Can you get onto the USCIS website and check the status of your case there? It'll confirm that you are at vermont.

Very strange that you should be transferred from Cali to vermont.Especially with the volume of work Vermont is dealing with. I am wondering if there was a print error.....

What state does the petitioner live in? Was the petition definately filed at the correct centre to start with? Sorry to ask obvious questions, but the transfer is odd.....if that is indeed what has happened.

I hope you get home for summer too. I know Vermont is slow at the moment, but I have gleaned from this site that the two service centres take it in turns to speed up and slow down. Lets hope 2009 is the year Vermont gets it act together.

Well Im sure you had a great time in the states and now back to reality...yeah alot of people have been getting approved. As for me, Im not really in a rush anymore considering I just found out im almost 10 weeks pregnant! That means that even if I do get my NOA2, I wont be able to complete the medical due to the chest xray??? So now I will have to wait to do the xray after the baby's born which is around mid august. If thats the case and all goes according to plan, then Im thinking of stopping work around July then move to the states once the child is a few months old. Either way, i cant really be too anxious about this NOA2 now blush.gif

There has to be a way around the Xray thing. There are quite a few VJ-ers who were on K1, pregnant and had to do the medical. Perhaps a delay of the Xray until you go to remove conditions??!!??! Mind you, depending on how quickly vermont were to process the ap, im guessing you would be ready to pop by the time you even got to interview.

For 3 days last week i was a bit annoyed. I had just sent Dave home and was looking at these people getting approved and feeling a little bitter.

But there is just about nothing that can be done. Then Kevin up there had to go and be all logical (thanks Kevin smile.gif ) and now I'm trying not to think about it and I am certainly not torturing myself by going over to those threads anymore.

It's a long way off.....but then i think of how quickly the last 40+ days have gone, and that there is so much to look into and sort before we can be together....and it gives me hope. Hope that this process wont be as long and drawn out as i imagined. Also....if they approved us to quickly...i would be in a panic! I have some serious saving to do!!!!

We are able to look online and see our case if that is what you are referring to. Nothing has happened with it yet besides the check (cheque where im from but im attempting to adopt americanisms) being cashed and the NOA having been sent to us.

Hey! welcome back from Hawaii!!!

Hope you had a blast! I always wanted to go to hawaii, mebbe one day as a citizen I may skip on over and drown myself in a few waves...

Well we got our NOA1 which was nice. Dave opened up the mailbox and screamed like a girl apparently. He said his hands were shaking, he was so excited. He's framing it, and took a picture of himself with it for me biggrin.gif

I managed to access the website with no problems and set up a portfolio to look at the case. I wish i didnt know the reciept number off my heart already....its gonna be a long few months till the NOA 2..

Dave is going to be here in a 2 and a half weeks (soooooooooo excited) so the NOA was a lovely xmas present to get before the main present I asked santa for arrives on a jet plane. biggrin.gif

Grrrr....i want it to be April time already...I cant wait for an end to the wishing away of my life until the next time I can be with my big friendly giant fiancee!

As someone who's been there and done that.....it's incredible how differently you look back on the process once you are with your spouse.

Igor's list is a wonderful tool. But staring at it used to give me stomach ulcers....especially when people who filed after me got approved. After a while, I would have to restrict myself on how often I looked at that list.

She has good reason to back away from you. What happens if after she arrives, she does something to displease you, and you decide that she doesn't warrant your support in adjusting her status. I think your capable of that. If you can threaten to pull the visa because a gift doesn't arrive on V-Day, I think your capable of pulling support for AOS when she doesn't answer her phone immediately, or doesn't tell you every day how grateful she is for you.

How old are you both? Some growing up needs to happen here before a real relationship happens.

This thread has given us soooo many good ideas. We started reading a book together on Friday night. It's been amazing. It had gotten to the point where I just wanted to spend time with him without having to force a conversation. Since October 2008, I feel like we've talked about EVERYTHINGGGGGGGGGGGGG. BUT this has given us great ideas on how to "hang out" without actually being in the same place.

As for those of you who have a huge time difference, I apologize if my initial post came off in the wrong way. I was having a moment of weakness and frustration and didn't mean it to come off to insensitively.


So glad it worked out for you! I tell ya, we stumbled on to watching the movies together and the sense of normality it added to daily contact was so helpful. There is only so much to talk about, especially if that is all you end up doing for months and months on end.

At this rate, you might actually want to talk to him by the time he gets off the plane :)

What a lovely place this is. People who are happy being screwed by a bunch of Nazi wannabees in our government can write about it here, but those who want to sound off about how said wannabees are ruining our lives are told to shut up.


This thread (after an initial ###### fest and back and forth of "my life is worse than yours, no mine is" conversations) had turned in to a place where people were making helpful suggestions on how to pass the time during the wait and as you often do, you came, you saw an opportunity to REALLY drag the entire conversation down and left your "me me me" stamp all over the joint.

No one is happy about being screwed by USCIS, not one person and your self centered and very short sighted if you believe that to be the case.

As part of being an adult you recognize that sometimes you cant have what you want when you want it. Sometimes you have to wait your turn and sometimes you have to suck it up and realize that whilst wait times are completely ridiculous, you made the decision to engage the immigration process and until you are approved..... you can sail through visa journey turning everything to muck OR you can be a big boy and actually consider some of the suggestions your peers have made.

Really consider them.

To watch movies together, we used to find the relevant link....click....and count down. Try sidereel.com for some inspiration. Or we'd go and rent a movie and click play at the same time whilst having google voice chat open. I'd do just voice chat with him whilst watching and it was great. We'd get to laugh at the same moments, cry at the same moments.....most of the time it would encourage incredibly random conversations and we'd have to press pause and have a talk about what we were watching. Totally dorky....but it added a sense of "normality" to our relationship.

We also used to log in to yahoo games, set up a private room and I would kick his butt in poker whilst talking smack to him about what a crappy hand he must have. Talk is great, but sometimes something else is just what the doctor ordered! :-)

We had a 5 hour difference and that was bad enough. 16 must be very stressful!

How did we cope? Well, I have to admit, during the period of wait I had no life outside of work and David. On weekdays, I would get home from work, eat....and then retire to my bedroom to talk with him. On weekends, I would use the time difference to my advantage and get everything done I needed to do before he woke up. Then, we would spend all day talking, watching movies together (1,2,3...then press play!) he would read me to sleep, leaving my video open whilst he went about his business. We lived and breathed for one another, spending every second we could.....talking, laughing, FIGHTING!!, all the normal stuff. Sometimes I resented him being so far away and having no independence during the long wait. Mostly, I just could not wait for the day when we could just sit in a room together. Not talking. Just being together.

In fact, when I first arrived, I told him not to talk to me anymore. We'd talked enough!

That seems so far away now. The key seems to be to look to the future during the wait. I know him better than any man I ever spent time with because of the time spent talking. It doesn't matter that people tell you this, because the visa wait is like purgatory.....but once on the other side, you'll tell others during their wait that......it. will. be. okay.

And the record, I would have used every family connection I had to speed up the process. The other side of the coin is that.....the wait strengthened our relationship and to this day makes us realize just how much we love each other even when we are biting each others heads off. Many relationships do not endure the visa process. Ours did. Life is gooooooood......full of the stresses of all relationships.....and goooood!

average time, according to the timelines listed on the links above, are 220 days...so roughly 7.5 - 8 months. But it may take longer or it may get through quickly. It looks like it'll be tight. I know he's planning a visit in April or May...but my question was more along the lines of having the party anyway since everything is booked, and a sort of mock ceremony, then sending him back, therefore not breaking any rules.
Either way..it's too early to panic about it. I suppose if it comes down to the wire, we'll consult the lawyer who helped look over everything and see what he says.


Unfortunately your lawyer will be able to do nothing to expedite your case. It's a waiting game sadly. Currently, if you are filing at vermont, it is taking a long time to process app's. California is a lot shorter. Where you file is dependent on the state that the petitioner lives in.

Like you suggested though, a mock wedding would be nice to go through.

Provided your fiancee has no problems on arrival into the states.

When he does come to visit you, tell him to volunteer honest but sparse information about why he is visiting. A couple of people on here have been denied entry at POE because they were a little to open and honest about their reasons for visiting (I'm here to see my fiance is one that raises flags wink.gif) I always go with.....I'm here on vacation.

I take it you haven't received an RFE yet? I'm not sure a lawyer would be of any assistance at this point. Basically, when you omit information from your petition, USCIS will contact the petitioner and request that the missing information is submitted.

Can you check the status of your case online? Have you contacted USCIS? It could be that they have not begun to adjudicate your case yet and therefore have not even discovered that the information is missing. Sadly cases are not always completed in the order they are received and some may slip through the net.

First thing I would do.....call.

Hmmmmm...your petition has been waiting a while. When was the last time you contacted them? If i were you, i'd stay on top of them. Call again. And consider getting your local representative involved. Sometimes a jolt from the right official will assist USCIS in seeing the merits of processing your case. Your over the magic six month mark now and whilst USCIS cover their butts by saying they are still processing April petitions....a rep might help move things along.

I feel for you guys. It must be hard to see other people being approved and wondering why nothing is happening with your case.

I take it you haven't received an RFE yet? I'm not sure a lawyer would be of any assistance at this point. Basically, when you omit information from your petition, USCIS will contact the petitioner and request that the missing information is submitted.

Can you check the status of your case online? Have you contacted USCIS? It could be that they have not begun to adjudicate your case yet and therefore have not even discovered that the information is missing. Sadly cases are not always completed in the order they are received and some may slip through the net.

First thing I would do.....call.

As long as the flights are running, I will be taking that trip over to America.

The current mortality rates that result from infection dont worry me. You are only slightly more likely to die from contracting this flu, than you are from any other flu.

What I worry about is my loved ones falling foul of an automobile accident, something that is far more likely. I guess the reason I would never let this infection stop me from travelling is that you only live once, and if I worried about everything that is likely to kill cause grave illness to me and my loved ones.....I would never get out of bed.

Filed, did a few more trips and I arrived here in July and got married on a beach with 2 witnesses and then went for a nice meal with our friends. I received my engagement ring 5 months after we filed.

Hardly anyone has a "usual" story here. You'll be just fine. Just be ready for her to answer questions about your first petition. They'll probably want to know what happened.

If need be...I can get a co-sponsor.

For you to be eligible for DCF in London you must have been living there for a minimum of 6 months immediately prior to filing the petition and have leave to remain there. This means at present you are not eligible to do so.


4) Is the process more successful/faster utilizing a lawyer?

NO - unless you have a complicated case a lawyer is not going to expedite your petition. In fact a number of people on this site have employed Lawyers to their detriment - things hadn't been completed properly..etc.

I'm really happy you decided to stick with this Svetlana. I really do think you need to give him some time.

I learned french in school for 4 years, my step father is french and spoke in french to me at home and yet...

It's not until I was forced to speak it in France that it actually really clicked. My french is horrible again now because I haven't been immersed in the language for a long time....but as long as he surrounds himself with English speaking people and you speak to him in English, he will be speaking coherently and understanding the language before you know it.

I speak English, have a Bachelors Degree with honors and still wont be able to easily find a job in this economy. I have to say, I feel very very sorry for this man. I would hope that my husband wouldn't give up on me when I cant find anything.....

It's hard to give everything that is familiar up and come to a new country. On top of this, he doesn't speak the language and is not being supported by his spouse.

I dont know anything about your relationship, other than what you have posted here, but I feel for this guy. Writting down everything he eats and sleeping in the garage? My goodness. I could weep for him. That is really really sad sad.gif Poor man.

Well I have to say...good for you. It seems you contracted the services of a lawyer who is willing to give you a realistic timeframe...many dont.

You have a way to go yet. Hang in there, make plans with your wife, talk of the future and keep yourself distracted with everyday things. It isn't easy, but nothing worth having ever is.

We all understand your pain, being away from a loved one....for a better word....SUCKS, but at this point you are in the lap of the USCIS gods. Keep an eye on the timelines of people who filed a CR-1 at the same time as you. It will give you an indication of when you are likely to be adjudicated.

Just offering up my support to you Mrs Hamilton.

My husband used to smoke weed but stopped about 2 years ago.....it wasn't something I agreed with and he chose me over the weed. It was hard for him to give up as he was a habitual smoker, and I was very very proud of him.

Being honest was very commendable of him, and the fact that he gave up should be applauded too.

Sadly the US government does not see it that way. Good luck with your future visa journey. I hope you and your partner can successfully wait this ban out and be together soon.
