Document your calls to them and be sure to call back Thursday to see what they can do for you. Thousands of people per year come to the US to get married.... they don't need a visa to do so. Think destination weddings. USCIS has nothing to do with the POE. It's always up to the CBP Officer. They have the ultimate say-so on who they allow to enter the US. The OP is not saying they are bypassing the immigration route. The are doing things legally.


They cannot see an application at the first point of contact. But if the OP brings a copy of the application and is honest about it, that is always a good sign to them that the person is going about things the right way.


...I'm not sure about this last part because if the OP shows a copy of a K-1 application which is filed but not yet approved and then in the same breath tries to enter on a VWP or B2 while saying she's there for her wedding this wouldn't make sense to a CBP officer. Applying for a K-1 visa shows the intention to immigrate through marriage. He would have no reason to believe that after entering on the tourist visa to marry that she'd go back home. Although some persons have been allowed entry under these same circumstances.

I think attempting to change the wedding date to maybe November or December while its still early is preferable.

No no not the embassy I said there is a private office close to the embassy and it does all the paperwork for a fee he the owner of that office has 20 years experience in filing application on behalf of people for a fee , I wanted that office to do all the filing work and he was the one who said that he has files waivers application to the embassy and said that I should say its fraud and file a waiver

No, you don't have to be wealthy, you just have to be willing to give your money. Who knows what he was told he was giving the money for. I know of someone who was giving money to his 'wife' because he loved her and wanted to be with her, but she was just playing him to have someone support her. He was just a manual laborer, so he had very little money. However, for her, it was just a business arrangement, and nothing more.


Interesting...but the OP said the broker was the one getting all the money. It would be more understandable if he was giving the money directly to his wife to "support the household" or as an "allowance" or for some "sick relative"

We're not saying it's a joke. Every action or omission in life has a consequence. When you're in a relationship where it is reduced to paper and the legitimacy of that relationship judged by a stranger then things that wouldn't even usually matter in a ordinary relationship can be seen as red flags or complications. (When I say ordinary relationship I mean one where both parties are citizens of the same country residing in their home country).

A visa is a privilege, not a right. A visa is granted by a CO based on his/ her discretion. In the exercise of that discretion, the CO is allowed to go over every detail of your past and your fiancee's past with a fine-toothed comb to determine if your relationship is bona fide.

A fine-toothed comb will not be needed to discover your previous marriage to a USC and the ties to "marriage broker" charged/ convicted of "selling" immigration benefits. That is a big glaring red flag. Probably at the top of the pile of documents in your A# file.

Three years is a long time to be with someone. Noone here can discount that. However, you have a few hurdles to overcome. The application fees you speak of sound expensive but look at an immigration attorney's retainer and fees as an important and necessary investment in you and your fiancee's future.

You have a long journey ahead of you. If your intentions are truly pure, I wish you all the best.

I am not being judgmental but I just can't imagine a situation where a USC would knowingly enter into a fraudulent marriage with an immigrant who wasn't aware. I would love for the OP to explain, if he so chooses, what he thought he was giving money to his ex-wife or some other third party to do... and how much money...

In any event, I strongly urge the OP to retain an experienced immigration attorney.

You are right about it being a strange question. Your current wife filed a CR-1 11 months ago, you aren't even divorced yet and already you are making plans to marry another USC who you're going to meet for the first time in person next summer? You don't even know if this new relationship will work out but you are already making plans to file a new CR-1... and you want to change your name on the documents to be submitted for this purpose... How does it sound to you now that I've put it in perspective for you?

Changing your name for the reasons you've stated is fraudulent. Your face will be the same when you send your pictures. Your fingerprints will be the same. Your parents' names on your birth certificate will also be the same...unless you plan on asking them to change their names as well.

The first interview was tough in your opinion and the second one will be even tougher. You have to overcome a lifetime ban and that statement you claim was made under duress will most certainly be brought up.

You need to get all your facts and dates straight, sit down with your lawyer so you can go through all the facts again with him/ her and your husband should accompany to the interview.

Make sure your lawyer is experienced in immigration law and in particular waivers, previous denials etc.

My official Final Divorce Decree was only one page which is standard issue in my country. It was signed by a judge and carried the official court seal and stamp. This was accepted when we filed (without resulting in an RFE) and at the interview.
Without seeing it, the document you have should be fine.

The copy of my divorce decree I sent in was accepted Girl from Celebes so I'm assuming the RFE gets sent out in cases where they're not sure if the Divorce decree is missing pages, final or if the copy sent in is not clear enough to be read. (These are merely assumptions though)
