Yes, It sure is frustrating to see the lack of consistency in processing times. Our NOA1 is July 17 and still no NOA2 or RFE or anything. And I can't get anywhere with an inquiry until after the six months current processing timeline has passed, so that's another 2 weeks of waiting. Ugh!

According to my dictionary otherwise when used as an adverb means 1. in another way; differently 2. under other circumstances 3. In other respects.

Now substitute any of those terms for otherwise:

a. Applications or petitions postmarked or in another way filed on or after that date must include the new fee.
b. Applications or petitions postmarked or differently filed on or after that date must include the new fee.
c. Applications or petitions postmarked or under other circumstances filed on or after that date must include the new fee.
d. Applications or petitions postmarked or in other respects filed on or after that date must include the new fee.

None of them is even close to your interpretation which if I understand it correctly is:

Applications or petitions postmarked or filed into the USCIS system on or after that date must include the new fee.

Sorry. I just can't agree with you. And evidence of some contract employees rejecting applications and petitions is not proof that they or USCIS is correct. I am not an attorney or an even an english major but I think I have a real good idea what the clause in question means. If USCIS wanted to say that all petitions and applications had to be received into their system before 7/30 than they should have said exactly that and never mentioned a postmark.

To anyone who knows: I had assumed there are also applications and petitions that were postmarked prior to 7/30 but received on 7/30 or after that were accepted with the old fees. Am I wrong?


Well, I have to say that my reading of USCIS's statement is exactly the same as Chris'. And with the utmost respect, I have to say, Bill, that, to me, your grammatical substitution exercise does the exact opposite as you suggest: It support's Chris' interrpretation.

For me, the key is "or" and where it is located in the sentence. The 'or' provides for 2 possible ways that USCIC can utilize to accept or reject. The dlemma is that it is at the USCIS's discretion about which of those 2 options it wants to utilize. To me, I don't see any implied equality between the 2 "or'd" options - something that those that are questioning why USCIS would use the word 'postmarked' are implying.

One other aspect that comes to my mind as well, is the earlier words in the sentence: "Applications or petitions..." it doesn't stretch my thinking to imagine that USCIS has some uncommunicated and undocumented intention that it will apply either of the 2 "or'd" options on a consistant, but differing basis depending on the type of "Application of Petition" being submitted. ie, certain petitions are accepted based on postmark while others are accepted based on entering them into the USCIS's system.

The one thing we can all agree on is our desire and the need for USCIS, et al, to be much more precise in their instructions and documenation at each step in this journey. And to have a specific mechanism to be able to get a 'confirmation of understanding' or 'ruling' that customers can rely on USCIS to stand behind.

May I ask you where you got that quoted item? The reason I ask is that I know in the Philippines, other country police clearances are required if the applicant was in that country for 6 months or more since age 16. The 6 month timeframe applies to K1 visas (which it looks like you are applying for). The 12 month timeframe is for other visa types.

Maybe this is a embassy specific timeframe, but I thought it was uniform. Anyway, just wanted to point it out.

Well, I think we would buck the trend of the other responders above and would trade our K1 ticket in for a IR1/CR1. but, our situation is probably unique as I have been spending most of my time here in the Phiippines with TinTin during the K1 journey. With any luck, we will be finally heading off to the USA this month (fingers crossed for our Embassy Interview this week on 4 April). If all goes well, our RFE-less journey will have taken 10 months. We definately had a bit of bad luck hitting the worst part of the "bubble" last summer when filing the application.

You also have to be careful interpreting those numbers. USCISlike to quote processing time from 129 submission through THEIR DOCUMENT APPROVAL (NOA2). This is only 1 milestone along the timeline to get your fiance to the usa. After NOA2, you have the NVC processing time, then the local embassy processing time, then the medical interview and then the embassy interview and then the visa issuance. Ge the picture??? VJ Timeline is a good way to get an OVERALL TIME ESTIMATE. - the one that matters to most real customers.....how long from time of filing the 129 will it take for my fiance to be here in the usa with me.

For us, we filed July 5, 2007 - TinTIn will arrive in USA late April, 2007. So our "real processing time" => 9 months. We had no RFEs and no "non standard" delays. Just the time that the Government's process took to run in our situation. (which was rediculously too long....<sigh>)

But one thing that you might want to ask your hubby and think about, is he claiming through the Veterans Affairs for medical benefits for his PSTD or does he have some type of disability claim for it? They might look into that when they are looking into your hubbys income and stuff. Not that I know, but from what I have researched is that they want to make sure that you will not be a public charge.

I wouldnt worry to much about or stress over it. I feel depressed too since it is the holiday season and it sucks not to have my hubby. But we are getting close to finally living a life together. Hopefully. I wish you luck and hope that all goes well for your family. blush.gif

For cases with problem documents (I also have undergone court procedures 1994 for my BC and everytime I request a copy from NSO, they still have my old BC), the NSO will not have copy of the annotated documents. For this cases, the applicant should go to the LCR and request for an endorsement letter with the new BC and the court's decision. At this point, request for more than 1 copy since their data base will not have the annotated forms. Ms. Hufana (I think she's the Asst. Director for region 3) told me annotated/problem documents usually gets into their system after 5 years or so. So this will cause problems when the applicant will try to get a copy, since they will still be getting the old documents without the annotation.

LCR don't forward documents (annotated) unless the applicant requests one, especially for those with correction of entry. Hope this info helps.

You may not have time, but it will be better to have it done while you're still in the Philippines and have your documents properly corrected and annotated, since you maybe needing it for future use. When I was at NSO, I requested for 3 copies.

oh dear! i have exactly the same problem on my BC. i already filed a petition for the correction of entry on my name in the BC in the LCRO in Cebu City. The registrar said it will take max 3 months to have the NSO file updated. Based on your experience, seems like the NSO file doesn't really get corrected until after 5 years! Gosh the system here in the Philippines really sucks!! To think that this error was also made by the clerk in the city hall and now we, the victims, have to correct the error they made and we have to suffer all the consequences!!! It really sucks!!!

I guess the only thing we have on our side now is prayers. Let us just pray for a miracle that the USE will approve our fiance visa application despite these discrepancies. Anyway we have done our part in correcting the name on the BC, so maybe they might consider that? I still prayers can move mountains......so let's jsut pray.


Yes the Philippine systems suck, but you dont have to wait 5 years. After the LCR sends corrected docs to NSO main, you can go there in person and get copies of the new annotated BC. The issue is if you want to get your BC copies from one of the regional nso offices, many times, they will not have the annotated version available. So you should take Helen's good advise and get many copies when you go to NSO manila.
