Me and my fiance want to get married in august in Georgia. She's from the Netherlands and wants to live/work here soon as possible after marriage.

Is it possible that we get married (when she's here as a tourist), file a I-130 form, she goes back and awaits approval etc? Or are there things that I'm forgetting?

Please help me.. I need to know what would be the best way to do it. We want to marry and file everything here in the U.S. What should we exactly do?

Ok I came to the USA on the VWP got married then RETURNED to England to wait for the visa!!

Once I-129F(K3) gets a case # from NVC its sent to the Embassy for more processing, the beneficiary will then be sent out a pack of forms to fill out & return along with a check list & readiness for interview form, when these are processed then pack 4( interview letter) will be sent. :thumbs:

Doing K3 in the UK is pretty fast, mine was 112 days from mailing I-129F to getting the visa in my passport, & mine was 1 of the longer ones, some are faster some are slower, but dont worry you will get there in the end :P

I-134 is good for 12 months so any time now would be good if she is close to interview, also I-134 is for K3 it says you are CR1/IR1 ???

Is it worth the expense of hiring an agent or immigration lawyer for the entire K3 application process (including I-130, I-129F and final stages with I-134/I-864)?

I would imagine it can help speed things up a tiny bit because an expert will help you fill everything out correctly (and therefore avoid delays due to mistakes). But aside from that, are there any other benefits?

My husband and I have been investigating the process thoroughly and reading all the forms. It looks reasonably easy to do the I-130 and I-129F on our own. Only the last packet looks more difficult.

We'd really appreciate people's opinion on this...we don't want to make the process even more expensive if we can do it ourselves!

We didnt use a lawyer......all the info you need can be found right here on VJ, if unsure about anything just ask, however silly the question may seem to you!!...........The only reason i would use an immigration lawyer would be if i had what could prove to be a difficult case E.G overstay, deportation, things like that!!.....also Lawyers dont realy save you any time at all!!

For those of you who do not know about my situation, when I got married in December 05, my husband went back to Jamaica. We have finally decided that waiting is not an option I need to send inthe petion and start the visa process real quick. Anywaayswe are gonna send it by the end of the month to the first week in March. I have been procrastinating getting my legal documents changed over into my married name. However because of taxes and my job I had to get it done today.

My question is:
When filling out the I130 do I use my married name?
The only document that has changed is my SS card, my passporthas not been changed as yet.
Would this cause a delay?

I also want to know, on the I130 required proof it asks for 'a certified copy of marriage certificate', but the FC-029 states that 'the INS has changed the policy requiring.... You may submit ordinary legibly photocopies of the original document.... You may be required to present the original....' Does this mean that I can submit a copy of my marriage cert? B)

THank you. I was getting worried there. To get a certified copy of tthe marriage certificate is $35 and any others requested at the same time is an additonal $30 each. A little expensive.

After TWO trips to the US Embassy today (of which more later), I finally got my K-3 approved!

That's seven months altogether, not bad considering the f'ups along the way. I'll post a full report later, but for now I just wanted to say thanks to all the people that helped me with questions etc. I have no idea how the hell I could have found my way through the K3 process without the assistance of some of the fine folks here.

I have sent and feel fairly confident that it wont be there.Have spoken to the police,looked up the info etc etc I was under 18 so it was a reprimand I believe now opposed to an Adult caution
but you know when something just niggles at you and I suppose until I see in print I'll feel better then.

Having said all that though, I think as it was just a caution, & not a conviction it would be ok anyway!! :whistle:

Hi ,congrats!!

I too was cautioned for a minor offense (shoplifting) when i was 17,I am now 28.
I am told that after 5 years this wiped as should not be shown up on Police check. I too still feel worried that this might come back to haunt me. I hope it wont,I dont think it will but still......................

anyone have experience of this??

The best thing to do is send for your Police thingy and see if its on there, and only start to worry if it is :P by the way your police "Thingy" is good for a year!! :yes:

Good Morning to All;

Well its been almost a year since Lina and I met and we are getting so excited and anxious for the NOA2 from Chicago for our K-3/K-4 Visas. It still is not clear to me after reading all the VJ Posts, and talking with Agents from the USCIS what the Process dates mean on the USCIS Website. Most of the Agents tell me this it the time that the are completing their review of your case and are ready to Approve. One Agent told me my Case could be within 30 days of this date.

If I understand the process correctly it takes about 30-40 days from NOA1 to NOA2, a week to get it to NVC, and 5 days for NVC to process a K-3. Then 2 days to get it to your respective Embassy for Fiancee'. So to clarify, does anyone have a good understanding of what the Processing Dates for K-3 Visas posted on the USCIS Website for Chicago mean? They are processing cases with a Receipt Date of January 10th right now. Are they sending these folks NOA2's or just starting the review?

Lina and I are excited for we are 8 days from the processing date for NOA2 and the NVC is stating it only takes 3 or 4 days for K-3 Visa to get their number and be sent to the Kiev Embassy. It is nice that they DHL these Documents to the respective Embassy. It is also nice that the Kiev Embassy in the Ukraine, according to VJ, is the quickest Embassy on Earth. Only 35 days to process a K-3 Visa.

We have our Packet 3 already (downloaded) and have produced all Documents so it will even speed things up more the moment the Embassy gets the Documents from the NVC. In Kiev you send in the KEV-1 Form stating that you have all Documents and are ready for Interview. Typically you get an Interview in 2 Weeks and the Visa 1-2 days after the Interview.

I hope to fly to Kiev on March 8th and then we will be together finally. We will fly Home together, no more separation.

You must first file I-130 =$190
Then when you get the notice from that you can send I-129F(K3)=$170
if you follow the k3 you will then have to pay, medical fee+visa fee+ a tiny fee to have the passport delivered to your door!!
The main costs are when you get to the US & AOS!!
or you can still interview at your hom consulate, which ever you choose its still a bit pricey....

I'm getting ready to submit our I-130 this week along with the G-325's. I would appreciate any advice anyone can offer. I'm reading so much information that I'm confusing myself. Do I need to file the I-864 now or do I wait until later? Is it a good idea to do a letter of intent and a table of contents? Please give me some information on this situation. I am married and I filed two petitions, an I-130 petition and a I-129f petition. The I-130 was approved and is completed by the National Visa Center and now we are waiting for our interview at the embassy. But the I-129f was denied and what is so strange is that it was denied because we were already married and it was denied for that fact. They said that the petition was filed and they throught that we were filing because I wanted to bring my wife to the united states and get married, but when I filed the I-129f I was married and I sent them the married papers with the paperwork, so I do not know what they are trying to say there. My attorney stated that we do not need the I-129f petition since the I-130 has been approved. Will I run into any problems about the I-129f at the interview or what to you all think of this.

If your Joint sponsor earns enough and can provide employer letter proff of earnings, then there is no reason for that person to put down value of house etc, as everything you list on that I-134 you should furnish the Embassy/Consulate with supporting evidence!!

I've filled out all I-134 information for myself and I think I'm okay but, I don't want to take any chances. I have a cosponsor but I'm not familiar with the paperwork he needs to fill out. Does he do the exact same thing I did? ....including - I-134 form, Statement from bank,...etc. ?? Also, my sponsor, is retired and receives 2 pensions. Because of that, he obviously cannot submit employment verification, what needs to be submitted in its place? BTW , I'm filing K-3 and my wife is still awaiting her packet. Thanks so much for any information on this. This forum is a lifesaver.

First, You actually need to submit your 2005-tax return if your petition goes through the NVC and to the embassy after April 15.



Is this documented somewhere as my interview will more then likely be before this date and all that I have been reading on various sites has led us to believe we can submit 2005 :unsure:

When i had my K3 interview, the guy at the embassy in London said it would be best to bring tax returns for 2005!!.for my CR1 interview :yes:

remain in the UK.

We wish to move to the US and we filed the I-130 in Vermont, however the petition has been returned and we have been told to send the petition to London;; however we cannot do this becuase my wife has limited leave to remain.. help !!!!!!!!!!

did you put down a UK address for your wife??.....................if so you should use a US address & perhaps re-send!!
Have you also tried filing at the London embassy & been turned down??

I have a problem with the I130. We sent the I130 to Nebraska service center and after the NOA1 I opened an account on the uscis website and I have been checking the uploads on my case basically every day for 5 months. Well, untill yesterday it said that the last upload date was october 27 2005 (after they got it basically) I know that it takes about 6 months for the I130 to be completely processed. Well, I went to check again 2 mins ago and it now says Feb 3 2006 (today!!!) as the last upload, but it doesn't say its approved yet. What does that mean??? Its only been 5 months and the processing dates say they are now processing the I130 of August 2005. I almost got an heart attack because I didn't expect that at all and I barely got my K3 Visa and I am still in Italy....I am flying back to the States on march 30. Somebody help me!!! :help:

Hey euro, long time no talk. How have you been? Congratulations on your progress too. Yes, it's pretty strange that first they sent me RFE documents twice and now sent two approval emails this morning. I have CR1 interview scheduled for end of March so I am not gonna bother with K-3.

When they issue the K-3 Visa do they specifiy a date you must leave the country? If so what was the time limit that is given? I know the K-3 Visa is a 2 year multiple visa but I am not sure whether they require the person to leave the country within a specified period of time the initil time the visa is issued.

Your NOA1 ( I-797C Notice of action)will arrive in snail mail!!, dont worry if it didnt arrive yet........it will, it can take anything from a few days to a few weeks to arrive!! :thumbs:
