We did bring along our wedding album with us when we had our AOS, really at that time, didn't have much more. But for my wifes' USC interview, just legal documents, that's really all they wanted to see. If her IO wanted to meet me, was in the waiting room. But she didn't want to meet me, just see my papers is all.

I recommend You call IRS and request a transcript (You would have to pay for a copy, whereas a transcript is free).

This is the easiest and simplest of all immigration applications. The list of evidence states A) OR B) OR C) - it doesn't state 'AND". Take them at their word, send only one of the documents requested under any 'or' listing. Do not send any more evidence with the actual application than is listed. They do not actually review the application until you show up for your interview so it is just as easy to bring along additional documents to the interview in case they might be needed rather than include them in the application. That is what I did - only included the exact items listed - no more and no less. I brought my file of supporting additional material with me to the interview but they were not at all interested in seeing any of it. She went through my application for the first time with me sitting there, going line by line and verifying everything, then she checked off on a check list the additional materials that were requested. I asked if she wanted to see the originals and she said no.

All they are trying to do is verify that you are eligible for the 3 year option (still legally married to the same US citizen), that you have been a good permanent resident (paid your taxes, no illegal activities) and that you meet the standard eligibility requirements (physical presence, continual residence, civics test, knowledge of English).

So, don't over think this - give them only what is requested and take the rest with you to the interview Posted Image .

The default setting is that you are done with "proof" as you stated it so eloquently. I would just send the required documents and, in regard to taxes, the tax transcripts. However, you never know who you gonna encounter when sitting in the hot chair, so it might be a good idea to just put a few items in your backpack when heading to the USCIS office. Can't hurt, and it's better than not having those and being asked for "proof." Take your house/apartment rent, a couple of bank statements from the past year, and one or two other documents, like a current credit card statement or car registration or AAA card, etc.



I heard pictures and things like that were a good idea too.... I guess it's kind of like visa/AOS/ROC all over again....

Ok, in the VJ guide they cover documents needed to file. Under the "If you are applying for naturalization on the basis of marriage to a U.S. citizen" part, it mentions:

It seems many people feel the need to send all the non-tax documents (option 1 above) even if they are sending IRS certified copies, or tax transcripts. It seems to be unnecessary, though. What I'm wondering is if these things (bank accounts, leases, mortgages, birth certificates of children) or any other things (like all those things we sent for the 2 and 10 year card) are necessary when going to the interview? Or are we actually done with "proof" once the packet is sent (short of RFE asking to send something we missed)?

I'm curious about this since we're planning to send our package very soon. Also, I hope if others read this, it will help clarify things for them as well.

I don't know if anyone will be able (or willing) to answer this one from experience. I would imagine, especially since she removed conditions, that it wouldn't be a problem. I suggest, just to be extra cautious, that they wait until he actually gets out to send the packet, though - just in case. The only problem I can imagine is "guilt by association" - someone could potentially raise a red flag about whatever reason the husband went to jail - wondering if she was involved or whatever (however fair or unjustified that may be). I don't think that, unless she was also investigated/charged/whatever, that could be considered a problem with the "good moral character" part of it. I don't know for sure, though.

As far as evidence of the relationship goes, the taxes would help (and are required). Also, any letters, pictures (if that's possible), gifts, phone records.... I would have her just treat his prison stay the same way you would the original long distance relationship - or the same as a couple physically separated for school, work, or any other reason. Gather the same evidence as in all those cases. Is his name still listed on the lease/mortgage/car? Do they have any children together? I imagine it's likely they have some evidence from before he went to jail. That's another reason to maybe wait a little (since there's no deadline) - they can add more evidence after he's released as well.

I would recommend going anyway, if possible. I thought I heard (can't remember which step of the process) about someone running into problems for not going to a cancelled interview that somehow wasn't really cancelled....

Ok, not to sound stupid...

once the forms have been filed, the interview takes place at the local office, right? In our case, I imagine that would be Philadelphia.

Then once a person has been approved, then comes the Oath Ceremony. That's at the same place? I think I remember reading that some places have same day ceremonies. How do we find out which places have that option?

Yeah, I know - I'm jumping ahead. I do tend to do that. I like to know what's coming (when possible). Helps me stress less.

I'm sure there are others who would like to know as well - and some of them might need to know soon.

Just so everyone knows, he called to say there were no problems. He wasn't even asked about the date on the letter, and it sounds like they didn't even look at it. So, it looks like Philadelphia allows walk-in biometrics!

My husband's biometrics appointment is scheduled for 8 Thursday morning. It would be very difficult for him to get there at that time because we only have one car, and I need to take my kids somewhere totally different around the same time. He said something about dropping the kids off, and then going to his appointment late (probably 2 hours late). I think it would be a better idea for him to do a walk in appointment tomorrow (a day early). What does everyone else think? My main concern is if he's really late, they might tell him to reschedule, which would delay everything.

I was excited yesterday when I realized it was my husband's three year residency anniversary. I know he's been eligible to apply for citizenship for a few months (and he already did), but now there's no concern about having to delay the oath ceremony once he is interviewed. Trust me, I wouldn't complain if his paperwork was processed fast enough for that to be an issue! I'll be happy once he gets his interview letter.

Anyway, it feels like we've reached a milestone or something. I kind of feel like we should celebrate.

Did anyone else get excited about their (or their spouse's) three year green card anniversary? Did anyone mark the occasion in any way?

I just thought this would be something interesting to mention.

Ok, I know I need to be patient - being in this process for a few years has taught me that. But I'm finding myself getting antsy. My husband had his biometrics more than a month ago, and no updates on his status, no letter or anything... and since he did walk in biometrics a day early, we start to imagine all sorts of crazy things - they didn't record that he had them done/somehow 'lost' them, his letter was accidently delivered to the wrong house and was thrown out, something weird happened with his application, whatever. I've been looking at the threads, and I know that a few people did wait more than a month for their interview letter. But it seems that almost everyone gets them within a month. What happens if it WAS sent to the wrong house? I worry about them thinking we decided to abandon the application or something....

At what point am I justified in worrying?

I was wondering about this as well. I really want my children to attend their stepfather's oath ceremony - I feel it would be educational, and mean alot to all of us. But, I don't want to drag them along for the interview just to find out they'll have to wait for another day. But I don't want to take the chance of having them miss it.... I guess there's always the option to say "no thanks" if offered same day, but who wants to do that?

I mean, does NO ONE ever know before going if there is any chance of having their oath ceremony that day? It's a big enough deal for many people that it seems strange there's no way to know ahead of time.... whether or not to bring along family members....

I wish there was an easy way to find out where it is/is not done, how often, etc...

just like any immigration process interview, it is with an officer, who will go through your file and ask the questions. The officer will go through the N400, ask him 6 questions from the 100 questions. he will read a question and write the answer. Is he filing due to the 3 year rule of marriage?

Is there a way to get a new 'pinned' topic outlining the steps AFTER the paperwork has been submitted? I see there's one that explains in detail about what to do up to and including sending the packet. I also notice that many people seem to ask a bunch of questions over and over, over time, about what happens after that. If we start a new pinned thread, we could have, all in one place, all the information we need while we wait. Things like processing times, what to expect for the interview, things like that.

For example, my husband was asking today if the questions he'll be asked (from that list of 100) are verbal or on a computer (like when he took his exam for his drivers license). I know I've seen several posts about what to take to the interview.

So, can we do a new pinned topic about "what happens after sending the packet"?

Also, can anyone let me know if the questions are on a computer, or asked by the interviewer?

Does anyone know about Philadelphia? I want to know if I should take the day off to go along with my husband. I don't want to take the chance of missing his oath ceremony, but at the same time, if there's no way they'll have the ceremony that day, I don't want to miss a day's pay (I'm a sub, so I don't get paid days off, and like many, we're struggling financially). If he doesn't find out until he gets there, that's a problem - I don't have the kind of job I can just leave at a moment's notice....

I have a question. My wife and I just sent the petition for removal of conditions to get her ten year greencard. I understand you can apply for citizenship after being married for three years which will be next may. I assume she should recieve her 10 year greencard by then but if not can she apply for her citezenship come may? Or do you have to recieve your 10 year greencard first. Also I am curious to what reasons people think is an advantage over being a citizen vs being a permenant resident? The only things I can think of is social security and being able to vote.

One thing I didn't see addressed in the responses (I could've missed it...) is your question about if she has to receive her 10 year green card before applying for citizenship. She does need to apply for her 10 year card (if she wants to stay in the country legally), but it's possible the card won't arrive before she can apply for citizenship. If I remember correctly, you can apply for citizenship as long as you've applied for your 10 year card (on time). I think the citizenship application pushes through the 10 year card application. I know people get irritated paying so much for a ten year card that they really never use, but it's a necessary step in the process. It would be a good idea anyway, since you never know what could happen - some people end up not being able to apply at the three year (minus 90 day) mark for whatever reason. Anyway, it's necessary whether you will end up applying for citizenship or not, or whether you get the card before applying for citizenship or not.

Thank you so much. For me, it doesn't help to know that others are also miserable/irritated/frustrated/etc. Somehow, it actually helps to hear others agree that it sucks, though. Validates my feelings, I guess.



It is all very strange. I can't believe the woman who called didn't give ANY identifying information. We seriously thought it was likely a prank until he got turned away today. I was still questioning the whole thing until he got his cancellation letter this afternoon. At least now we have proof that it was cancelled.




My husband and I got to spend the entire day together since we both took off work. That was a good thing about the day. I also got caught up in one of my classes, which helps.



I'd never heard anyone say "commiserations" before to someone - I like it! Chocolate - good idea. One of the best medicines ever (especially since I don't drink)



Well, I hope you both (and everyone else who is waiting) get through the process quickly.



I actually don't get to think about this much between work, school, and my kids. But today was different. If I really think about it, I don't know why I care so much anyway. He has his 10 year card, and we're not planning to leave the country anytime soon (his passport expired, and we decided not to renew because he should have his new US passport soon, we hope). Elections are over for now. It's not like citizenship would change anything right now. Waiting a few more months really doesn't matter in the long run in our situation. But still… something about being so close and having it thrown into the unknown. And possibly only because someone messed up and forgot to mail his file… (seems like it from what we've been told).



Oh well. I'm just going to put my brain back on work/school/family mode for now. At least until the second interview letter arrives….

Unfortunately, after traveling the whole way into Philadelphia, paying for parking, etc. he was told they couldn't interview him because his file is somewhere else (didn't say where). They were nice about it, but it's still really frustrating. We're both out of a day's pay, gas money, parking, etc. Now we just wait to find out when he's been rescheduled to interview.

Oh well - at least the journey was quick and easy at the beginning - the visa was the fastest and easiest part. Seems like we've been downhill since then, so it's a good thing this is the final chapter!

Hi everyone.

Well, I posted the original post as soon as he listened to his voice mail - we were just stunned, and not thinking. Well, a little later (when we could focus more) we listened to the message again. Yeah, it's REALLY strange. No name was given, no return number (and it was one of those calls that came in with no name and no number on the caller ID), etc. VERY suspicious. The only thing that seemed legit about it was that no one else knows he has his interview scheduled for Monday morning. He didn't want to tell anyone about it until after it happens, so not even family or friends know. We were wondering how someone would know his cell phone number AND the date of the interview. He did give his cell phone number for text message updates, so USCIS would have that number.

Anyway, he had already decided he would go. Even if he received a letter of cancellation in the mail, he would go. We figured it would be better than not going. Even though it means missing work. Hearing what everyone else has to say just confirms it. Yeah, maybe someone got sick or something - no way to know. And the thing is, we weren't even given enough time to schedule an Infopass appointment. I told him that we might as well go to the appointment because it would be 'faster' than Infopass. The worst case scenario is that we 'wasted' time finding out why his interview is delayed. Best case scenario, he gets to interview - either because it was never actually cancelled, or because they have some opening/can squeeze him in. Like he said, once we're there, he doesn't care if we have to sit there all day, if they can fit him in somehow!

So, my husband was scheduled a while back for an interview on Monday morning, November 8. We were eating dinner tonight, so he didn't answer his cell phone when it rang. After dinner, he checked his voice mail, and it was a message saying that his interview has been cancelled and he'll receive a new interview letter within the next 30 to 90 days! No explanation of why, or anything. Just that it's been cancelled. We've been waiting for this, and now just a few days before, they tell us he has to wait a few more months?

Certain countries won't allow you in with an American Passport when they see you were born in that country. They expect you to have a passport of that particular country. That is the problem I think. When the US simply wouldn't mention the place of birth, that problem wouldn't exist. It is confusing anyway. A lot of my Belgian friends were born in Germany because their parents were stationed in Germany with the army. Although they are Belgians , on the American passport it looks like they are Germans. This is very confusing and might lead to problems.



I hadn't thought of that... I'm a USC born in another country because of my dad being in the military. Only one passport, only one citizenship. I did notice the fact that it probably looks like I was from somewhere else and naturalized. Now I'm wondering, if I ever travel to the country of my birth, if I'll have a problem since I don't have a passport from there...

A few people lately have said that during their interview the IO asked to see relationship evidence. None of them said whether or not they submitted joint tax transcripts with the N-400 application.

Those of you who have just completed your citizenship interview, did you submit joint tax transcripts with the application, and were you asked to show any other proof of relationship during the interview?



Yes, we sent the joint tax returns (as required), and my husband was asked for bills during his interview. He took a bunch of things, but the guy wanted utility bills. He said that mortgage statements don't prove that a couple is still together - they could be part of a divorce settlement or something like that. I'm just mad I wasn't able to go - I went to Morocco for his visa interview (and stood outside alone for hours), his infopass appointments, and his original interview in November (which turned out to be cancelled - he got the letter the following week). (he didn't have any interviews in between)

It seems like the guy was ok with what he had - he told my husband he might stop by unexpectedly sometime, and my husband said he was welcome to (knowing my husband, he was serious, too!) I guess that worked - the guy said he'd send out an oath letter as soon as my husband re-did his biometrics (his others 'expired' - he did them back in July, and since his interview was delayed...). He went that day, and we're just waiting for them to be processed. I hope he gets his letter soon.... and more importantly, I hope his oath ceremony is on a day my kids are with me. I'd LOVE to take them, but doubt their father will let me take them out of school on one of his custody days to go to their stepfather's oath ceremony.

Anyway, yeah - I recommend that everyone takes current utility bills to prove they're still together. The problem is that most bills are only in one person's name, so you'll have to take some in his name and some in her name, from the same months, and with the same address, of course!

We're dealing with the same problem - just waiting and waiting. The difference is that everything got all screwed up before the interview. We sent the package 11 months ago, and he was scheduled for his interview at the beginning of November. At the last minute, it was cancelled because they didn't have his file! It seems no one ever bothered to order it. We waited for the interview to be rescheduled, then went for an INFOpass in January. He got his interview (finally) rescheduled for February. At the interview, the IO told him he passed, but he had to re-do his biometrics. Because of the screw-up, they were 'expired'. The IO said as soon as the fingerprints processed, he'd get his oath letter. He went that day, immediately after the interview, but we're still waiting for a letter. It's annoying - it's been almost a year since we sent the application, we did everything right, he passed everything, and he's still not a citizen because of someone failing to order his file for the interview. It seems that no one wants to do anything for some reason - we have to keep calling, and I think he's going to have to make another INFOpass. It's like we're having to force this process forward little by little. I wouldn't mind waiting the full 120 days for the letter if he had his interview in a more timely manner. If they had kept his first interview, he would've been a citizen by now.

We actually have a huge plastic container full of papers, starting from the K-1 stage. That alone was alot - pages and pages of pictures printed out (9 to a page), pages and pages of IM, phone bills,... you name it. I've just been piling each new stage of paperwork up on top. Not only am I sentimental, but I honestly don't have the time to sit there and sort through it and decide what to keep. Even if I wanted to get rid of all of it, it would take forever to shred it all. I did look through it a little recently for some things for him to take to his interview. I don't plan to do anything with any of it for a long time, even after he finally gets his citizenship. We have room for it, and it's sitting there, happily, in its little spot in the basement.

Also, doesn't it say something on the form, where you sign, that the form is complete and correct to the best of your knowledge? It sounds to me that to the best of your knowledge, at the time you signed the form, you didn't know you had registered to vote. I would definitely emphasize that.

As far as a lawyer goes, I think this is one of those times it might be a good idea to get one (and I hate paying lawyers). The outcome is just too important.

I actually put NO next to hve you ever registered to vote as i was unaware that i had, but found later on that i had indeed filled out a card in 2006. The USCIS officer pointing it out to me was the first time it had been brought to my attention and i had no recollection of doing this at the DMV.



That's exactly what I would mention in the letter - that you didn't realize that you checked a box for registering to vote. Since that was 5 years ago, it makes sense that you don't even remember doing it. It sounds like even if someone had mentioned it to you immediately after it happened, you would have been unaware that you did it. I think the fact that you never voted backs you up that you didn't intentionally register to vote. You were probably just trying to be thorough and check all the boxes you saw and fill in all the blanks as well.

You never know the reason. My husband applied last May, was scheduled for an interview in November, and it was cancelled at the last minute (we got the letter AFTER the date of the cancelled interview). When he went to find out why he hadn't been rescheduled as of January, we found out that no one had ordered his file. Since it wasn't there, they couldn't interview him. He finally got his interview in February, but we're still waiting for an oath letter. It's been over a year now.

Still nothing? Come on venus, take over and start bugging all your representatives about this - have you considered going down the writ of mandamus route? That ought to force them to get it done, you're past the 1 yr mark of sending the paperwork for naturalization in.



He finally got a call back today, but the lady just said it's in AP, and there's nothing we can do right now. She said they won't even tell her why it's stalled. She said that AP stops the clock. She said it could be something as simple as waiting for verification from some school he went to or something. Sounds like hooey to me. It's so annoying. She said all we can do is sit and wait for the process to start back up again. I don't understand - it's such a straightforward case. And he didn't have to sit in AP (or if he did, it was so fast, we didn't even know about it) for his visa, AOS, or ROC. If everything was cleared back for his ROC - not too long ago - I don't understand what the hold up is. I even called them when I got home and he told me about it. I was told the same things. Nothing anyone can do. No one knows anything - and by law, we can't be told. No way to know what is holding this up, or how long it's going to take.

I don't know anything about a write of mandamus. Can that help in this situation? How do we do that?

I just feel like I've been trampled.

We sent the letter two weeks ago. They said they'd get back to him, but no news yet. His interview was almost 90 days ago. We sent the packet more than a year ago.

I figured we'd be done by now. We should have been done months ago - his interview was originally scheduled almost 7 months ago.

This is a straightforward case. We're still together - very happy. He's never been in any trouble. Only left the country once; for less than 2 weeks. No RFE or anything like that. Not sure why this is turning out this way.

At least he got here quickly - that was the most important thing. We hated being apart.

I agree. Poor guy had to wait until I finished finals so I could help him with the letter (he does a good job, but still likes for me to double check his English). We just finished it, so we can send it to go out first thing Monday morning.

I mentioned that to him, so I hope he gives it a try. I'm just no so sure what they can do if it's just a matter of waiting for the background check, though..... It just sucks that his interview was delayed for more than 3 months because no one bothered to order his file! And it's confusing about the biometrics, too. First they said that he had to re-do the fingerprints because they were expired (on the day of his actual, re-scheduled interview), then he was told at an INFOpass appointment that his fingerprints from last summer were NOT expired and everything was ok - the file was just waiting for a supervisor to sign off on it. Then he gets this email saying his background hasn't been checked... is that the same things as the biometrics?

I'm just irritated and overwhelmed. It's not even JUST waiting this long - there are other things going on in our lives right now. Hell of a week....
