Some of you seem to overlook the fact that he hasn't said anything about wanting to end his marriage. Perhaps he really loves his wife, and wants to make it work - how do we know? His concern right now is that she won't go to his interview with him. If he got deported, he'd be away from her, and would have little or no chance to work things out. He might have nothing to go back to since he'd have to have given up his job, residence, etc. Think about it - ever go visit a place you used to live in? There's rarely even a friend around to talk with, places change. When I stop in the city where I lived for more than a dozen years, I barely even recognize the place. He might really have a life here now. He doesn't mention children, but it IS possible that they have one. So, he has to give up the life he has now just because they're having problems? I'm not an immigrant, but would hate if I had to leave my home when I went through my divorce in the past. Even if my home was 'just' a new area I had been living in for a few years.

I understand your frustration. I just read something about filing for naturalization that might possibly make it a little more bearable. Well, maybe it will at least make it a little less annoying that you paid for I-751 when you can apply for citizenship soon (it DOES kind of seem like a waste of money) and have yet to be approved. It states in the Guides that "the I-751 must be approved in order for you to apply for Naturalization 3 years after AOS based on marriage to a US Citizen". I imagine that in some cases, the I-751 is NOT approved, which means that person would not be allowed to get citizenship. Maybe if you think of it as step three (step 1 being the visa, step 2 is the 'green card') of the N-400 instead of a separate, unnecessary step, it would be a little easier to deal with?

Also, some people have to wait until they've had LPR for five years for citizenship, so they 'use' their ten year card longer. Some decide to wait for N-400 for whatever reason, and some decide not to apply for it at all. So for them, the I-751 isn't such a 'waste'. I can see your point, though - why can't they just make the first card a three year card, or allow for a less expensive option to bridge between the 2 year card and citizenship? I guess it would be impractical, and they want to make sure that the conditions are met before approving citizenship.

Either way, I hope this makes it a little more bearable for you. I also hope we see you adding your approval to the list soon!

We just got our approval in the mail today (dated last Friday), and we sent 12 days to VSC before you. There are several people who sent after us and got approved in the past weeks. So, there's a good chance that you'll get your approval letter soon. I know it's hard to wait, but try to be patient.

I just updated the May list as well as the VSC list, so they'll be on the top of the list.

In the instructions it states:

"If the sponsor fails to give notice of a change in his or her address, as required in 8 U.S.C. 1183a(d) and 8 CFR 213a.3, the sponsor may be liable for the civil penalty established by 8 U.S.C. 1183a(d). The amount of the civil penalty will depend on whether the sponsor failed to give this notice knowing that the sponsored immigrant(s) has received means-tested public benefits."

8 U.S.C. 1183a(d):

"(d) Notification of change of address
(1) General requirement
The sponsor shall notify the Attorney General and the State in
which the sponsored alien is currently a resident within 30 days
of any change of address of the sponsor during the period in
which an affidavit of support is enforceable.
(2) Penalty
Any person subject to the requirement of paragraph (1) who
fails to satisfy such requirement shall, after notice and
opportunity to be heard, be subject to a civil penalty of -
(A) not less than $250 or more than $2,000, or
( B)if such failure occurs with knowledge that the sponsored
alien has received any means-tested public benefits (other than
benefits described in section 1611( B ), 1613©(2), or 1621( B )
of this title) not less than $2,000 or more than $5,000.
The Attorney General shall enforce this paragraph under
appropriate regulations."


I think this is one of those things they don't really enforce UNLESS the sponsor is purposely trying to hide. I hope so - I'm one of those who didn't realize I needed to send the I-865 until more than a year after we moved, while filing ROC. I just sent it a day before sending the ROC, and added a copy of the I-865 with a cover letter explaining that I didn't realize, and apologizing for the oversight. We had no problems, and his 10 year card should be here any day now!

Just thinking 'out loud' here... maybe how organized you are counts for more than how much you send...? But I think how much you should send depends on where your SO is from, and whether or not you have 'red flags' in your case. If your SO is from an 'easy' consulate, you're approximately the same age, have the same primary language, religion, etc, then sending hundreds of pages might be unnecessary. But, if you're in a situation like we are - 'difficult' consulate (where most people get 221g, extended AP, whatever), and have different languages, religion, larger than 'normal' age difference, USC with a recent divorce, etc, NOT sending in plenty of evidence almost guarantees denial or delays.

Either way, no matter how many pages you send - whether a dozen or several hundred - I think having things organized nicely is essential. We sent (if I remember correctly) 260 pages for ROC. It didn't take a long time to get approved (under 5 months through VSC), and I think it's because we had everything in well labeled sections, arranged by importance (taxes near the front, extras at the back) and/or date (the bills, mainly). We started with the check, cover letter, and application, then had tabbed sections on other required documents as listed in the guides. That way, if someone wanted to get home early, they could just glance at the tabs and briefly glance at each section to make sure we had the required evidence. If they had any reason to wonder about us, they could easily look more thorougly through any or all sections. If they were really bored, they could look through the sections at the back at photos, photocopies of envelopes from holiday cards, letters/invitations from family/friends, pictures the kids drew...

The "is more or less better" debate will probably never be resolved. I don't think the answer is the same all of the time anyway. There's no real way to know 100% what the person who will be looking at your file is going to want, how much proof will be needed, etc - everyone's different, and each case has different circumstances/requirements. But think about it - would you rather look through papers in random order, or ones neatly organized and labelled? I'd rather do the organized ones, even if it was a larger pile. Besides, if something is needed, I want the person looking at my paperwork to be able to find it easily instead of maybe deciding instead of searching, an RFE is faster and easier (I remember one time going out to buy a new extension cord because I had just moved and couldn't bear the thought of looking through boxes to find one).

Just my thoughts, for what they're worth.

Just curious (haven't sent our I-751 packet just yet, but we're close) - will waiting more than a year for the 10 year card delay the citizenship process?? I think I read somewhere that you're allowed to apply even if you haven't been approved for the I-751, but does that mean the N-400 process will still be delayed?

Also, just curious - has anyone ever still been waiting for I-751 decision when the N-400 decision has been made? I might not be using the correct terms - sorry. I hope someone understands what I'm asking.

This seems logical to me - children of the LPR, not those of just the USC. I'd only add to what you said (for any with this situation): any children adopted by the LPR. Either way, as much as the LPRs might love their stepchildren, they aren't legally their children. For example, if something happened to me, my husband would have no legal rights to even see my children. (I won't even get started on that - not actually relevant to this discussion)

We also moved, updated our address, and did not receive a reminder letter. Someone reminded me that just because you submit the AR-11, it doesn't necessarily update your address all over USCIS. So, we're guessing they sent a reminder to our old address, but since we moved more than a year ago, the post office didn't forward it. Oh well.

Hi everyone - long time, no see. I haven't been checking because I'm not quite adjusted to my new schedule - not only am I back to work as a substitute teacher, but I started my master's degree. The past month has been a bit overwhelming! I don't seem to have time to do anything.

I thought USCIS forgot about my husband, but this morning, he got email that his case was finally being transferred to the local office. He's now in the "Interview and Testing" phase. If I remember correctly, that means he should be getting an interview letter soon. I hope so!

Well, I better get back to studying. I just wanted to say hi, give a quick update (now that I have one), and say congratulations to everyone who is moving along in the process - and a bigger congratulations to those who are done! To the others who are still waiting, I hope hearing that someone who was worrying that the file was lost or something finally got a ray of hope gives you encouragement - I hope you're next!

He finally got an email response, but all it said was:


The status of this service request is:

We apologize for the error on USCIS Case Status Online that states you were mailed a Request for Evidence (RFE) notice requesting additional evidence on Form N-400, Application for Naturalization. This is a USCIS error. The notice that was mailed out was your Biometric Appointment Notice with your local Application Support Center ( ASC) which you may have already attended. Your application is currently pending and will be worked in the order it was received by USCIS. Again we apologize for the error and any inconvenience it may have caused you.


So, still no news about the interview. He hasn't gotten any letters - yellow or otherwise. No idea when his interview might be. I don't even know for sure they got his biometrics or if they got lost somehow...

Bummer. September 17 is "Citizenship Day". It would have been so cool if he had his interview by then. Oh well. As long as it's before NEXT citizenship day!

Call Customer Service and ask for a service request for the "RFE", you will have your interview letter in 3-4 days after you call. Is what I did and also one of my best friends did and we received our interview letters 3 days after the call.

Just a quick update, in case anyone is interested....

It turns out that my husband's oath ceremony was scheduled yesterday, and that was one of my custody days. We were able to take the children with us, and they were really happy they got to go. We didn't tell ANYONE about it until yesterday, so we didn't have to worry about anyone (ie - the ex) interfering in things. I ended up dropping them off late (for the first time) afterwards, because the ceremony took longer than we thought, there was traffic, etc. But they got to go, and we are all very excited about it. I know it's a bit boring for young people, but they liked the slide shows and stuff, and were old enough (at least the 11 year old) to understand the significance and importance of the ceremony. I had them take things to read, and the little one drew pictures too while we were waiting. I also let them take pictures of things before and during the ceremony - they got a little silly, which was fine (they were quiet) and made for some laughs when we were downloading the files to the computer.

I know my son would've been very disappointed if he hadn't been able to be there to watch his favorite person (his stepfather) become a citizen. He was very proud.

The whole thing was wonderful, and I found myself in tears at times.

I'm so happy it all worked out for all of us.

Well, we went to the INFOpass appointment. The lady was really nice. She said she doesn't know why my husband had to re-do the fingerprints, since they were in the system (she even knew when he went for them in 2009 for his ROC) and she said they're good for 15 months - which would be until October 2011. She also told us that the guy who did the interview approved the file, and it's now waiting for his supervisor to sign off on it. Once that happens, he'll get his oath letter.

I'm so happy we went. Not only did we find out that the officer definitely approved him (always good to hear it twice), but I think that going for an appointment somehow moves things along. It seemed to help for getting the interview rescheduled. It seems unlikely that there will be any problems. Now it's just continuing to wait.

How is your relationship with your ex husband? If it's cordial, you might want to ask nicely if he will bend his day with the kids so you can take them to the ceremony. Remember it's not your oath but rather (as far as he's concerned) some other man's oath. You mentioned you could take him to court but I'm afraid you'll lose the case since the courts gave him that day to be with the kids. I say try playing nice and lets hope he goes along with it. It will be nice to have your family there. Good luck



He's a jerk (did you read what I wrote earlier in this thread?). I know it's not my oath. My husband wouldn't care if they went either. It's the wish of the children. If my ex would look at it that way, and had a decent bone in his body, he'd let them go. But he didn't let them see their own grandmother a few summers ago, and it was the only time she could come that whole year (she lives far away, and can't afford more than one trip here per year). I won't bother with court, since I doubt we'd be able to go in time and I can't afford it anyway. The 'nicer' I would be, the more he'd know it was important to me, and the more I can guarantee he'd say no. If I wanted to be petty and self centered about it, I could say I hope they CAN'T go, because they'd know if was their father's fault, and they'd get mad at him. Plus, then I wouldn't have to deal with taking them and keeping them quiet and happy the whole time. It would be a special time just for the two of us. The problem is, I'm not wired that way. This is a one time thing, and I wouldn't want my children to miss out on it, even if it would make me "the good guy" and their father "the bad guy" - and without any wrongdoing on my part.

You are in Penn, so let's say they have 6 Oath Ceremonies per year within the reach of the USCIS Filed Office that's adjudicating your N-400. So if you want yours to be on a certain day of the week, you may have to wait a few years.

That said, watching an Oat Ceremony ranks on the excitement scale second only to watching the Pharaonic circumcision of a little girl in Africa. You couldn't pay me enough to attend one as a spectator. Little hint: Los Angeles has 12,000 applicants in one day. Strong binoculars needed! Think Texas Cattle Drive with lots of waiting involved and without the whips. It's torture and if children have to watch it I call it a case of child abuse.

Trust me, my life would be easier not taking the kids. However, THEY want to go, and I know it's important to them (especially the 11 year old).

The lady said yesterday they have from 4 up to as many as 9 ceremonies per week, so that's not the issue. She also said they're fairly accommodating of requests. We can try, and if it's going to be a big problem, we'll just have to figure out a way to let the kids down easily - emphasize how boring it would be for them, and how much more fun it will be to celebrate afterwards. I just know my son would love to be there to witness the moment his stepfather becomes a citizen. He's sentimental like that (like his mom).

I just find it infuriating that their father would make them miss out on something out of pettiness and spite (like he did in the past when they wanted to come over for a few hours when my family was visiting from out of town). That's the real issue. The children want something (reasonable), and their father won't let them go (and it would be no skin off his back - I'd pick them up and drop them off - it wouldn't cost him anything) just because he knows it will bother me if they miss it. And it would only bother me because I know it would upset them. Any adult with half a sense of decency would put the wishes of the children first (as long as it makes sense - not giving them anything they want, no matter how unrealistic or unreasonable).

He also told them in the past that they weren't allowed to use any words of my husband's native language in his house. He's got issues (especially when it comes to people who are 'different').

If it were me and the ex was that uncooperative, I think my kids might suddenly come down with some type of illness the day before they were supposed to visit dad. Might sound shifty but sometimes you have to fight shifty with shifty.



He'd pick them up even if they really were sick (they are 'pawns' and/or 'property' to him). And the way the schedule works, it would likely be a problem logistically anyway. They're with him a certain number of days, then with me a certain number of days, etc. There would be a good chance the oath day might be in the middle of his custody days. He wouldn't let them stay with me an extra day (much less days), and I couldn't just keep them (by going out of town where he couldn't find us, for example) or take them out of school without his permission. Two reasons: 1 - I couldn't put my kids in the middle of something like that. Not fair to them. 2 - I can't really afford the inevitable legal bills that would be associated with it. (I kid you not - one time, my oldest lost her cell phone, and I got a letter about it through my lawyer, all but accusing me of taking it and hiding it from her. Nothing came out of it , but I ended up owing hundreds of dollars in legal fees).

The only flexibility I have is to pick them up early from school to go to the ceremony if it happens to be in the late morning or afternoon on a day they would be with me after school anyway. If it comes down to it, IF the ceremony is right in the middle of the day, I could chance it by taking them out of school and then taking them back, and just dealing with the fallout later. But that would only work if the ceremony wasn't too early or too late in the day.... and would likely cause so much stress for all of us (although I think the children would feel it was worth it to them).

I just really hope they let us 'pick' the days at INFOpass, or that we just get lucky and they schedule him on one of those days anyway. That would be best for all of us.

As long as it's before the end of the school year (and not on a day off of school), there are really only 2 days of each week that would be a problem, so I guess we have better than a 50/50 chance...

It would really suck if, after all the hassle this has turned into during the past 5 months, we had to decide between delaying and hoping for a 'good' day by rescheduling, or having them miss this very important day.

Thank you so much. I think he should anyway, to find out about the delay (and because doing so in the past seems to have sped things up). While he's there, he can plead for an oath ceremony on a day the kids will already be with us.....
