He can come and visit you for as long as the VWP allows (assuming he has that).  He won't be able to live in the USA until he has an appropriate visa allowing him entry to do so.

 

If it was that easy - everyone would go to the USA to await their visa. smile.png

 

How long have you been living in the UK and on what visa?  I'm curious as to why you're not doing DCF.

 

I've been living here for almost 2 years on a 2 year spousal visa (not sure the exact name for it). I have the option to apply for a long term visa here and then eventually citizenship but we both realize we would rather build up a life in the US.

 

We didn't do DCF because I didn't do my research and didn't find this place until much later! 

 

I'm so homesick but at this point I think I would rather be with my husband than not so the bad news is we will just have to ride this out and the good news is we are together and can both work at least until the end of January.

First let me say I hope this is in the right forum! My husband and I are living with his parents and the living situation is deteriorating quickly and we don't have many options of where to go while we wait for the approval. We received our NOA1 June 10 but looks like we could be waiting well into next year just for the NOA2.

 

My question is, is it possible to move to the US and have my husband wait there? I understand he wouldn't be able to work but our living options and my job prospects are much better there and it just makes sense to go back as soon as possible.

 

Any advice is greatly appreciated!

So, we will leave Part 6, 13.a - 13.c as it is because those are the numbers listed on his tax transcripts but he will send us copies of the past 6 months of pay his pay stubs.

 

Also, I'm getting him to send us a copy of his biographic page of his passport, should this be enough to prove his citizenship?

Hello, I'm my husband and I currently live in the UK, I am the petitioner and he is the beneficiary. Our family friend is our joint sponsor since I have been living in the UK for the past 2 years.

 

Our sponsor is married and they have no children so his household size should be 3, correct? On Part 6. Sponsor's Income and Employment he has listed his individual, annual income as $50,000 which meets the poverty guideline requirements for a 3 person house hold size.

 

This means there is no need to list his wife's income, correct?

 

Also, on Part 6, 13.a-13.c where he needs to list his total income, it should just be what HE earned in those years and not he and his wife together?

Hi Mayb, Can i ask (as i am about to do the same), how long after you sent the letter to cancel the i130 did London accept and process the i130?

 

Does London just need to send the letter or do they need to "see something on the system"? I was just wondering as it could take USCIS a while to cancel and for London to see it!

 

London advised me they would not approve our petition with them until the one in the US was cancelled but I went ahead an mailed London a copy of our notarized letter requesting to have our US petition cancelled and London approved ours a few days later! So in short I think they may tell you that they have to see it cancelled but in reality I think they are just looking for your intent to cancel it. 

 

As far as I'm aware our petition is still live in the US despite my letter requesting it be cancelled having arrived over a month ago.

thanks for the suggestion on sending the copy of the NOA1 sent it and a letter today, over night was £49 so we opted with the £6 option of having it arrive within 5 days.

Yes I reside in the UK and I meet the requirements for DCF through the London embassy. Everything is inline for my I-130 being approved in London except that my petition needs to be cancelled in the US. I originally filed in the US because I did not realise DCF was an option at that time.

 

The USCIS has many offices, so where should I send the request to withdraw my petition to?

I filed an I-130 in June and it was sent to the Overland Park Kansas office.

 

I decided to file another I-130 at the USCIS London Office as that process is moving much faster than the U.S. right now. Despite being advised by both offices that I didn't need to cancel my US petition I received a Notice of Additional Processing Requirements stating that in order for my London I-130 to be approved I need to cancel my U.S. I-130.

 

I assume I will send the request to withdraw my U.S. petition to Overland Park? Also, does it need to be notarized or just signed?
