Middle East and North AfricaIs this discrimination?
QUOTE (ahmkri @ Mar 12 2009, 03:19 PM) <{POST_SNAPBACK}>
My husband has been working as an assistant mgr. at a restaurant. He has a business degree from egypt. He is the assistant manager and the manager is a catholic mexican who is manager bc of his 4 yrs of experience, no education. My family has a get together on the saturday april 11 for easter with the young cousins where they hunt eggs. I am christian my husband is not sure of his religion although he has a muslim sounding name. So i asked my husband to take the april 11 off for the easter with family. He just called me on the phone and said his manager said that HE needs the 2 weekend sat/sunday off because he is christian. Is this right? My husband asked more than a month in advance and hasnt taken a sick day yet. He also closes 6 days a week so THIS manager can see his family at night. There are ppl above this manager and I need to know what other ppl think ?

Maybe the manager didnt mean it to sound like that. Im not trying to make excuses for him, just trying to give him the benefit of the doubt b/c my husband is mexican, and sometimes he tries to say things how he would in spanish but in english but he doesnt understand that it can come off rude. Maybe the manager is chicano (mexican blood, but U.S born), and maybe he wanted it to come off like that. However, i do think that the manager is probably using his position and power to boss other people including ur hubby around. That is just my impression from the little bit you told me though.

Middle East and North AfricaSugaring?
Funny u mention that. I just heard on the radio that New Jersey is banning bakini waxes b/c alot of women are getting infections b/c of 'double dipping' the sticks. EWWW!!!! (bakini wax in new jersey is already illegal, but they are seeking to actually enforce it now, it actually made the front page headline) Ive never gotten anything like that done professionally, ive waxed myself, and i think its fine, but if you do do it, just be aware that the person is wearing gloves and if you see them double dipping, ...ehmm... run away.

Middle East and North AfricaAnyone have this problem when booking a flight?
With my husband, he has 2 last names and no middle, the same thing was said, that the names on the boarding pass had to match the pass port, well when i tried to put it in, same thing happened, it didn all fit, so i ended up taking out all the spaces so instead of John Jacob Smith, he was johnjacobsmith, i told him that if he had problems, say that they wasnt enough space for the spaces between the names, maybe if do your best with the names, and have him bring his ID along with his passport, (more proof that he is who he says he is, it will probably be alot better. i doubt u will have problems. I am sure there are people with the same situaction from different countries and cultures, what are they going to do? tell them they cant board because THEIR program wont let you enter YOUR information CORRECTLY? doubtful. very doubtful. good luck!!!!!!!!

IR-1 / CR-1 Spouse Visa Process & ProceduresI- 864 Affidavit of Support
Does anybody know if the I-864, affidavit of support, I-485, Application to Register Permanent Residence or Adjust status, I-131 Advanced Parole Travel Permission, and the I-765 application for employment authorization has to be notarized ????? (for the AOS of course)

IR-1 / CR-1 Spouse Visa Process & ProceduresEmployment Certificate of Petitioner at Interview
Alot of people are worried about putting too much, buts its not a bad thing if you do. As long as you include all the things you need, you should be fine. You can deff. include stuff that you may think will be helpful. If they dont want it, they wont use it, but they just might take a glance at it. I included everything i owned, copies of titles to cars, trucks, suvs, my w2s, my federal income tax forms, my husband's tax information, his letters from employers saing that they have jobs waiting for him, saying how much they are going to pay him, anyhing extra cant hurt.

IR-1 / CR-1 Spouse Visa Process & ProceduresApplicants with lawyer
My husband and i didnt use a lawyer, and i am so sorry that you are having so much trouble. I think people should do away with using lawyers unless they have very complicated cases, the paperwork really isnt that hard, and with the help of forums, you can definately do it the same way if not better yourself. As for having NVC send you copies, im not sure, but i doubt it. Its your responsiblity to get the originals, or have a responcible lawyer who will get them to you or take care of them, that is what you are paying him for. No offense, just trying to be realistic, NVC has a lot of cases to process, so it probably isnt particularly worried about sending copies to 1 person because their lawyer isnt doing a good job. Sorry i couldnt be of more help. I would say ditch the lawyer if you can. or maybe sign up for email notifications. Thats what my husband and i did, and we didnt have any problems with that, unless your lawyer already took that option too.

IR-1 / CR-1 Spouse Visa Process & ProceduresAffidavit of support question I-864
If that is the case, and you have enough tax information for the past three yrs, not including this years taxes, i would say send them. I know because of my age, i only have 2 yrs worth of tax information. You might want to have 2008 taxes present at any interviews or meetings you have regarding your visa just incase they want to see it. I know that based stricly on my income alone, i didnt make enought to support my husband, but the immigration officers in mexico looked at my assets and stuff and said it was fine. they didnt even want to see my sponser information. obviously i am sending my sponser information this time because this is AOS and about a greencard and it maybe be a little bit more tricky, but as long as you can show something for the taxes you should be fine. if they ask you why you didnt include the taxes for this year yet, say you hadnt had them done yet. You do have until april. innocent.gif

IR-1 / CR-1 Spouse Visa Process & ProceduresCo Sponsor for I-864
my parents both co sponsered my husband and they used the I-864, it has a box to check if you re the co sponser on the form and just fill it out accordingly. The co sponser has to count every1 that they support. So to answer your question, yes, the co sponser has to support 125% above poverty line for himself, his wife and the immigrant, fyi, assets help if you iclude them, copies of car titles and maybe life insurance, mortgages showing how much you paid on the house .... also showing that you own the house,,, it all helps

I know that with my husband, and the paperwork for the I-864, im pretty sure as the sponser, it is required that you send in some kind of paperwork showing that you have something. even if you just have assets. even tho i dont make enough money, i sent in my tax info for the last 2 years, (bc thats all the taxes i have filed b/c of my age) and proof of all my assets. both my parents sponsered my husband as well and sent in alot of their informaion. As the petitioner of the immigrant, you have to show something. Ive read it in the paperwork, so you might want toread through it. any1 feel free to correct me if im wrong, or post the information if they can find it.

my husband was here for 3 years on an h2b works visa, so he has a social and everything, we still filled out the appropriate affidavit o support and i had a sponsor, is that ok? I know it did when i showed his tax information and stuff showing that he can support himself and that he works hard.

IR-1 / CR-1 Spouse Visa Process & ProceduresI-864--Using Assets Instead of Income
QUOTE (bluesgorilla @ Apr 16 2009, 01:02 PM) <{POST_SNAPBACK}>
I'm preparing to file my I-864. I'm currently unemployed while I attend school so will use all assets with zero income on the I-864. I have a question about which assets are acceptable. The form says that assets must be convertible to cash without "undue harm" to the sponsor or family members.

I have an IRA and other retirement accounts that are roughly 15 times the asset requirements for my family size. However, since there are penalties associated with converting these accounts to cash, I'm not sure if I can use them on the I-864.

Does anyone have any personal experience with using their retirement accounts to satisfy the asset requirements of the I-864?

I would record the IRA after the taxes and appropriate charges are taken if you have to use it, like karin and otto said, but i would also get a co-sponsor. just in case.

IR-1 / CR-1 Spouse Visa Process & ProceduresRFE after case completed
QUOTE (calleigh @ Nov 23 2009, 11:30 AM) <{POST_SNAPBACK}>
Our case was completed on Nov 20th. I called NCV today to check for possible interview schedule, but to my surprise ( and dismay), the OP told me that I need to bring with me my hubby's w2 on my interview. He is currently unemployed (we have a co-sponsor). His last employer didn't issue w2 (company went out of business),but he submitted his last paycheck with his IRS. He told told me that should have sufficed.

I thought everything was ok when our case was completed huh..I'm still waiting for the NVC's email.

Ok, i dont thnk its necessarily a RFE, on the interview letter that you will get eventually, it says that w2s ae one of the required things 'if it insnt already submitted' my husband and i took everything, and when we got there, the officer was like 'where is document XYZ, and i said, i submitted it, it should be in there, but i also have a copy here, she sorted through evrything and found it. CHances are, he OP was just telling you to bring all the financial info that you have, and that means on YOU and your COSPONSOR, get copies, do what you need to do, but if your case is complete they will send you an appointment letter.

K-1 Fiance(e) Visa Process & ProceduresGot our NOA2 and another new question...
I did the K-1 for my husband from mexico, so im not sure if the same thing applies, but all i know is that he can only hel with the financial information, not hurt it. I know with alfredo it gave you room to include his information on the I-864 (for the AOS part), and iincluded all helpul paperwork showing his good finances for the I-134. You can put it if it helps, or not if it doesnt.

K-1 Fiance(e) Visa Process & Procedurestwo last names
My husband is mexican, so he has no middle name and two last names. Just fill it out as you would as if he had one of each. Except Put his first name, his middle, and then both last names. dont condense or anything. if you need extra room, just attach a piece of paper to the documents that you mail making sure you are specific with what form you are referencing and what space you are referring too and write it/type it out completely, for example Billy Bob Johnson Taylor. If you type it out so Billy is the first name, Bob the middle, and Johnson Taylor as the two last names, you will be fine. Like i said if you run out of room while filling the forms out, Like Billy Bob Johnson Ta... then just attach a piece of paper completely typing it out. Ull be fine. Alfredo and i were fine. They understand that spanish names are like that. My mom even hyphenated his two last names on some of the papers and they didnt care. Its all the same person.

I think I met a better, more responsible Filipina, and will likely want to petition her instead. I will probably go visit her in Phils in 2 months. Too many red flags of a train wreck on the first girl, So I had to cut my losses with her and move on!

^^^^Are ya serious??? You make it sound like the Philipeans (sp?) is just a processing plant that you can just grab a girl and dispose of her when your not interested any more. You met a better more responsible Flipina, umm... you should have been more sure about ur decision the first time before you wasted her time, your time, and that of the people that process your case b/c now your slowing down people that are REALLY in love and that REALLY want to be together. I would say dont bother wasting your time on the next girl, sounds like you might fall out of interest with her too. Unless you have an unknown situation that can clear some of my misconseptions up, i suggest you quit clogging up the immigration process for those who fell in love with foreigners and have good intentions of staying with them for their whole lives.

K-1 Fiance(e) Visa Process & Proceduresvaccination records - not requested
If you can, get them in your own country where it is cheaper. I know my husband got them in mexico, and just had the vaccination records transcribed by a civil surgion when he got here in the U.S since he didnt need a full medical, since that was required for the K-1 visa interview before he got his approval. Get them in your country if it is cheaper and just bring the vaccination record with you.

K-1 Fiance(e) Visa Process & Procedureswork history: student??
I had similiar problems when i filed my husbands AOS, it asked for 3 yrs of IRS income tax returns and i only have 2 because 3 yrs ago, i didnt make enough. So i just gave what i had, and of course showed proof of assets and i also had 2 co-sponsers just in case. I heard of another girl that showed proof that she was in college, she got a letter/certificate from her college stating that she was enrolled full time, maybe you can print something out/show proof that you are not allowed to work while going to college. Just show the most info that you can, and since you cant prove that much as far as income, i would recommend getting some co-sponsers.

K-1 Fiance(e) Visa Process & Proceduresdivorce decree
I know that for the interview that my husband and i are going to have to do for our AOS it says that we should be ready to bring the originals or certified copies of all documents, so if you sent a copy of a birth certificate, bring the original to the interview, same thing with anything important like that. So i would say original, or certified copy just to be on the safe side. Look at it this time, going out of your way and not needing it is better than needing it and wishing you had gone out of you way. Hope this helps.

K-1 Fiance(e) Visa Process & ProceduresI-134 question
My parents were iffy about bank info too, your dad can write a letter to the bank asking for all of the stuff that instructions askfor, but he can put in BOLD that he doesnt want his account number on the letter that they return to him with the requested information. That way, immigration gets what they want/need, and your dad can be more comfortable, and you can get your approval.

The reason why they ask for bank info is because the whole point of the I-134 is to prove that the fiance will not become a public charge. They need to make sure that if you cant make the money, that someone can give it to the intending immigrant so that they will not become a public charge, thus thats why they ask for the bank info.

K-1 Fiance(e) Visa Process & ProceduresConsidering a K1
QUOTE (LuvMyPortuGAL @ Apr 8 2009, 04:40 PM) <{POST_SNAPBACK}>
Hello,

We are newbies. We are considering a ALL of the options for having my fiancee get to USA ASAP. It is important that she be here a coupld of time this summer to take some exams as to not lose an entire year when exams are again available in 2010.

We were hoping we could have her visa and her moving here by July as we thought up until a few days ago, that it was a 3 month max process. We now see it is a VERY LONG time and Summer time seem out of the question.

So instead of getting into ALL of the questions that we have I will start with one simple one.....

After I submit the I-129F and wait the 150 days or so for approval, can my fiance come to visit me (possibly a few times) for an extended period (under 3 months) and take her exams on a the visa waiver program?

Thanks.

P

Um, i believe that once you have a k-1 or ANY visa for that matter being processed, you cannot apply for another one, so if you want to do the K-1, (it is faster than the K-3), i dont think she will be able to come to the U.S on a visitors visa. I am not a 100% sure though someone feel free to clean things up. P.S my k-1 application was processed over the summer last year, i dont think it took all that long,i sent it in late march, early april, and i got an approval letter August 11th so like 4 months.

Oof... I forgot to ask:

About evidence... We've been together within the last 2 years some times. But I think most of the boarding passes dont exist anymore. We have all the itineraries but how strong does the evidence has to be that we have been together?

Evidence is later down the road after you guys are approved and it is time to go to the interview to get the K-1 visa. WHen that part comes, you will need stuff like itineraries ifyou can, pictures lots and lots of pictures, with family with friends, (Obviously you both in the pictures) make sure that you know who every1 is that is in the picture, i know they asked my husband that, calling cards if you use them to communicate, you can have skype records, and you can even have your friends and families write letters saying that they have met your fiance, and that his family has met you, they like you, and that they are looking forward to you being a part of the family and that kind of stuff.

K-1 Fiance(e) Visa Process & ProceduresOk Im really extremely confused!
QUOTE (Silverishkitten @ Apr 9 2009, 02:22 PM) <{POST_SNAPBACK}>
Ok... So I've probably read about 20 sites saying the same about this.
I'm really confused and I really don't know anything... I live in denmark and have danish citizenship, but I was originally born in Romania, and my birth certificate is in romanian, but has an approved, translated document in danish. What problems could this arise?

Also... would a k-1 visa even be right for us? A little background story. My bf is 18 years old smile.gif And I'm 20. We've been together nearly 3 years and we're both really sick of not being able to be together. I'm really considering starting this k-1 thing so that I can be with him for good. But how does one become a fiance? Do we have to do something? Like buy a ring or what.
Also would the weird age situation become a challenge? I don't know, but don't people in some state still get considered underage untill 21?
Also, seeing as he's only 18 and is just about to start life on his own, he probably doesn't have enough money to pass the requirments(but his family do support us and will help)... So would it be ok if he get someone from his family to sponsor us? What if I bring money of my own?
If he files for a petition and it all goes like it should... When do I come in play? What would my role be?

Can anyone give me examples on how long time this process took for successful k-1 holders?
It all sounds really hopeless doesn't it? ... I really doubt we're even eligible to apply for a k-1 but I really hope we can.

Also, please don't judge either me or him cos of the age. I know we're both young, and that we might be making a decision that's too serious. But if you knew how we felt(which I assume most of you do), no one will question or relationship and this decision.

So I will be really really grateful to any useful answers. It's nice that there's people out there who went through this smile.gif

I am not sure about the birth certificate, but the age situation i dont think will be a problem. I started the k-1 process with my husband when i was 18 and he was 23, so 18 is the adult age here, 21 is the drinking age its different. As for becoming fiance. if you want to get married, or if someone proposes, and the other accepts, you are a fiance. No need for winning races or passing tests to become 1 hahah good.gif As for a co-sponsor, its good, and alot of people have them, so you should be fine, just check the poverty guidelines. And because you are going to sponsor him, or if he is going to sponsor you, both monies from both parties can be considered, also assets too, like if you own a car, or have land, or a mortgage, it all counts. As for examples on how long it took, well for my husband and i, i filed for him last march, and we were approved august 11th, he had his interview in mexico in december, and was home for christmas. We are now doing he AOS part, which is where he gets his greencard now. Also no judging, i am young to, as is my husband, but we love eachother as i am sure you and your man do too, whats age got to do with it???

QUOTE (Dchama @ Apr 8 2009, 12:01 AM) <{POST_SNAPBACK}>
I keep noticing people writing that their petitions have been "touched". What exactly does that mean? How can I know? I received my first NOA for my I-129F on Jan 30 2009. Should it have been "touched" by now???

Touch means when the papers have been 'touched' online if you check your paperwork updated (although i dont recommend it now because the system is not opportating correctly and many numbers are not in there) the date will change, for example, if you sent the paperwork January 1st and you ge the NOA1 on January 20th, and you check online and the date will say 'NOA1 sent January 20th or w/e' but if you check it periodically the date maychange, the date changes everytime your papers are handled or processed a bit more, so it may change to Febuary 13th, or w/e, do you understand????

K-1 Fiance(e) Visa Process & ProceduresLetter From Parents
QUOTE (Gary and Alla @ Apr 12 2009, 09:57 PM) <{POST_SNAPBACK}>
At the interview they will want to see "evidence of ongoing relationship of a type that leads to marriage". Letters from parents and family are not "evidence". Phone records, letters, emails, travel documents are "evidence" Letters from family will generally be disregarded unless they are supported by other evidence, in which case they are not needed. But, they are free and easy to do, so why not? I hope you are keeping copies of other evidence your realtionship generates, that is what you will really need.

I had letters written stating that my parents had met my (fiance at the time) and that they liked him and were aware of the marriage plans, and supported him, and we had pictures to prove that my parents had met him, thanksgiving pics... and the alike. We also had proof that my fiance was living with my parents at the time with recipets for paying rent and that kind of stuff. The letters were never actually asked for but, it was nice to feel that we had it just in case we needed it. I would say go for it. It will never hurt to have TOO much, but it can if you have TOO little. good luck.

K-1 Fiance(e) Visa Process & ProceduresCase status.

A question about case status updates online. I received my NOA1. In the letter it gives instructions on where to go to check the status of my case. But when I go to the USCIS website it says my case can not be found. And it has been a couple of weeks already. I called their customer help phone number and the rep said it may never show up online. Is this something that i should dig deeper in to or let it be and remain blind until they send me a notice by mail? I would hate to upset some people by calling about this. Maybe it will show up down the road.. *shrug*

The receipt number begins with a WAC and is processing through the California processing center.

Any advice is appreciated. Thank you.

ALOT of people are having problems accessing their case status, it seems helpless and not worth your time to keep checking. It may show up along the road, but then again, just like the rep said and many of us are/have experienced it may not... i would say if you dont get another NOA or the paperwork that you are supposed to get within the specified time aloited like the usual 90 days, i would call in and check with the rep on the status of your case.
