I've noticed there has been a change this year, last year by average it took no more than 3 months for the approval of I-129F petition and the NVC would mail the petition to the assigned consulate the same day they would send the notice that they received it. This year I'm seeing that USCIS is taking more than 3 months to approve it and NVC is taking more than a week to process the case. From what I know, NVC usually stamps the petition the day it is received but does not send a letter right away saying they received it. They send a letter once they do a name check and a quick review and then they assign a case number and then send a letter to the petitioner saying we received your case and assigned a case number as well as sending the petition to the assigned consulate. Now I'm seeing that some procedures have changed. Hopefully in a matter of a month, everything will be clear for those who are stuck in AP

I've almost given up trying to anticipate how on earth USCIS and NVC go about doing what they are doing. I sadly encountered two people on the VSC november '08 thread today, neither have received their NOA 2 yet. One filed before me, one just a short time after and yet I have my visa. How is that fair? I give up. CSC was whizzing by and yet, recently people have been having to wait for ages just to receive a NOA 1 in the post.

Hopefully it will be a max of a few weeks of hold up for you guys. Fingers crossed for you.

I just called NVC to see if I was stuck in AP and the guy I spoke with didn't know what that was. He said it can take several weeks to be sent to the embassy and that the embassy would contact me when they have it. I have been reading that the paperwork is sent within a few days or it is stuck in AP. Would I be wrong in assuming that I was stuck in AP? Or should I wait a few days to find out. NVC got my approval june 12 (last saturday)

When you called NVC, did you ask them date of arrival and date of departure from NVC? When I called, they specifically told me that it had not left, it was still there, and then I asked them why, it was now 1 week and a day past what the NVC letter stated it would be sent to the embassy, and he told me that we were in AP, there is no time limit. and I agree with a previous post, some called this letter, the "letter of lies", because basically in my case it is a flat lie!

I wonder why I haven't even rec a letter from NVC saying that they rec my case. They have it and it's in additional processing. Aren't I suppose to get a letter?

I think you can probably blame that one on the postal service to be honest with you. They tend to be consistent at sending out the letter of lies at the very least.

This letter is inconsequential at the moment to be honest. If you already know you are in AP, the only thing NVC haven't done thus far is tell you they are forwarding on your case, when they clearly have not.

Just asking...
How often did/do you guys call NVC to see if the case has been released? I want to call everyday but dont want to make them mad and hold it longer... whistling.gif

I rang once a week, sometimes twice. You can ring more if you want, but as it looks like the standard time frame is between 30-50 days, that is a lot of calling. I guess I only called once a week because there are only so many times I can stand to hear "yes mam, that petition is still in additional processing"

Sorry - quick edit

I also wanted to make sure I didn't get so hung up on the NVC additional processing stage, that I failed to get on with preparing packet 3. There is so much information to gather for the interview and packet 3 and getting hung up on the processing would have meant I would have been very demotivated to get on with filling out the forms for what was to come.

We were stuck at NVC the end of last year for 53 days. I was beginning to wonder if they would ever send the case on...but they did. Chin up...they will move your case forward..once they work that toothpaste issue out wink.gif

QUESTION: i was checking out your timeline and it appears you were able to get your packets, medical and such and move ahead even while your case was still at NVC stuck in AP! is that what happened or am i reading that wrong? how is that possible? if thats what you did, i want to do that too! at least its better than just sitting still and waiting.

I booked my medical quite a while in advance. For UK applicants, the only information you need to know is the case number provided on the "letter of lies" (as I call it) that NVC first sent out. It differs from country to country though as some require the packet 3 letter to book a medical appointment. Ask for advice with regards to the embassy you are dealing with.

There is probably little point sending in the packet 3 information until your case is confirmed to have arrived at the embassy. Without a case file to marry it up with, the information may get lost.

The best thing in my opinion to do, is find out what you need to supply to your embassy for packet 3 (again, this differs, ask in your regional forum) and prepare the forms. Keep calling NVC and once they tell you that they have sent on the package, allow between 3-7 days for this to be recieved by the embassy. Then contact the embassy and double check they have recieved it. It took a little while for me to recieve the packet 3 letter (again! Some embassy's dont send letters, they send emails - Sydney is an example) but as I had already found out what the embassy needed for packet 3 the day I recieved Packet 3, I sent off what was required of me.

Once the embassy has recieved the file and entered it on to the DB you can send in the packet 3 contents.

That said, I think you should do some investigatory work on the embassy you are dealing with to find out if the above mode of action is suitable for consulate you are dealing with.

Sorry - I realise you addressing Talyss, but I thought i'd be a nosy cow and give you my opinion anyway biggrin.gif

Sorry to see that you guys are in AP.

As Talyss says, it appears to be random. I had my interview today (and was approved) and at no point was the additional processing even brought up.

Hang in there. Between 30 - 50 days is the average time. I know after such a long wait, that this is scant comfort, but there is light at the end of the tunnel.

We have all been there and out the other side. In the meantime, feel free to come here and have a moan.....it really does help when an injustice like this occurs.

K-3 Spousal Visa Case Filing and Progress ReportsHow to Expedite I130 or I129F K3 Visa?
QUOTE (life2live @ Oct 29 2009, 01:36 PM) <{POST_SNAPBACK}>
Currently i'm living with my son who is 9years old in albany, NY. My first wife (his mom) died when he was 4years old. I got married last year. Since I was in Green card, I didn't applied for I130 for my wife. After my status changed to US citizen I applied for her I130 and I129F. My son spent 3 months with her in the summer vacation. He liked her very much and both had a very good time in India. After coming back to USA, he feels very lonely and he misses her a lot and he is not able to sleep well. Keep on asking me, why getting visa is taking so long and why I have to suffer. He is asking so many things about the Visa. And he asked is there any way to expedite this process. I said NO. But he is keep on telling me that there will be some way to expedite this process. He is still not sleeping well in the night and getting up in the mid night and looking for her.
Is there any way to Expedite this process? Pls. help me on this regard.

I can show this site and tell him that ...here is the process and how many of them are waiting... But still don't know how to convince him..

As his father you need to instill confidence in him, and be confident in the information you provide to him. It doesn't sound to me like you are being definitive enough.

Just explain to him, that everyone who is in the visa process is missing their loved ones. Everyone has to wait inline for their turn and that there is no way to expedite it....because you know there isn't... right? It is hard to get an expedite and the only ones I have seen offered are to those who are in active in the military.

Time to be brutally truthful with him.....and by the sounds of it....to be brutally truthful to yourself.

Gawd, is this thread STILL going on?

Some men like tits, some men dont. Some men like hips, some men dont, some men like blue eyes, some prefer brown Some men like em smart, some men like to remain unchallenged. . . . . .

Personal preference is the key here as it is important to most of us that on some level we find our spouses physically attractive, even if it was my husbands goofy personality I first fell in love with.

Waivers (I-601 and I-212) and Administrative Processes (221g)getting ready to resubmit hardship letter
I agree with other comments.

It seems you are placing your husband before your daughter. At this stage in her life, she needs a stable safe background to grow up in. The discrimination you currently face is the kind of discrimination she will soon face as she becomes a woman.

If your husband loves you, then he loves your children who are an immediate extension of you, and will want to see his wife and children safe and happy. Try and return to America and petition from there. Your children need their mother in good health.

You will be in a better frame of mind to fight for this waiver if you are safe. Take on board the advice of those who are trying to help you with the waiver letter.

I really hope you can make things better for you and your daughter in the first instance and then fight for your husband.

London is a low fraud embassy so you are "likely" to be approved...however.

They will never..EVER...tell you whether you are going to be approved until you have your interview. Expecting them to give you an answer now is like expecting them not to do their job properly.

I'm sure you'll be fine, but nothing is guaranteed until the words come out of the CO's mouth. Speculation and expectation are natural, but dont expect a guarantee until 18th Nov.

Good Luck!

I had a brief sight test.

I used to work in an opticians too and it is the standard chart used by optom's. As you have access to charts I would go in with glasses on and see how you do. The sight test was in no way evolved. Just as simple as covering one eye and reading the bottom line of the chart first forwards with one eye covered and then backwards with the other eye covered.

Hi!

Medical was fine. They rushed me through as there was a family ahead of me and I was in and out within 30 mins.

I got told off by the Indian doctor for my occasional smoking but I have to say I found her pleasant, efficient and really easy to talk to.

Everything is fine pending blood results. Although I have to get a tetanus shot when i get to America and have this then transcribed by the infamous Dr Arnold in texas. I would have had to have done this anyway as I was deferring my HPV vaccination because I will be 27 by the time I go to adjust status.

The blonde receptionist was having a good day, as she was really sweet to me and I am happy to report that my Dr was able to confirm something I have known all along.

I am female.

What on *earth* are you talking about? I have NEVER seen a declawed cat, ever - and we are friends with many, many cat owners.

I certainly wouldn't go around suggesting that declawing is the norm - it's not. It's seen as just as cruel a practice here, and I know several vets who won't even perform the procedure.

I had never seen a de-clawed cat before I met my friends cats in September. Both are de-clawed. The first was from a shelter and had been de-clawed by the previous owner. The second had claws, but the kitties would fight and the one with claws would kick the butt of the one without them....so they had him declawed. Apparently that practice is very common in Florida.

I personally would never de-claw a cat. I've seen a couple of rentals where they only accepted de-clawed cats. So i would never move there.

I have had outdoors cats all my life. Never an indoor. Doesnt seem right to keep them in. But we have a gators here and other predators like snakes. So i might have to re-think the outdoor cat idea.

United Kingdomwhy dont people get how stressful this is
I've stopped talking to mum about it now. she looks like she is going to cry every time me leaving is brought up.

I think the thing I found the most difficult was this feeling of having to legitimise my relationship over and over and over to patronising colleagues who couldn't understand how you could possibly conduct a relationship over the internet. The whole legitimising thing, and stigma of having met someone on the WWW often left me frustrated and in tears.

Prima, I think how stressed and frustrated you are at the moment is born out of the fact that things are out of your hands at the moment. I get stressed when my actions have absolutely no effect on the end result. I guess what it boils down to is that I dont like being put in a position of reliance on others.

Hold in there. I know you have mentioned it is hard to see approvals when the K1 situation is yet to be resolved for you. Visajourney is here for the good, bad and the down right ugly times. And this is an ugly time for you. Not bad.....because you will get the pending documentation sorted and you will be issued your visa

Ok, an update: he DID send the packet to the right address, so there shouldn't be any reason why they haven't gotten it. I think we're going to send it again, just incase, and send it recorded delivery this time just to ease my frantic mind...wink.gif

In the original packet, he sent the checklist along with ALL the forms we had downloaded and filled out (some signed, some not, as per the directions). He did NOT send the police certificate, his birth certificate, or any of the I-129F materials. Was this all correct, or is there something else we should be sending / not sending? The info on the actual embassy website is kind of unclear, and he's nervous that sending in the wrong things will delay the processing.

You are absolutely right not to send in police cert, birth cert, proof pf relationship and financial documentation. All of this information is presented at the interview.

All they want are the forms. If you look at the embassy information section for london on this site, then this will give you the list of forms you need to send in and whether to sign or not.

I would give them until the end of the week. The embassy is really busy at the moment with all of those people trying to obtain visitor visa's for the summer season....so they are taking a while to input information. If your still worried send again for peace of mind. I would definitely send it recorded delivery just so you are sure.

Interesting to see how you're all missing Blighty so much. Is it just me that, after living in the States for the last 6 months, and enjoying everything it has to offer, wouldn't go back home in a hurry if you paid me?

Serious question.

I would not go go back home to England if you paid me or in a hurry. Im with you so happier here.

I just miss some of the food. I love it here in Florida. Once I can drive, have a job and my GC, I think it'll feel even more like home because the day to day drudgery can kick in. At the moment I feel like I am in limbo a little bit.

Nope - go back to England to grey skies and pinched pale faces desperate for just one consistent week of sunshine....no thanking you biggrin.gif

Funny - my husband always complains about the bacon & the cheese while he's here...I thought he was being overly-critical, but now I'm not so sure.

My first-ever trip to England is coming up in December, so I guess I'll find out first hand!

Related: I am NOT a fan of Marmite - yechh!

I refuse to believe that ANYONE is a fan of Marmite

MMMMMMMMMMMMMMMMMM Marmite on toast with melted cheese...

MMMMMMMMMMMMMMM.....there is only one problem.

I hate the bread here..uuggghhh too sweet. Ahhh crud, I am having a marmite craving sad.gif

Have you tried Sourdough (California style)? Not sweet at all...the perfect bread for toast. Makes the best cheese on toast, specially if you have English cheese.

Ooooooo! Thanks for the tip on the sourdough! I have tried Potato bread but I hated it....but I cant wait to give the sour dough a go:D

The closest to English Cheese I have found is the Vermont Cabot - Hunters Favourite....the extra sharp is the closest i have come to a medium cheddar and is actually really nice!

And no pothergavel....it's definitely....mmmmmmmarmite ;-)

I'm making my mum bring over Salt and Vinegar chip sticks and some marmite at christmas, the best gifts an english expat could ask for biggrin.gif

I miss proper bacon so much, I'd sell my granny for a back bacon and egg sandwich right now.

rofl.gif

I just sprayed coffee all over my keyboard. You kill me, girl.

Whoops....sorry camie biggrin.gif

I wouldn't really sell my granny. She makes amazing bacon and egg sandwiches. She feeds a mini bacon and egg sandwich to her cat every sunday morning.

I'm just so bloody jealous the cat can get his paws on one and I cant.

Gemmie - I'm kind of looking forward to a hot christmas! Our apartment is on a lake and I am thinking about getting the BBQ out and doing some steaks, then going down to the pool biggrin.gif It'll be soooo weird.

I am so going home for christmas next year though. I hate cooking.

I'm not going home for Christmas. My parents have decided to escape the cold weather and visit us in Florida!

A warm christmas day will be so weird!

I miss things like Hotel Babylon and this site is a one stop shop pointing you to links for programmes.

Some are hit and miss. But most of the time I find what I am looking for!
