I am legally married and have a marriage license. Was just wondering if the culture or way things are done in my religion will count or be questioned, in addition to my other concerns.

I'm adjusting from a tourist visa not a fiance' visa; we got married 3 months after I started my visit here; this was my third visit to the US to see him. I have never been married before, and I got married in the US.

Hey all,

I'm currently undergoing the AOS process, my husband and I are both Muslims, he is a Muslim USC which reverted just about a year ago; in my religion we can't marry a man outside of our religion..anyway, we're doing fine and have no problems as he didn't really follow any religion before he met me. There was nothing in the forms asking about faith or religion, will this be something that will come up during the interview and if it does, will it be a problem that he reverted?

Oh and one more question, we have a different way of marriage in our religion which needs to be conducted down the road after we're done with the process; what matters to USCIS is getting married and registered in the U.S, correct?

Hello,

I am reading about the i-864 form and have a few questions but first a brief about my situation: I'm here on a tourist visa and was visiting my boyfriend, he proposed, we got married last month. We've filled all the required papers for the I-130, I-485, etc. He is a USC. We've been together for a little over a year but last year 2010 he didn't have a job so didn't file for taxes. Before then, he was married to someone else.

1) Does he fill out 2010 even though there was no income at all?
2) He has a daughter, from what I've read, she needs to be included as a dependent, correct? (she is 18)
3) I still have my job in Jordan as I did not resign when I came to visit (I was intending on returning), but I have an arrangement to work with them online as a part timer now; can I include that income even though it's not subject to taxes?
4) In the instructions for the i-864, it doesn't say that we need to include proof of employment or proof of income, but do we? Both of us?
5) On a separate note, for the I-130, in the instructions it doesn't mention that we have to include a cover letter but I think I read somewhere else that we need to?

I would appreciate your help; we're almost done with the package, this is all that's left.

My I 130 just got approved. Thanks to Allah and wanted to thanks all my fellow VJers who have been so much help to me. I check VJ everyday and have learned so much from this website. I wanted to put one thing out there that I expedited my application like 2 weeks back based on humanitarian basis. My husband is in Karachi, Pakistan and recently there has been alot of target killings there. First I didn't even know that this situation qualifies for expedite and I got to know about it through VJ so I requested expedite and it got approved and two weeks later I got the approval. I just wanted to share this with everyone here. If my post can help anyone I would be more than happy. :)

My husband used his IRS tax transcripts for the previous 3 years and we also submitted a letter from his employer with his yearly salary.
We did not need any pay stubs at all. You may not even need an employer's letter either but we included it just in case.

We received an RFE requesting the employment letter with hourly wage, position, dates of employment, possible promotion, etc and we sent in the payment stubs too. Send them in.

It has to be one of them. The case should show up online if it exists.

If you are consequently receiving mails, I bet you don't need to leave a note for the mailman. But on the safe zone, putting name on the mail box is the easiest and simplest way to avoid returning mails to the sender. The US government is very strict in delivering mails in terms of cards or the like.


We constantly received mail, that's not the issue. The issue is that the cards are crucial and have to do with identity which is why I was instructed to let the mailman know so it's not returned.

I would suggest you put your name and your husband's name in your mail box which is visible to the mail man. Some mail man won't put the mail in your mail box especially when they are unsure even if your address is correct. It happened to my SS card. They returned the mail when in fact we provided the correct address due to the fact that the mail man isn't sure if it's the right mail box. We knew it when we went to the closest SS Office in our place. They advised to put our names on the mail box. I guess you would do the same.


When I applied for my SSN, I was told to tell the mailman that I'm going to be receiving it in the mail or to call the post office and let them know. This avoids having it sent back; this was for my SSN, I don't know if it applies to your green card but it might be the same thing. In my case, I left a note for the mailman in the mailbox telling him I will be receiving it and for him to leave it in our mailbox, and I got it.

I guess I don't understand why it was suspended and they didn't simply request more info, I mean she wrote on her application that it was suspected that it was for the sole purpose of immigration. I'm really surprised this happened if she sent in evidence already.

I've never heard of a suspension of a case, it's either approved or denied..suspension suggests that you can't even appeal, is that the case or can you appeal?

Isn't there a way you can file a complaint against this person? Request that someone else interview you? I don't know how these things work but it seems very unfair and I don't see a reason why she would deny you. I believe she was having a bad day; I don't think it's a good idea to give up, even if he is move to where you're at for a while, get married and try again for the CR-1.

I agree with that, you should remain calm, confident, don't look away or seem nervous. The questions they ask are to prove your relationship is for real, so it should be a breeze. I'm sure you can appeal or reapply; I'm sure it's difficult, all of us here have gone through some kind of separation from our loved one, good luck to you.

Oh dear, could it possibly have been an immigration officer having a bad day?? You must have submitted proof that you two are in a relationship because it's required to be sent in with the application. I am here on my tourist visa and it was my 3rd visit here before my boyfriend proposed. We sent in all the required paperwork and things seem to be running smoothly up till now. It seemed you answered the questions but what did you take with you exactly?

I don't know if you are Muslim, but for us, you CANNOT have a religious marriage (Katb al-Kitab) if you are applying for a K1 visa. It was the FIRST question my fiance was asked at his interview. I would assume it is the same for a religious ceremony in any other religion as well.


Yes that is true. In my case I got married here in the US and will do the religious wedding later on. He is saying that they she wants a ceremony just to satisfy family but not legally (with signing documents). I believe he means just symbolically like a going away party.

Is it possible to get 'married' (just perform the marriage ceremony & have the reception) abroad, and not have any documentation signed abroad or anywhere, then enter the U.S. on the k1 visa and get married legally in the U.S. w/in the 90 day period?  Is there any risk to doing this?

 

I think you answered your own question, keep it simple. It's a marriage ceremony. Papers aren't going to mean much whether you signed them or not. In a lot of cultures, the marriage isn't official until you have this marriage ceremony. What are you going to do if this question is asked at the interview? Say you had a marriage ceremony but didn't sign anything? Lying isn't even an option. USCIS deal with all kinds of cultures and they aren't clueless. You asked if it's possible, everyone has answered there's a risk. Believe them.

translated with the certification statement that the translator attests that the translation is correct. I forgot what this is called. if you get it notarized then an apostle certificate as well.


I didn't send in a certification from the translator. Both of my copies were issued by the Civil Status Passport Department - Ministry of Interior in Jordan (which is the government entity that issues birth certificates for Jordanians). It has the header and stamp on both.They give us the Arabic and if we ask for the English they have them done. I just sent them in as a response to an RFE and attached a letter explaining, will they reject it?

What do you guys think?

I am so sick and tired of people friends, certain family members, even strangers talking about the high divorce rate among Nigerians who come to America whether male or female. I hear it from everyone its really starting to annoy me and I felt like using this outlet to let out my steam. Like I tell them if you both know you love each other and trust each other then what’s the problem. I agree it will not be easy when they get here, we all know that. There is the culture shock and everything else that comes with entering a new environment. But is it impossible? NO!! Can it work? Of Course!!
This stereotype that all Nigerians just come to America for papers is annoying. Ok ALOT of them do, but then again some don’t. That’s why you take time and get to know the person you are dealing with. I have known my fiancé since 2005; we met at my cousin’s traditional wedding. I used to go home to see him, visit with his family, and know him from inside and out and once I felt this way it was then that I decided to file for him to come here. How do you guys handle this when people tell you "Oh he or she will change when they get to the states?" OR “The marriage will not work out?” Or “No matter what you know about him, he will leave you once he gets his green card”. I know that everything at the end of the day is in Gods hands, but I wanted to see what other people thought.


Unfortunately, some people follow the herd. I know it's annoying, but as long as you're sure of what you're doing (and you seem like you are), I say ignore them, generalizing is retarded.

Where does it say that they have to be originals? For our AOS we sent copies of everything and printed my husband's pay stubs online and it was fine. Have your husband get an employment letter from his employer too stating his hourly wage, dates of employment, how many hours a week he works and his position.

I'm sorry she's being difficult..on a positive, I do really think that your paystubs are enough, after all they are issued by the company, my husband never submitted an employment letter to prove that he can support me. He just submitted his paystubs and his tax information and we were good to go. Worst case they'll send an RFE asking for one but I don't think that'll happen. What state are you in?

For me, my paystubs were enough..I don't see why she would deny you this request..it's really odd but maybe we can find a way around it..have you tried going to your HR dept instead of your boss?

I thought it was strange too that they would ask why I didn't change my name but to be honest it seemed that it was just the IO's curiosity. So this is what i have so far for evidence:

 

1. 6 Affidavits of Support

2. Apartment Lease in both our names

3. Bills with proof of same address (TV, Electricity, Internet, Verizon family plan, DeadRiver). All these have the same address but are in one of our names (i'm assuming that's okay).

4. B-day, Anniversary cards, Invitations addressed to both of us. 

5. Insurance card and copy of life insurance with each other as beneficiaries

6. Joint Bank Account with sample statements from checkings and savings in addition to letter from the bank stating when we opened the account together

7. We're currently looking for a house to purchase so I'm including our Mortgage papers with my as a co-buyer, and our pre-approval from the financing company. Also forms signed by both of us for our Realtor. 

8. Papers proving that my husband had a vasectomy reversal so we can start a family (receipts, papers from the hospital)

9. Around 60 pictures of us, family, friends, etc.

10. Our Renter's insurance policy in both our names.

11. Our joint tax returns for the past 2 years

12. Car registrations for 3 cars, one we sold and two we have now. Also we are financing the 2 cars we have now and i'm the co-buyer on both.

13. A promissory note addressed to both of us from an acquaintance promising to pay us back an amount of money we lent her.
