Hello all...

I am sure this has been asked before, but I have searched and searched and have not been able to find a definitive answer... so I apologize in advance and appreciate any responses.

I am a Canadian and am planning on marrying my American boyfriend.

I have been looking through all the visa's and I feel like the K-1 is the best route to go, but....

I've always wondered if it is possible to just go down for a "visit" and get married one weekend and stay permanently in the US while we file all the paperwork. Is that possible? is there a different visa for that or do they all require me to return to Canada and wait out the process.

I thought I read that you could stay before, but I can't seem to find the site I read it on and everything that I've been reading now seems to be the K-3 which sounds like I have to go back and stay in Canada.

And if it is possible for me to stay while all the paper work is being hammered out, would I be able to apply for a SSN so I can work right away?

I truly appreciate any answers to this... It will help us decide the route to go.

At what point do you pay this one? I did see the other day that this was reduced, but am I confusing this payment with non-immigrant visa fee of $141? . I sent the USCIS $340 in aleady and my packet has been sent to Bangkok from the NVC, but in Packet three, it only says: APPLICATION FEE: Each K Visa applicant must pay in Thai baht the equivalent of US$141.00 non-immigrant visa fee, which is non-refundable, at any Thai Post Office. Please mail in the receipt, which is valid for one year.

Is the $141 in addition to the $240? and if so, at what stage do we paay it?
(or is the $141 just wrong?)

I was curious about that as well, but after some digging I found a post. The $240 is what you take with you to your interview and it pays for the visa..... hopefully I read that correct.

They go by gross income. The forms do not ask how much you owe out. They only care about what comes in. His household size will include his children, even if they are not living with him. Himself, any dependent children under 18, any other dependents he claims on his taxes, plus you: http://www.uscis.gov...form/i-864p.pdf
They will go by the I-864 guidelines and instructions, even when using the I-134 at the K-1 visa interview because you will be needing the I-864 for AOS after you are in the US and married.


A breakdown of the fees is as follows, but this list does not include the medical fee(approx. $200) you will need to pay:

USCIS - I-129F Petition Filing Fee: $340.00

DoS Visa Application Fee: $350.00 $240 as of April 13, 2012

USCIS - Adjustment of Status Fee: $1,070.00

USCIS - Removal of Conditions Fee: $590.00

Total Immigration Fees for Receiving Your 10 Year Green Card: $2,240.00

Since the K1 visa is the route we'd be taking... I'm just trying to get a couple questions I've had regarding this process hammered out.


When it comes to the financial part... how heavily do they weigh on that. My fiance makes a decent salary, but currently pays a good portion of it in child support payments and that causes him to live somewhat month to month at times. Will that reflect negatively on our application?

Also I know that the cost seems to vary.... I'm wondering if someone would be able to expand on them. It seems that what I've read it's anywhere from $1200-$2000 and I'm curious if anyone has a break down of the expenses...

Thank you for any assistance... I just feel like I've read so much and it's making my head spin

Hello there, sorry for what I think might be a stupid question... but I'm seeing conflicting instructions regarding the service centers.

When looking at the VJ guide, it directs us to the TX address, but then I saw a different page that said if the Petitioner is in KY send it to Vermont... I just don't want to send it to the wrong one and cause a delay.


again sorry for buggin ya's about this, we're just prepping to do the I-129 in the next couple weeks and I want to have all my bases covered and have the questions answered that I may be confused about.

Hello All...

So I was just told by my roommate that he intends to move in with his Girlfriend late summer/early fall and that means I will be moving from this address.

My question is, would it be completely wrong to use my Aunt's address who lives in the same city when filling out my I-129 and other forms (in May)? Since at this time, I have no idea where I'll be living.

I'm just afraid of having to go through address changes especially when it could be around the time when the NOA2 could be approved...

Any pointers would be greatly appreciated.

I will be heading down to KY next week to visit my fiance and we're going to start / finish our paperwork for the K1. On the I-129 form it asks if your fiance is there while filling this out and then wants info from I think the i-94.

Well I"m Canadian and don't need anything like that to enter the US, so if we put yes i am there.... I can't really finish that line of questioning other than when i'm leaving.

Any idea what I should do regarding this?

When going over this form, it asks for Mothers maiden name, birth place etc and current location. What if my fiance doesn't know where his mother is? She left when he was a child and he has only seen her a hand full of times and the last time was 10 years ago.... Guess? Is it ok to use where he thinks she is even though it might not be correct?

They will write to you and tell you what it is you are missing, we also forgot to send in copies of passport pages and copies of entry and departure stamps, they also requested letters from friends and family, this delayed our case by a month, personally I would wait for them to contact you, you could send them in now but I guess you prob don't have your reference number yet so it might prove hard to match up their end.




Doesn't it say a copy of the petitioners Birth Certificate OR passport copy?

or am I missing something, cause we never submitted any copies of passports... all it said to do was copy the front and back of his BC.

I would say yes. I started looking into the same thing here in Canada and it's advised as it costs money getting it done from the Dr doing the medical here..... and free at the Health Unit

There are also vaccinations that you can't get all at the same time..... ie. Hep B is a 6 month run..... but that's only for ages up to 18....


When doing research for here, all I need is a tetanus and flu shot :) hopefully it's as simple as that for you.

So probably a weird question, but I have been traveling back and forth from Michigan to Canada every month since February to visit the love of my life. I have a Michigan Enhanced ID card that allows me to travel between the two countries without an actual passport.

For purposes that would make me feel better (because I don't have actual passport stamps to prove meeting) and I just have a feeling an RFE is on its way to me, is there anyway to get proof that my Enhanced ID has been swiped at the border? The dates and times that I have traveled.

Does anyone know if I were to stop in the customs building at the border, would they be able to give this to me? Or is it not even worth it?

My fiance has visited me once when we met my family and friends in March, so he does have a bus ticket. But because we are visa exempt with Canada, there are no passport stamps in his passport either.

Is this something they take into consideration? I mean, I have pictures, parking stubs from various places we've been together in Canada, texts, emails, FB messages, Skype records, gas receipts for when I've gotten gas in Canada on my travels...etc. Do you think this is enough? Should I been getting notarized statements from family and friends saying they know that we've met and that our relationship is bonafide?

Just trying to get my ducks in a row for when its time for interview and/or an RFE comes our way!

When filing the I-129F, I submitted the G-1145 for notifications on our approval/status changes. However, I've since gotten a new phone number. Should I make an account on the USCIS website to reflect that? I want to know ASAP when we get approved, and my email hasn't changed, but just curious if I should do that. The idea of a stranger receiving a text message about something so personal and official with my personal info seems odd. They did mention as I was going to make a profile earlier that they do not want duplicate accounts, and I wasn't sure if the G-1145 would be considered an account with them. I'm an early/mid August filer so, I could really happen any day for us Imagine.

It is because we got rejected and we had a co-sponsor. So now, we're gonna go thru with CR1/IR1 Visa.


I was actually surprised that the CO asked me to find a co sponsor, he was not smiling in the beginning and when he said that my fiance's income is not enough i was already shaking but when i heard the magic words "co sponsor" i hurried in giving him all the documents we have prepared, and as per Hank's advise i also had i864 ready signed by both my fiance and his mom. But the i134 seemed to be enough for the CO. I am really thankful that we were approved. I think the CO looked into 125% of the poverty guideline because i am pretty sure we hit the 100% mark. I believe it varies on the CO that would handle your case. I heard there were some that were not allowed to have co sponsors and others just hit the 100% and got approved.

hi I just finished my interview today and what i was asked was the most recent 1040 and w2 my fiance's income accsg to the CO was not enough so he said i need to find a co sponsor good thing that i have his mom's signed i134 and most recent paystubs,1040 and w2, after looking at the docs i submitted for about 2mins he said everything is good and I got approved!!! Praise God! always be ready with documents!! i was lucky that i was armed with original documents and photocopies that can support the petition.Thanks to all the VJ'ers help :)))

Did both of your kids tested positive in the TST? What is the induration of the TST of your 2 year-old?

 

My child(2 yr old), his TST reading was 17mm and Chest x-ray was negative at SLEC in July. No history of TB or even known exposure to persons w/ TB or primary complex. I was just confused when we received our passports w/ the US visas, my child's passport has an annotation of, ' Class A or B (TB) req ATTN at USPHS POE'.

 

I visited my son's pediatrician, she told me that my child may have been exposed to TB but the doctor also doubt it since I am the only caregiver of my child since birth upto now, no yayas. My xray at SLEC is also negative. She advised me to get another chest xray for my child after 3 months, now, it is still negative.

 

I am just worried of what will happen to us at our POE in SFO next week. I hope someone can shed light on this matter. The ones that I read here are old threads, 2008 and 2010. sad.png

 Their TST reading will be this Monday, Oct 21, 2013.  I am a bit worried because my 2yr old has this big red mark on his arm where the TST was inserted.  I am hoping we don't encounter any problems.  I am hopping you could update me too just in case I would have the same problem. I'm praying the Medical results are okay.

my daughter will be given 4 vaccines while my son will have 6.so far they didnt give us the option not to take the immunization. Good luck on Monday. I hope it's our last day on Monday. It's been very stressful waiting for so long. My monthly period is such a hassle i only need to finish my physical exam and immunization because they want to make sure there's no more spotting hopefully we get it all done on Monday.

I called the US Embassy Manila Immigration Visa Unit and asked them if it matters if it's typewritten or handwritten. they said as long as it's legible and no erasures it doesn't really matter. Just make sure all forms are filled  out specially the parts where you need to mark as NONE or N/A. Do not leave any fields blank, 

The tick boxes that needs to be marked x make sure you have them all filled out. 

 

If you've double checked them try making multiple copies and ask someone to proof read it again just to be sure. 

When we are anxious and excited we tend to overlook a few details and we can't afford to do that now. :)

What i did was fill out the DS-160 online and all you need to do is print out the Confirmation page that you have completed the DS-160 form online. That's if you made the appointment after October 7, 2013.

How many dependents does he have? If he he doesn't support anybody then you coming over woyld only mean 2 members of the household. If he lives with his family but but doesn't fully support them or spends for any of them then he currently should have 0 dependents. If he pitches in for the house bills, I still reckon that he only supports himself with 0 dependents. How many people does he support fully currently? That's the number of household members he has.

   He has 1 dependent, his 11 yr old daughter that was living before in the Philippines and his ex wife and him agreed that he gets full custody of the kid so she was just in the US last July 2012. We have a 2 yr old son and I have a daughter.  I think now I am more scared if we need to meet 125% because I thought we are already good with the recent increase he had but i am not sure what else to do but to submit all necessary forms and documents and we'll know by Oct 30.. 

I'll just keep on praying.

sorry for the late reply and the confusion. He has 1 kid from his first wife and i have 2, one is my daughter and our son so technically it's him and his daughter and me and my 2 kids. Im a newbie here and i haven't figured out much how to do timeline and all but for now we are already scheduled for interview on Oct 30. 2013.

 

Good news is that his hourly rate changed from $12.85 to $13.60 and would only reflect this coming Oct 25, would that be good enough?

His mom has filled out form I-134 and has given me her form 1040 and W2 for support just in case they would agree in accepting a co sponsor. 

 

I am a bit relieved but still nervous. Our immigration attorney has not replied yet which makes it more annoying because she doesn't seem to be aware of the changes in the K-1 document requirements,.

Would there be any way for me to get approved on my visa interview if my fiance's W2 shows he doesn't meet the income for household of 5? He earns  about $25,784 annually and it requires that he has $27,570 for household of 5. Is there any way his mom be a co sponsor since they live in the SAME household. I've read that the US Consulate in Manila does not allow co sponsors for K1. What do we need to prepare?

 

I want to cry now..i called the Immigration Visa Unit and they said it will just be denied bec of insufficient income and that i'll be public charge..I don't know what to do anymore..We even have an immigration attorney, if we get denied we just wasted money for nothing... :( Help please...
