K-1 Fiance(e) Visa Process & ProceduresCase status.
QUOTE (Erroneous @ Apr 22 2009, 01:26 AM) <{POST_SNAPBACK}>
A question about case status updates online. I received my NOA1. In the letter it gives instructions on where to go to check the status of my case. But when I go to the USCIS website it says my case can not be found. And it has been a couple of weeks already. I called their customer help phone number and the rep said it may never show up online. Is this something that i should dig deeper in to or let it be and remain blind until they send me a notice by mail? I would hate to upset some people by calling about this. Maybe it will show up down the road.. *shrug*

The receipt number begins with a WAC and is processing through the California processing center.

Any advice is appreciated. Thank you.

ALOT of people are having problems accessing their case status, it seems helpless and not worth your time to keep checking. It may show up along the road, but then again, just like the rep said and many of us are/have experienced it may not... i would say if you dont get another NOA or the paperwork that you are supposed to get within the specified time aloited like the usual 90 days, i would call in and check with the rep on the status of your case.

K-1 Fiance(e) Visa Process & ProceduresThis waiting time is killing me ! ! !
Try to keep yourself as busy as possible. I know it was really hard for me too. My husband and i are in the AOS stage of the k-1, and i know our situations are little bit different, my husband is from mexico and your fiance from china, and your waiting for this years NOA2s, but if you stay as busy as possible, and talk to her as much as possible, try SKYPE, you can talk to her face to face, and its FREE!!!!!!!! As for practicing your chinese, yah i can imagine that that would make you miss her more, after all she is the one would want to be practicing with, and everything. But if chinese is really something that you want/need to learn, then i dont see you being able to cut it out. I would recommend you skyping with her, and practice with her and talk to her, while you see her. I think it will really help. I filed my I-129F last year end of march, and my husband and i got approved August 11th, so 5 months, and then we got our fiance packet, and filled out the stuff and we were ready for his interview in december, and he was home for our first christmas together. I wish you luck, stay strong, i know its hard, and look into SKYPE.

K-1 Fiance(e) Visa Process & ProceduresNeed Birth Certifiacte Back
QUOTE (LuvMyPortuGAL @ Nov 23 2009, 11:57 AM) <{POST_SNAPBACK}>
Hi,

My fiance will be coming to the US on Friday. We are starting to make arrangements to be civilly married to start AOS process as soon as possible (which takes forever I understand) and AP process (which better not take long!) ASAP! It is crucial that we get AP as soon as possible and cannot afford any delays.

Working papers is obviously very important as well.

Anyway, I called local offices and they say they will need among other things the original birth certificate and certified translation. However, they were forfeited at the consulate interview. Is the *original* birth certificate and translation in the sealed envelope and will we be receiving both of them back at the POE? It is highly important that we have it.

Any comments on AP approval (and speed there of) would be helpful.

Thanks.

If you gave it to the person at the interview, it will be in the sealed secret envelope you couldnt open, but i know that everyone on visajourney warns to NOT give originals, TAKE THEM, but DO NOT GIVE THEM, take copies, if they want to see the original, let them see them, but if they insist on taking the original convince them with a copy, b/c the original you will need that even after AOS process. It says specifically on USCIS paperwork to NOT GIVE ORIGINALS. BUt if you gave it them in portugal, then they will still be in the envelope, but when the AOS paperwork asks for copies of the original birth certificate, if you dont have any on hand, you might just have to put 'refer to original already sent in the yellow manilla envelope' or something of the alike. The AP is different for everybody, but i am sure that you are already aware that AP, EAD and the greencard, can all be done together, if you do it together, and not seperately, it is cheaper and typically faster. My husband got his AP first then his EAD, and we jst got card production ordered for his greencard on Nov. 18th, our case also took really long, we submitted in march, and we are just now receiving his GC sometime in december. that i 9 mnths. It usually doesnt take that long, people that filed in march with us got apprved for greencard in june, july, so it is different for everybody. Hope this helps.

K-1 Fiance(e) Visa Process & ProceduresAffidavit of Support obligations

So i need a joint sponsor with my fiance because I don't make quite enough money to support 3 people under my income. Anyway, my parents don't want to sign the affidavit if they would be responsible for medical bills for him in the case of an accident or the like. Does anyone know about that? Would they be responsible for that because they could be thousands of dollars... help! I really hope the answer is no because otherwise he really wouldn't be able to come. that would just be tragic...

You dont have to have your parents sign the affidavit of support, your grandparents, or best friend, anybody who knows and supports you and your situation with your SO could do it. Also, if your husband is in landscaping or another dangerous job, you can go to a place like med center 100, or another place that gives good medical care without insurance for lower prices. i do not know where you live, so the discounted places may vary in your state. Also, if your husband is involved in an accident, through his job, his job should pay for it, that is why the have insurance for their employees, if they do not have insurance there for their employees, then you might want to reconsider him working there. if he cannot go under your health insurance, for whatever reason, he could work at a restaurant or something like that, they do offer benefits that he can get to cover himself until you and he are stable enuf to go under the same health insurance. As far as other 'accidents' there shouldnt really be any, except for freak accidents, and i would imagine that him being your SO, that your parents should be willing to help him because you care so much about him. The affidavit of support is more for welfare and that kinda stuff, so that the government and taxes do not go to a foreign born national, that is what the affidavit of support is for, to take care of the foreign born national so that they do not become a public charge. Hope this helps.

K-1 Fiance(e) Visa Process & Proceduresfiance shipping docs from Colombia (?)
ummmm i am not sure about colombia, but i just sent a package to my mother in law in mexico today, just put her name, her address, and state, which is state of mexico, i have never had problems with the stuff getting there, in fact, mailing it ( i mailed 3 pages of pictures) cost me 2.22, it will probably be a little more expensive since it is going a bit further than mexico, but not by much, you can't get a verification of it arriving, but you can get it 'certified' i think thats what its called, and you can go online and check when it arrives, or where it is, as for putting your telephone number and such on there,..... i dont know why she would do that/need to, but maybe its a colonbian thing?

I am hoping someone can help me with some pretty important questions. My fiance visa was approved. Due to the fact that my fiance is Mexican, i am dealing with the ciudad juarez consulate. When i called to get some more information as to why i never got a packed of information, and that only my fiance did, i was told that i did not need a packet of information and that only my fiance would be filling out the papers that he got in his packet which consist of the CDJ-401 Intend to marry affidavit, and also the DS-156. The guy also told me he had to get a police report and a medical examination, which i already knew. However, the guy at the ciudad juarez consulate told me that only my fiance would be having an interview and i wouldn't, he also told me that i WOULD NOT need to do the I-134 affidavit, and that i would just need to submit proof that i can support my fiance. But i thought that that was what the I-134 was for? The I-134 is an organized form, and because i am going to have co-sponsors for my fiance, i was looking forward to using that form, whereas, the ciudad juarez consulate completely confused me. If someone could help me understand what is going on that would be great.
P>S Preferably someone that has done the fiance visa through the ciudad juarez consulate would be awesome.

2nd problem,
Just looking ahead and wondering, after my fiance and i get married within the 90 days that he receives and arrives in the united states, we have to apply for the I-485, however when we apply for that, does that mean that he can continue to stay here even after his fiance visa timeline expires? (I am talking about after we are already married, and file for the I-485, does that mean that he can stay here without problems?)

Hopefully someone can relate and help me sad.gif

Ok- I will do my best to help you, but someone else more experienced can feel free to jump in and help! My fiance will be going to his interview hopefully next month, so we are at the same stage as you.

The I-134 is not REQUIRED at Ciudad Juarez, but most people use it because it's a good way to organize all the information and show your financial situation. I will be using it, and also having my co-sponsor fill one out. You, the American, are not allowed into the interview with your fiance (as far as I know). So, yes- just your Mexican fiance will be having an interview. He will need more than just the DS-156 and CDJ-401 forms. He must also fill out DS-156K and DS-157 which can be found on the Ciudad Juarez embassy website.

And yes- after you and your fiance get married in the United States, he may wait here while they process his application for permanent residence. He doesn't have to go back to Mexico while he goes through the process.

Check out the "Juarez Consulate" thread- it's a lot of pages, but read through some of it. I think it will make you feel more prepared and help answers some of your questions!

Good luck!

Caity

Thanks so much for responding, you deffinately cleared up some major speed bumps, but i did go to the ciudad juarez site, and under fiance visas, i clicked on the fiance packet, which "says" that that is everything that the fiance is going to need, fill out, understand, bring with him or w/e everything that he needs to do is supposedly described in that packet. And i looked on the juarez site under fiance visas for the other paper work that you said i was going to have to fill out. If you could let me know if i should get my eyes checked, or if they are in a different place that would be great. good.gif

US Embassy and Consulate Discussionhad K1 Interview , asked for more Docs; do I need to make another appt
Marlene, you do not have to set up an appt. with ciudad juarez. That is what the open appt. letter is for that they send you in your approval packet. Im not sure about where you are in your K-1 adventure, but if you have any questions, let me know. My husband was down in Juarez in december doing a k-1. We have since gotten married and i will be mailing his AOS papers next week.

US Embassy and Consulate DiscussionTemplate for Employer Letter
What do you mean template? like how it was set up? Both my husband and i had our employers type 1 up on the company stationary, and it included things like how much i make, how long i have been working there, if the job is considered temporary or perminent, and what makes me qualify for the job and not somebody else, like experience, and so on, for my husband, (the intending immigrant, b/c he has been in the U.S b4 and has jobs here, ) we got a letter from both of his employers on company stationary, saying that a position in so and so company is waiting for him doing so and so job, why he qualifies above others, and how much he is being/going to be paid, and if the job is temporary or perminent, pretty much the same thing as mine, just that the job is waiting him and ready for him to start as soon as he enters the U.S. Hope this helps.

its just juarez, my husband had his k-1 appt there in december, just fill out his/her name like it says, or example John Jacob Taylor Myers, John is the first name, Jacob the middle, (or most mexicans dont have middle, i know my husband doesnt, so just leave that blank) and then Taylor Myers, in the last name spot. Let me know if you have any more questions about juarez specifically b/c last year we were where you are right now.

im not sure if i had answered ur question, when i went back and read it i was unsure if you were asking if you should include the mother/fathers name. Follow the directions above, but only use the names that your husband/wife takes. If they sign their stuff with all of their names, and it has all of their names on the passport and other important info, use all the names, doesnt matter if its 9 names long, thats what a supplement is for. good luck!

US Embassy and Consulate Discussionform i134 questions
Im not 100% sure but i think that ur fiance has to submit an I-134 even if he doesnt make enough. He is the MAIN sponsor, and of course you can have 2 co sponsors. For the poverty line, for example, your fiance's boss would have to make 125% above the poverty line (with you included) so if the boss is married, that would include himself, his wife, and you, so that is 3 people totol, look and see if he makes 125% above teh poverty requirments for 3 people.

I know i didnt make enough in order to sponsor my husband alone, but i still had to send in an I-134 and i included copies of car titles as assets and past tax info to help, both my step father and my mother sponsored my husband also and included letters from employers just like i did, and i also included letters from my husband's employers here stating that he had a job awaiting his arrival in the U.S.

The boss might have som1 above him, if he does, he should get a letter from them, if not, he should probably submit proof that he has his own business like his permit or w/e, im not sure what is required, you might want to look at the instructions of the I-134, b/c i have heard of people being their own bosses and submitting that kind of stuff.

Relationship to sponsor, fiance's boss/best friend or something like that, not a big deal i dont think.

5)ds-157
6)cdj-402
7)passport photos
8)proof of relation

Not all of the 'required' papers were asked of myhusband, but from what he told me, they were asking different papers from different people, even if they were all there with the same fiance visa intention, ( i guess to try to catch somebody that didnt have all the correct paperwork, but we did)

You can find the list of paperwork that you need at this site, under visas Juarez consulate website

Good luck, and let me know if you need anymore help. My husband was there in december, so i know how it feels. blink.gif

US Embassy and Consulate Discussioncan anyone sponsor your fiance?
I think your mom may be able to sponsor just 2 kids, if she can afford to. But as far as your sons friends sponsoring him, i dont think that that is feasible. The whole point in sponsoring is being able to support them in the form of money, home, food, all that. Living in a different state might make that a little bit more complicated, but thats just how i see it.

I should really take a deep breath because this cannot be good for me ohmy.gif

I sent everything that alfredo would possibly need. taxes for the last 2 years, (since that is all i had filed b/c of my age), and copies of that years w2s, i got a letter from the bank to show assets, and i sent copies of my 3 titles to my vehicles as assets. i also sent a letter showing that alfredo had a job waiting here, and proof of his tax info (from his h2b visas that he had in the past), i pretty much used the exact same stuff for the paperwork i did for AOS, just fill out a different form.

I'm planning on going there the second week of June (finally!!!) and I could use some help, before I go crazy due to stress girlwerewolf2xn.gif

From the posts i have read and from my husbands experience in december, they ASK you if you want the vaccines, but you DONT!!! 1, for k-1 visas, they are not needed, 2, all the vaccines that are required in teh U.S you can have done in the centro de salud in mexico for free. and just bring your vaccine records to the U.S and have them transcribed by the civil surgion. It is alot cheaper all around, and alot more convenient.

Thanks for the advice GueraKristina. I'll take that on count.
It is just that I kind of freaked out with this influenza thing, imagining that because of that they could probably tell us to get those vaccines. blush.gif

No problem. alot of people dont take advantage of the fact that you can get the shots done in mexico for FREE and then just have them transcribed here, i know we did and we probably saved atleast 300 dollars.

You should take all the proof of relationship that you can. Some people can get though the interview without having their evidence looked at, like limejello, they just wanted to see her baby's birth certificate and that was it, but with my husbands interview in december, they looked through every picture, quized him on who was who, and their names, and their relationship to us. Anything with BOTH names on it will help, bank accounts, car titles, anything. They say that you dont have to take the 129F paperwork because if you have an interview, theyalready have that paperwork, but alot of people like to take it just incase. We didnt, and we were fine, they didnt ask or it, or anything, we did take the 797 approval notice of our fiance petition though, just a proof that we were approved, we also took the letter we got that said that the paperwork was going to be sent t juarez but none of that was asked for. GOod luck, and hope this helps.

Hello Everyone,
I've been incomunicado for a while as we adjust to our new life together here in the U.S. We are getting married on July 3rd, which will be just short of 90 days after her entry. When do we start the AOS process and what are the first steps? Any help would be greatly appreciated. Are there any other threads out there that I should be looking at for more information?

Thank You!!

Even though you arnt going to be getting married for awhile, you can start your paperwork right away. I-485, I-131, I-765 are probably what you are going to want, and most of what they require as far as paperwork and proof is stuff that either you used for the fiance visa interview as proof, or you got the info when you crossed the boarder like I-94 and copies of your fiance's passport info page and her k-1 visa and that kind of stuff. You are 'technically' supposed to have your AOS paperwork submitted BEFORE the 90's run out, so you might want to try to do that. I have never heard of people getting penalyzed for not doing it, but it is 'frowned' upon, an may cause complications apparently. Good luck.

Well I hope your right epifreak and this whole issue with the swine flu clears up soon because I wouldn't want to make arrangements for nothing. My question is for people who have already gotten their visa. From what I read which has been really helpful is. Is it safe to say that you will have to wait one day after the interview to obtain the visa unless your lucky and get it that same day? Also, if the interview is on a Friday is it very likely you will have to wait until Monday?

i agree with buggylifer, make plans to stay the second day. My husband was in the consulate for a full 12 HOURS!!!!! but he did end up leaving with the visa, some people get a slip though, and are told to come back the next day for their approved visa, so it really depends on how crowded it is, and if you get a slip or not. I would say go prepared for the extra day in juarez. With the 'rumored' cases in juaerz too, i dnt know, i would consider wearing 1 of those stupid looking masks, caughing, sneezing, stay away from people who are doing that, and wash your hands, better yet, carry sanitizer, and use it frequently. do not touch your face, or that of your SO without washing it well.

Hello, I still am kinda new to the Visa Jorney website. I have found this to be very helpful, My fiances case was fowarded to the Consolate in Ciudad juarez on april 7th, It was delyaed at the NVC for 49 days for additional Processing!! GRR!! Am i suppose to call Juarez now or when? are they going to send a letter or a package or soemthing? I am not too sure. THanks!

NVC will send you a letter saying that an approved fiance visa on you your behalf is being sent to ciudad juarez to be further processed or something like that. That is when you know that it eventually will be there (and wait a bit before you call so you give it time to get there). They will send you guys a fiance packet, which has the directins of what to do next and what papers you will need for the ciudad juarez interview. DO NOT RELY JUST ON THE PAPERWORK THEY SEND YOU FOR COMPLETE INSTRUCTIONS!!!!!!!!!!!!!!!!!!!!!!!!!!! Alot of the info is missing, so look at the guides or double check with somebody on visajourney before you go to make sure you have everything that you need.

Thank you, I will try to hang in there, but as Tom Petty once sang....The waiting is the hardest part! I think it was Tom Petty anyway.

Lets just all hope that it doesnt take u guys as long as it took alfredo. i am sure you would go crazy, like i did.

Question for you all.... The Consulate received my packet from the NVC on the 26th of March. I called today to see if Packet 3 had been sent out and they said it will be 90 days before this is sent. Does this seem to be correct?? I would like to hear how long others have taken. Seems to me most people are 30 days or so. Thanks!!!

I think everything with immigration is 'supposed' to be around 90 days. They say that to cover their butts just incase it takes awhile and so abunch of people dont bombard them with calls questioning about their paper. I got my fiance visa approval letter August 11th, saying they were transferring it to juarez and that i would get the fiance visa packet soon. I think i got it about a month or so later. If it takes LONGER than 90, i would call. They will probably give you the same ####### that USCIS gives you, 'well did you wait the 90 days??" "No." ..."Well please call back when you have."....something along those lines.

We are in Juarez now. Medical tomorrow and interview on Friday. We are hoping to go back on Saturday, but not sure if we'll be that lucky. I'll be sure to post our experience when we get through this process.

Good luck!!! And be safe. I am curious to hear how many people will be in the consulate for you guys, cause i know when alfredo went for his interview, it took him 12 HOURS to get out, with his k-1 visa in hand of course. I was panicking thinking something had happened because i wasnt returning text messages, nothing, i was soooo nervous. He said that there were sooo many people there when he was there, alot of them k-1 visas. Just be safe, and let us know if you have any questions.

Sorry it's taken me so long to post. Davys' visa was approved at the Juarez consulate yesterday. He was there for about 7 hours. I've listed the questions they asked him below:

His name and when he was born?
Where did we meet?
Why does he want to marry me?
Do I have any kids and if so how old?
If he had met my family?
If I had met his family?
Where we would be living?
What he would be doing when he was in the US?
When we planned to get married?

He said that overall the interview part only took about 15 minutes, the rest of the time was just waiting. The CO also kept referring to me as his wife but he corrected her and she then said future wife. He said that the CO was very nice to him, joking around and laughing.

At this point, we are just waiting on the mess that is DHL. The phone number states that the visa isn't ready yet but the internet shows that it is, but it won't tell you what location to pick it up at. So we're trying one and then the other.

Also, when your fiances go to the consulate, be very careful about the people standing outside, numerous people approached Davys about things he was "missing" in his packet or how many copies he needed of what and that his pictures wouldn't work. They are just wanting your money, so ignore them. Also, DHL closes at 6PM, not 7PM like the taxi drivers tell you.

Hope that helps with any of your questions. Today we're leaving Juarez and crossing into El Paso, and then home to Denver.

Good Luck to all of you!!

Congrats Jen!! I am so happy for you!! You CANNOT imagine how great it will feel when you finally have Davys home with you. Aldo came home with me on Monday night from Cancun and I keep pinching myself because it doesn't seem real that he is FINALLY here! All the trouble and waiting is SO worth it!!! I wish you both the very best of luck! biggrin.gif

Congrats to everyone and best wishes to those still waiting or in the middle of the process.

Alfredo had problems with the chicanos when he crossed the boarder, so if you plan on doing that, be prepared. Sorry you had a crappy experience, hope all goes well for you though. Alfredo's interviewer actually looked through every1 of our photos and questioned him about every1 that was in them. (before we went to the interview, every1 kept saying that their proof of reltationship was never even asked for), but thank god we took lots, b/c the guy looked through it all.

Documents do not have to be translated as long as they are in english or spanish. Take the oringinals, but take COPIES, they might want to see the originals, but if they want to keep something, insist they keep a copy if it is something important.
