Interview in London

Hi all

I was notified today after only 3 weeks of waiting that my interview date is April 25th.

My question is can anyone tell me or does anyone know what is the latest time you can expect to be finished the interview. I am trying to arrange a flight back home and am hoping to be done by 3pm. My appointment time is 10:30am. I know its all estimating but any knowledge can help.

Well, looks like they cashed my $190.00 check! Must mean they accepted the blue ink, right? Anyhow, I sent my I-130 to the California Service Center April 3rd and the check was cashed April 10th. In the future, I will write in black ink, but I think I got away with the blue ink this time

Shouldn't one's signature always be in blue ink on any official document in order to distinguish easily from a photocopy?

Waiting for the NOA letter for the I-130

[font=Comic Sans Ms][color=#33CCFF] I sent my I-130 and my G325A form on the 10th of March we have been waiting for 1 month and a few days, I called to ask why I haven't received the letter yet and everyone has been receiving there's in a few weeks, well i'm glad i finally did they had made a type error in the computer system sending it to the wrong address. It was received here on the 22nd of march in my Post office Box and was returned to the California Service Center to be corrected the Address i sent with the form was correct I was just hoping that someone could tell us is it right that we now have to wait almost another 30 days so we can continue the process Can anyone give us any advice in what to do and how to handle this error they made Please Help and also can anyone answer this it says that it will take up to 990 days to 999 days to process this type of Visa Please tell me this isn't true I was told this is the faster way!!

If they already issued you a NOA1 then you will already be in the system i dont think they will give you another USCIS# just because of an address error!!........OH you ask about the days 990 -999, does this mean you have the notice ?? or not??
anyway dont take any notice of those days thats just a standard thing!!..........Actualy California is speeding up so fingers crossed!! :thumbs:

getting frustrated

hey everybody

my wife got the I-130 form returned back for the 2nd time , the fuirst time because she misses my name and address in arabic and this they they only said incomplete petition, and they didn't mention what thing is missed;, and she doesn't know anything about the missing part, it's just getting frustrated. we wasted already 2 mounths , do we need to get a lawyer or what,
hope that someone can help me and my wife .

Did she make the cheque out to the right place??..Department of homeland security, and NOT USCIS
did she sign the cheque??.......she needs to read over them carefully to see if she can spot what the problem is!!

It appears that in the Phillipines, it is determined on a case by case basis whether DCF is an option for a USC residing in the Phillipines. At least that is how I read it. Were I you, I would read all the information at the embassy website and make your decision based on that. Here is the link:

help!

Someone referred me to this site as being a site that could be very helpful. I'm looking for some information or some advice as to what would be the quickest way to bring my fiancee to the US.

Here is my situation. I am in the US military and I met my fiancee in South Korea. She is a citizen of the Phillipines. I have a friend that is currently in the same situation and he chose to submit a fiancee visa through the Vermont Service center and it just got approved after about 3 1/2 months. They are waiting for the interview date. I'm assuming it will probably be around five months before his fiancee receives the visa.

At any rate, I am back in the US now and my fiancee is still in South Korea. My service center is the Texas service center. From the graphs I see, it appears they take longer to process the 1-29F's than the other service centers...is this a true statement? How long can I reasonably expect this process to take if I do everything correctly?

Also, would it be quicker for me to go back to South Korea, get married at the consulate and file the I-130 there at the consulate and then do a I-129F Spouse K-3 visa application? Which process would likely be quicker from start to finish?

Any help would be great. I'm trying to sort this all out and get all the required paperwork and documents needed.

Basically, I'm looking for some advice as to which route to use.

I think if you can DCF then you should do that!! i.e file I-130 direct to the Embassy/Consulate

that was on 2.28.06

I also wanted to add................if you think this might of happened to you, why dont you call NVC to see if they have got your petition as some times it will be at NVC before you get your approval in the mail........you will need to speak to an operater for K visa & you will need your MSC#.good luck!!....some people have also found out they have been approved by doing this also!!.......but dont lose heart if they say they didnt get it yet!!.......as they can have it a week or two without issuing a number yet!!, if they have not issued a number they will say they didnt get it yet!!

.but your approved I-130 has to go through the NVC process yet

.I realy dont think you will have your visa by june, sorry

as for the K3, I think in Manila you still have a very long wait after approval & NVC, so for that reason i would say dont bother with it!!

you have 2 options, I came to the US on a K3, but i opted to follow the CR1 route too, so i let my I-130 process through NVC then onto the Embassy in London, where i will return for my CR1 interview this month, or you can apply to adjust status AOS in the US!!, I think you need your I-130 approved anyway for the AOS interview, but you can apply before its approved!![b]

I Need some one to please help me understand, I already did the I-129F visa petition for my fiancé ones he came to the USA ad we got married, know I submitted the I-130 form and when I received the NOA 1, I submitted again the I-129F petition to Chicago, is this faster then when it was a fiancé petition what is the deference? Does it work the same way? I am very confused; I want my husband to come over as soon as possible what is the fastest way? Please help…

Its just the same form I-129F, you know what how a K1 visa works, but the I-129F for K3 is a multi entry visa valid for 2 years, no advance parole needed to leave & re enter the country, if your Husband comes here on the K3 visa he will have to adjust status just like with the fiance visa K1 :thumbs:

hi we still waiting for for letter of action for the I-130 but this time they said to my wife they correct the adress and they will send it as soon as they can but the officer told her she not need to send I-129f so we must wait till the 130 approval and make decition so I want to ask how much time the 130 it take to aprroval and if we not go to other steep by I-129 that mean the k3 will take much time or no

Your I-130 will of been transfered from Nebraska to california to be processed, it has actualy speeded up, the K3 has slowed down!!
take alook at the timelines of people that have applied recently!!
But you cant send your I-129F(K3) untill you get your NOA1 as you have to send a copy of that with the application!!

Do you mean as long as K3 doesn't expire, I can stay in the U.S. and receive a green card without filing Adjustment of Status?? Sorry I am still confused...

NO if you enter the USA on a K3 visa you will have to AOS, or another option would be to process your I-130 all the way through NVC then return to your country for your CR1/IR1 interview!!

Once in the US with your K3 visait is good for 2 years so if you didnt want to appply to AOS straight away you dont have to, but if you want to work you must file EAD, you dont have to go back to your country, the AOS interview will lead to a green card!!

Question about Adjustment of Status

Hello. I am new here

We are applying for a K3 visa. Our I-129F is stuck somewhere, and has not been processed yet... I understand that we have to file for Adjustment of Status before I-130 is approved. If I-130 gets approved before K3, can't I go to the U.S.? We have NOA1 for I-130 and our I-130 has been touched once. I am curious how long it usually takes to be approved. My hubby in the U.S. calls them almost every week and has been requesting for our I-129F to be forwarded to NBC, and 4 months have already passed... I am afraid our I-130 gets processed first.

If your I-130 gets approved first dont panick as it still has a long way to go before an interview will be scheduled for you, it will spend any thing from 2 months to 5 months at NVC, this all depends on paper work speed!, your I-129F (K3) once approved is only at NVC just long enough to get a case number, then it is forwarded to your Embassy/Consulate......so YES you can still use the K3, and NO you dont have to AOS before your I-130 is approved infact, i think you cant interview for AOS untill your I-130 is approved!!.but you can apply to AOS!!, or has all this changed now??some one will correct me on this if things have changed :thumbs:

K3 DCF Filing

I put this in the DCF filing forum but I'm posting it here too in case someone has information. I'm a bit confused about the new DCF requirements in India and unfortunately the Delhi Consulate is no help. First I can't get an answer when I call on the phone and then when I sent an email I got a standard reply back that goes to everyone and DID NOT answer my question which is this....

The New policy for DCF in Delhi starts on June 1. I plan to move to India for a couple of months in the middle of May. I was wondering if those who arrived before June 1 would be grandfathered in under the old 60 day policy. I was also wondering exactly what they considered to be a resident...I already have a job lined up for the two months I will be there but I do have to be back in the States by mid-July.

Anyone know anything that can help me? BTW, I'm doing a K3 filing because we married last month.

Hi,

I am currently on a visitors visa in the US and getting married in may which has been planned for months. because i didn't know the whole immigration process we got ourselfs in a pickle. someone told me the best thing we can do is get married and then i go home to the UK and file a K3? is this the best way to go or is there a faster, better way of doing this?

if i do have to file for a K3 is the first form to send off a I-130? any help would be great....

I did that......came to the US got married then returned to England to wait out the visa process!!
I came on a K3 visa which took 112 days from mailing to actual visa in passport!!, but its taking just a little bit longer than that at the moment maybe add a month!! :yes:

The I-130 seems to be getting approved faster now too.......... :thumbs:

YES first you must send the I-130 then once you have the first notice from that (NOA!) you send a copy of that with your I-129F(K3)!!

First, if you marry on a tourist visa, it's considered a visa fraud and this will stay on your record when you apply for an immigrant visa later on (I have absolutely no idea how bad this is, but it does not look good for sure)

it is NOT visa fraud to marry on a VWP as long as you return to your own country.........it is considered visa fraud if you enter the US with the intention of getting married & adjusting status!! :yes:

Ok I know that the NVC assigns the Interview date for the CR1 visa, but my interview for the K-3 is on thursday in Montreal and the NVC has assigned a case number for the approved I-130 on April 10th. Could they cancel my K-3 visa interview if they recieve information from the NVC about the I-130? Oh please tell me I'M imagining things

The K3 wont be canceled , I had my K3 interview & got approved even after i had payed AOS fee bill & sent the DS-3032 back, so dont worry!

I checked my case status today and I my 129F has been approved. They mailed out my approval on April 13th. I am SOOOOOO Happy!!!!!!!!!! My NOA1 came on February 8th 2006. So it has been about 2 months..The wait is over and now on to myPacket 3.

Did you use courier, you have to copy the list then change the font to courier, you prolly knew this though, just trying to help :blush:

Those nice delivery folks called me yesterday evening to tell me they were delivering my visa today - I just got it - elation!!!

Now all I need to do is to file to remove the conditions (CR-1) just after our 2nd anniversary (in a year and a month) and I think thats about it! Of course, the form doesn't tell you how to do this but we've a lot of time to figure it out.

I just wanted to thank you all, there is no way we would have been able to get through this form filing business without this website and the people on it who go out their way time and time again to help us out. And thanks to Euro especially (this is getting like an oscar speech), we were always just a little ahead of you then a little behind you and it was great to have someone who was also doing K3 and CR-1 through London to compare notes with because not too many others seem to do it this way.

Anyway, I will soon be on my way to Mr Mike and looking forward to being able to work, have a bank account, drive and all those lovely things I have done without for 7 months!! Who would have thought someone would be looking forward to working??? That will probably last a week!

Glad to hear ya got your passport back Louise, as for lifting conditions, well um its 2 years -90days from the date on your green card :huh:

, not your wedding anniversary :yes:

My green card is dated 5th may 2006 so i lift conditions any time after the begining of Feb 2008 :thumbs:

Had my interview - it was fine. Although she wouldn't take my passport pic I had done in CVS in NY - said it was too dull and grainy! Thankfully I still had a pic left from my K3 visa interview although it was 7 mths old... She also said I would be lucky if I got my passport back in time for my flight on Tuesday morning...great!

The 2nd lady, an American lady, was really lovely.

Anyway just glad its over and I hope and pray I get it back in the next 2 days.
