The best thing you could be doing right now as you only just begun is to read the guides on each process i.e, K3 & CR1/IR1, and prepare yourself :thumbs:

Hiya guys. When you get your NOA1 for any petition, whether it be the I-130 or I-129f, is it safe to throw out the copies or is there a chance of getting an RFE still? I am just curious because I had stated before that I didn't make copies of the second set of my I-130 that I mailed in and only kept the first set for which I messed up on. It is still in the computer and I was wondering if it was safe to delete it seeing as to how my name is different, but then I thought of well what if there is still a chance of an RFE?!

I so hope I didn't lose anyone here lol.

first he will have to file for the k-3 if u are already married and he can do that immediatly. he will file the I-130 form and then when he gets a reciept number from them he will make a copy of everything and send in the I-129f form. he can get all these form from their website. http://www.uscis.gov. if he is unsure of everything then he can hire an immigration attorney to do everything for him.

then u just sit and wait and wait and wait.

I am considering traveling along with my wife and step-daughters when they finally arrive in the U.S. on K-3 and K-4 visas. I am wondering how it all works once we have arrived at the POE. When I arrive in Atlanta or JFK (my usual POE’s), there are customs lines for U.S. Citizens and customs lines for non-U.S. citizens. I assume that we will be able to meet in the area immediately following our separate passing through the initial customs check, and then go together for their special processing. Is this correct? We certainly hope for the best initial arrival process to occur. I do not want to screw it up for them. Anyone care to share their experience in this matter?

I suppose alot depends on the POE, I dont know about JFK, but i know about philly & Chicago, as both these POE processed my visa's K3/CR1.................CR1 was done at Chicago husband was with me, he went through the USC lane i went with the visitors lane, but i was moved down to the end desk & husband was allowed to come to that desk with me :thumbs:

Good Luck.......................when i visited while going through the process i took my NOA1 with me, which i'm glad about as the officer asked me how our marriage worked with me in the UK & Hubby in the US, & did we have plans........i said uh huh we are currently going through the immigration process, he asked did i have any paper work for this to show him, and i did :D ...................but i also took other ties back to UK to show i would be returning :thumbs:

he didnt ask to see anything else, he was a very pleasant man, i had a return ticket for a week, but decided to stay a month :yes:

My wife is considering a visit from South Africa, but I don't know if it is worth the risk in being denied. It is a 19 hour flight over the ocean and 2000 dollars for a ticket so it would probably be best for me to go over there again. I can't imagine how horrible it must be to travel across the world, drop that kind of cash down only to be turned down and sent home! Not worth the rist IMO.

Yes that a long way to come just to be turned back!!.................................but if you dont bet, you cant win, right :yes:

I agree I-130 CR1/IR1 visa is the best, but you still have a way to go, you still have the NVC process to go through, which takes as long as you allow it to, so get those forms sent back as soon as they send them to you, then you have the Embassy part :thumbs:

Did you actually use the pics from your computer yet?? I am curious because when I got my passport to come to England back in 2004, I used photos from Wal-Mart because they do passport photos. I sent in my passport application and it got denied on account of the photos. I then went to the postoffice who in my area is where you go to fill out your passport application, they told me there that the government are very picky about the photos that get sent and that most passport applications get refused when they are done at Wal-Mart, Walgreens, Eckerds, etc..I didn't want to use the post office the first time because the pics cost 15 dollars at the time. I honestly wouldn't risk sending in pics that are not generated by the post office or by any other agency that does the actual passport application. It cost me a) the price of the original pics plus the price of the new pics =$22.00 b.) the price of the first passport application and the price of the second application for which I had to pay 80$extra to have it expedited on accnt of the fact that I was leaving in 3 weeks=350$....moral of the story??? Don't muck about when it comes to the US government and needing anything important from them. Use proper photos..why risk it even if you got away with it the first time or the second time???

I used that programme to make the pictures for my medical , my K3 visa & my CR1 visa , no problems at all, i got a friend to take a few pictures of me with a white backgroung, then made them on the programme :thumbs:

I have also signed up on the USCIS website to receive e-mail updates. However, I have never received any e-mails from them despite the fact that my case has been "touched". From what I understand this seems to be the case w/ some people. Meaning, some people do get notified by e-mail while others do not - it all seems to be luck of the draw. Remember it's the USCIS we're talking about - everything is chaotic. Good luck.

You only get an email when they have somthing to tell you, all other touches mean NOTHING!! therefore they dont email you :thumbs:

my I129F status was touched today but i did not recieve any email from them . I checked my email address and that is correct. It is actually a hotmail address. Is anyone else having any issues with the updates ? I have changed my email address twice and it not working and email addresses are valid. Is there any other way of knowing why it was touched ?

A Touch wont always mean an email will be sent, it just means for what ever reason, cheque cashed etc, someone looked at your petition, you will only get an email notification for RFE or approval, some people dont ever get emails not even for approvals!! :yes:

I've been doing some searching, and here is the USCIS's definition:

Exclusion - Prior to the Illegal Immigration Reform and Immigrant Responsibility Act of 1996, exclusion was the formal term for denial of an alien’s entry into the United States. The decision to exclude an alien was made by an immigration judge after an exclusion hearing. Since April 1, 1997, the process of adjudicating inadmissibility may take place in either an expedited removal process or in removal proceedings before an immigration judge.

So, it sounds to me like it would be.

However, to provide more info, the option was given to withdraw the application to enter the States, which was done, and no bans were imposed nor stamps made in passport.

That said, would this be a reportable 'exclusion' on the I-130?

There have been people on Visa Journey that have been refused entry on the VWP, yet still got K1 visa's, to be denied entry only means that!! you were denied entry & not excluded!!.........if you have been denied entry on the VWP this also means the VWP option is no longer available to you!!

On 1 of the forms to get the CR1 visa it does ask if you have ever been Denied entry!!

Yes, I think so. but I am hoping that the I-129f brings him here quicker. I'm going to wait a few weeks just to see how everything goes with my I-129f.

I keep reading three things. People who abandon the K3 for the CR-1, abandon the CR-1 for the K3 and also people who state that if you receive the K3 first, do not abandon the CR-1 but return to the country for the interview once it is approved because it might be faster than applying for an AOS after she arrives in the country on a K3.

If she receives the K-3 Visa first, do we need to abandon the CR-1 process or is it still an option to continue the CR-1 for a more rapid change of status approval?

I have the understanding that the K3 is to get the spouse here quickly so that you may wait for the CR-1 staus together.

Help?

Your understanding of the K3 visa is correct, Be sure to fill out the "NEW" form with the extra questions :thumbs: ..........I came here on a K3, we also still went with the CR1 & i returned to England for the CR1 interview!!
you will need an approved I-130 to AOS from K3, it wont make AOS any faster though :no:

so you do have choices, you can do both see which gets to the embassy first, if CR1 get there around the same time as K3, then the embassy will cancel the K3!!

Read the guides and learn, as your only in the very begining, soon you will know all you need to know :thumbs: :yes:

Looks like the K-3 is the front runner, especially if you already have information from embassy. Which way you choose to go is up to you and your needs. Do you want him home faster, or do you want him home with his green card in hand and nothing more to do for a couple of years?

Why not do both.................if K3 is the first then arrive with K3 then once you have an interview date for the CR1 then return to Germany for that interview???

but if both arrive at the Embassy at the same time, the embassy will cancel the K3 & just go with the CR1, as the purpose of the K3 is to reunite spouses faster while waiting for the CR1/IR1 to process :yes:

:blush: I dont know how you missed that :P .but for over a year now there are only 2 service centers that process the I-130, that's California & Vermont, but people still have to mail them to the service center for thier state, so Nebraska & Texas are transfered to California :thumbs:

Hi everyone,

I feel little silly asking this but for the life of me, I cannot find it on my own.

Is there somewhere one might see the processing times / dates of the I-130. If I click on the individual service/benefits center and go to the chart which lists the particular visa application options, I dont see the I-130 listed. I do however, see the I-129F for the K3 and the I-129F for K1, just not the I-130 (e.g. 'now processing cases with a receipt notice date of ....').

The reason I ask this is this ............I filed the I-130 on May 30 and I do have a delivery receipt of June 1. However, ( and I know any concern is premature at this point) my husband is traveling from Canada on June 30 for a 2 week visit in Michigan and I feel he should be able to give the border agent some kind of info regarding the status of our petition and not just " um I dunno ,we filed it". I will send him a photocopy of the delivery confirmation receipt and he is in the military so he will have a leave pass and other supporting docs as to prove his intent to return to Canada. We have been traveling back and forth without issue for nearly 3 years now and I dont forsee any unusual problems,although we were not married until recently................ ya neva know!

Prior to preparing the packet I researched timelines and sort of created an expected timeline as to when each step might be completed....as I prepared the I -130 packet to send out, my insecurities and worrysome nature told me I was SURE to have forgotten something or made a mistake. I checked and rechecked, sorted and resorted and as I stood at the counter in my local post office I was trembling. I consoled myself with the knowledge that if I had in fact made a mistake, the USCIS would simply ask for clarification......no harm no foul. I have to tell ya, by day 10 I was beside myself , CERTAIN I had of course made a mistake.....sent it to the wrong place.........forgotten payment or even worse ...fallen prey to a covert govt conspiracy to destroy what's left of my last nerve. As I have followed along the past weeks, I realize that I am not alone in my worry as we all are riding the same train. It doesn't appear as if anyone filing the I-130 in the past month has received an NOA1...........so again , short of calling can we find answers?

As you sent your I-130 to Nebraska it will of been transfered to California, so you need to be looking here for it https://egov.immigra...nter=California
If you sent a check, once the check is cashed you can find your USCIS# on the back, it will begine with WAC

Hello everyone

I Just filed for I-130 about two weeks ago and still havent recieved the NOA1. Is there a way to check the status of my case online ? how do i retreive the case no in order to follow up online ? what is the usual time frame for 1st NOA to come ? I am so worried and missing my wife so much.I't so hard to live without somone you love so much. I love her a lot and pray for her more than i pray for myself. I carry her in my spirit and take her in my soul. Please help me before i loose my mind. I cant leave anymore without my wife. i really really miss that cute lil thing !! Dear All,

Have been re-directed to post on this particular forum.

My fiance is a US citizen, and I am over here on a visa waiver.We recently became engaged, and have been looking at our options in regards to marriage. I'm due to return to the UK in a week, and we've considered having a civil ceremony here before I leave.

I spoke to the relevant government department on the phone, and apparently as long as I enter the US legally (which I believe is via the visa waiver) I can marry, then we would file for forms I-130 & I-145, and thus would begin the process of getting my paperwork processed.That would be option one.

Option Two would be for me to return as we'd planned in 8 weeks and have the civil ceremony then, a contributor to the board pointed out that issues regarding visa fraud could arise, if the ins felt that I'd entered with the intent to marry.

Am I on the right tracks with this? (obviously not asking you for legal advice per say, just advice!)

This is true, but in Moscow they don't give you back the passport the same day as the interview. It must be sent out by DHL. I think that is the question he was asking, if she can travel immediately after the interview. My fiancee had her interview and was approved but had to wait for the passport. The interview was on a Friday and the passport arrived at the DHL office in Moscow on Tuesday, I think.

I dont think they give the passport back the same day at any Consulate now, as Reba was saying,...........well she cant travel untill she has her Visa in her passport :thumbs:
