Hi

I was told that when i get to the Port of Entry i need the documents i brought to the embassy during my interview. How true is this?
blink.gif

When your visa is delivered, an envelope that you are not permitted to open, is also given to you. This is handed in at POE and contains everything to do with your case (all the forms you sent, medical results...etc)

so thats all i need to present at the POE? no more like pics, emails and other documents?

The envelope and of course your passport containing your visa. No other proof of relationship is required. The only thing they will do is get you to complete an I-94 document. This is given to you whilst you are on the plane, you fill it out, and give this to the POE officer. They will stamp it and then give it back to you. You will need to keep this safe as it is one of the bits of evidence you need for AOS.

thank you very much! now i dont have to think about carrying those heavy loads of papers again lol.

The brown envelope you are given is quite heavy, but nowhere near as heavy as all the information you have to take to the embassy.

Have a good POE biggrin.gif

Just thought I'd pop a quick note on here to thank EVERYONE who contributes to the site. I went for my K1 interview in London this morning and was approved without any fuss, I'll post a review in the correct place.

Without all the useful information that's on here along with the experiences and advice from all of us that are (or have been!) in the same boat the entire process would be infinitely harder.

Thank you all so much! Ah, come 'ere everyone *HUGS*!

Another thought: you sound quite young, are you still a student or would you consider going back to college? If so, and you can pay the university fees at a US college, a fast way of getting a visa is to apply to a US college or post-grad and then get a student visa. This would not allow you to immigrate permanently, but you could study in the USA and be with your boyfriend without the need to get married.

umm online... And I know this is the point where alarm bells ring... but it's not like that, at all! It's actually a really funny story... but I won't bore you with the details!lol

I'm still a student in Dublin... but I'm told (by USIT) that I'd have to finish this year in college if I was to be considered for a student visa... and I really don't want to leave it that long... I'm ready to just drop everything and leave.

Well your options have been outlined above. Fiance Visa - K1, Spousal Visa - CR1 / K3.

The visa by way of fiance / marriage will take at the very minimum 6 months to do. You have a wait ahead of you no matter which path you take.

Have you met your boyfriend face to face in the last 2 years? That's the most important bit as a starting point. Without this requirement having been met, you can not go forward with either of the above mentioned visa routes.

Dont worry, a large proportion of the VJ community met their spouses online. i met mine on a karaoke website blush.gif

Claire.

Do you want to get married to your boyfriend? Your on a family immigration site. And this is the first question you need to address.

Read the guides link Matt provided.

You have a few choices. All of them involve marriage, all of them cost a fair few bucks, and all of them incur a wait away from your boyfriend.

Don't rely on getting your NOA 2 quickly peeps, and for goodness sake, don't be booking any weddings because you have seen a rash of approvals.

Things cant stay like this forever, and wont. Enjoy it while it lasts, but always prepare yourself for the worse.....if you don't set realistic expectations regardless of these fast approvals.....when your NOA 2 doesn't come in 40 days or less, you'll be driving yourself insane.

K-1 Fiance(e) Visa Case Filing and Progress ReportsVSC is moving quickly and decisively
It runs in cycles. When we were at VSC people at CSC were regularly being approved up to 2 months ahead of their vermont counterparts.

6 months before we filed a couple of friends of ours were saying VSC was kicking them out and being at CSC was like pulling teeth. There is a complete lack of consistency...

LOL. The lady said that the case are usually sent out after about 3+ weeks or so...oh well!

Uggghhh. Giving differing information is something we see all over this website all the time.

We were in AP for 35 days.....

But us UKers should consider ourselves lucky. Once our information gets to the embassy, the turn around on when you get the interview is really quick compared to other country's.

Hang in there. As scandal has said....AP times have come down considerably from when AP started happening in December.

Best thing to do is use the time carefully and to get your packet 3 information and interview evidence ready. I returned my packet 3 info the day the packet 3 letter arrived.

Good luck, I hope the AP is over soon.

Leilei is still cooking mostly Chinese style food at home, mainly because that's what she knows best (and because we both like it). She's settling in well now, and finding lots of American style food that she likes.

We're having our reception this Saturday, and she'll get to meet a lot of my extended family. wacko.gif I feel sorry for her!

HAHAHAHHAHAHAH, that's how Dave feels for me too. He has 11 brothers and sisters and I have inherited by marriage over 50 nieces and nephews. At least 1/4 of those people are bordering clinically insane wink.gif

We didn't have a reception because I wasn't paying for well over 100 of his family members to come to Florida and eat, so my judgment day is going to come around when the next family reunion occurs....

I hope you both have a wonderful day smile.gif

Hi Everyone!!!

It's been forever sice Ive been on VJ!! Alot has happened since my last post --- had an emergency C-section and gave birth to my beautiful son 8 weeks early due to pre-eclampsia! Anyway, he's almost out, hopefully in a week or so. Rich had to take an emergency flight to Sydney since my condition was pretty bad so he's here now.

As soon as Little man is out of the hospital we are making an appointment to Report his birth to the US cosulate, get his passport and social security number...so much paperwork to do!!!

Anyway, I hope everyone is well!!

@ Kevin - how was the interview?

@ Ellie - Congrats!!! Im so happy to hear you're finally in the US!!! How time has flown.. blush.gif

Congratulations on the birth of your son! I am so happy he is safe and well and wow! I'm sorry you have been so unwell. A good friend had pre-eclampsia and spent the last 5 months of her pregnancy in hospital. She made it nearly to the end but only because she lay down the whole time! Rich must have been freaking out on that flight. Keep us updated. I hope he is out of the hospital really soon.

Thanks for the grats smile.gif

@ jeremy...no beach day planned yet. Today is wedding ring shopping / david taking me out on our first "proper" date night. I realised we jumped so fast into being instantly in love, the cheeky devil never took me on a proper date. So its ring shopping, the movies and sushi for me today. I am going to tackle the SSN number and marriage license on Monday.

We had decided to just have Dora come over here and wait out the 6 months on her VWP Portuguese passport (some Chinese residents of Macau have Portuguese passports due to Macau's previous colony status. But if that could raise a red flag, or delay the AP should she come here? I search all over VJ and every other post seems to disagree about VWP visits causing problems with the K1 process, or possible rejection at immigration POE when she tries to visit.

Sorry Jeremy, but from my reading here on VJ I have garnered a sense that.... whilst VWP is perfectly valid for a visit during the process (providing the user can prove ties to his/her home country), now she has been unsuccessful at her interview and put into AP, they are unlikely to let her in to the country at the risk of her entering with the intent to immigrate. As a VWP holder you are still asked to fill out a form on the plane which asks whether you have ever had a visa denied. What would dora write??? Her being on AP will most likely be on the immigration information systems.

Should she try and enter and be denied, I dont believe there would be any repercussions on your current AP situation, but she would have to be completely honest about her reason for entering the US. If Dora was at all tempted to be untruthful to get past immigration and this was discovered......this WOULD have an impact on your current petition. Misrepresentation to the immigration authorities can subsequently lead to the denial of a visa and have an impact on any future visa's you apply for.

OK, you are right, thanks for the straight answer. I was too emotional before, but what you wrote helps me to realize that seeing each other short term is not worth risking the overall process. We will return to email and Skype for now, and cross our fingers that AP is not so long. I will love the day I wake up out of this nightmare, and can start living a normal life again.

I'm so sorry you have to go through this. sad.gif I really hope they can sort this as soon as possible. I just wanted to add that, whilst embassy's are processing additional information supplied to them, they say you are in AP. It's like a catch all phrase that is used and not necessarily something to be feared.

I hope this is over for you and Dora so soon.

Ellie-and-David,

Interesting to read the exact wording of the letter that states we are in adminstrative processing, you are right, it basically says thay are holding our app until Dora provides some Macau immigration records. The strange thing is they say they need the immigration papers for Lou Sio To (dora) and for Gary Souders. Gary Souders is my father's name, not mine!! That is strange.

So we are off to get Macau immigration records, a 10-15 day wait on those, then submit them to the embassy. Maybe this AP is not the black hole I first thought?

Here is a rough re-type of the letter from the embassy:

"this is office is unable to issue an immigrant visa to you because you
have been found ineligible to receive a visa under the following
sections of the united states immigration and national act:

1) your case has been suspended under section 221(G) of the united
stated immigration and national act, pending the receipt and review of
the information and documents listed below:

enter and exit record from Macau immigration authoities for LOU, Sio
To and Gary Souders,

your cas has been suspended under section 221(G) of the immigration
and National act, pending additianl proccessing. We will contact you
should additional information be required or when the processing is
complete.
No further action is necessary on you part. If you wish to inquire
about the status of your case, please use the inquiry form on our
website at http:/.hongkong.usconsulate.gov.

you or comeone desingated by you can submit all document exactly as
requested to the Visa information unit's outside window at the
consulate general way working day, form 3pm until 4pm. no appointment
necessary.please remember to bring a copy of this letter.

please do not drop your passport at the us consulate when u submit ur documents."

Jeremy

Okay, that is really strange. Is the request for info for your dad a misread on their part? Comply with what you can, but make sure you chase them up on them asking for your fathers information. How strange!

Yeah AP is a catch all. From what I can gather the biggest thing to fear is a name check, something that usually happens to males from muslim country's - although even that back log has been reduced.

Hang in there, give them what they ask for, question what you think is a mistake on their part.

If Dora was at all tempted to be untruthful to get past immigration and this was discovered......this WOULD have an impact on your current petition. Misrepresentation to the immigration authorities can subsequently lead to the denial of a visa and have an impact on any future visa's you apply for.

I am so depressed. Dora was rejected at her Hong Kong embassy interview. They said we needed more proof of relationship. That was OK, but then afterwards when we submitted all the extra docs they asked us to send, then again sent a letter that said they are not sure of our "timeline". HK embassy has now said we need to send over all immigration records from the Macau immigration offices to show when she went in and out of Macau, Dora is from Macau.

They worst part is the girl from the embassy told Dora, "after you send in the immigration records we have no idea how long it will be until you can get a new interview date, and then we are not sure you will pass that interview, you have to wait and see."

We are both so upset and low now, it has been almost 8 months now, and it seems that things are getting worse not better. I just can not take the endless "one more doc" "one more letter" round and round, it is so depressing.

We are now thinking Dora might try to come visit me in the USA again, while we wait on the HK embassy to review the latest set of papers Dora will send tomorrow, they said this process may take 6 more months!!!!!

I feel so hopeless and sad, I do not know what to do to get this visa through.

Should I call a senator, or call the embassy? Anything I can do? Help.

Jeremy

I'm so sorry Jeremy. At this point you are in the hands of the consulate. All you can do is comply with what they are asking you for. I am sure (like when dealing with all of these govt agencies) that the time line they have given you is probably one that has been plucked from the air.

I would address the Hong Kong forum and look for others who may be / have been in a similar situation to gain a more accurate reflection of how long this is likely to take for you.

I think if Dora tries to visit you, she will be turned away. A denial will probably raise red flags and I am sure at this point in the process they are able to see information on your case when you get to POE.

I am so sorry sad.gif I think you need to give them a reasonable amount of time (I know.....what is reasonable when you are parted from the one you love:() before you can start asking for intervention from a higher power.

Well guys, I'm headed off for China again tomorrow. I'm going to help my fiancee fill out her forms, then next week we're flying to Guangzhou together for her interview. Hopefully all will be well, and she'll be back here with me within a month. (insert crossed fingers emoticon here)

Best of luck to you Kevin for the 16th! To Jen and Nick also! Only ten days to go.....eeeeeeek.

This should be addressed in your regional forum as different embassy's require certain information and operate within different timeframes.

Hi Everyone...!!

Had my interview today and everything was done and completed in less than an hour from going through all security checks, finger prints, waits, and interview! Oh, except one "minor" hiccup - my birth certificate has my mother's maiden name as my middle name. However, my passport and all other legal documents doesnt include this name (I was born overseas). So, prior to issuing the visa I need to either amend the passport to read as my birth certificate or obtain a name change certificate and send it back so they can issue the visa. Either way, there is a waiting period from 2 weeks to 4 weeks and my k1 approval expires in 2 weeks. I have emailed the US consulate explaining the waiting period so hopefully, they can extend this 4 month period for at least another month!

But other then that - they said all was in order and gave me a pre-departure information sheet to read over.

Congratulations! Sorry about the hiccup but providing an extension should definitely not be a problem as these kinds of situations occur all the time. Let us know what they say!

Also did I mention......CONGRATULATIONS!!!!!!!! kicking.gif

I'm so nervous about my interview on friday....EEEEEEEEk!!!!
