine what the "California DisService Center" looks like is too much to bear....

I'm not asking for individualized, personalized service from USCIS. God forbid. I'm only asking for these folks to put together a system that reflects today's technology and can handle the small minority of cases like mine which have an easily fixable "problem" with some degree of common sense and responsiveness and not make me start from scratch when its not necessary.

K-1 Fiance(e) Visa Process & ProceduresDoh! I Forgot to Send the Check!

Something my Dad always said to me as a child comes to mind! "If ifs and buts were candy and nuts, oh what a Christmas we'd have!"

And what you are proposing are some pretty big ifs!

Yes, of course based on what we now know as the USCIS, my ideas are like Santa Claus. But nothing I mentioned is science fiction.

1. Why on God's green Earth, can't USCIS accpet electronic payment?

2. Have you ever bought concert tickets or movie tickets online? Bar code prints out like a charm and you go right to the show, the ticket taker scans it and away you go.

3. We are so accustomed to crappy, slow and de-humanizing bureaucratic treatment, but it needn't be so.

K-1 Fiance(e) Visa Process & ProceduresDoh! I Forgot to Send the Check!

USCIS is not known for it's understanding and tolerance but in this case they do have every right to send the application back. As much as we hate it, they are providing a service and in most places you don't get things done without being paid.

For example, say they process your file and then request the fee; how can they then guarantee you WILL pay them? Even the initial processing would have been a waste of manpower; they could have been processing someone who DID enclose the cheque instead. They could also do the initial processing and then stop if they didn't receive a payment but, again, they will have still wasted manpower up until that point.

Yes, it's a pain that you've forgotten the cheque and even more of a pain that you'll more than likely have to pay the higher fee; but at the end of the day it is up to US to make sure we have submitted everything properly; they are not at fault here, whichever way you look at it.

Just to clarify. I am not asking them to process the fee without payment. They are going to "waste" manpower in rejecting and sending this application back anyway. What I am saying is that if they were customer oriented they should be able to handle a case like this without sending the application back. It's not that hard people....

If USCIS had any imagination, innovation or flexibility, they would have a bar code that you could print from the internet that you would put on your application with all the basic information available. The person who opens your application would scan the bar code and have all your contact data etc. In this case, upon seeing that the check is missing, this person could, with the click of a mouse, notify you by email that your application cannot be further processed until payment is made and to send payment to XXX address with said reference # YYY (Or better still make an onlie Visa Payment) so when payment arrived the envelope could be routed to the proper person and the application would be back on track. This is not Buck Rodgers!! This is not Star Wars!!! This is the 21st Century.

Just because they say on the form that "Your application will be sent back if you don't do EXACTLY what we say and how we say to do it." Does not mean that their systems or their processes don't SUCK.

None of this is going to change the fate of my application, and you are correct, it is not their "fault" that I forgot the check, but it IS their fault that their managment, systems and processes are antiquated, user-unfriendly, and grossly inefficient.

I love a good discussion! Cheers to you all!

K-1 Fiance(e) Visa Process & ProceduresDoh! I Forgot to Send the Check!
Thanks,

After reading the posts, I think I may go with option #2 and just deal with it.... The $285 penalty sucks, but I am more worried about the time involved.

If I thought the USCIS was a well run and competent institution, I would not even mind the fee increase. But I HIGHLY doubt that the almost 300% increase in fees will result in a 300% decrease in the wait time or the hassles. The US Immigration system from top to bottom is a national DISGRACE.

And some people actually want to turn over the health care for themselves and their families to the same people who are brining us the USCIS? Madness.

James

PS Yeah I sound like I'm all mad, but I'm actually quite calm. I've been corresponding with my fiancee for almost 2 years now and this "dumb" mistake won't stop me... but my backside does hurt from kicking myself so much!

K-1 Fiance(e) Visa Process & ProceduresDoh! I Forgot to Send the Check!
James
With all respect...you just started the process, why call them "bastards" already?
aaand...
is it too much to ask for you to add the check to your application in the first place? I think the mistake is clearly on your side, why should they take action in your behalf?

I know they make it difficult at times, but if you forget to add your check, sorry, It think there is no reason to get mad at them for not calling you for a reminder.

I hope though that somehow you will get around to pay the higher fees, but I honestly doubt it. From what I have read so far when people have forgotten the check, the application got rejected and they had to resend it. I don't think they have much sympathy for that, not normally and not regarding the fee increase you might face.

Good luck on your journey!!
Thanks for the post. Yes I did use the term "bastards." My intent was using it in the "generic" sense as in "Don't let the bastards get you down." Yes, the mistake is "clearly on my side." That is not the issue. The issue is how this type of simple mistake is handled by the USCIS.

Begin Rant.

1. If the USCIS had even the slightest shred of customer service orientation, this scenario would be handled as follows... The person opening my package would see that I forgot to add the check. They would send me a form email to the address I displayed prominently on the cover of my application, notifying me of the discrepancy and asking for payment by a date certain perhaps 7 days, which if not received, the package would be rejected and returned to me.(total time for this arduous task approx, 15 seconds).
2. If they were conducting themselves in a customer oriented manner as suggested above and I failed to respond promptly, by all means I would have no room to be angry with them or their process.
3. So the fact that I am going to suffer a $285 penalty for a simple mistake that could be EASILY rectified does make me angry. I don't think I'm asking for the moon to have a process to send a payment for an already received application.
4. I am certainly kicking myself after taking so much time and effort to put this application together and making a dumb mistake such as I have described. But there is NO good reason why they could not afford me an opportunity to send the missing payment in good faith. NONE whatsoever. That makes them "bastards."

End Rant.

So with all that said, I am most likey going to have to "take my medicine" and pay the higher fee, but I don't have to like it.

Good Luck on Your Journey As Well,

James

K-1 Fiance(e) Visa Process & ProceduresDoh! I Forgot to Send the Check!
Thanks again for the advice,

I did call the Customer Service # and spoke to a very nice lady actually. She gave me the following options.

1. Send in my check to CSC, with a note explaining what happened and the tracking # from the certified mail receipt and the date it was delivered, 25 July 2007 (The applications are initially stored in bins according to the date received, so this would make it possible for someone to find it and marry it up with the fee that I send in.) and "hope for the best."

2. Wait for the CSC to reject the package and they would send the back the application and I would then re-send with the new fee.

3. Send in a "new" application (one of my TWO back-ups I made) and the new fee, AND send a letter WITHDRAWING my previous application. The possible advantage of this strategy was that rather than wait for possible 45 days to get rejected and sent the old application, this might accelerate the process.

Any advice or comments on which option is the best? At this point, time is more valuable to me than the money involved, although I would rather lose neither if possible.

Thanks,

James

K-1 Fiance(e) Visa Process & ProceduresDoh! I Forgot to Send the Check!
Thanks for the quick responses... Does someone have the phone number I can call???

I hope these bastards don't reject the doggone application. Is it too much to ask for someone to send and email or even call me and say, hey you forgot the check, send to address etc etc...???

There has got to be a a better way...

K-1 Fiance(e) Visa Process & ProceduresDoh! I Forgot to Send the Check!
Hello All,

I sent out my I-129F application to the CA Service Center on Monday 23 July, 2007. I realized on Saturday that I forgot to enclose the damn check for the application fee of $170.00. Anybody know how I can take care of this? Do I just send another seperate envelope with my name and information etc to the CA Service Center etc? Or is there a number I need to call before sending to get a reference number or something? Laguna Niguel is very close to me. I could drive there in like 30 minutes. Can I just drop by this place and give them the check? Help!

Also, I am hoping that someone will tell me that I don't have the nightmare scenario that I will have to pay the new Fees eventhough I sent my application well before the deadline. Thanks for all your help!

 Our K-1 was just approved!!!!!!!!!

samir shannon - Thanks! I was given a bit of grace. I'm hoping the March NOA1 folks and all of the recalls get their well deserved approvals. What's up with that!!!

dunno what's going on with the ones prior to april. it does seem like they are up to 13 jul 06 imbra receipt date though.

and no approvals today.....hmmm. i'm starting to wonder if they are doing assemblyline processing - one checks for this, one checks for that, all into a big stack and then the next day do the notices.

def. most are given early in the week...but who knows what system they are using? There are plenty of others with early RFE receipt dates & no NOA2 yet, like GaryC.

Question... how do you know when it get's to NVC, and when it leaves?

K-1 Fiance(e) Visa Process & ProceduresAny problems with attorneys?

Yes, it is so frustrating isn't it? Here is the last time I tried to get info from my attorney (since then I've just come on here for all info):

I wrote:

Jeff,

I wanted to touch bases with you and get a bit of information. Paul flies back to Germany on January 22nd because his 90 days will be up. Are there any documents that he needs to bring with him? As far as the next steps of the process go will the USCIS contact us directly or will you get all of the correspondence? Can you give us more information as what to expect next with the interview and so on? We feel a bit in the dark as to the process and what to expect.

Thank you for your help,

Karoline

The attorney's response:
Karoline,

Paul does not need to take any documents with him. After the INS approves the fiancee petition (hopefully shortly) the file will be transferred to the US Consulate in Frankfurt. Paul will have an interview at which time he will be asked about your relationship, how you met, how long you have dated, etc. and also if he has any criminal problems. Paul should not sweat the interview!

I will keep you posted with any developments.

Regards,

Jeff.

from what I understand Paul should have most definitely taken with him the copies of everything we submitted. On top of that, I could have provided him with my bank and financial info, etc. That would have saved me from having to ship it to him. My attorney makes it sound like it just goes straight from NOA2 to interview... Ugh. Plus, he calls it INS. Not a huge deal, but come on, at least give me the confidence that you realize it's not called INS anymore.

Oh, and msu17. I agree that it seems completely unreasonable for the embassy to send packet 3 to the attorney in the US, but here is a post where it seems like that happened. http://www.visajourn...amp;hl=attorney I'm just afraid it will happen to us too. In some ways I feel like I'm too far along in the process to get rid of the attorny and that I will just end up complicating and prolonging. I really don't know what to do. But I'm still supposed to pay him the other half of the money (i paid half as a retainer). And I really don't feel he deserves the money.

Thank you for your replies :) You people keep me sane :P

Okay, another question regarding firing my attorney: The NOA1 went to his address as opposed to mine. The NOA2 is currently in the mail, and I assume it is also being sent to his office since the first notice did. Does that mean that my fiance's packet 3 will also be sent from the embassy to my attorney? I've read a couple of posts where it seems like that happened. And I imagine that will add time. If I do fire my attorney now and if packet 3 will be sent to his office as opposed to my fiance's home in Germany, what will happen? Is it possible to get all that changed in time if I fire the attorney or am I better off just keeping him because it will complicate and lengthen our wait time?

I'm so frustrated. :( I wish I had never hired him in the first place.

I think I'm in the boat right behind you. I had no experience in this area and thought "I don't want to waste any time- I'll just hire an attorney so I know everything is handled ASAP". I received a recommendation from a co-worker and did some online research to check the company's background. I felt like I was being responsible in my actions and was confident in the attorney.

Well, now I'm beginning to have second thoughts. Everytime I email my attorney he answers in one-word responses. And half the time I've tried to contact him by phone it ends up going to an answering machine. I feel like I'm bothering him everytime I have an inquiry, but at the same time i AM paying this guy to represent me. Am I wrong in thinking he should keep us updated on any paperwork we may need in the future? I'm at the point where I feel like I should call him everyday to check the status- afterall, I didn't shell out a fair amount of money just so he could press the "send" button.

Should I give it more time before I begin to lose it...?

K-1 Fiance(e) Visa Process & ProceduresInappropriate Touching
How do you know when your application has been touched? I'm assuming the date will change on your Case Status page, but since I have yet to see it i don't know what to expect. I know it doesn't really make any difference (seeing that some get touched several times before the next step, some not at all), but I think I might be a little more at ease if I just knew that someone has actually SEEN the physical file.

Since mine was sent to the CPC I'm guessing it will still be a while before it gets touched. Figuratively and literally speaking.

K-1 Fiance(e) Visa Process & ProceduresAre there any REAL people working for USCIS?

Ya, I DEFINITLY know the feeling :) I have 2 close family members getting married the same time and I am so jealous they dont have all this to deal with!!! VJ is super as a support site!!! I see you're in the UK so you can get the police certificate started if you want. I cant remember the exact form to ask for, but you go in to the local station and they should be able to help you. They guestimate it takes 40 days for that to arrive and its good for a year. Also check on the embassy's website for the immunizations you need. I think its the MMR that takes 2 shots over a 2 month period, and with NHS its usually cheaper to get them done in the UK. Check out the UK forum, someone posted the paperwork that you get with packet 3. A lot of those you can find online, so take a look and familiarize youself with them. Not much to do till packet 3, but those few things will at least let you feel like you're doing something!!! FYI though, they dont have to get started until packet 3 though, so dont feel rushed! Hope to see ya in London in a few months ;)

We are planning a full floofy dress and church ceremony and reception, but we didn't plan anything (ok, i bought my wedding gown the day before) until he had his visa in hand. We're finding that other than some difficulties with the church (which are sorting themselves out), it's been easy to find a reception hall or a ballroom (we're having a smallish wedding, so that helps) for July.

I wouldn't put down a dime or make solid plans; there's a lot that will be up in the air and things can get delayed through no fault of your own. But if you're flexible on the date, remember that once you get the K-1, you have six months to use it, and that's enough time to plan parties.

Yeah, that's what we're doing too- Catholic wedding with mass, etc. I mentioned the idea of going through the courthouse at first (just to get the legalities out of the way) to my fiance and then planning the ceremony later. Unfortunately, he feels like this is a "cheat" at getting married and would rather wait until the church bit. I agree with him, but from where we currently stand I see no light at the end of the tunnel and will take what I can get. I know I'm not very far in the process (only being 6 weeks into it), but it's really doing my head in to wait around for someone else to tell me when I can get married. I'm sure this is a fairly common feeling around here.

I'm scheduled to put a deposit on a reception site next weekend- they've said they can move date around AS LONG as the original date can still be rebooked. I guess this is a chance to take... I'm sure I'll be stressing all week about whether or not it's worth it.

This website is really helpful- it's like a support club. It's nice to know there are other people going through the same frustrations.

Oh yeah- Are there any documents needed at the next step that can prepare in the meantime??

I am SO glad I found this website. It feels like I just got a whole new bunch of friends who can sympathise with my situation. I told my fiance about this website and he said "just have faith, try not to stress and let's hope for the best"... what a sweet guy. -I just wish it was that easy!

Actually it is my fiance who is in London. I believe he has already gotten on the police certificate bit- at least I hope he has. -So maybe you'll run into him at the embassy. If you see a nervous, chain-smoking brit chewing his nails because he's lost (I'm sure that narrows it down), send him my love.
