We mailedour I-129F 3/3/2006 by next day mail and it was delivered to Vermont at 12;34pm the next day. Will we receive our NOA 1 by email or snail mail? Also it seems to be taking longer they we expected. Thankyou and we wish everyone goodluck and God Bless. Shiela & Bruno

Your NOA1 ( I-797C Notice of action)will arrive in snail mail!!, dont worry if it didnt arrive yet........it will, it can take anything from a few days to a few weeks to arrive!! :thumbs:

I honestly dont know the answer but Lorelle's advice was good, just go get the advice of a immigration lawyer................ are you are both currently living in the US and you have papers already in the system, ???

K-3 Spouse Visa Process & Proceduresmedical records

I've been having a hard time locating my records for the jabs I had as a youngster.

The last thing I've been told was that the records are destroyed after 25 years.

Does this mean I have to take all the jabs again in Knightsbridge? Anyone else had difficulty in sourcing their immunisation records?

Was it your Doctor that told you the records were destroyed after 25 years???
I'm old and my doctors had all my records & the surgery nurse tracked them down for me, she filled out a nice little blue booklet saying when i had them, then she gave me the ones i needed, which were tetanus booster, MMR which you will probably need as "older" people in UK dont have this as a child!!

Hello. I mailed my I-129f for a K3 visa on February 22nd and according to delivery confirmation it arrived on Feb. 24th (in Nebraska). I still have not received the NOA1 and the check has not been cashed. At what point should I start to worry and what can I do?

You sent the I-129F to Nebraska??? or the I-130??
because your I-129F for K3 should of been sent to the Chicago lock box!! they then will transfer it to Missouri!!

your I-130 will be transfered from Nebraska to California some times it does take a while to get the NOA1 :yes:

YES you send it to Chicago and they will then send it onto missouri............... :yes:
Chicago is not a service center, we send papers there & they send them on to the service centers!!

London uses the I-134........you can find whats required as evidence for this on the London Embassy website, its pretty basic stuff.......after you get your approval the process seems to fly by so you could start to send the things required now as the I-134 is good for a year!!
When i had my K3 interview in London the papers they asked for were.....
Medical results (un opened)
marriage certificate
employer letter(husbands)he's the usc
NO tax papers even though i did take the last years one's as my hubby is self employed but they didnt want to see them!!!!
Police certificate thing (which if you havent sent for, you should do it NOW!! as it takes 40days or so to get
2 passport pics 2"x2"
and last MY birth certificate.
you dont need to take any thing extra only the things they ask for!!
I took my husbands divorce papers, they didnt want to see them!!!

take all above documents plus a copy of each as they keep the copies & give you back the originals!!

My packet 3 intructions state to return form DS-230 part 1, DS-156 (in duplicate) and DS-157.

I also have another I-134 Affidavit of Support form in there. What do I do with this? I suppose I could fill it out again but there are no instruction to do so.

If you already had a I-134 filled out, then just ignore the one they sent you!!......dont send the I-134 back , take it to your interview!! :yes:
The other forms are correct, you can fill the DS-156 in electronicaly online at the Embassy website, & print it off with a barcode in duplicate before you send it back, :thumbs:

K-3 Spouse Visa Process & ProceduresReceived my I-797C Receipt

Great news...I received the receipt for the I-130 today. We just mailed it to the California Service Center on March 2nd. It says that they received it March 6 and the notice was dated March 10th. What a nice 1-month anniversary present. Right now I'm kicking myself...we were going to have Paul sign a couple of blank G-325A's before he left...but in all the rushing around with the baby we forgot. So now I have to wait for him to mail them before I can file the I-129F. I hate this even one more day is too much...and right now the NSC's processing times for I-129F is about 5 to 6 weeks. Does anyone know how long it is taking to get an interview at the embassy in London? Keeping our fingers crossed.

Thanks for the replies, its put my mind to rest. I thought I would have to apply for a K1 visa and then wait for that before I could go and get married. Does a k3 one take longer or less to get? Also do you need to meet an income requirement still for a K3 one? and finally can I still enter the USA on the VWP after we have married and in the process of getting a k3 visa providing I intend to return home?

Yes you can still visit on the VWP while your immigrations process is on going & are married, I did it a couple of times with no problems, as for how long it takes, my K3 too from mailing to actual visa in passport 112 days, some are less some are more!!

when visiting make sure when asked questions at POE you are honest & take things with you to prove ties back to the UK, i also took my NOA to show we were going through the visa process!! :yes:

Hi have been browsing for a while and all the information here is really useful. Its good knowing other people are in the same situation as me. Just got a question thats on my mind.

Is it possible to enter the USA on a visa waiver programme, marry while on "holiday" and then return to home country, in my case being the UK and then apply for a K3? Is that harder than normal or what implications would it have if we did it?

I understand you can enter on the VWP and marry and apply to adjust status as long as you can prove it was unplanned but I think that can cause a lot of problems and complications later on and could mean deportation.

How would I check the I-765 processing times (for K-3, category a) 9), filed to Chicago address), - do they go to National Benefit Center?
And at what point they take your biometrics - before they give you the EAD card or after?
Last time I checked it takes about 3 months at the National Benefit Center to process the EAD application.
That is really sucks!

Yes they are processed at the NBC, biometrics is before approval & card!
my NOA1 for EAD is january 19th, i still have no bio appointment!!
although someone with the same date as me has had biometrics done and been approved, so its swings & roundabouts it seems, all i can tell you is Good Luck :yes:
you can check the procress the same way you checked your other papers at the USCIS online page!!

Yes some times this does happen, I can remeber early last year CSC didnt change the date for what seemed like ages!!

Hi!
I"m sending the I-130 for my husband tomorrow (Vermont Service Center) and would like to know if I should go ahead and apply for K3 for him or just wait and do the CR1. We've been married for almost two years and some people think it'll be better to wait for the I-130 to be approved but it might be faster to apply K3. The waiting time for an interview at the Embassy is about two months for both CR1 and K3 and therefore, the processing time here is what makes the difference. The question that I have about K3 is that he wont be able to work as soon as he gets here since he has to apply for EAD and it takes a few months right? Please let me know what you think. Any ideas are highly appreciated. Many thanks!!!

Only you can decide, BUT if i were you and going through VSC i would just do the CR1/IR1 as vermont are so much faster than CSC (which process ALL other I-130)

Line 14 asks Name of spouse so of course I have to put my name there...right?
So since my name is there do I have to put it on Line 21a as well?

Yes she can i did while we waited for our petition to be processed............she should take things to prove ties back to the uk with her though & she must answer questions if asked honestly!!..........with the things i took to show ties back to the UK i also took my NOA1 the POE officer did actualy ask to see it!!

My wife just got visa on her CR-1 case and the K-3 case is being sent to the embassy. Does anyone know what is the process to cancel the K-3 case or would embassy cancel the process itself after seeing the duplicate beneficiary?

Bloody hell Perdesi are they still processing your K3........jeez :P .......with the problems you have had with this, I would be certain it is canceled, send an email!!and ask them for a reply to confirm it has been canceled!!.....
it might cancel out BUT, better to be safe than sorry!!

I can only answer for England police certificates & they are good for 1 year!!............not 100% positive but i think the police certificate is only needed at the embassy/consulate!!....and has to cover ALL places lived from the age of 16 :thumbs: so different country=different police certificate :yes:

I visited while going through the immigration process....I took things to show ties back to the UK, i also took my NOA1 which i was glad i did as the POE officer asked, did i have any paper work to show i was going through the immigration process!!, as he asked who i was visiting, family or friends, i answered honestly & said Family, he asked who, i said my husband!!.......he laughed & asked how that marriage worked, me in the UK hubby in the USA....so i said its pretty good, but we are going through the immigration process, thats when he asked for evidence!! so thats when i showed the NOA1.
The best thing is to always be honest!!
my POE was Chicago.

I know the waiting sucks, but hang in there, there have been many people on these boards that have the same problem with the "online" status !, to be honest it isnt that important, its just one of those things that nice to see!
The K3 seems to of slowed down a little, but not running into months like it was early last year & the year before, so hang in there :thumbs: ,cos once the approval comes, it just flies, The I-130's you probably have seen getting approvals before K3's were probably processed through VSC which is a lot faster than CSC where your petition is :unsure:

i would like to know if it would be better to have a lawyer when someone overstays more than 3 years, but are married. has anyone gone threw this situation i have heard alot of people being in their country. but what about someone who is in the u.s. and cant go back reason for facing being banned. im scared to file and have my husband taken away from me. :crying:

I would say YES it would be better to have a "GOOD" immigration lawyer someone who knows the immigration process, as an over stay can & will be tricky!!

Hi all,
Well I finally got the I130 out and have began getting the I129F ready, bu tI would like to know once everything is ready and I have gotten the NAO1
Do I send this packet to Vermont or the the P.O Box in Chicago?
I am aware that I do not need this until about the next two weeks but I would really like to know, doesn't hurt to have everything ready before hand.

You send it to the Chicago lock box, they then send it onto Missouri for processing!!

Last year K3(I-129F) processing slowed right down too.............when i say slow i mean it was taking months, I-130s were being approved before K3(I-129F).......
all you can do is wait, like Boiler said, you are both still in early days!! :thumbs:
They were that slow we didnt even bother applying for K3 in April when we applied for I-130, but then in August things picked up so we sent K3(I-129F) .....................and people before me and other last years applicants were waiting a very long time!!

I don't accept what you say about just starting..............when we received NOA1 receipt for 31st Jan processing time was down to about 45 days!!!!! They move the goal posts and we're just supposed to accept "You've just started!" :ranting:

Hi all

I was notified today after only 3 weeks of waiting that my interview date is April 25th.

My question is can anyone tell me or does anyone know what is the latest time you can expect to be finished the interview. I am trying to arrange a flight back home and am hoping to be done by 3pm. My appointment time is 10:30am. I know its all estimating but any knowledge can help.
