US Embassy and Consulate DiscussionI-134 and the self-employed...

On the form it says 'I have attached my last tax return OR report of commercial rating concern...'

What is a report of commercial rating concern? I've tried googling it and I still am clueless...so would appreciate hearing from other self-employed sponsors....did you use it? What good is it? Etc...

Any info would be greatly appreciated.

My husband is self employed, I took last years tax returns and a letter from the guy he dos most of his work for, the Embassy didnt even want to look at his tax returns!

Removing Conditions on Residency General DiscussionAssissting House Living

Hello everyone
I am currently holding a conditional green card. I have heard some information about assisting housing living for low income family. The rent for those apartment over those area are very low. Will it affect my green card if I apply for those Assissting Housing Living? Because I know that for green card holder, I shouldn't apply for any public assisstant (like Welfare Program, Unemployment, or Food Stamp . . . ). I don't know this Assisstaning House Living program consider a public assisstant or not. Anybody ever have any experience like this, please help me

Wow. Hopefully there is a VALID reason for your desire to get on the backs of working US Taxpayers. Hm. It's difficult for me to restrain my reaction after reading this.

 Bloody hell, the OP didnt say FREE housing payed for by tax payers!!!!,

tobias... assisted housing living = also known as HUD is in place for families who qualify for it... and no, it will not affect your green card... the public assistance that it refers to is TANF and medicaid... good luck!

Yes good Luck

Removing Conditions on Residency General DiscussionHow long before I receive biometrics letter?
QUOTE (hello28 @ Apr 30 2008, 05:35 PM) <{POST_SNAPBACK}>
Hello. I received my NOA 1 date at the CSC of April 15th, 2 weeks ago. I haven't yet received the letter with the biometrics date. Should I have received this by now? I always get a lot of mail but for some reason, for 2 days in a row I got ZERO mail (not even junk mail)... so I'm worried the mail may have gone to the wrong address. How can I find out if we have a biometrics date... or what number can I call? thanks.

Dont worry, i got my NOA dated April 16th from CSC, I have'nt got my Bio appointment either as yet, i'm not worried it will come when it comes good.gif

QUOTE
Did you sign up for email notification with your new case number? You can tell when something has happened by the dates of movement (usually referred here as "touches").

If the biometrics for this is like the AOS method, you will probably need to wait at least a month.

When Removing conditions we cant see our status online until we get our Bio letter,as NOA & BIO case #'s are different! good.gif and it's the BIO case # thats the one to be used for "online status"

Removing Conditions on Residency General Discussioncan a employer ask for green card
If she has a no legend/not restricted SSC then they can NOT ask her to re-verify her employment status, i just went through the same thing!

About Form I-9, Employment Eligibility Verification

GREEN CARDS”
The terms Resident Alien Card, Permanent Resident Card, Alien Registration Receipt Card, and Form I-551 all refer to documentation issued to an alien who has been granted permanent residence in the U.S.. Once granted, this status is permanent. However, the document that an alien carries as proof of this status may expire. Starting with the “pink” version of the Resident Alien Card (the “white” version does not bear an expiration date), and including the new technology Permanent Resident Cards, these documents are valid for either two years (conditional residents) or ten years (permanent residents). When these cards expire, the alien cardholders must obtain new cards. An expired card cannot be used to satisfy Form I-9 requirements for new employment. Expiration dates do not affect current employment, since employers are neither required nor permitted to re-verify the employment authorization of aliens who have presented one of these cards to satisfy I-9 requirements (this is true for conditional residents as well as permanent residents). Note: Even if unexpired, “green cards” must appear genuine and establish identity of the cardholder

US Embassy and Consulate Discussionguangzhou china embassy
I can confirm that the Guangzhou consulate sends the I-864. I had sent my bao bei an I-134 between when I received NOA2, and when she received P3. The supporting information is the same, but, it's a different form and another Global Priority Mail shipment... (And, that ought to help, right? Lots of letters back & forth...)

If I dont go with to the K3 interview will it affect my IR1/CR1 process??

NO i wouldnt think so too different visa's......................has your I-130 been approved yet??
but if your thinking of doing that i would email the embassy and just explain you have decided to follow the CR1/IR1 process but thanks!!

an approved I-130 can be at NVC for a while until you decide to continue the process i THINK it might be a year before they cancel it if nothing has been done with it!!

if this is what you are going to do you realy should email London ASAP!!!

Oh #######!!
well maybe you can email the embassy and ask for a later date, much later maybe, just make an excuse up, cos if she isnt serious about the divorce she is losing out as are you!!
but if she does change her mind i suppose you can always do the CR1/IR1 route!!

but i seriously do wish you GOOD LUCK!!!!

K-3 Spouse Visa Process & ProceduresWe can't get info on our case online

When I went online to get info. on my case's status, the receipt # wasn't accepted. Could this mean there's a problem or that a decision's about to be made? Even though the USCIS told me there were no problems, I still got transfered to an Officer anyway. Please advise me on my situation.

This doesn't look good at all. I'll tell you why, based on my experience.

Before sending marriage fraud allegations to the 'CIS, I was easily able to access my immigrant ex-wife's case status info. online. After it was rcv'd, it only took them a few days to prevent any access.

You can't access it anymore, then got transfered to an Officer.

This post irritated me..........you are just going to make people worry with out reason, ALL cases are different!!!..YOU were able to see your case online, the OP has not ever been able to as yet!!
a lot of people have not been able to see their cases on the USCIS website, somtimes they never do see it.this does NOT mean anything bad!!!!

K-3 Spouse Visa Process & ProceduresStupid question about I-130 and I-129F

Hello,

1.) we filed for an I-130 at the NSC. I was told that they would forward it to the CSC. I am right assuming that the California Service Center processing times are relevant for us? Or still NSC? (Necessary background information: We got married earlier this year).

2.) the processing time (from NOA1 to NOA2) for some I-130's seems to be significantly lower at the CSC than indicated, e.g. 100 days instead of 180. Does anyone know a good explaination?

Thank you,

Clemens

Yes you should be looking at the processing dates at CSC!!.....as for how long each case is processed its just the way the cookie crumbles!!........But i can tell you that they do seem to of speeded up a lot recently!!

Hi, I have a related question.
We are going to move June 1. We are currently waiting for CR1 to complete at NVC and for EAD.
We already sent in the DS230 with the old address of course, as we had no clue that we'd move until yesterday!!
Who do I have to inform? Embassy and USCIS about EAD? And how? Use a form, just call or what?

I would call NVC & perhaps email them too......to be sure they change it!!, unless its already at the embassy then i would email your embassy!!, as for your EAD you will have to call the USCIS number and change your address with them!!

K-3 Spouse Visa Process & Proceduresstarting immigration for spouse while still in his country.

Hiya...Ok so the 29th of April is our big day to be married!! WOOHOOOOO...We are going to start the K-3 while I am still in the UK..(I being the USC). We know that we can start the process while I am still in the UK, but my future husband and I were wondering if it is possible if I stay here during the whole process. My visa certainly gives me the time to do it, but not sure how it will work in regards to getting NOA1 and NOA2 along with anything else that may be sent to us. I realise that we have to show that I have residence in America which I do have. Just need to know how it would work if I continue to stay here during the K-3 process. Also, I have read that you have to pay for the application in US currency. Does anyone know how or where we can go to get that from over here? I know that it can be done. Thank you for the help. I know that I have more questions, just can't think of them all right now...lol.

Kindest Regards,

Laura and Ian

All your mail will go to the US address, so who ever lives at that address will have to forward the mail to you, all fee;s have to be payed in money orders in Dollars!!

K-3 Spouse Visa Process & ProceduresNOA2

I knew there was something else...The NOA2, is that what is needed for my future husband to be able to come over to the US? And how long after it is given will he be able to come over if that is the case? AND..lol..if he is in the middle of the sale of his house here in the UK when it goes through, how long after it has gone through does he have to go over to the US? Meaning...is there a time frame from which the NOA2 is given and he is told that he can go that it expires?? Thanks again..

Laura and Ian

PS...I have tried to upload a pic of my wonderful soon to be hubby and I but I seem to have some problems. Can anyone help me on this please?? TA!!

Hiya Laura
Take a look at my timeline (signature) these are the steps after approval(NOA2)...your petition will be sent to NVC national visa center, they will issue your petition with a NVC case #, it will begin with LND,I know your in England with Ian, so when you know your case is approved at VSC, call the NVC 603-334-0700, to find out what your case number is, give em a week then call!!then you will have papers sent to you to be filled out & returned, Ian will have to fill out a DS-3032 agent form, this just makes you his agent, i think some people have emailed this to NVC when the time is right!!....you will get the AOS bill $70 round the same time, then you will get the I-864 afidavit of support!!,& IV bill $380, Ian will get the DS-230!! after all processing is dont & you get case complete at NVC they will forward your petition to London, Ian will need to have a medical once London has the papers you will beable to keep emailing the Embassy to find out when Ian's interview date is!!
Good Luck

K-3 Spouse Visa Process & Proceduresconfused questions

Well, the problem with canceling the big wedding is we'd be out about 8k heh. Invitations, castle rental, caterer's, etc that's already been payed and non refundable.

We had an engagement party with about 40 people there, we got a lot of pictures of that, so that's good. I'll make sure all the local family is invited if we get married this week lol.

The wedding in Toronto at this point would be for her family and just so she can have the big wedding she wants. But since we'd already be married, we wouldn't be changing any legal paperwork, just a confirmation of vowes I guess you'd say.

Sounds like a good plan

K-3 Spouse Visa Process & Proceduresconfused questions

Thanks for the input.
m_olask,
unfortunately, the K-1 is kind of a non option anymore. We have too much invested in the wedding in July to pull out. Castle rented, caterers on deposit, etc lol. If we get married now it'll just be the legal quickie ceremony and the one in July will be the one for her family and friends and the big fanfare.

euro,
are you able to visit during the paperwork process?

She isn't going to be able to move here til later in the year anyway, so if we're lucky we'll have the paperwork all done by the time she can move here anyway and we'll be set heh. Not sure how long the process takes. I've tried looking at peoples timelines but I've noticed, different countries or origin and destinations take different time for the same process's.

YES you can visit while the papers are being processed, BUT she will have to beable to show strong ties to Canada, I visited while our papers were being processed, & was asked at POE how our marriage worked with me in the UK & hubby in the us...lol, I told him we were going through the immigration process, and he asked did i have any paper work with me to show that, I had actualy taken our first NOA1 with me!! & he said your good to go!!................lots of people do visit while the papers are being processed, best advice is NEVER lie when asked a question, dont offer a big answer, and take evidence of ties!!

I think you can DCF in Canada now, that might be worth a read for you!!!

Yes you can get married now while she is there & file the papers!!
as for income as long as you have 125% above the poverty level on your taxes then your good to go, I cant actualy find the link to the poverty guide lines but i'm sure its around here some where!!

as for the info the lawyer told you BLAH!!! i dont know why the tell you to break the law like that........I guess maybe as long as they get the cash & they are not the ones getting deported for immigration fraud ( ya never know) then they will advice anything

I got married in the US on a visit, then returned while the papers processed!!

Good Luck & have a great wedding day

EDITED to say......K3 is some times faster than K1 and its a multi entry visa, K1 you have to ask permission to leave by way of (AP) advance parole!!
to beable to apply for K3 you first have to file I-130!! as the receipt from that(a copy) needs to be sent with the I-129F(K3).
