Do they want the police incident reports for each charge or do they want a background check from the police station? A police incident report would be a report stating what exactly happened when I was arrested, that is if the police even wrote up a report. A background check is available at the police station, which just states each arrest in any given county. It appears that they don't just give out incident reports, a subpoena is required which needs to go through court, at which point a judge would decide whether or not to release such information. I've tried calling and asking, but they won't tell me exactly what they're asking for, this is very annoying. I've already got certified copies of the dispositions, now I'm trying to get background checks and police incident reports, but they won't give out the incident reports. My convictions are in two different counties. When I went to the police station and asked for a police report they gave me a background check. I would really appreciate it if someone who was or is in a similar situation would help steer me in the right direction. I have two DUI charges and a Possession of Marijuana charge, just misdemeanors. Thanks for your help guys, and good luck with your own applications.

The info on that page is for non immigrant visas (visiting) you are applying for an immigrant visa (K1, correct?). You dont have to worry about that, those "pre-interviews" are not talking about the K1 interview stage.
Just go to the K1 interview and bring your police certificate and court records (if applicable). You'll be fine, try not to worry, be honest and you'll be ok! Best wishes!

Didnt know what forum to post this in sorry. My fiance called the court house in London to get his court documents on an old conviction he has, which he'll need for the interview. the person he spoke to on the phone to didnt know what he was talking about, so he'll go down there in person and ask.
Does anyone know how to obtain them? (he thinks they might not have them cause he heard the courts only keep records for 3 yrs?...his conviction is over 10 yrs ago.)

I would suggest you do due diligence before you set out to get married. It is very possible to do what KP outlined. Couples can go to the local office and get their marriage registered and get a marriage certificate after the traditional or religious marriage. That is an option for Indian citizens. It will work for you Indian citizen or not as long as you give a local address, have an Indian sounding name, speak an Indian language and look Indian.

You may have to do what I described if you don’t look Indian and don’t have an Indian sounding name because what I described is the right and legal way for a foreign national to marry in India; especially if you want a marriage certificate which you do. Then as I said before, the rules over there are subject to interpretation and someone with right connections can make things work any which you want.

I was there to file the Intent to Marry application but I understand one party can file.

You may be able to do as suggested by timesnap - not declare yourself as a foreign national and get your marriage certificate much easier and quicker. I got married in Chandigarh in Dec 05 and this is my understanding how the Hindu Marriage Act works if one of the two parties is a foreign national.

Both parties have to file Intent to Marry with the Registrar of Marriages. It involves filling some forms, filing some affidavits, submitting passport styles pictures of both etc. The government departments do what they do with these and one is allowed to be married by the Registrar or the Magistrate between 31st and 90th day from filing the Intent to Marry. The Intent to Marry can be filed by either party. I had marriage certificate in my hand 15 minutes after the being married by the Registrar.

If you decide to do what I did, I would strongly suggest you hire a local attorney – rules and their interpretation is very regional in India and attorneys know to ‘expedite’ things. Also, we were told by our attorney to wait to have the religious ceremony after the ‘court’ marriage – legally the Magistrate could not marry us if we already were.

Look at the average time is taking now for K1 approvals through your SC and add to that the time it takes for NVC to send petition to the embassy and the time to interview from when the embassy receives the petition. I think it is taking 6 weeks or longer to get an interview date in India depending upon the embassy she would go through. And throw in the time it may take the courier service the embassies in India use to deliver the passport with visa. My wife’s got her passport back on 13th day after her interview in New Delhi –probably an exception.

Hi, I am an USC and I filed (I-130 & I129F) for my wife using my last name instead of her maiden name. Her passport is in her maiden name, so does she have to change from her maiden name to my last name in her passport or can she keep her maiden name? I know that the embassy will issue the K3 visa using her passport name. I am just wondering would there be any problems if we decide to keep her passport in her maiden name even though I sent all the forms (I-130 & I129F) using my last name. (reason is because, in India where my wife is, the process of changing names in a passport takes a long time). Any inputs will be much appreciated...Thanks

My wife got her K3 from New Delhi in Apr 06. We had to get the clearance certificate from passport office in a hurry as well. Fortunately we were able to get it in a week. I think you have to wait 3-4 days to get the medical report back from the doctor in Delhi as well.

Rescheduling the interview should not adversely affect your case except, of course, the delay. The embassy probably would have the interviews for Jul scheduled in the next week or so and you may be pushed out to Aug.

Try to get the clearance and passport back.

I was very sure that they don't allow USC spouses in for interviews - I am not sure if I read it on embassy's website or elsewhere but after my wife went for her K3 interview in New Delhi she told me that she saw other USCs with their spouses at the interview.

I suggest you send an email to the embassy and ask this question. They usually reply in 2-3 days.

If your passport was issued within the last 6 months you should only need the report from the passport office. I am not sure what you mean by renewed; if just the expiry date was extended on a previously issued passport then you may need reports from the police dept as well.

2. I have also renewed my passport and I read somewhere that someone whose passport has been renewed 6 months before the interview does not need a police certificate. Is this true?

My wife had her clearance from Passport office in Chandigarh in March. From what I understand there is a standard form you fill and pay a fee. My wife had to wait for over a week to get it.

Shalz -- my wife's regional passport office is C'garh also and since her interview date is going to exceed the 6 months since her passport was issued, she is going to have to get a PCC from the passport office too (she has the police station one). Can you please share what all your husband had to do?

Did he simply fill out the form and went to the information booth with his passport and they took care of it? Or did he have to find an "agent" of some kind? Any help would be appreciated -- my wife is going to C'garh on Monday.

Yes KP, he got 2 clearences, one from the passport office and second one from the police station.

No, He didn't submit all his paperwork at the VFS. He only paid the courier fee there.


Oh -- that is a really helpful thing to know -- thanks. The only thing your fiance had to hand-carry was the pictures, passport and evidence of relationship, right? The VFS took everything else?

Also, did he get 2 clearances? One from the regional passport office and one from the police station?

My wife went through New Delhi Embassy for K3 in Apr. She had everything the embassy's website suggests and some more with her. They didn't ask for much and only kept copy of 1040 and original W2 for 2005, original I-134 and letter certifying my employment.

I just talked to my wife; she doesn’t remember what she had put down. I am quite sure she would have put down my address since she had her passport changed to show her married name and Indian passports have husband’s name in it as well.

Mention of an address in US should not cause any delays or put the process in a longer loop – it is obvious why one is requesting a PCC and PCC is given for a particular country, in this case her passport will get a stamp saying PCC given for USA. My understanding is that the PCC from passport office is given based on the police report. If your wife had her passport issued recently and required a police report, as most do, she should be able to get PCC from passport office fairly quickly.

Then, if your wife is going to have it ‘expedited’ it may not matter anyway.

In the form required to be filled out to obtain the PCC from the passport office, my wife has to put in "husband's name and address if married, otherwise father's name". Obviously she should put down my name because we are married (hence the K3 petition). But, in this case, is that the right thing to do (meaning, is the PCC going to MUCH longer because they have a US address for my). Maybe I am just getting paranoid :wacko: The PCC from the police station was so much easier.

For the K3 people who's wives got the PCC from the passport office, what did your wives put down? Your name or their dad's name?

My wife had her K3 interview in New Delhi, India in April. I did not send her a letter from the bank. She had my income tax returns, W-2s, letter confirming my employment, recent pay stubs and bank statements. The embassy only asked for 05 income tax return and W-2s.

When I provide the I-134 for the K-3 interview, do I really need to provide a letter from my bank? I have sufficient income, a letter from my employer, pay stubs, W-2's, and 3 years of tax returns.

When I was following up on my wife's passport after her K3 interview, I was told by VFS that they can hold the passport at their office in New Delhi if my wife wanted to pick it up. She didn't. She was in Chandigarh. The VFS in Chandigarh insisted on delivering it to her address.

My fiance interview is in three more days and he will be trying to fly out on the 20th or possibly earlier has to help white wash and do some last minute things then when he gets here we have to get ready for our wedding which will be December 16th woohooo Praise the Lord so very excited here now...just waiting for his interview and then his visa...Question can he ask to pick his visa up at the VFS office? He is having his interview in New Delhi India wish us luck! Has anyone else from New delhi pick up their passport and visa from the VFS office?
