Maybe you should get married in Paraguay, file the CR-1 next year and then when you complete your service you both can return to the US to live as man and wife. The other option is to have your fiance apply for a tourist visa to visit the States with you.

You have to be engaged and have proof that you have met in person within the last 2 years. The duration of the relationship is not as important as having proof that you are actually in a bona fide relationship and you intend on getting married to each other upon arriving in the US.

I think it depends on who gets your case. I imagine that one "case" officer upon finding a mistake or omission would stop right there, issue the RFE and then put away the case while another might just go through the rest of the documents to see if everything else is okay.

In the first case, after you send in your RFE and it is reviewed, if that officer finds another problem then another RFE will be issued. If there is no problem then your case will be move forward.

In the second case, the officer would just be waiting on your RFE response to move your case forward since he/ she had already gone through all documents initially.

a letter from your employer stating that you are due back at work on a certain date, a return ticket, and pack lightly if you can. most from the UK dont seem to have any real problems but you can never guarantee entry. just be honest when asked questions and you should be ok.

I think the bigger issue is getting stronger proof of a bona fide relationship.

Regardless of what rights your son's father may or may not have, your son is not leaving the US so I don't see how this has a significant bearing on the application. Your son's father's existence doesn't prevent you from marrying or getting engaged or bringing your fiance here.

After a denial, some people choose to build a stronger case and refile while others choose to fly to the beneficiary's country to get married and go the CR-1 route. Either way work on your evidence.

I think it's different when the father is unknown or not listed on the birth certificate. Does your son already have his passport?

Was the first guy who was arrested for rape the same guy she was trying to petition in this thread? If so, she is beyond help. And yes, the CO was spot on. Getting him fingerprinted will help a lot in preventing him from using the system some how later on. If not, then she got engaged to another guy in like 90 days? Some one help me out here.

Oh, that man ain't getting here anytime soon. That's why he was denied. IF he got an interview date and then rescheduled, the petition wasn't cancelled. This is disturbing in so many levels!


She said she actually cancelled the petition in the October topic so at the very least (if she was being truthful then) she must've made contact with USCIS about her concerns.

I just don't understand...

Is it possible the visa denial has something to do with what you wrote 60 days ago? Did you take action to cancel the petition? Was the Consular Officer aware of the arrest or your intention to cancel the petition?

I cancelled my petition because I've learned that he was charged for rape and indecent behavior. Thank God I dodged a bullet. Hope his #### rots in jail. Next time I wont be so hasty. You really have to get to know a person before making such a drastic step. i feel very relieved.

The K-1 of 'fiancee' visa is for persons who intend on getting married in the US within 90 days of entry.

You could still get married in May but file a CR-1 instead after which would allow her to move here permanently.

If you just want a visa for her to visit you, she would need to apply for a tourist visa though.

Her entry will be solely at the discretion of the CBP officer when she arrives. It is possible though. Some people have been allowed entry with a pending petition, others have been turned back.

You could submit either the K-1 or CR-1 while she is visiting. She would return before her I-94 expires and wait the remainder of the time in her home country.

You could visit her while she waits or she can chance a visit to you.

Newbe, you sure are correct. My fiancee is from a Big City and I live in a rural area. Also she is from 80 degree daily temp city whereas we have snow and 15 degrees here. Not a nice welcome for her.

She complains alot about not being able to walk to a store and see lots of people everywhere like in her city.

She does not seem to have any interest in getting the green card as others keep saying here.

She tells me often that if I do not want to marry bring her to the airport and she will go back to her country.

She has meet my family many times and tells me she loves to spend time with them.

She has always been in independent girl and I think she is having a hard time adjusting to living with me. She keeps telling me to give her time and she will adjust . Right now she treats me more like a good friend then a fiance.

This woman has changed A LOT. I dated her for more then 2 years and she was an angel in her own country.

She is very friendly for example makes me dinner and lunch and cleans the clothes. But she does not seem to show love. I ask her about it and she just says she needs time to feel comfortable here.

someone mentioned she is entitled to 50% of my things, income? if we get married? What about a prenup agreement? Does that not prevent her from getting 50% of everything?



Why would you want to marry someone who is simply like a roommate who happens to do chores around the house? Actions speak louder than words. If she's not showing love there is the possibility that it's because she's not in love.

I'm not trying to be harsh. I'm just trying to let you see the situation through an outsider's eyes. You clearly love her but I always say love is a two-way street and you are obviously having doubts regarding whether you really should marry her.

Tell her you'll book a ticket for her to go home and you'll work on your relationship from there then re-file. See what she says after that. See what she does.

Excellent advice - I hope the OP takes it. I remember the tone of the former post and it was not good.

Granted, there are always adjustments that a newly arrived fiance must make, but to just up and leave without any notice does not bode well. When you add in ALL the cell phone activity with other men, that's inexcusable.

I wonder if the OP's fiance did some research while gone and found out she needs to get married to adjust status. :whistle:

I really hope it works out for you... She came Nov 15 and you have 3 months from that date to get married... As a K-1 visa holder she can only get married and adjust through you with certain exceptions. If she doesn't marry you, she has to leave after the 90 days. If she marries you and it doesn't work out, there are ways for her to adjust on her own.

:ot: My advice is, do some research on how former K-1s adjusted without the help of their spouses and re-read the former thread you posted.

I kept my maiden name and this was never an issue. Never came up during AOS at all. If anything, it made things easier since I didn't have to run around changing my name on other documents.
