what exactly does it mean if you have been flagged? the time i got hassle i was held for about 10 minutes or so and asked a few questions about why i`m travelling and what job i have. everyone on here is making it sound like i really shouldn`t try to go back to the US, if thats the case then i am totally lost, i mean my girlfriend can`t make it accross to the uk as easily as i can to the US. any more advice? i mean most people on here ar epeople who are either in the k1 process or people who have done it, how often did you all visit your boyfriends or girlfriends when you were going through this? i am so confused right now.

When you say "HELD" do you mean just at the immigration desk?........or did you get taken to secondary inspection??.....One of the guys on VJ got questioned every time he came to the US & was allowed to come in & visit every time!!
To be flagged just means the next time you present your passport to enter the US the officer would be aware you were questioned before!!
I dont think you should'nt try again, I say if you dont bet you cant win!! RIGHT :yes: ..............just make sure you take evidence of ties to the UK and also try not to stay for long periods of time!!....... i visited while going through the immigration process & traveled before also, only twice was i asked more questions than i had normaly experienced!!
But do be prepared if denied entry, you wont beable to use the VWP again!!
EDITED to add.......In one year alone i visited feb-march-june-august-oct,...but only short visits from 1 week to longest 4 weeks!!

Is this true? Because I can remember re-entering (for a job interview) US after being denied entry (due to having resumés in my briefcase)--as "undocumented B-2/B-1" (the "default status" for Canadian visitors to US).

hey, i am new to this website but i have done a lot of reading on it and it seems like the most helpful website out there. i have a few questions. i met my girlfriend online a few years ago and then in the summer of 2005 i came to visit her on the VWP and i stayed for the 3 months that we are allowed, i then returned to the UK for 3 months and then came back for a month to visit her again. after that i was in the UK for 2 months and then came back for 6 weeks to surprise her on her birthday, however i got serious questions the last time i i tried to get past the customs man at chicago. he gave me a real hard time, he asked me how much money i had, what kind of job i had in the Uk and my reasons for visiting and what i`ll be doing the whole time. this lasted for about 10 minutes of me just standing there talking to him. it scared the ####### out of me. i understand now that i was entering too much, i just naively thought that if i didn`t overstay the 90 days then i`m not doing anything wrong. my question now is though, how long should i leave it before i try and come back? i know that a lot of you have reported trouble at the customs when trying to visit your boyfriends or girlfriends. we plan to file for the K1 visa next year and are trying to worko ut how to see eachother at least a couple of times a year without me being turned away and sent back to the UK. so can anyone give me any advice? any similar experiences? i`m thinking that i won`t be coming back for about 6 months, will this be sufficient? if i come back in like 6 months and only stay for about 4 weeks? or do you think that this could still be a big problem? i am so confused by it all!!
any help or advice at all would eb so hugely appreciated.

Hiya Paul Your problem was the fact you used the VWP so often for so long!! but you know this
A trip every 6 months might be ok but you wont know until you try just make sure you have evidence of ties back to the UK, morgage,letter from employer,bills stuff like that, & Good luck :thumbs:

does anyone know what happens to the envelope that the embassy gives you when you receive your visa? i know you give it to your point of entry but do they open it there? also do they give you back any papers that are in that envelope, like the birth certificate? thanks!

You should submit photocopies of evidence like birth certificates and show the original at the interview.
If he hasn't already had his interview (I lost track of the time!) he could get an original back, but it's unlikely from the POE on.


oh. yeah he had his interview and got the visa. do you think that they will give us at least a copy of it at the poe? where do those papers go after the poe? its hard to get a birth certificate from his country. i cant believe we forgot to make copies. thanks

I dont honestly think they will give you anything at POE!!!
you should realy always take the original plus a copy of all documents to the interview, otherwise you will have to apply for a new one!!

I also think it has somthing to do with what date you put on the DS-156 as your travel date!!..........London will always try to accomodate(SP?) you as close to this date, even though they say not to make travel plans, but after asking a few people around the time of my K3 interview, we found this was the case, the ones that put dates got quicker interviews!!........................or it might of just been a coincidence :huh:

If your NOA1 is dated March 6th or after, your case is affected by the IMBRA
nonsense.

With a receipt date of January 5th, you'll be fine! Relax!

I think her/his interview was yesterday & was cancelled by USCIS, & no one could understand why..........after reading this it all becomes a bit clearer................so she isnt fine :huh:

today is really my confusing day... after i called NVC and they told me that they havent received my petition ( 19days) i called the famous USCIS center in California, and the lady told me very passionatly "maaam, its written here, after the I-129f has been aprooved, the center will send it directly to the us consulate of the country from fiancee" "am sorry maaam, i dont have access to ur file but, thats the way it is,u have to contact ur embassy, maaaaam..."

now am totaly lost... everybody here inside gets infos form NVC that their petition has been reveiced, in every site its written, but, no, the lady told me another story.. well, it would be t least a hope more, but, i dont know, somehow i dont beleive it. i had really to be very stuborn with her, that at least i could give her my receipt number... seems they wont to do or help as less as possible... but, on the end now, am not more clever then before, quite the opposite :(

UM Your petition will be sent to NVC for a case number to be given.......they NVC then send it to the Embassy/Consulate !!...............these people should realy give out information if they have no clue!!
The USC will get a letter from NVC once the petition has been sent to the Embassy!!

Sher aka .. Used to be Meandmygeordie .. now just 'me'.

My Geordie went back to the UK the end of Nov 05 and told me in March 06 that he won't be coming back to the US ever. I've taken some time away from this board and to heal from the last 3 years of relationship and hard work as we brought him here - and am going to post my experience so people who have experienced this can find some support. I don't want to be a downer on the board but think the other side of the story needs to be told as well. Stay posted.

I once tried to change a ticket too, for the same reason, wanted to stay a bit longer.......................but it worked out cheaper to buy a new one, so i bought a return, to the UK then chose my return date back to the US, at the end of the year december, which worked out great as thats the ticket i used when i came to live here :thumbs:

My US fiance and I are currently filing for a K-1. It has only been in the pipe line for 2 weeks so still in its infancy. We are trying to do it on our own which may turn out to be a bad idea.

Our wedding is arranged for August 26th, very premature I know, but we thought we'd do ceremony with or without K-1.

My questions:

1. Am I correct in thinking that we CAN'T apply for a marriage license & therefore certificate if the K-1 doesn't arrive in time?

2. I am going to continue working for my UK employer whilst in the US. If my K-1 doesn't come, can I stay in the US after our ceremony until I need to be back in the UK for the UK embassy items?

3. Based on 2, will I have any problem on arrival to US in August if I say I'm intending to stay for 3 months on my Visa Waiver?

4. I think I've goofed up with my flights as I have a return ticket for sometime in September, do I need to declare / show / prove this?

5. Can I, as a UK resident, purchase a return flight to the UK from the US?

I'm sorry for all the questions, hope people can advise.

Jason, you can't get married then return for your K1 interview, you would have to change to a CR1/K3,
visiting the US on the VWP always has its risks, but you should take as many ties to the UK as you can, to show you intend returning!!
the return ticket should be shown at POE only if asked!!
as a UK resident you CAN purchase a return flight to the US, I did this once at the end of last year!!

WOW!! I just wanted to ask why didn't you do DCF, but I guess if you wanted to get married in Las Vegas, then this is pretty much the only way to do it. (I thought about the same thing, marrying on WVP, but I thought, the risk is just too high)

Sorry...Direct Consular Filing. It is basically filing for a C-1 or C-3(?), when the petitioner and beneficiary are in the b's country...since your fiance is stationed in Germany, you could have filed through the embassy instead of going all the way through USCIS. Pretty fast process. I wished I could have done it like that...

its for filing the I-130 which leads to a CR1/IR1 visa :thumbs: which when processed at POE , you will get your greencard in the mail very soon after :yes:

You wouldnt effect your K1 process at all, as you would be "DENIED" not "DEPORTED", and later in the process there is a question asking if you have ever been denied entry!!, some people on VJ have been denied entry & it has not effected thier visa process at all :thumbs:

Okay, so the 400 pages of e-mail hard copies don't have to go... Whew... That would have really made shipping the 129F a pain. :lol:

As it was, I sent copies of my passport visa page, copies of boarding passes and train tickets, copies of our handwritten "let's get married" letters, and five or six photos.

However, that leads me to a question... When I visited Bobbie in Qingdao, I took my digital camera...so all of our photos together are electronic. I pasted them into a Word document and printed it out for the 129F. Ought I to get photo prints made, and send them to her for the interview?

Using a Michigan address means you will be processed in CA which can double the wait time.


California processes I-129Fs from Michigan? The instructions in the pdf read to send it to Nebraska... :o

If someone can provide you with the Case number, from your NOA-1 (I-797) form, you can set up an online account with USCIS, enabling you to follow your case online.


Depending on your bank, you can get the case number the day after the check is cashed. After I sent my K-1 package in, I checked my bank account Web site every day. When the check showed up, I got its image (front and back) and got the case number from the endorsement on the back of the check.

I received my I-797C (NOA1) today, but I had known since last week that our K-1 was actually in the queue.

Hello VJ'ers i send in my k-1 package to the TSC on OCT 1st, i have recieved USPS confirmation that they have recieved it already. This is my issue though. i am going to india to visit my fionce next week for about 2 months i will be in india. while i am over there how can i check the status on the case? i did pay with a check from my personal bank account. i am waiting on NOA1...once i do recieve that then how can i check anything if i am overseas?


You can go to the USCIS Web site and use the receipt number from the NOA1 to check on its status.

USCIS Case Status Online.

You can also get the receipt number from the cancelled check... It will begin with three letters, e.g. WAC.
