K-1 Fiance(e) Visa Process & Proceduresquick question

hey everyone!!!

I checked the status online at the USCIS website and this is what it said:
"On March 3, 2006, this approved or re-affirmed case was shipped to the Department of State for visa processing. If you have any additional questions, please contact the Department of State."

does anyone know how long will it take for the packet to be delivered via snail mail? (I live in Toronto, Canada, the US embassy is located in Montreal)

peace and good luck to all of you
patience is a virtue (apperently) ;)
Elunia28

As for how long it will take your approval notice to arrive in the mail i have NO idea, it will get there eventualy...........but the main thing is..CONGRATULATIONS on your approval!!

K-1 Fiance(e) Visa Process & ProceduresImmigrant visa application processing fee????

For USC fiancé(e), the cost of the I-130.

The visa fee must be paid by beneficiary AT the consulate (or slightly beforehand, depending on the country where located).

(and, BTW, Immigrant Visa fee is outside the glister of K-1 anyway).

We don't have to fill out an I-130
On the US Department of State website, it lists a fee of $335 for the DS-230 and I have to fill that form out.

You will have to do that when you AOS!!!
the only fee you will have now for your K1 at the Consulate will be the visa fee...not sure how much it is i think about $100us.............

K-1 Fiance(e) Visa Process & ProceduresI-234 or I-864

Hi! I found this on the visajourney website for what is needed after receipt of the NOA2...
"I-134 Affidavit of Support form. Ensure it is notarized (by a public notary), with all required supporting evidence. Some consulates may require a different form. Some require an I-864."
Can you let me know which one is required for the UK embassy?
Thanks!!!

London uses the I-134 for "K" visa's  ...and if your other half wants to download the form & get the evidence together thats also good too as the I-134 is good for a year!!

K-1 Fiance(e) Visa Process & ProceduresAnyone still awaiting packet 3?

According to an query email responce from NVC our file left NVC on March 23rd for the London Embassy. On the NOA2 dated March 8th by email, recieved march 11th by mail it said 4 weeks till we'd get something from London. By my calcutations its been about 3 weeks. I'm seeing some people dated 15th left NVC but all from NSC or VSC...anybody around the same time as us whos still awaiting packet 3?

It's taking all my might to not phone the embassy and ask whats going on....I HATE not having the online status case at this point...I'm naturally a busy person...and I've got nothing left to do now......police certificate underway, got supporting evidence to provide at the medical whenever that will be, co-sponcers filling in her forms.....

*twiddles thumbs*....Feel pretty helpless now....

Fiona

You will have to wait a little bit longer, as your petition was only sent to London on the 23rd, its normaly about 3 weeks from that date they are likely to send you pack 3.......you can start to email them, but i dont think they will of put your petition in the computer yet!!
just incase you dont know the address for London here it is.......
Londonconsular@state.gov

EDITED to say...........dont call, as its just a call center in Scotland ,& its a bout 1:30 a minute  you are better emailing!!

K-1 Fiance(e) Visa Process & ProceduresI did it

 I filled in the .pdf versions of the forms in packet 3 they sent and printed them off...filled them in CORRECTLY this time, following the vj example forms and advice from rebecca etc... Wrote my covering letter and sent off all 4 forms (includes DS-156 duplicate). Just gotta wait till i get my police certificate so I can send back the checklist

I was re-reading the medical instructions again and it says "if you can't get a medical date before the interview don't worry we will look over the results when we recieve them and contact you about your case." So is there still a possible way you think I could manage to sneak them onto the same day?

Also I had one question. It goes on about evidence that the applicant won't become a public charge...now it says bank balance can be used as proof. If I got a letter from the bank that states how much we have saved (since July 05)....money is for going back, interview, medical etc etc, hotel.....will they take that into account in our favor as it is savings..?

 ty for making me understand packet 3

Apparentely you dont need the police cert to send back the checklist. I think you will delay your interview if you wait for that! Someone correct me if im wrong but get that thing in the mail!

The OP means to be sure the police certificate is in hand before sending back checklist!!...not to send police certificate back with checklist!!

K-1 Fiance(e) Visa Process & Proceduresdifference between k1 and k3

Hi, Ive read through alot of things (including the guides) but am very confused, me and my partner want to get married some time but are not sure, now we have 2 choices, i can go to usa on vwp and get married, then come home and file for k3 or i could file k1 then go to america. the only thing worrying me is:

1. not being able to work while processing the stuff on k1 which can take ages.
2. not being able to leave the usa untill i have done aos whereas i could on k3.

apart from those 2 things what are the main differences that have an effect?

from looking at the time its taking to process the forms in the service centre, k1's are getting done quicker which is swaying me towards that but I dont like the idea of not being able to come and see my family for years after.

Only you can decide...............if you do chose K1 it wont be "YEARS" untill you see your family, K3 does have the benefit of being a multi entry visa, you dont say what your home country is, as this can make a difference to the time it takes for any visa!! e.g I came here on K3 which took 112 days from mailing to visa in passport (LONDON), but to apply for K3 you first have to apply for CR1(I-130), then after you get the reciept notice from that (NOA!) you then apply for K3 (I-129F)
Keep reading the guides & then you can decide which is the best option for you

K-1 Fiance(e) Visa Process & Proceduresk1 or k3 processing times/

I am seriously considering marrying my Fiancee and applying for a k3 instead fo the k1 to speed up processing times.
Do all K3's apply through the National Benefits Center?

The reason I ask is that they show a processing of the 129f's as January 25, 2006, which is much faster than if I do the k1 through nebraska, which is still processing decembers.

Any thoughts on anyone? I just want to be with my future wife sooner rather than later. Thanks.

Yes all K3(I-129F) are processed through NBC, but first you have to send your I-130 to your service center depending which state you live depends on which service center you use, Nebraska & Texas both transfer I-130s to California service center!,Vermont also processes I-130 so add a coupld of weeks for that as you need the NOA1 reciept notice to send with your K3 (I-129F)
Good luck on whatever you decide to do

K-1 Fiance(e) Visa Process & ProceduresNonexistant forms?

My fiancee's congressman's office just told us we need to fill in a form IV15. This form, as far as I can tell, does not exist. Does it? And if not, what should I do?

Thanks in advance.

If my memory serves me right (which at times it dosent)...Its the Consulate/Embassy checklist!! try getting it from your Embassy's website!!

Well, we sent that off as soon as we got it. Now the embassy are saying they don't have it.

AH i see well this depends on how long ago you sent it??........as the Embassy some times says they didnt get it yet if its only been a couple of weeks , as soon as the manualy process your papers & input them into the computer will they say they have papers.........so maybe try emailing them to ask if they have got them yet!!
Which Embassy is it?

K-1 Fiance(e) Visa Process & ProceduresI-134 Form

If my fiance comes with me to the interview, does it still need to be noterized? It seems pretty silly to do that if he is standing beside me to prove that he signed it.

Should we get it done anyway? The reason that I ask is that my fiance is in Canada with me right now. To have it notorized in the US, we will have to go back across the border, get it notorized, and then come back into Canada to have our interview in Vancouver. Is it really necessary?

YES he still has to have the I-134 Notorised!!
maybe you can email the Embassy to see if they have a notary & if he could get it dont there???

Ok so I have been reading ahead and it says when you get the additional pictures for the medical and the interview you are to sign the back of them. I just submitted the K-1 petition and I wrote our names on the back of the pictures that I submitted with the G-325A. This was according the instructions in the guide on this forum. Was I supposed to have signed them instead or is that only for the later stages?

Yep I am freaking over every little thing!

K-1 Fiance(e) Visa Process & ProceduresTax records required?

Hi, i have my interview in London on May 5th 2006, i was just reading another thread about tax returns and would like a quick confirmation on a question that wasnt fully answered, and is worrying me.

here goes,
are copies of tax returns required from my fiance (the petitioner) for the interview if you are not self employed?

My fiance is sending me a letter from her bank aswell as a letter from her employer with the affidavit of support, is this sufficient?

thanks in advance.

:)

I Had my interview in London, and i was required to take my husbands last years tax's (only 1 year) as he is self employed, i also took a letter from the guy he does most of his work for!!...................They never even asked to see the tax returns, even when i asked did they want them, the guy said no!!

K-1 Fiance(e) Visa Process & Procedurespolice certificate requirement

hi everyone,
i have seen conflicting information regarding the police certificate that the fiance is required to submit with his package of information at the interview. in one place i read that a police certificate from every place the fiance has lived since the age of 16 is required for ALL applicants. in another place i read that the police certificate is required ONLY for people who have criminal records. (actually, i read these two conflicting instructions on the ciudad juarez consulate website!) my fiance has no criminal record and has never had any interaction with the police in any of the places he has lived. i am hoping that this means we will not have to go through the aggravation of requesting police certificates that say nothing about him.

does anyone know what is actually required?

thanks.

Your Fiance is required to get a police certificate from all countries lived in since the age of 16 reguardless of criminal history or not!!

K-1 Fiance(e) Visa Process & Proceduresvisiting girlfriend, problems with customs

hey everyone, you have all been a great help and i am very much appreciated for it all. i do hae one other question though, if you come over on the VWP and you are refused entry, what are the ultiate ramifications of that, i mean other than you just simply not being able to use the VWP anymore? can you still apply for a tourist visa and get in or are you basically banned from entering america for a long time? and also is it a definate that being refused entry on the VWP will not count against you filing for a K1 visa?
thanks again everyone, you have been a terrific help.
take care now
Paul

and a response to poster WIDGE
when i make my next planned trip, i would have been int he US for a total of 95 days in the past 12 months, do you think that will help my cause or you think it will still be too much?
thanks

Yes it simply means no more VWP travel, dont know about the tourist visa, & no it wont have any effect on your K1 process

K-1 Fiance(e) Visa Process & Proceduresvisiting girlfriend, problems with customs

what exactly does it mean if you have been flagged? the time i got hassle i was held for about 10 minutes or so and asked a few questions about why i`m travelling and what job i have. everyone on here is making it sound like i really shouldn`t try to go back to the US, if thats the case then i am totally lost, i mean my girlfriend can`t make it accross to the uk as easily as i can to the US. any more advice? i mean most people on here ar epeople who are either in the k1 process or people who have done it, how often did you all visit your boyfriends or girlfriends when you were going through this? i am so confused right now.
creasy

When you say "HELD" do you mean just at the immigration desk?........or did you get taken to secondary inspection??.....One of the guys on VJ got questioned every time he came to the US & was allowed to come in & visit every time!!
To be flagged just means the next time you present your passport to enter the US the officer would be aware you were questioned before!!
I dont think you should'nt try again, I say if you dont bet you cant win!! RIGHT  ..............just make sure you take evidence of ties to the UK and also try not to stay for long periods of time!!....... i visited while going through the immigration process & traveled before also, only twice was i asked more questions than i had normaly experienced!!
But do be prepared if denied entry, you wont beable to use the VWP again!!
EDITED to add.......In one year alone i visited feb-march-june-august-oct,...but only short visits from 1 week to longest 4 weeks!!
