There are some other caveats to my work situation which I will mention but I want to ask firstly what impact the above two situations will have on the K-1 Sponsorship process.

Something similar happened to me and my husband. He lost his job just before we were due to file. We filed anyway and crossed our fingers and hoped that he would find something before I had to present his financial information at the embassy stage. He did.

This process takes a long time. You could potentially have a 5 month wait until you receive your NOA 2 and then on top of that depending on the consulate you are dealing with, you could have additional time on top of this.

If you do not gain a job before you get to the consulate stage you should seek a co-sponsor. This co-sponsor will have to be a USC earning the minimum as per the poverty guidelines set out by USCIS.

It's up to you whether you would prefer the security of a job before filing or whether you would rather bite the bullet, file and hope that you are able to gain employment in the interim.

Sorry to hear you are stuck in AP at NVC.

At the moment this is a common occurance. NVC are holding on to petitions from anywhere between 10-50 days. The letter is something they send out as soon as they receive the petition but is sadly not indicative of your petition actually being sent to the embassy.

The time spent in AP at NVC has decreased significantly over the last few months and there is a thread dedicated to tracking the average time spent in AP at NVC.

Sorry but the words you have written in brackets are unclear. Do you mean.... can you send further evidence of your relationship to USCIS AFTER you have filed the K1 petition?

No. Is the simple answer. Any information you submit to USCIS after you have sent your whole package in, will not be accepted as part of the petition unless you are asked by them to submit further evidence. The one trip you have already taken (and have evidenced in your petition) means you fulfill the requirement of having met (as long as it was within the last 2 years)

Any evidence of trips you make after you send in the petition can be taken to the interview and form part of the proof of your ongoing relationship with your fiance.

The answer is yes. The important bit is meeting, not where it occurs.

You seem well informed about the co-sponsor situation in the Phillipines. Perhaps a member from that area can advise on the + and - of getting married v's K1 when it comes to co-sponsors in the Phills.

Good luck. The most important part is making sure you two meet. Without doing this, you are going to be unable to file. Very few waivers are granted on the "met in person" requirement. It's also important to meet because (and I wont be the last one to say this) you and your kids are inviting a new family member into the home, and you never really know someone until you have met them. I speak from experience, as do many people on this website. It's not a criticism, its a fact.

Finding work at the moment is not easy, even in IT fields. I would get an idea of what's going on in the area you are moving to by looking at Craigslist / Yahoo hot Jobs / Monster. It'll give you an idea of how many positions are likely to become available.

Hopefully by the time your visa is approved, you have applied for AOS and have your Employment Authorization in hand (likely 10 months from filing until you are able to work in the US, because you cant work until you have an EAD card) the current recession will have eased off and job opportunities will have improved.

Age is not a problem in the UK but you can be denied if:

Either of you are still married (you must be free to marry)
You have not been together within the last 2 years
You can not provide proof of a bonafide relationship
Certain criminal convictions
Admitted use of illegal substances and untreated alcohol dependency issues

By no means is that a complete list, but some of the reasons people have been denied in the UK.

I have not cancelled the petition for her as I still have hope for her. But now after finding out about her past boyfriend.
I think it is best to cancel the petiton. But she is still trying to hang onto me. Maybe in case her past boyfriend doesn't show..
I feel used over this and will be more cautious in the future.

Do you mean, she has her EAD but she hasn't adjusted status yet. If it's the EAD you are talking about then she received that as part of her adjustment of status, if she doesn't have any basis to petition on (and the only avenue she would have right now is VAWA if this is an adjustment of status based on a K1) then your friend will have to return home.

So for example, his birth cert (if it's not the original) needs to be a certified copy.

I think you are light on your misc. fees. Translations? Easily $100, maybe more depending on how many documents she has. Express mailing can be more than $100 for one delivery for DHL or Fedex, check with them about packages to India, at minimum you will need to send the I-134 for the interview. Police certificate? Cheap in some countries, not so in others.

AOS fee when she arrives...$1010.00

I see... Hey, according to that link, a K1 and a K3 take about the same amount of time to process - but K3 can be done for a lesser price. I have always been told that people choose to go with K1 because it is faster. The webpage you linked us to was last updated on October 16, 2009 - very recently. Are those time frames accurate? And if so, what is the true advantage of a K1 over a K3 (if one USC simply does not care which country he marries in)? I mean, if they take the same amount of time, couldn't I use the savings from a K3 to send to my friend to handle some expenses on her end? I mean, it looks like you avoid that AOS fee with a K3. Can some of you tell me WHY you picked a K1 over a K3? Thanks.


I picked the K1 route because in all the abnormality of long distance dating, the one thing I did want to follow the "traditional" route on was starting our married life....together. That was our choice. I get why other people do things differently.

And FYI - you do not avoid the AOS with a K3.....you avoid AOS with the CR-1. You should read the guides here and do some research.

In our case, it was two K beneficiaries coming from China, so the total expense including my two trips to China (mostly staying with family instead of hotels) and travel to the US for two was right at $10,000 but that was all before the fee increases. For a single beneficiary an overall cost with two trips abroad is likely to run 4 to 6 thousand depending on travel expenses and incidentals. Canadians in border-town relationships would be significantly less expensive.


Ex'acto mondo. So dependent on personal circumstances. It's very difficult to estimate. It may have even been more than I quoted...things to do with immigration (another $200 for my things to clear customs next week) are yet to be figured in to the final figure.

It's a romantic and financial commitment...no doubt.

I was told I had to have an EAD before I could be issued an ID. They wouldn't accept my I-94 because the 3 month expiration date DIDN'T establish my intent to persue "residence" in Florida. An EAD did do that because it was valid for a year.

I tried to argue it, but even a supervisor wouldn't budge.....and I left feeling very confused. Now I have both the EAD and GC...I'm going back!

If you leave now without AP or a GC you will have been deemed to have abandoned your AOS and will have to start the visa process all over again, only this time on a spousal visa.

I would do as others have suggested and request an infopass appointment, but this appointment guarantee's nothing....AP still takes a while to process.

My I-129F was being processed when I came in March 09 and I encountered no problems. I had with me a copy of my lease and a self compiled letter that I had my boss sign saying "you are on leave from .... to .... have a lovely trip, yours sincerely...."

I never volunteered more information than was required and always said I was on vacation.....because.....I WAS on vacation...anytime away from work was a holiday.

For a K-1 entrant to be authorized to work, they must file their AOS (for their PR/Green Card) and EAD, once married. EAD will take anywhere from 30-90 days (usually somewhere in between). They will not be authorized to work until the EAD is issued (or their PR/Green Card is issued; whichever comes first).

This 'temporary EAD' you've read about, issued at JFK POE, will no longer allow an employer to hire you. If you want to work, enter the US, get married within 90 days, file AOS and EAD and wait until one or the other is issued. :thumbs:

I am glad the K1 still exists. I couldn't put a price on starting our married life TOGETHER. Oh wait..yup...the cost of AOS. Worth every single cent.

Oh maaaaaaaaan. I remember my last few days before I immigrated. I felt so overwhelmed I could have run away from everything and not looked back for weeks. I could hardly breath at the enormity of what I was about to do.

It may be that she just needs some time. Some people dont have a lot to lose when they leave but they are probably the exception and not the rule. Many of us left friends, family and lives we loved.

I dont think you were being scammed (she didn't take the money...where is the "scam"?). I think she just couldn't face leaving it all behind. You never know, she might come around. Although...if YOUR already talking about future prospects...maybe she did you both a favor??

To my interview in London I took emails, letters, googletalk transcripts and 5 photos.

None of which were looked at. No really, not even once was I required to present them even though they were offered.

So just print out a few photos and add them to your evidence. What you should really concentrate on is having all of the financial evidence sorted and that all required forms are completed. This is the real area of downfall for people. I would also have handy a copy of the original information you sent with your I-129f app. The interviewing officer couldn't find my husbands divorce certificate from his previous marriage and had I not had a copy on my person, I would have had to submit further evidence.

EDIT: The above poster is dealing with a different consulate and therefore your evidence should be tailored to the consulate you are interviewing at.

It's better not to underestimate any Latin American or South American consulate, so include a reasonable number of e-mails (plus screen-shots of all) to convey the firm impression of a bona fide relationship, si man. USCIS will not care about this evidence, but sending it with the K-1 petition ensures that the consulate will receive it & cannot deny its existence. Be sure, however, that none of your e-mails (or screen-shots) refer to either of you as "husband" or "wife"! All of the real world would understand, but embassies & consulates are NOT the real world, no man.


This is good advice. Every consulate is different, and I would therefore heed the advice of someone who has been through a Latin / South American consulate (Ideally the consulate YOU will be dealing with).

London is a notoriously easy consulate to interview through, and therefore front loading (and even excessive evidence of your personal relationship at interview stage) is not always required.

The UK CBP at the french border can be a pain in the butt too.

David and I flew into the UK to Heathrow with NO problems. Crossed the border into France with NO issues. But after visiting Paris for a few days we went to regain entry into England at the Calais border and they gave us real hell! I didn't have my greencard with me (I had left it at my mum's house in England, because I was terrified of losing it and not getting back in to the US) and I forgot the flight information proving we were going home. The only thing that saved us was the K1 visa in my passport and my Florida driving license (showing proof of some sort of residence in the US)

That immigration officer gave me fits! And she was totally objectionable!

Always be prepared to show you are going home / have ties to your home country.

I'm glad that I made a copy of everything as the lady interviewing me could not find the copy of my husbands divorce to decree in the file.

Luckily (and thanks to VJ advice) my husband had made a copy of the entire packet and sent it to me prior to interview. I was able to supply her with the document and therefore avoided an RFE. In fact, as I was rifling through my file to find the divorce decree she did mention "dont worry if you dont have it, you can send it in and then we will issue the visa".

Not cool. I did not want to leave that embassy without handing my passport over and guaranteeing it would be back on it's way to me asap.

I agree.... why would someone have issues going back to EuropE where you'd be better... money there is great know that much been to london in 1998 quality of life was as good.


quality of life is not guaranteed even in Europe. That is a HUGE misconception. If that was the case then there wouldn't be people homeless and destitute. I saw a good number of people who were destitute in England. You would have had to be blind to miss them in London.

The 90 day rule is NOT a trial period and anyone using it as such probably shouldn't have applied for a K1 in the first place.

OP - the fact is, you have no basis for adjustment of status. I wish you good luck in the future

Unless things have changed since we did this, showing current employment with letter, stubs etc should suffice.

My husband was unemployed for 8 months before he got a job the week after our NOA 2. We therefore only had 3 months worth of paystubs and a letter from his employer to prove that we met minimum requirements.

Line up the co-sponsor just incase.

The OP is going through a distressing time and you ME ME ME'd.

Things change, people get scared, the reality of moving kicks in, relationships fall apart and we are talking about real lives and not a statistic so a little compassion wouldn't go a miss.

OP, do as others have said and take the steps to withdraw.
