I need advice on the best thing to do.

I know my interview is July 10th in London but i have not received my packet 4 in the mail. I have emailed the embassy to say i have not got my packet 4 but of course they have not responded to me. I tried to book my medical in the hopes that my packet 4 would be along soon after but they told me i needed my packet 4. So what do i do?

Any ideas f the best thing to do?

This might be a good reason to call the 1.30 quid a minute line, dont have the number, but call em & ask them to send you out another pack, as it didnt arrive yet, you will need the letter to get you into the Embassy, call them, & good luck :thumbs:

After much digging (and reviewing my earlier posts both on this site and immigrate2us.net) I found this: http://www.uscis.gov...igibility.htm#j which indicates that we should stay here to file. I also spoke with a lawyer I found and he agreed that this is what we should do.

We sent in the I-130 and the G-325A. He didn't come over with the intention of marrying me-- it just kind of happened. The original plan was for him to come for Christmas and then stay with his dad in Ohio until his return flight which was in January. We filed the I-130 package before his VWP expired, and received the NOA1 the day after his waiver expired.

Does this count as overstaying? We read somewhere that as long as there was paperwork pending, it wasn't considered an overstay, and that overstays were typically forgiven in the case of marriage anyway. If it does count as an overstay, what will that mean for us?

The best i can advice is, as you didnt file the I-130 with the I-485(I thik thats the form) somone will be along to correct me if not!!, but anyway he has now got an overstay, my advice would be for him to return to the UK A.S.A.P, and wait out the rest of the process, i'm not sure if he will need to file a waiver at the interview in London, but it will probably be approved if he does!!, but the important thing is, he must'nt overstay any longer, sorry this is not the news you wanted to hear :(

This case has been approved. On June 20, 2006, an approval notice was mailed. If 30 days have passed and you have not received this notice, you may wish to verify or update your address. To update your address, please speak to an Immigration Information Officer during business hours."

Since my husband and I already live in the US (he came in December on a visa waiver, we got married in late February), we were hoping to do an adjustment of status. What is in store for us next? We haven't gotten the actual NOA2 in the mail yet, so I don't know what other forms/documents that contains.

Do you still have to do an interview if you're doing an adjustment of status? And as far as the affadavit of support, will they send the forms when they want/need them, or should we go ahead and have them sent now?

Hi

My situation is pretty tough because i will need to work as soon as possible after entering the U.S. I understand some people have had to wait and then reapply for a SS card. I wonder if you get a number straight away in such cases and if you can actually work with the number only in that case? Do employers usually want the actual card or will they understand that there is a process to go through?

I am after any information regarding this as i am doing the CR1 pretty much because i want to work straight away and i hope this does not cause problems for me. I know it will be financially tight to begin with but i need to earn asap.

Give it 3 weeks from getting your greencard,Green card should arrive fast then go to the social security office, I checked the box on the DS-230, and they didnt send me 1, so i had to go to the office, :thumbs:

That has been very standard from NVC for as long as Ive known, because many many sites not officiated with NVC (department of state) have forms for download. What they are not wanting is outdated forms being used which can happen if downloaded from other sites. However, I have never noted a DS-230 refused from NVC when downloaded forms have been used. Afterall the Department of State site itself also has these forms for download and use.

I agree, I used a downloaded DS-230 with NO problems, I think they are probably trying to stop people mailing it in too soon :thumbs:

I read somewhere that it is the NVC that schedules your interview and not the embassy is this true ?, and if it is does this mean you can find out your interview date by calling the NVC before your case is recieved at the embassy ?

Also what do you need to schedule your medical?, can you do this from info you can get from the NVC or do you have to await until it has arrived at the Embassy ?

Your interview will be scheduled by the London Embassy!! :thumbs:
you can't find out your interview date from NVC, but you can find out if you have "case complete", you can either keep emailing the embassy or call DOS to find out if you have an interview scheduled, but first you have to wait untill your case is at the Embassy!!, you can call & arrange a medical useing your LND# :thumbs:

The DS 230 have been generated for my husband's IR visa on the 25th and I need to know some information please......
Does the NVC send the DS 230 to my husband in Sri Lanka or me? (I'm the Agent for him).
If they send it to him, should I print it out from the state dept website and fedex it to him and have him fill it out and send it back to me, and send it to the NVC with the cover letter that I made with James shortcuts?
Or
Just fill it out myself since I'm the agent, and send it to them with the cover letter (and also the copy of his passport)?

Your husband has to fill it out, and send it back with a copy of the bio page of his passport, it will be quicker if he can download the form himself if he has internet access!!

I would have thought that someone be it a INS employee, or embassy official would have all read from the same song sheet and be able to clarify an answer to the question - (as well as a laywer). Would an official/ employee not be in a better position to answer that question than even a lawyer?

the best thing to do would be a lawyer BUT the next best thing would be when you have your interview in London, be prepared & take the filled out waiver with you, that way if the Embassy says you need a waiver then you can file it right there & then!...................Good Luck & fingers crossed :thumbs:

I'm glad you brought this up. We're sitting here biting our nails waiting for the interview date!!! It's weird when you get to this stage. The paperwork was troublesome, but feeling like it's out of your hands...just waiting....ARG!!!

London has been great about email communication with us. They screwed up the date they received my hubby's medical results, but they were very quick to get back to us via email! The DOS has been very helpful too.

Dunno, I didn't track our case this closely. I just waited for stuff to plop through the mail slot. I did check ONCE with the NVC and they said they had no record of our case because it was a DCF and would not even go through their office. So I never tried talking to them again.

You can call anytime, wait untill you know when NVC send it to London, DOS will beable to tell you when London get the file etc :yes:
EDITED to say...DOS were not much use to me, as London emailed my interview date to me before i had chance to call DOS, however i did call them a few times, they gave the blah blah 8 weeks type answer!!, but someone on VJ found out from DOS there interview date after only 2 days of the file getting to London, so "swings & roundabouts" :unsure:

YES i would think so!!
from papers being reviewed at NVC to case complete was about a week for me!!, then another week or so for the file to get to London, then you should start to email asking if they have scheduled an interview for you yet!!, but dont worry if they tell you they didnt get the file yet, just keep asking :yes:
You can also call DOS to find out if a date has been scheduled for you as they will know as soon as London knows, Good Luck on a quick interview :thumbs:

Hi, my wife and I are going through the CR1 route which we started back in September. We sent off the Affidavit of support a few months back, got it returned for errors and sent it back to them after fixing them about 3 weeks ago. I've been told that I need to start e-mailing the US embassy asking if they've received my case etc as soon as possible, but as I don' t really want to keep emailing them before they even get the case I was wondering if there was a rule of thumb as to how long to wait?

My wife is from the US and I'm from the UK so it will be the London Embassy it gets sent to. Am I waiting on them to send her some notification to say it's been sent on with various details like a case number or something or will we not receive anything like that? We start the K-3 method and that got transfered to London really fast but as the I-130 got approved a few weeks after the I-29F we decided to go the CR-1 method instead so we could get the majority of the paperwork out of the way whilst I was still working. Kind of regretting it now as we've been apart so long :(

Any advice would be most appreciated.

London wont tell you when they recieve your case, the next thing you will get from them is the interview letter (pack 4), NVC will write to you to let you know they have sent your case to London, once you know its been sent, then email away :P in the subject line put your case# LNDXXXXXXXX
Has your wife booked her medical yet? as she will have to do that soon too!

Hi, I am just wondering how many police certificates I need to obtain. I have lived in 2 counties in England in my life, and I have just received my certificate from the county where I now live. However, do I need to get one from the other county I have lived in, or just one, as I think it states on the London embassy website one from each country? Also, it says on their website that the certificate should state how long you have been resident in your current place of living, but the police certificate I have does not state this anywhere.
Would appreciate anyone's help, am confused!!!

The Police certificate covers ALL adresses in the UK, they do the check through Scotland Yard which covers every where in the UK.......so what i'm saying is you will need only 1 police check!!

:yes: Lorelle said it better than me, not sure about re-paying fee's, i was in this position, NVC asked if i wanted to AOS rather than return to the UK for interview, I said NO!!, but to have to "RE" pay the fee's wouldnt surprise me at all!!!!

Not exactly. If your spouse is in the US on a K-3 and you e.g. file the I-864 and DS-230 with NVC and you dont wish to continue with the CR-1 process, you can notify NVC that you will be adjusting status in the US from the K-3 and they will then return the approved I-130 to USCIS. Any fees, forms etc submitted to NVC for the CR-1 are then void. It is the approved I-130 that gives eligibility to apply for adjustment of status from the K-3, or to apply for an immigrant visa (CR-1). Both result in the same.......immigrant status. Its just a matter of which path to that status you wish to take.


as for the OP if you are so close to interviewing for your CR1 then isnt it worth waiting a while longer??
I arrived on K3, then returned to the UK for CR1 so i entered on both visa's, as far as EAD with K3, you could be actualy waiting 3 months for that to go through, i did apply for EAD while i was here on K3, applied in january & eventualy got an appointment for biometrics for the 15th April :huh: , i didnt bother as my CR1 interview was scheduled for 28th April!!

Anyway whatever you decide to do, i wish you luck :yes:

I know it is said "If the I-130 is approved and the applicant has not applied for AOS yet, they may return to their country and once issued a CR-1 or IR-1 Visa, return to the US as a permanent resident".

Does anyone know if it is possible to do the interview in the US, if someone was to leave after the K3 was approved. Since plane tickets are pretty expensive, I was just wondering if someone has succesfuly done this. If I don't have a choice... I don't have a choice. I know that getting the CR1 visa is much better then getting AOS after entering in the US.

CR1 & AOS result in the same thing!!
if you arrive on a K3 & do the paper work through NVC, with the intention of returning to your country for interview, then thats good!!, however if you do the papers through NVC then op to interview in the US, it will be a AOS interview & NVC will forward your papers to your local office & you will wait in line with everyone else waiting for a AOS interview!!!

What do we do if my husband has to change addresses in the midst of this process? What form? I saw the AR-11 but it says thats for alien relative IN the U.S.

Any and all help will be greatly appreciated. ;)

What i did when i wanted to change the address on the petition is........................i emailed CSC(the only service center with an email address), and told them infact i sent them 3 emails to be sure they changed it!!, if your not at CSC then you could try calling the misinformation line number at the bottom of your NOA1??

well alittle "Tip" on getting your interview before Christmas.......when the form asks what date you travel put a date in there, E.G i told them i was traveling 29th december i got my interview on the 16th :thumbs: if you dont put a date they seem to think there is no rush!!!!

Hi all, this is my first post here as I only discoverd this site last week and any advice would be appreciated.

My wife is a US citizen and I am english. My wife returned to the States in May 2006 as she was then 6 months pregnant and that was the latest she could fly home as we wanted the baby to be a US citizen also.

She filed I129f and I130 on May 23rd 2006 and we received a notice of approval for I129F by email on August 28th 2006.
I flew out to California for the birth of our daughter on Sept 8th 2006 for 4 weeks as work kindly obliged and gave me 4 weeks leave.

Upon returning to the UK my paperwork had arrived from the US embassy. I have a medical exam for the K3 booked for November 6th 2006 and was just waiting on my police certificate to arrive, it finally arrived yesterday the 20th October 2006 and now I am about to send in my paperwork for the K3 visa back to the embassy on Monday the 23rd October.

Yesterday the 20th October we recived an approval notice from UCSIS by email saying that my I130 has now also been approved with an approval date of 17 October


What should I do now? go for the K3 medical and is it the same as the CR/1 medical? ????? or will I have to have a seperate medical for the CR/1?????????

Do I need another police certificate if I wait for the CR/1 interview ????????

Shoulf I send in my completed K3 visa paperwork or wait until the embassy sends me the paperwork for the CR/1 interview, and is that likely to take long for me to receive from them????????

Also what would be the advantages/disadvantages of either option?????????

I know if I go to states on a K3 I will have to apply for AOS so is it easier to go on a CR/1 so I dont have to go through that process?????????

I did both K3 & CR1.................K3 i arrived here in december last year with that visa, i applied for EAD which took 3 months just to get an appointment for biometrics, which i ended up not bothering with as i had already got my CR1 interview back in London scheduled, so i returned for that interview & re-entered on the CR1!!!
The medicals for K3 & CR1 are basicaly the same, cept for K3 you dont have to of had all your vaccinations, BUT you should anyway!!
You wont need a seperate police certificate as the one you just got is good for a year!!
Your CR1 interview isnt going to be for a while yet as you have to go through NVC, then once you get "case complete" at NVC you will have to wait another 2 months for your interview!!.........if you are in a possition to do both as i was then i would say go for it, it has a plus that would work great for you, I.E you would probably have your K3 intime for Christmas with your family in the US!!, you could still do all the CR1 paper work & return to the UK for your CR1 interview...........................the only other options are, abandon your K3 & stick with the longer wait of the CR1, while waiting in the UK, or get the K3 & AOS in the States!!

I 'm in a big pickle right now!! I have my K3 interview on the 13th Nov which is great BUT the NVC sent my complete CR1 case to the Embassy 6 days ago ( they dont have it yet)

I emailed the embassy to say that the NVC had completed my case and could i interview for the CR1 on he 13th instead of the K3. I sent the email over 12 days ago and have still not had a response. So I called the London embassy today and they couldnt tell me anything!! The girl was not very nice on the phone either! :(

To top things off I am sick from the MMR vaccination I had to get at the medical! ( which i already had) :wacko:

I really dont know what to do!! I really want to interview for the CR1 and dont want to have to come back to the UK for it!! I booked my flight for the USA for the 11th Dec but i guess that can be changed if need be! Has anyone else had this problem or in the same boat??

From case complete @NVC to interview in London is normaly 2 months..................I doubt you will beable to change your K3 interview to a CR1 interview...................I think the best option is either cancel the K3 interview & wait for your CR1 interview to be scheduled, keep emailing them & fingers crossed, you could end up lucky & if they have input your CR1 case into the computer you MIGHT if your lucky get the switch..........Good Luck :thumbs:

I have been going through the forms I-130 and G-325a that we have been told to fill out. We looked at the G 235a form and its asking for hubbies assets.

Will having only $10,000 in savings now affect the application? Will they deny it on that?

We are getting a joint sponsor (Hubbies mate and wife who earn combined $40,000 USD per year), but we don't file the joint sponsor form till later on right?

Also its asking hubbies yearly income. Does that mean his income now, or his US income (none as he's worked here for 5yrs)

If you are only just filing the I-130 & G-325a out then you have lots of time before you file a affidavit of support, I-864 which i think is probably the form you are refering to??..........................when my husband filled out this form, he didnt put any assets all he chose to put on the form was his annual earnings, & backed that up with tax returns, he didnt put the house or anything else on there!!

IR-1 / CR-1 Spouse Visa Process & Proceduresproof of being single?

Hello! I'm traveling to Tanzania in January to be with my fiance for a few months. We've been trying to figure out where it would be best to get married / what type of visa would be best for us. In the case that we decide to file for a IR-1/CR-1, we'd have to get married in Tanzania. How do I obtain proof that I am single and legally able to get married?

Also, was the IR-1/CR-1 process hellishly long for those who have gone through it? It's tempting because it's so much cheaper than the K-1 process, but I don't really want to be away from my fiance any longer than I have to.

The CR1 process is a long process but worth it!!, and also its not really any cheaper than the K1 process, all the same fee's have to be payed for both!!....just at different times, with the CR1 you will pay the fee's at NVC that you would pay anyway for AOS with a K1!!

as proving your single, well all i can say is you cant unless you have divorce papers??.....other than that its all based on "your word"!!

I agree with fwaguy that it is typically done by the county and not the city. You should contact the county the marriage took place in for the answer. This really doesn't seem like a big deal, hope you get it sorted out.

City Hall is the place where you would of got your marriage license from, did you>??..............did you get your license & then after your wedding did you get your marriage certificate??

I also got married in the US........we went to Detroit city hall to get the license, after the wedding we went back to city hall with the signed license & they converted it into a marriage certificate!!........BUT not all states are the same here its all on the same paper license & certificate.....other states may issue seperate bits of paper :unsure:
