Wow, this waiting is enough to drive anyone mad headbonk.gif I know my waiting time just seems long to me, and it has only been 1 year, 2 months, 3 days, and 10 hours since I last saw my baby in the New Delhi airport. So I was wondering what was the longest time anyone has waited before their fiance stepped on American soil?

QUOTE (milo75 @ Mar 14 2009, 02:17 PM) <{POST_SNAPBACK}>
My limited understanding with the OCI is that at some point your husband would have had to been an Indian passport holder???

This is the verbage from the Ministry of Home Affairs - A foreign national, who was eligible to become citizen of India on 26.01.1950 or was a citizen of India on or at anytime after 26.01.1950 or belonged to a territory that became part of India after 15.08.1947 and his/her children and grand children, provided his/her country of citizenship allows dual citizenship in some form or other under the local laws, is eligible for registration as Overseas Citizen of India (OCI). Minor children of such person are also eligible for OCI. However, if the applicant had ever been a citizen of Pakistan or Bangladesh, he/she will not be eligible for OCI.

To me that reads that they had to have been an Indian citizen [or eligible for Indian citizenship via birth/family lineage] prior to requesting the OCI - not a citizen of elsewhere looking for status.

It's been my understanding that for a non-Indian-origin spouse [someone who can't claim thru their own parents/grandparents a link back to India] the only option is the PIO.

Plus, my SO knows I'm only using him for the PIO card anyway biggrin.gif .

Same here, Milo, same here laughing.gif

Asia: South221g is favourite for New Delhi Embassy
I am sorry to hear about your situation. That is heartbreaking rose.gif. The way I see it, you can try to submit the documentation before they request, it might help to move things faster. It is up to VFS if they decide to take it or not. If they say no, then at least you will have it ready to immediately file when they do send the 221g. good luck good.gif

Yes, he hired an advocate, that is how we got the information. They said that is the way to bypass the 30 day waiting period. So much redtape, it is no wonder people try for K1 first. But the embassy limited our options by returning our case. Oh well, water under the bridge now yes.gif

Thanks Arun good.gif I got the NOC letter when I was there in February. The court said it was good for 6 months, but to be on the safe side, I will get another one the week I get there. Yes, we are going to court right after we get the certificate from the Arya samaj. The courthouse told us that they will need something in writing, along with 2 witnesses, affidavits, along with proof of identity to register our marriage.
Good luck on your interview!! Keep us posted. Maybe if you are still in Delhi by May 12, you can come to our marriage yes.gif

Thanks, I am just sad I can't get anyone in my family to come, although they have all agreed to write affidavits. He is trying to see if someone can also videotape so my family can enjoy. Lol, my best friend suggested I bring my laptop and a webcam, so they can watch it online tongue.gif

Well, everything is set, bought my tickets last night. He has arranged everything with the temple and Pandit. We will have a traditional Hindu ceremony. I am excited to have the mehndi done. i am hoping to borrow a sister's video camera.

Asia: SouthGetting married in India...
The original petition was denied for lack of bona fide relationship evidence, which is why we want to overload with the i-130, no excuses this time wink.gif.
Yeah, he is a wedding planning machine, I don't know how he is doing it all, but I just talked to him, and he is going to the temple near his house. He already arranged for his family to come into town. One of my sisters were going to come to the wedding when we were getting married in September, but since we bumped it up 4 months, she doesn't think she will be able to. One of the reasons for the bump also was because tickets are so much cheaper now. I could not believe the prices for April and May. I have promised my mom that when he gets here, we will have the wedding we have always planned. Since my family is unable to attend, that is my main reason for having their affidavits. It will be a small intimate wedding ceremony so nothing elaborate, maybe we will have a bigger party afterwards. It is just hard to want to have the big celebration when it is with people that I barely know, besides his family and friends that I have met on previous trips.
Thanks for all the input yes.gif Keep them coming!! Good luck Sara on your upcoming nuptuals. It just blows my mind that you have had to endure this difficult wait headbonk.gif
I am still a firm believer we will all be with our loved ones soon. Nothing is going to stop us.

After much discussion with my fiance, different attorneys, family members, and friends, we have decided to get married in May since CSC will not review our expired K1 petition we filed in April of last year. Upon my return we will file our I130 for our CR1 visa.
Does anyone have any advice for us? Anything we need to be aware of? I know I will have to address our K1 petition when I file the I-130, not a problem, since I plan on using this time to insert my rebuttal and include additional evidence, including the evidence from the fatal 221g that the embassy requested.
So far we are planning for the Arya Samaj wedding since I am unable to get a 30 day leave from work. We will take that information to the court within a few days so they can process our civil marriage certificate.
What am I missing? I will change my last name on everything when I return. I will make him the beneficiary of my 401k. I have a letter from my apartment manager that she is aware of our intention to live in my apartment. I will have affidavits from both sides of the family. My banks will not allow him to be added to any of my accounts until he gets here, but he is checking into adding me to his Indian account. We will have plenty of pictures. I have kept every single receipt and boarding passes from my February trip.
I can't help but wonder what else I will need since this is not an original filing of a petition. Can anyone see what I am missing? blink.gif

All those things you listed looks perfect. One thing make sure you have pictures of all ceremony because at the time of interview consulate officer will ask for it.

Wish you best of luck with the process!!!!

Thanks, Waithatter, again, congrats on your recent approval yes.gif

thanks Arun and Catie! it won't be long now. i actually packed yesterday, i am usually a last minute (as in a few hours before i leave, scrambling to get everything done) kind of packer. but i promised my fiance and my mom both that i would actually pack earlier, lol. they both think i am crazy when i wait so long, hehehe. i am looking forward to this. i am also looking forward to get the ball rolling again after feeling so stagnant for so long. it has already been over a year since we blindly applied for the K1. if we knew then what we know now, lets just say we would have planned better yes.gif but all things MUST work together for good, and it is not in our hands, but God's. we believe that He is the one who brought us together in the first place since neither of us were "looking" for a relationship in 2007, the relationship found us wink.gif please all, keep us in your prayers. we are praying for you yes.gif

Thanks VJ family. I appreciate your supportive thoughts, and well wishes. Yeah, I remember how hot it was during this time of year. We are planning to go back to the mountains for our honeymoon as soon as we get our marriage registered we are "running away". I did go shopping this weekend to look for cool casual clothes. SO EXCITED!!! Just hoping that I can get there on time this time since last time I was delayed a day. I didn't really schedule much rest time. I arrive on Sunday night, and we are getting married on Tuesday. No time for error or bad weather no0pb.gif
