we filed for the k1 and got denied. after more preparations, and sending over 11 lbs of evidence, plus a marriage license, we were approved the cr1 visa. he is home with me now. so, although you did not make it to the interview process, i highly recommend going into great detail (pages if necessary) explaining why you did not continue with the k1. when i filed, i sent in a 5 page affidavit detailing our relationship and timeline. i also included affidavits from his side (india family and friends) and affidavits from my side (family and friends).

once you get past the posts of wanting it pinned, there is some good information. many people have gone through the same heartache and have overcome, and you can too good.gif
have your husband contact marc ellis, he is on this site as ellis-island is his profile, and a darn good attorney.
lastly, if it does come back to the uscis, then, since you are already married, they will issue you an NOID (notice of intent to deny) or an NOIR (notice of intent to revoke). they will give him a certain length of time some 15 some 30 days to respond. so make sure you have gathered all of the additional information to form a great rebuttal to their findings. marc is highly recommended, and has done several cases on returned petitions. if you do not use him, make sure you find someone who is well-versed on the subject, and has evidence to prove they have dealt with the situation before. when we had our petition returned, our previously hired attorney came clean and said he has never done any case like ours before. so again, make sure they know what they are doing, or you will be wasting your time. you are in a delicate situation, and time is of the essence. good luck in your process. i am a firm believer that love will find a way good.gif

sorry to hear that. did they give you a specific reason? have your husband scan in the sheet they gave him. contact your senators' offices. see if you can get a second interview, etc. if it does make it back to USCIS, then you will have the opportunity to rebutt the consulars findings since you are married. an opportunity not afforded to engaged couples.

Hi - my husband and I went in for our interview on Dec 23, 2009 and we were placed on Admin Review for six weeks. At that time the embassy will either tell him that he has the visa or he doesn't have the visa. If he doesn't get the visa, what are our next steps? I'm not sure what else to do. I contacted a lawyer and she did say that there is nothing I can do now until after the embassy makes there decision. But I want to know if anyone of you ever had to go through something like this and what were the steps you took after the admin review?

since you are married, if the embassy returns your file to uscis, you will have an opportunity to rebutt the consular's findings. uscis will send out notice to revoke/deny to which you will be given a small amount of time to respond. usually 30 days, but i have seen as little as 15 days. so in the event that your husband does not get his visa, i would strongly suggest you start gathering evidence to back up your file.
i do hope that he does get the visa, because if it is returned to america, then there is no specific timeline they will get to your file. good luck :thumbs:

Thank you, when I said it hasn't left the USA, I meant that the petition has just been mailed, and should be on it's way to California. My husband is moving on Sunday. I will try to notify USCIS. He has already filled out the DS-3032 and 230, I can use white-out to correct the address, i guess. He has already signed it, in order to cut out time. I also already have his pcc, it was dated for April 22, 2009. Do you know when they expire? I can have him get another one since he still has to mail his original birth certificate to me. while he is at it, i guess it couldn't hurt to have him re-do the 230 and 3032? hmmmm, you have given me something to think about. thanks!! biggrin.gif good luck on your journey good.gif

My husband (beneficiary) is having to move to a different apartment due to some construction/renovation work. We have already submitted our petition, including the g325a's. so would we need to bother submitting his new address since it is still in the USA? and will we have to worry about his police certificate since he is not moving out of delhi? or is it better that once it leaves NVC to submit his change of address? I know last time with the K1, he never received packets 3 and 4, and had to go to the embassy to pick them up.

As far as which visa you want to apply for, fiance or spousal, depends on your intentions as soon as you move here. there are some advantages and disadvantages to both. but, yes, i agree with karin that you can come here, get married, but you have to go back to the UK and wait like everyone else. chances are it will be very difficult to re-enter the usa while your k1 or cr1 visas are pending. you can always have your husband come and visit you if you cannot see another day without him.
vj will help you get through the lonely and hard times. as they stated, we have all been where you are going, at least as far as the separation is concerned. don't get me wrong. there are some difficult days and not so difficult days. for me, the most difficult has been the waiting, waiting, and more waiting.

5. 2 Affidavits of friends who were at our wedding
6. Affidavit from me stating the relationship is real and describing our relationship
7. Copies of photos from different places of me and my husband (about 20 pics)
8. Copies of wedding photos (about 12 pics)
9. Printed copies of a few yahoo messenger conversations and emails (most important ones of our relationship like when he asked me to be his girlfriend, his first email to me, etc. We talked every day on messenger for hours. Do I really need every conversation or would a good assortment from our relationship work?)
10. Airline receipts showing trips we took together or to visit each other

We don't have anything in both our names because we have not been able to do that since he does not have a SSN yet. So is there anything else I'm missing? I'm starting to second guess myself and nerves are setting in and I don't want to miss anything.

Oh, and a question about the I-130. I'm not sure how to answer question 22. "Complete the information below if your relative is in the US and will apply for adjustment of status......" He still lives in Canada and only comes here to visit. Do I need to fill this out, or can I just answer N/A? Is my thinking correct that since he maintains a residence in Canada that he doesn't need to file for Adjustment of Status for a CR-1 visa or am I really confused? helpsmilie.gif

All they need to do is ignore the I-129F petition when it gets to the consulate and respond to all NVC document and fee requests for the CR1


Thank you! She was really stressing out. I am not completely clear on the K3 process. So they don't ask for anything at NVC (separately from CR1?) I gave her the links on the CR1 and K3 flips. She can just not go to the K3 interview? Or would she have to go to both? I hope that eases her mind.
