K-1 Fiance(e) Visa Process & Procedures	Fiancee failed interview test, what to do?	it may be time to consult a good immigration attorney. if he is going to refile, he has to prove their decision was wrong. it will be a long process to say the least. my husband's original interview was on november 12, 2008, so next month it will have taken a year. since i do not know why they think it was a sham, and for immigration purposes on your brother's case, this is why i say get an attorney. some people recommend marc ellis (ellis-island). i did not retain him, but he was very helpful in advising me what our options were. good luck to him it is devastating (to say the least). K-1 Fiance(e) Visa Process & Procedures	Fiancee failed interview test, what to do?	is that the only thing the 221g said? did they ask for additional evidence? what part do you mean she failed? did she not know the basic answers to the questions? first advice is to contact the senators and see if the case is actually still in cambodia, which will be the best case scenario. the next step is to contact a reputable immigration attorney with experience and documented evidence that they have been successful with returned petitions. our case was sent back in december 2008, and reached uscis on february 4, 2009. we got a response on july 15 that our case was expired and to refile if we so desire. the embassy asked us for additional documentation on our 221g and when we could not provide it, the sent our case back for "further review". K-1 Fiance(e) Visa Process & Procedures	I 29 f sent back for revocation	i agree with MENA, we didn't wait either, because like i said, i heard it takes years. we were told they received our petition on feb 4. i got married on may 12, sent our petition on june 29 (noa1) and on july 14, they cancelled our previous petition, sending the letter, but by that time, they already had our i130. cr1 is a better visa than k1 by all means anyways, so u can look at them as doing u a favor in the end. K-1 Fiance(e) Visa Process & Procedures	I 29 f sent back for revocation	when my i-129f petition was sent back to the usa, i was told under no circumstances to withdraw. it is like admitting guilt when you did nothing wrong. you have to find out why the embassy originally denied, and do everything possible to overcome, then you can refile. if they sent it back because of expiration, be careful, but vsc has a tendency to review and reaffirm lately. csc, let ours remain expired. it was sent back from india because we didn't have enough evidence proof. so after we got married, i filed the i-130 with over 11 pounds of evidence. if you do decide to get married, your k1 is completely invalid. csc sent our letter stating our petition was expired and we could refile within 5 months of receiving. vsc has been known in the past to take years. good luck in your decision, and God speed edited to say, i picked the brain of attorney marc ellis who is well-versed in returned petitions. i did not hire him, therefore, could only ask "general" questions. he is known on vj as ellis-island. If it's taking between 80 and 110 days and we started our petition now on april 07, does that mean that i'll probably be getting my interview in october? That's very depressing I've seen so many in Nebraska with a 4 months average, do you think it's going up now from 4 (average) to 6? I've seen cases of 3 months between i129 and interview in rio. Touched means that USCIS did something with your petition - it was looked at by someone, for some reason. K-1 Fiance(e) Visa Process & Procedures	MISTAKEN FEES	Hey Guys, May be someone could tell me whats up with my case now.I don't know what to expect anymore... Here is what happened: My I-129f was sent FEB.22nd, BUT made a mistake...i did not know that the fee was now- $170-, because on the Form i printed out ,said we were suppose to send $165. Then,on march 17th i got a letter saying "Notice of Action" in it, but talking about the wrong fee.So at the same day i re-sent the documents with the right amount of money. Five days later, the money was cashed out of my bank account,and so far nothing else happened. No other documents were sent to me. So, my question is: Was that my NOA-1???What am i waiting for now??? I apprecciate if anyone could tell me anything at all about this!! Thanks. If the money was cashed and you received the NOA1 i think everything is ok. You have to wait for the second NOA. So if this process starts taking too long maybe he can come see me again, we're trying to save money tho, this whole K1, AOS process is expensive for us, plus he has his job, he can't leave friday night and come back sunday night, if he comes he has to stay at least a week, otherwise it's not worthy. K-1 Fiance(e) Visa Process & Procedures	K1, G-325	hi everyone,my fiancee and I filled in I-129 and G-325, but after we found that we did a mistake in the G-325 four papers,the question is :in the bottom of every paper of those 4 ones, there's "this form is submitted in connection with application for : Naturalization Status as permanent Resident Other (Specify) so i had to choose one of them,i chose the STATUS AS PERMANENT RESIDENT, i did that in the all 4 papers.but after when my fiancee were reading infos in this site and saw an exemple of the G-325 she found we did a mistake in that,when i saw the G-325 (http://www.visajourn...Form-G-325A.pdf) i found that in the 1st paper i have to choose : Other (specify) and wroe the I-129.... and in the other 3 papers i have to mark the : Naturalization . Is this what i have to do or there's something else .thank you You have to put other and specify, what you did was wrong. Don't send to them like that. It's best for you to do all over again and send it right, than send it wrong and they return to you, that'll take a lot of time and it'll delay a your process. Good luck! Until this morning I was planning on getting married here in South Africa in September, my US fiance was going fly here, get married, and file our paperwork - IR1/CR1. But then I got a return phone call from the US embassy, and was told that we can't file the I-130 papers here as he is not a permanent Resident, or studying etc.. So now I am screwed, what do I do? What visa should I file for, how should we do things. Please help, I am such a mess right now, it's not even funny. Haven't seen him since the day he proposed, which was like 2 hours before I borded the plane to fly back to SA. I know that some of you have been apart alot longer, and I'm sorry.
