I just got an email from the US Consulate here in Sydney advising that they've already received our package and giving instructions on downloading the packet 3 along with all other info....that was pretty quick..

Ellie - you are correct, it states that you must have the interview and visa issues within the 4 month validity date from receiving the NOA2....such a relief!!! At least I dont need to worry about leaving so soon. Now my plan is to move to the US around October or hopefully November..its a shame that our baby wont be able to spend its first Christmas here with my huge fam sad.gif ..oh well, that just mean that I'll be here next year August to celebrate a massive 1st birthday for the baby biggrin.gif

Cool, that's really good to know about the four month rule....we are going to need some time too. I suspect I will be approved whilst I am actually over there (I leave on Saturday for 2 weeks...)

Wow.....October / November!!!! Yeah, the missing out on spending time with the fam will be sad sad.gif but......like you said there is a big first b'day celebration to have smile.gif

My parents have already invited themselves over to Florida for xmas next year.....grrr...smile.gif

I got a jump on all the packet 3 stuff and discovered that besides the police cert, I have most things covered. I have even managed to obtain my vaccination transcripts for the medical and they cover me from my date of birth to current day! I know im jumping the gun....but im trying to be prepared for once (doesnt happen very often!!!!!)

On February 23, 2009, we mailed you a notice that we have approved this I129F PETITION FOR

Woohooo!!! We finally got our NOA2!!!

Now in addition to Richie's employment dilema....I was wondering if this is going to affect my visit to the states next week??? I know I was fine going thru POE last November after receiving the NOA1..but unsure now that there's an actual approval on the system???

HOLY MOLEY BATMAN!!!!!!!!!!!!!!!!!!!!!! CONGRATULATIONS SWEETIE!!!

The gap in employment is not relevant, it is the position he is currently employed in RIGHT NOW that counts. Is he not employed full time? Can he not fill that information out?

After all the c$%p you went through with your petition last time I am so happy for you!....sooooo happy.

As for your visit. I believe they still cant see the application on the system BUT, gaaaaa, it may be worth doing a little research on that.

I would take the following information with you when you go over:

Lease / mortgage
Letter from job stating expected return date
Full itin inc return dates
A printed out copy of the NOA 2 (I mean seriously, which one of us would be stupid enough to ruin this all now after waiting for so long)

In addition.....stick with the good old catch phrase

"I'm here on vacation"

Congrats again! I cant believe this is starting to happen for us all smile.gif

Thanks heaps!!! I know, finally got it...although sooner than expected! You guys should be getting yours soon since there have been a couple november filers getting approved.

Well he literally just got a job offer like...two days ago...he's been going to his induction and will soon be getting his learning material in order for him to start studying to qualify for his license (insurance/finance agent). We dont know too much info right now as he only just received a bit of info. Looks like he will need to pass his course and get all the licenses and then he will be able to start getting income...the timing just sux with the whole employment thing!!

As for my trip...first of is hawaii with friends and then I fly off to NY to see him so I can just say that Im going with friends on a vacation..even though it might look dodgy with me staying a week longer than the others, ill just say im going to NY to visit friends..I'll have my employment letter, bills, r/t tickets, itineraries and also bring along my obstetrician/pregnancy info to prove that I will be having a baby here in australia and have an appointment set for when I return from my trip....hopefully its enough proof *fingers crossed* ..oh and yes - that NOA1 and NOA2 copy to prove im doing this the right way tongue.gif

Aggghhh, tell me about sucky timing and employment....Dave still hasnt found anything, but as soon as i leave is pushing to get a job, ANY job that pays the min pov guidelines and will get the application through. Regardless of how quickly we get approved, I still only intend to go out in September......we set a date of Sept 19th to get married (A year to the day we first met face to face) It's just amazing at how quick vermont are starting work.....I thought this was it for us all till April/May time. At one point the time line said June!

With regards to his employment, you can delay sending back the packet 3 info for a period of 4 months (I'm sure I read that somewhere but please dont take my word for it) and it wont effect your application. That would give him enough time to complete his course and gain his licenses and get someone to sign off that employer info form for him.

I think you have more than enough proof of ties there!

Posted February 20,2009

As of December 31, 2008 they said they were working on May 12, 2008 unsure.gif

So changed from April to May.

Felt like sharing the information...even tho its not much progress, its some progress at least!

Thanks for that! Even though I dont like at the processing timelines from USCIS website anymore, it just feels better knowing that alot of October filers are getting approved and ours are on its way!

Just a question...has anybody else downloaded the packet 3 yet? I havent even looked at it but I heard that some December filers were already getting theirs ready haha blink.gif

I've started getting some of my stuff together too for the next stage. We are hoping not to get approved to quickly....dave still hasn't found a job sad.gif BUT....BUT! I'm still getting things together with a positive outlook on the whole thing. Police Certificate application is going off on Thursday and I applied for my birth certificate before we started the process....a little strangely i had my ex fiance, who is a civil servant, sign the back of my photo's and declare who I was for the police cert. Luckily he was cool about doing it!

Yes, we are also patiently (but worriedly) waiting also, no word yet from USCIS and based on all we've read here I dont put much faith in calling them for a status; also our case # is not yet registered on the USCIS website, but that also seems pretty normal.
I hope we start getting approvals very soon, we are rooting for everyone!

Matt & Huong's timeline:
Feb 2008 - met online, luv at first chat, hehe
June 2008 - met in person, spent 10 days in Vietnam, had wonderful time
6/24/08 - proposed marriage aboard Bassac in Mekong Delta
11/5/08 - Sent 129F to USCIS Vermont Center
11/7 - NOA1
12/18 - spent another 15 days in Vietnam, had engagement party, great time
1/3 - return to US, very very difficult and emotional separating

Hi matthew. Nice to see you around.

Can you please fill in your timeline? It helps VJ predict when we will be receiving our NOA 2's and helps people see their status on Igor's list.

Thanks....and good luck.

As far as I could make out, only a few November filers for vermont have so far been approved.

I am however, happy to see so many October VSC's being approved.....it means we are not far behind smile.gif

I'd be interested to know what their response is. The standard response given out by most officials is that they wont even look in to your case unless you qualify for an expedite that has been refused or you are at the 6 month mark at USCIS.

I studied in the US for four years..... will I need to get FBI clearance and a police check from the US? I thought it was only from countries OTHER than the US that you had lived in for over 6 months that you needed police checks from.... am I wrong??

Sorry, cant help you there. Mine is very straight forward as i have only ever lived in one place.

Might be worth looking around to see if there is guidance anywhere or starting your own thread to see if you can get any help from members more experienced in those areas.

Becky....

You could look into getting them now, but some country's put a 6 month limit on them. You'd need to find out the specifics of applying in pakistan. I know in England our certs are good for 12 months for the purposes of a visa, but like i said....check your own embassy out to see what the rules are.

I am not 100% (only 95%) sure, but from what I have been reading, the police record is one of the items on the list for package 4. Although they MAY or may NOT ask you for it during the interview, I know I cannot be too prepared if I have it. And since I have studied and worked in the States for 7 years, I will need a clearence from FBI and that takes a while. That's why.

As for the birth certificate, I think that is also one of the things required for any foreign fiance. Somebody, please correct me if I am misinformed.

Hello, everyone~

I hope you all are doing very well during the waiting. For some reason, I have a really good feeling that many of us will SOON be hearing from VSC for the second time-the NOA2!!! That is why I am getting an early start in preparing the package 3 and 4. I just submitted a request to FBI for the police record, which will take up to 6 weeks. Other documents, e.g. birth certificate, the original and the translated one, my fiance putting together his part, like his w-2 records for the past 3 years, other financial statements, letter of employment. He works for the Board of Education so it can take him forever to get what he asks for from the "system." Anyway, I am just wondering: is anyone else doing the same thing, or it's just me?

By the way, I went to the hospital where I was born this afternoon and applied for a copy of my birth certificate. I was told anything before 1980 was no longer tracable (I was born in 1976), which means they do not have any information regarding my birth and thus will not be able to issue the certificate. What should I do? ....

Only the USC has to add the birth certificate right?
I was thinking about starting already too with getting stuff together because it looks like vermont is going faster!
Also about the police record i thought that if the embassy wanted it they request it themselves by the police? maybe im wrong...thought we didnt have to care about the police record as long as they didnt ask for it.

Yup. You must have a birth cert and you are responsible for applying for your police certificate. Some country's take longer to issue the police cert than others so it is worth looking into it now

Ooooooo! Hawaii again! You lucky thing! I'm so glad you get to see Rich again so soon. We are spoilt now and are struggling to do more tha a couple of months apart at the time.....especially as the air fares are soooooooo cheap!!!

I hope they keep the prices low!

I know im so excited! i saw a r/t ticket from Sydney to Honolulu for only $600 and the usual price is approx $1300!!! then I decided that since Im half way there I may as well see Rich in NY which only ended up costing another $600 r/t from honolulu...this is definitely my cheapest way of getting to NY thats for sure!

Awwww!!! So cool! We'll be seeing our SO's within a couple of days of one another.

Oh NY....never been. Dying to go. Dave's born and bread new england boy and was so close NYC it was never a big deal. Mind you, I'm kinda glad he moved down to the tropics given the weather in the northern states at the moment....

My My My!!!

2 approvals. Well I'm in shock! I feel a bit sorry for all those poor dears from Aug / Sept / Oct who haven't been approved yet but it is encouraging to see some kind of movement. Actually I have to confess....I cant believe how quickly the time has gone since we filed.

Awwww Kevin, so glad you get to go to China again, it would be AMAZING to get the NOA 2 whilst there! Even better before hand though ;-)

I am seeing Dave in just under 5 weeks. I got a deal on a direct flight I couldn't turn down......Lets just hope they let me in.

And I cant wait.....it's been cold and I'm looking forward to some good Florida rain.

Well at least we have a bit of hope now that a November filer got approved...hang on there and hopefully it wont be too long before you're able to start reading your books again biggrin.gif

Oh gawd...i really forgot how much i enjoy reading! Lil ray of hope. I see all these Nov filers getting approved and a lot of them have been praying. I'm thinking about taking it up....only myself and my SO are both athiests.......so i dont think it will work.

I think i'll just do the waiting inline thing, hoping by some fluke a VSC worker bypasses the rest of the Aug, Sept, Oct filers and gets to me hee hee.... devil.gif

Ok, I take that back. I do have a sense of karma about things and I dont think the above statement is going to help matters smile.gif

laughing.gif dont worry...I'll do the praying for you on your behalf....as for me, im still constantly checking the "approximate" approval date for me even though I can exactly have my xray until after the baby's born...so im probably looking at moving to the states around October...if I dont spend Christmas here with the fam..

Awww thanks sweetie smile.gif How are you feeling? I hope the lil one isnt making you feel to yucky.

I check the approximate approval date all the time too. The other day it said June, which horrified me for a moment!!!! Then VSC did some work and it got better again. Yeah, Im thinking September time. I'm not giving notice on my house or Job until that visa is in my hand. Then I'll have about 6 weeks to pack my life up. Sounds like quite a lot at the moment....but 6 weeks is nothing really...EEEEK!

I cant wait till I am in his company all the time and am able to read a book....!!!!!!!!!

Here's the thing. It's uneven, unbalanced and unfair. I have noticed that people who have applied and received their NOA1 AFTER me are getting their NOA2's before me.

The USCIS has NOT given me any indication that there is a problem with my case nor if there is any quality about my case that requires further investigation that those cases received after mine. The damn thing hasn't even been touched as far as I can tell.

No, this is not efficient! I would like a legitimate reason from the USCIS as to why my case is taking longer. I have a right to know as a citizen who contributes to this country, pays his taxes etc.

It is a disgrace to me and all Americans to say that we treat people who want to be a part of our nation like garbage. Especially when legitimate, law abiding citizens simply ask their government to allow their LOVED ONES to be a part of their lives here.

I think the manager of the VSC should have some accountability here. There should be more information passed to clients. For example, does the issue of divorce make cases take longer? Are there additional security investigations that need be done with some cases (perfectly legitimate in my view)? Was there something that requires more infomration? Is the USCIS being timely in requesting that information?

Many other countries handle this so much better and are far more efficient in this regard. I say the Us Government has some explaining to do and I think the senators from me state, Vermont and the heads of the State Department should get letters expressing our deep dissatisfaction in one of this country's proud traditions, accepting immigrants!

Cheruvim.

You should be a litle pacient and positive, VSC have been really slow this last monthes ... but you are still within the processing time of 6 months... I have seen August, and Sept approvals lately... and you apply on October, the strange is that you got your NOA1 on January ... have you checked on line at USCIS page?
You should check there and see when did they got your petition, and then you should start counting your 6 months of waiting.
Complaining about US goverment you arent winning anything, you should keep your mind positive, and your apporval will come. Positive thoughts and good feelings, always bring good things to your life!
star_smile.gif

Why should we have to wait 6 months???!!?? CSC currently show it can be done quicker...and that's the point people are trying to make. You also have to bear in mind that VSC and CSC are only one part of the process....add another 3 months to that and it's nine months to be with your loved one......positive? patient? no thanks.....i just want the opportunity to be treated like the human being that I am, and be with my Fiancee. 9 months (and some people, some very patient and misfortunate people have been waiting over a year for a NOA 2) is NOT acceptable.

I don't want to be the one to burst any of your venting bubbles...However, most of you are still within USCIS estimated times. And contacting your congressman earlier in the game is mostly useless, as USCIS will give your congresman the same response they will give you. Sorry kids.

Ken knew that he was within waiting times when he wrote that letter. He actually wrote it at the beginning of his visa journey. The letter was not specifically about his case, but about the fact that it takes on average 6 months to get this type of visa processed and it only takes up to 3 months to get a business visa expedited for those corporations who wish to employ overseas workers (and I will grant a distinction between an immigrant and non-immigrant visa - but still HALF the time)

6 months, for USCIS to process our forms. The system does not work well, and the current levels of productivity in Vermont are not justifiable (weather permitting or not) on any level. The sudden surge in California shows, it can be done faster. But someone has to take responsibility.

It's about time the people in charge were asked some questions.

yea waiting is what we are doing ...and being patient...
was just thinking why VSC is taking soo long cause my fiance called and they said it may take 9 months which is kind of long ...
Best wishes to all

Becky. VSC quote 9 months to cover their backs. You will likely find the NOA 2 will take 5-6 months and then there is the additional time on top for forwarding to NVC and then onto the embassy.

Sadly it is a wait situation. We all understand how hard it is to be apart from our loved ones. And can appreciate you miss your fiance. But there isnt a lot that can be done unless you fall under an expedite situation.

Lets just do some hoping that VSC hurry up and approve those people who submitted their petitions before us November filers......

It'll be over soon, and you and your fiance will have forever together :-)

ok, maybe some one has this answer. I just called NVC, I had received the letter dated June 11, that they have received my approved petition. It also states that the case will be forwarded within a week to the consulate. I called just to find out the date of arrival and the date of departure from NVC.
I was not happy to find out that we have been chosen for AP. How can they do this, after sending me a letter saying that it will be forwarded within a week? The person who answered the phone told me that the letter is generic, and that it is not a guarantee that it will be forwarded within a week. anyone get this as well?

Hey guys,

What would an "AP" be and how does it work?

Thanks!!

This all depends at what stage we are referring to AP. AP at the NVC stage is additional or adminstrative processing. By tracking trends, we have recently seen that NVC has been holding back cases for between 30-50 days after they have recieved them, and have then forwarded them on to the embassy. Nobody is really sure what goes on during this additional processing and why some people are selected and others are not. There is no way to make additional processing at the NVC stage go any faster. You just have to sit back and keep calling until they send your petition on to the relevant embassy.

I was held at NVC for just over 30 days. My case was relatively simple, I am from a low fraud country and neither myself nor my partner has ever been in trouble with the law. There is absolutely no reason we would have been singled from any of the other petitions going through NVC that day, except for the fact that it is totally random.

I would also like to add that I recieved a letter that told me that NVC had processed my case, and would be sending this on to London. In fact that letter is standard, and a bit of a fib.

AP at consulate level is very different. The time lines vary greatly some being in AP for just a few weeks to others being in AP for months. This kind of AP tends to take place in particular countries. AP at consulate level usually occurs after the beneficiary has had an interview. If you are placed in AP at consulate level, you are usually told why, but never given a timeline of how long it will take. A popular reason is "additional name checks"

I guess the thing to remember is....that whilst the wait for the NOA 2 is a long an arduous one, you are never completely out of the woods. I was so elated when I recieved my NOA 2 and so low when I found out I had been placed on AP.

I would also like to mention that, I had my interview last week and the AP I was put under in NVC was never mentioned. My interview was successful and today I received my visa..... 7 months to the day that I sent off my petition.
