Your embassy asked you for specific things to submit then follow it. If in your interview they ask about money or support, you can or can't tell them.
The CO will know if you are being honest with your purpose.
Us too, we depended on VJers help throughout our journey.

My job offers me a certain flexibility to not be in the office all the time. All I need is an internet connection and I can do my job.

I was thinking about going to the Philippines for a few months to help my fiance get ready to move to the U.S. once we are approved. I could support her during her embassy interview, getting her all of her things in order, etc., ect., ect.

At what point in the process do you think it is "safe" to pack up and go to her country? After the NOA2 has been received and her embassy interview scheduled? Wht is the last thing I need and should look for here that tells me it is safe to go and be there for her?

Any thoughts would be greatly appreciated.

But she does have final divorce documents from Japan. She has filed to have those documents recognized in the Philippines (the Philippines don't have divorce and all foreign divorces must be legally recognized in order to get remarried in the Philippines. We plan on marrying in the US) That was the point of the consulate officer was trying to tell her. Just bring your marital record, divorce decree from Japan & since you are marrying in the US that is all you need.

Sorry but that is just not the case. You must prove at petition time that both parties are free to marry.


We had applied for a tourist visa (since we are still waiting the judge to rule on her "Recognition of Foreign Divorce" case. They denied her but the interviewing officer told her all she needed to do was bring in her Philippine Marriage Certificate and her Japanese Divorce decree and she would be "good".

If there is a requirement to have her Japanese Divorce legally accepted why would the consulate interviewer tell her that? I saw someone post in another of my posts

My fiance lives in the Philippines where there is no divorce. We are in the process of getting a divorce to a Japanese citizen obtained in Japan in 2006 to be recognized in the Philippines (she was married in the Philippines and have petitioned the court to recognize the Japan Divorce of 2006 to amend her marital status).

We started this in Oct 2008, refiled in Family court in Jan 2009. After many delays and hearing (the last in Sept 2009) we are simply waiting for the judge's ruling. Her lawyer states the delay is due to the number of cases ahead of us. So we wait.

Here is my question....

When, during the whole K1 Visa process, is the marital status of both parties checked? She has her divorce documents from Japan.
I was thinking that IF this won't be a problem until the US Embassy (Manila) interview, we could submit our I-129 now to get the 4 month processing done then just wait to schedule her interview until we are sure the judge has ruled.

Any comments or assistance is appreciated.

Greetings Vjers!

My fiancee filled out and signed her G325A form and sent it to me via FedEx. She shared her form with me before she mailed it but I missed an obvious mistake. In her employment section she forgot to list a period of unemployment that occurred between her current job and the second one listed. Although she only has 3 jobs she used all 5 lines in the employment section due to the length of the Company name and address (see example below)

The question is, what now? I would like to submit our package this week. Here are the options I can think of...

Option #1
Should I use white out or correction tape on the first 2 entries, so that I can hand write her current job to make it fit in the top line and unemployed in the second line.

Option #2
I could add "Unemployed" under Job Title and the dates under Start and End dates of the second line even though the address contination is in the beginning of the second line (see below).

Option #3
I have a set of blank G325A (the previous form) that she signed on my last visit to the Philippines. There is no way I can use a PC to fill these out and will have to fill them out be hand (I did this and sometimes I had to write VERY small).
Since her forms were on the previous form (still acceptable) I reprinted mine using the old form.

Has anyone used white out or correction tape on their form?

I was lamenting that Nik and I weren't on track just one year later.

I mean, not only is 10/10/10 great (even a guy can remember that date!!) but 101010 in binary is 42, and it's just at the end of the 42nd week of the year - and for a crazy Douglas Adams girl like me, it would just be so great.

But, in the end, just getting married was more important. Besides, I bet most of the good places are already booked by now...

For everyone: in my opinion, calling a guy " who sends money" to ( who they think) their fiancée a STUPID is ridiculous. It's not being stupid of him, the girl is just taking advantage of him. She is too smart to fool him. He trusts her :lol:

When we were in the process of our K1 ( we've met) I asked my then fiancé to send me money every month. I said I couldn't take care of myself anymore. I gave him the breakdown of my monthly expense and he trusted me. But he didn't know that I was saving up the money for the future :) so when I came to the US I have the money with me which helped us for my AOS. I would say, I tested his trust on me that until now we don't talk about financial matter. He knows everything is in good hands :)

Divorce is not allowed in the Philippines and divorce secured anywhere by a Filipino is not recognized in this jurisdiction. If you’re a Filipino, it doesn’t matter where you get a divorce: such divorce is invalid/void in the Philippines. This is because under the nationality principle (Art. 15, Civil Code), all Filipinos – where they may be in the world – are bound by Philippine laws on family rights and duties, status, condition, and legal capacity. In certain instances, however, a divorce validly secured abroad by a non-Filipino may be recognized here in the Philippines.

Is there a legal provision that recognizes divorce in the Philippines?

Yes. On 6 July 1987, President Corazon Aquino signed Executive Order No. 209, otherwise known as the “Family Code.” Article 26 of this law, which took effect on 3 August 1988, reads:

All marriages solemnized outside the Philippines in accordance with the laws in force in the country where they were solemnized, and valid there as such, shall also be valid in this country, except those prohibited under Articles 35, 37, and 38.

On 17 July 1987, Executive Order No. 227 was signed into law, amending Article 26 of the Family Code, among others. Article 26 now reads:

ART. 26. All marriages solemnized outside the Philippines in accordance with the laws in force in the country where they were solemnized, and valid there as such, shall also be valid in this country, except those prohibited under Articles 35(1), (4), (5) and (6), 36, 37 and 38.

Where a marriage between a Filipino citizen and a foreigner is validly celebrated and a divorce is thereafter validly obtained abroad by the alien spouse capacitating him or her to remarry, the Filipino spouse shall have capacity to remarry under Philippine law.

What are circumstances that would make Article (Family Code) applicable?

We have a basic discussion on Article 26 of the Family Code. Included in that discussion are the two elements that must be shown before the second paragraph of Article 26 is applied:

There is a valid marriage that has been celebrated between a Filipino citizen and a foreigner; and
A valid divorce is obtained abroad by the alien spouse capacitating him or her to remarry.
Is this provision applicable to former Filipinos?

Yes. Article 26 was later interpreted by the Supreme Court to include cases involving parties who, at the time of the celebration of the marriage were Filipino citizens, but later on, one of them becomes naturalized as a foreign citizen and obtains a divorce decree. The reckoning point is not the citizenship of the parties at the time of marriage, but their citizenship at the time a valid divorce is obtained abroad by the alien spouse capacitating the latter to remarry. (Philippines vs. Orbecido III, G.R. No. 154380, 5 October 2005).

Article 26 provides that the divorce must be secured by the foreigner-spouse. What if the foreigner-spouse continually maltreats the Filipino/Filipina spouse, isn’t it unfair that the Filipino/Filipina can’t initiate divorce?

It may be unfair, but that’s the law, consistent with the State’s policy of not allowing divorce for Filipinos. This doesn’t mean, however, that the Filipino/Filipina has no other recourse. If the circumstances fall under the grounds for annulment/declaration of nullity, then the marriage could still be annulled or declared null and void from the beginning.

If there’s already a divorce validly secured abroad (by the foreigner-spouse or the Filipino spouse who became a foreign citizen, losing his/her Filipino citizenship in the process), can the Filipino spouse immediately remarry?

No. The existence of a valid divorce decree, however, does not automatically entitle the Filipino to remarry in the Philippines. The foreign divorce decree must be judicially recognized in the Philippines. This means that the proper action or petition must be filed in a Philippine court. For purposes of re-marriage, the divorce validly secured abroad is not automatically recognized here in the Philippines.

Isn’t it enough that I already forwarded the divorce decree to the Philippine Embassy (or the Department of Foreign Affairs) and the National Statistics Office (NSO)?

No. The foreign divorce decree must be recognized here in the Philippines; a process which may only be done through the courts.

Why should we waste money in filing a petition in court for the recognition of the divorce decree?

This is the requirement of law, unfortunately. The divorce decree must be proven, just like any fact, in court. The presentation of the divorce decree is insufficient. Proof of its authenticity and due execution must be presented. This necessarily entails proving the applicable laws of the jurisdiction where the foreigner-spouse (who could be a former Filipino) is a national. One of the requirements under Article 26 is that the decree of divorce must be valid according to the national law of the foreigner.

I am looking for those who has actually used NOA2 and MNL case# for medical. Please only reply if you have done this from experience and not just because you heard it's true. The USEM website says only Appointment Letter to bring so that's why I am trying to confirm this. Thanks!


You should have at least the interview date. Print the letter that the embassy would email you when you set you interview date and use that plus your passport. You can set your medical a week or 2 prior interview just to be safe.

Problem ko 3 months lang kami nagkakilala ng fiancé ko tapos engaged agad nung first visit niya ditto last april 2010.

Meron bang katulad ko dito na sitwasyon or short courtship lng then file agad ng K1 Visa. Pls tulong naman oh! Lakas lng kc talaga ng kaba ko at worried na worried ako. Confident nmn ako sa fiancé ko dahil alam ko ang lahat tungkol sa kanya kc open nmn kami sa isa't isa pero yun nga lang minsan lng talaga hindi ko maiwasan ang mag worry. Every night nlng halos di ako makatulog hahayy…fear ko lng kc baka isipin nila na visa lng ang habol ko which is really not. Hindi nman sa pag mamayabang, maganda nmn sitwasyon ng family ko at ng sarili ko. I am independent. Ka gagaling ko lng ng korea for three years at semi conductor ang trabaho ko. kahit piso nga wala akong tinanggap sa fiancé ko kc I am fine naman and my family.

We know that when have tax transcript no need for paystubs , emp cert . Are there among here who did this sending originals tax returns? Does the consul really ask for the original tax returns of the co sponsor because those infos are all there the SSS # and everything...Pls help. We started to print all those tax returns they emailed us here but some here advised they might ask for originals the consul....


I think copies of tax returns and w2's are fine.

That sucks about her job not remitting SS payments and not providing health insurance. In my case, since i was the oldest i also help out all my younger siblings to go to college. Gladly they able to finished their studies. I ended up going to college and working full time. My younger sibling finished college earlier than me. We are 5 and when i started my schooling I was on the same level as my youngest sibling. I hope she'll be able to sort it out. I admire her good heart. I don't wanna comment about the family, you can't correct the mistakes of the parents by looking at their faults. Though she refuse about getting money from you.. you could send her gifts even simple once to ease her burden.

I think that's how things goes sometimes in Filipino families. We ought to help our siblings if our parents can't afford to do it. It's part of the culture. But she can make choices but sometimes it's hard to think things just for ourselves. She might feel guilty if she won't help because she feels responsible for her sister and her family. Try to learn more about her culture and what she believe.

Congrats! She need to attend CFO seminar and have CFO sticker on her passport. Package letter contains brown envelope, visa and passport.

PhilippinesMiddle Name Changed on Marriage Certificate

When I married my wife in the US they said that she can change her middle name on the marriage certificate in the traditional Filipino way. Meaning that her maiden name now became her middle name with my last name.

Before our marriage and on her original birth certificate and passport / Visa she had a different middle name.

Now here's the big question: When we are filling out our AOS forms now after marriage shouldn't we use her original middle name as on her birth certificate and passport Visa ?

or the new middle as reflected on our marriage certificate ?

I used the name that i signed on my marriage certificate. The traditional Filipino way. My maiden name as my middle name now and my husband's surname as my last. I think would not be a problem, because you would be submitting a copy of your marriage certificate with the AOS packet to support that. I used my new name on my SSN as well. Posted Image
