as for income as long as you have 125% above the poverty level on your taxes then your good to go, I cant actualy find the link to the poverty guide lines but i'm sure its around here some where!!

as for the info the lawyer told you BLAH!!! i dont know why the tell you to break the law like that........I guess maybe as long as they get the cash & they are not the ones getting deported for immigration fraud ( ya never know) then they will advice anything :huh:

I got married in the US on a visit, then returned while the papers processed!!

EDITED to say......K3 is some times faster than K1 and its a multi entry visa, K1 you have to ask permission to leave by way of (AP) advance parole!!
to beable to apply for K3 you first have to file I-130!! as the receipt from that(a copy) needs to be sent with the I-129F(K3). :yes:

OK so when I was looking for my reciept number online it says to enter your reciept number starting with the letters, It begins with three letters such as (EAC, WAC, LIN, or SRC). Mine starts with MSC, is that right? and why cant I find it? Is there something wrong with my reciept? Thanks in advance

Yes MSC is right if it's for a I-129F (K3).....dont worry too much about it a few people have been having trouble with registering a number on the USCIS website!!............just keep trying :thumbs:

Thanks for the link. It says they are currently processing K3 visas for Feb 21,2006, but I sent my I-29F to Chicago. Does Chicago forward the I-29F application to the NBC and is the NBC date refer to when the NBC recieved the I-29F or when Chicago recieved the I-29F?

The I-129F(K3) is mailed to the Chicago lock box, it is then transfered to NBC Missouri service center to be processed!!.......... :thumbs:

Your I-129F isnt in California, it gets processed in Missouri at the National Benefits Center!!, it seems to be taking around 3 months now!!, check the NBC Missouri processing dates :thumbs:

Help!!!! I finally received my packet 3 from the USA Embassy in London. But I didn't get what others got.

I am already married to my husband when I filed the I-130.

And I only received the following in Packet 3:

DS230 part1
OF169 1 and 2
IV17 and 17A (vacination stuff)
I-184
IV18A

But I didn't get
DS-156 or any mention of it
DS-157 or any mention of it

And there's no mention of a $100 fee for this packet like other have.

What should I do? Just send in what they gave me and hope no one made a mistake?

Has anyone else encountered this???? What happened???

and you should of got a I-134, but all this i have told you is for K3, i see your married, maybe your DCF???

Congratulations to those that are been aproved this week and las week as well. I'm getting frustrated because I'd like to take the same trip as well as all of you are , but I'm been left behind. I know that USCIS is processing aplications dated FEb.21 or before and mine is FEb. 22 , however there are some VJ's that are dated after me and are aproved. What's going on? Am I going to get an RFE? Am I going to get denied? or simple they just forgot about my petition !!! :crying:
Eventough my I-130 is aproved and already at NVC it will take 4 months before my wife and child get to the US and if I only get a positive respose from Missouri I will have my family here in 2 months , every day seems to be the longest one. :(

wow frank thats alot of touching going on with you...............I think you will probably get both approvals round the same time, this seems to be the norm these days..............I wish you good luck on hearing any day now :thumbs:
Edited to say..........I remember germangel being in the same boat as you, & she contacted NVC just out of curiosity & to her surprise, she was approved , been at NVC & onto Embassy with out USCIS even telling her :yes:

thanks all for the information and response.

Is the AOS pretty much a guarentee with the successful entry for a K-3, so the issue is simply the length of time and paperwork until the green card is received? It seems that with another interview, there is in our case a small risk of denial at the interview... the personel seems to be such a ####### shoot, I would almost sacrifice time and manage risk for sure, but longer, bet.

There is no guarentee with AOS as there is no guarentee with Embassy/Consulor interview!!


I also entered on a K3 & then returned to England for my CR1 interview!!..............much faster way of getting greencard!!

I was asked at POE how our marriage worked with him here & me in the uk, he was joking about it, i said, it works well for now & that we were actualy going through immigration !...he asked did i have any paper work with me about that.....I showed him a NOA1, he said your good to go & have a good trip!!

which visa would you prefer??..with the CR1 you probably have around 5 more months to go before getting the actual visa in your passport!!...................K3 is faster, I did both came here on K3 then returned for my CR1 interview!!

Ok we can all stop worrying, you have the correct USCIS "MSC" number for your I-129F K3, as for not hearing anything from vermont yet............it takes a while for the petitions to be processed, have you looked at the processing times ^^^^^at the top of this page??, that should give you some idea of the dates currently being processed!!

well we sent our I-130 to Vermont but we sent our I-129F for K3 to California...do u think we were supposed to send it somewhere else?

Your I-130 went to the right place, BUT your I-129F for K3 should of been sent to the Chicago lock box, who then forward to Missouri NBC!!
you might want to check your I-129F to make sure California dont think its a petition for fiance :huh:
Did you send a copy of your NOA1 from VSC?
Does your USCIS case number begin with MSC??

Dont worry about the USCIS online status message, lots of people get this message, just keep trying!!
Your next step is just wait for an approval, while you are waiting, take the time to read the guides on this site to prepare for the next stage.

I posted before what information would be needed to petition for my step son to come over. I have read the link that someone gave me (aussiewench), but I am confused on something (as usual lol). My step son won't be coming over right away as he still needs to finish school which won't be until next may. By that time my husband will already be over there on his K-3, so does this mean we will have to reapply for his son? Or will it the application that I use for my husband still be valid depending on when it gets approved? From my understanding, say my husbands K-3 goes through in September/October, from that date that it is approved, does the visa holder have 6 months to use it then it is considered invalid??? If that is the case then, if my husbands does go through in Sept/Oct., then that definately will become invalid by the time my step son is able to come over. Any suggestions/thoughts/ideas???

Yes Ian once he gets his visa has to activate it within 6 months, the forms you will get will ask you to list children of Ian & will also ask who is to follow, your step son will need to have a medical, but can get a K4 visa from Ians K3 while ever Ian is still on a K3 status, I.E is until he AOS, which s fine as the K3 is good for 2 years!! :thumbs:

Now what if he has a job waiting for him, or if we get co-sponsored by my parents.

Hmm...starting to think doing the K-1 Fiance visa route might work better for us. Just worried about the work situation. Even though I make decent money, he is in the position to earn higher and will be the primary bread winner in the house. As long as he is able to work legally in the US then I am pretty at ease.

All i can tell you is I-130 (CR1) takes around a year from start to finish, I-129F(K3) takes around 100 days from start to finish but first you have to file I-130 as you will need to send a copy of your first notice from that with the I-129F petition, also to do either you first have to be married!!........CR1 enables you to work within a matter of weeks rather than months, with K1 you have to apply for AP advance parole if you want to leave the US even for a short time, with the K3 it is a multi entry visa, K1 takes around the same time to process & get visa as K3!!
I did CR1 & K3 at London, i came here on a K3 then returned to London for my CR1 interview!!

Pack 3 will be sent to your wife, it contains a few forms for her to fill in...and it contains the I-134 but if i were you i would download that & send it to your wife as this has to be filled in by you & needs to be notarised!!
ohter forms in the pack are DS-156-DS-230 and my memory fails me on what other forms!! :yes: :unsure:
edited to say................the pack also contains, checklist & readiness for interview form!!

Hi there,

I have my K-3 visa interview for my non immigrant visa in June. My wife has also received her I-864 letter for my k-3 immigrant visa(CR-1). Can I get the K-3 visa and then move to the US and then proceed with the paper work for the CR-1??. That seems too confusing because then we will have to pay for all the paper work for that visa. Has anyone done that on this website? How do I go about telling the NVC that I don't want to pursue the CR-1 visa?

I came to the US on a K3 visa, we continued with the CR1 also, then when i had an interview scheduled in England for my CR1 i went to England , had the interview & returned to the US on a CR1 visa!! :yes:

Your wife could contact NVC and ask what your options are, she will of payed all the NVC fee's now right???
it might just be worth you returning to Canada for your CR1 interview!!

Can I send both my wife's and child's I-130s in the same envelope?

Do I need to send notorized copies of marriage and birth certificates or just photo copy is sufficient?

The guide says certified copies, but the instruction on the form (I-130) itself does not mention anything about notorizing the copies.

Third time today - this person is not talking about AOS adjustment of status, they're talking about AOS affidavits of support. They need the I-134 soon, for their K3 visa application, the I-864 later for their adjustment application. They want to prepare both at the same time, now.

I don't know much about the process but isn't the 90 days wait something that's option on a K-1? You could enter and marry the same day, hypothetically? Or is this 90 days for another bit? All so confusing!

The time it takes for K1/K3 depends on country!!......................BUT to beable to file K3 you first have to be married,& file I-130 as you need to send a copy of the NOA1 from that !!...........here's a example of K3 in England, mine...from mailing to actual visa in passport took 112 days!!

They always give those "long wait" answers, then it covers themincase of delays, but it wont take anything like as long as that!!.once you know London has got your petition give them a week or 2 then start to email them asking if they have scheduled an interview date for you yet!!

Ok, now this may seem like a daft question and I am probably going to be kicking myself when I find the answer, but I need to ask. Looking at the address where to send the I-129f petition, I have noticed it gets sent to a PO BOX, how the hell do we track that and make sure it gets signed for if it is a po box???
