Hello Twisted K,

How did you manage to get a date in January from Delhi Embassy? I am trying to find dates through the VFS website and every time I fill in the details (State of Residence (Haryana), Language, Purpose of Visit etc.) and click on continue button, a pop box comes up and says me to try back in 24 hrs. This is going on for past 4-5 days with me. I thought that January dates are not opened yet, but seems you got one. Can you help me out on how to schedule a date. Thanks in advance!

what type of visa did you apply for? if it is a k1 or k3, then you will have to wait for delhi to schedule your interview. it is for cr1 or ir1 you will have to contact nvc.

Actually, that is what we thought as well. But, you don't pay the visa fee at VFS. You pay that during the day of interview, just before you are called in for your appointment.

why are you upset with people that have spent years studying the immigration process. you came on here for help, but the ones that know what they are doing, you get upset with. would you rather have them lie to you? or did you come here for truthful guidance? people cannot always tell the emotions when it is in a typed form. but it seems like you have taken things too seriously, and are trying to back up the fact that your husband came EWI. i have also worked as a volunteer with several people who have entered this country illegally as an ESL teacher.
if you are going to just get upset every time someone says something you don't agree with, then you are going to have an interesting life, to say the least.

in the delhi office 90 percent of the ap gets sent back to the states so i dont hold much hope

K1 is considered a non-immigrant visa, therefore, $131. if you were applying for cr1/ir1, these are immigrant visas, and the cost for the application is $400.

My fiance recieved the regret letter also with the other box checked, but it says "your case is being returned to USCIS for further adjudication. What does that mean???????


sending your case back basically means they did not believe in your relationship. it is a denial on the embassy level, but they know that only USCIS has the last say, so they send it back. uscis will review, and since it is a k1 case, they will either re-affirm, or close it out due to expiring of the i129f. if the case is originally VSC, they have been known to sometimes reaffirm. if it is originally CSC, they have been known to let the case expire.
so, depending on why your case was being sent back, will let you know how to proceed. good luck, and just a quick note. i recommend reading the pinned topic at the top of MENA on returned petitions.

I dont know if this will help but I will tell you of our instance. We were in AP due to a minor technicality. When my fiancee went to submit information as requested the consulate would tell her nothing and mostly were rude. However when I personally went on the days alloted for the USC, I was treated very well and was given the information I requested and an explanation of what had happened. In our case it was only that her fingerprints were not readable when transmitted to the US and she had to resubmit them. They would not tell her this but told me and explained everything to me. The only thing they could not tell was how long it would take to fix. In the end it was two weeks then we received the visa. There is advantage if it is possible for the USC to make the request in person. I feel there is some injustice to the way people are treated at the consulates also. I feel I received preferential treatment over other USC who were not caucasion. I do not believe this is correct or fair but based on what I witnessed and the others I talked to I believe it to be very true.

I guess in a nut shell what I am saying is that there can be advantages to the USC personally visiting the consulate if possible but there is still no gaurantee. It is very frustrating and I have much feeling for those who have been in extended AP. I wish you the very best and hope you may receive some answers soon. Hope I am not making things more confusing :wacko:


in the OP's case, no additional information was required. it is just a limbo AP like my case. the waiting sucks, to put it mildly.

honestly, it is not likely to find out the real reason for a denial, as the COs are not obligated to tell you. you will just have to go through every detail of the interview. yes, it is very common for them to have their minds made up before the interview. in 2008 when my then fiance was interviewed, they already had his 221g ready requesting the additional information. it was because of this 221g that we were able to figure out they were denying us for the lack of relationship evidence (which we really didn't have a lot back then). so when i filed for the cr1, i went into overkill on the evidence department. and this time, i am proud to say, they have told us over and over (embassy and DOS) that they do not need anything else from us.
some people have applied for freedom of information act (FOIA) and the ones i have talked to all said it was a waste of time, as it takes several months to get an answer back. you can try to get your senators to find out, but as was stated earlier, immigration is not subject to the legislative branch.

you have the right attitude, and i believe you will be successful :thumbs: know that there is always other options. if you haven't already, i still recommend reading the pinned topic on the MENA forums. if you post on there, someone who has been through this will answer. especially kiyah. she is the best. she went through this and is willing to help any and everyone. also i contacted marc ellis. he is on here as ellis-island. he is a great attorney who has helped many get through this. although i did not retain him, he did answer general questions. i know many people on here have retained them, and they are all with their SOs today. keep up the fight :yes:

i agree with the above. keeping your passport is a very positive sign. it usually means they think it will be a short ap. if they thought it would be longer than 3 months, they would have never kept it. they may just be doing document/background checks. they kept my husband's passport at the interview, and his visa was issued 30 days later.
