K-1 Fiance(e) Visa Process & Procedures	planning to visit fiance	take it from someone who is still kicking themselves for not being there for the interview, please go for that instead. being an american citizen, you can probably get in without hassle. although you may not be able to actually be present during the interview, your fiance can let them know if they have a doubt, to talk to you directly. when i went to india this past february, i just had to show my passport and the reason i went to the embassy, and i was able to pass by everyone in line, and get right in. not sure about s. korea, but yes, hindsight, being at the interview is a great idea, and may help to show your seriousness	Twisted K	Female	India	2009-03-05 10:25:00

The first thing you need to do is CORRECT the reason you were denied, which means you need to know what it is in order to fix it. Unless the reason the you were denied was that you were not married (not possible with a K-1) there will be something else you need to correct. Getting married does not make any other problems "go away". Agreed We sent in 11 pounds of paperwork showing bonafide proof to overcome our obstacle. For example, if it was denied and sent back for being expired, then it depends on the service center. Ours was sent back because of lack of evidence, and it was expired. Since ours was from California, they have sent us an expiration letter, which, much to my surprise, took only 5 months and 11 days to receive. Now, I know someone who was sent back at the same time, for the same reason, but to the Vermont Service Center, and their case was revalidated and sent back to the beneficiary's country. I said all that to say, it depends on why your case was sent back. And also since you were sent back to Vermont, you may want to wait to see if it gets re-validated, because VSC is on a roll. Honestly, we did not wait, but lucked out that CSC has let our case remain expired, and advised us to refile if we wish	Twisted K	Female	India	2009-07-28 13:53:00

K-1 Fiance(e) Visa Process & Procedures	My fiance has been denied his visa and I just found out I am pregnant	I echo talking to Marc Ellis, although I did not retain him as my lawyer when we refiled, he was very helpful in answering my general questions. He will want to interview you and your fiance. But as far as the NOID, you will not normally get this letter with a fiance visa, it is mainly used with the spousal. We never got a chance for an NOID, but simply a letter from USCIS stating our case was basically dead and we could refile if we were so inclined. If/when you do decide to refile, make sure you are prepared to address the reason for your K1 refusal. Also, Marc will tell you to never, ever, under no circumstances, to withdraw your I129f. I read in your original post and it says that your US Immigrant visa was approved. So have you become a citizen since 2002? Otherwise, that is another can of worms, so to speak, as only USCs can apply for fiance visas. If you are an LPR, then you can get married and bring her otherwise. K-1 Fiance(e) Visa Process & Procedures	RETURN TO SENDER	i agree with the above... he can't send her home, but he doesn't have to follow through with the marriage, and she will be out of status after the 90 days. as far as being able to file another i-129f, there are discrepencies on whether or not he will need to write a waiver for the IMBRA law. the law clearly states if 2 or more petitions will require a waiver. but some are having to file a waiver with the 2nd petition. also, it depends if he files it within 2 years of the first. if my recollection serves me right, i believe he will need a waiver on that too. but i have not been in that situation before, so i am sure someone will be by to correct my recollection	Twisted K	Female	India	2009-08-12 13:19:00

You just have to provide what they asked for. if nothing else is wrong/missing/incomplete, then she will get the visa. i am a witness that they do not ask for everything that is required before the interview. you have to be a mind reader ahead of time. the consulates do take into their own hands and vary country by country what is required. heck, in india, the requirements are different from consulate to consulate. the good part, she wasn't denied on the spot, and they gave you time to fix what needs to be fixed.
