I recently got approved and received my NOA2. Now I'm eager to know where my application is and whether or not NVC has received my application. I have checked the USCIS site to see if there are any changes to my status but nothing is shown. Is this how i will know where my k1 documents are or should i call NVC to see if they received my application? Those of you who have already gone thru this please let me know how this whole piece of the process works (specially if the beneficiaries country was Ecuador) thanks!

The beneficiary once they receive the visa have a period of 6 months from when they get the visa for the visa to expire. Therefore you could stay there for as long as you want as long as the visa does not expire wich again it would expire 6 monhts from the time she receives her visa.

No... the legal marriage needs to take place within the USA. Now you could maybe do the church ceremony in your country but it must not have any legal status since like stated earlier the K1 would become null and void. Maybe you could do the church wedding there but not register your marriage there. You could simply come here and go before a Justice of the peace and have him marry you guys here in the USA after that you will have to file for AOS (Adjustment of Status).

We are debating on whether or not we should change our plans. We had originally planned to wait about 2 & 1/2 months after she arrived on her K1 visa to get married. After thinking things thru i realize that if we do that and lets say she is able to get a work permit at the point of entry it will only be good for 90 days. This means that if it take 2 months for us to get her EAD after we get married she could spend a good month & 1/2 without having work authorization.

My first question is: How long on average does it take to receive an EAD? (we would like her to be able to work)
Second question is: How long do people often wait to get married?
Third question is: Do we have to submit a AOS before the 90 days expire?

Hi All,

i have a checking account which serves for me as a revolving account which means i really do not have much of a balance in there most of the time. Because of this i do not want to include any of my bank statements. As far as my income i make close to 46k a year. Will that be enough? I already have my employer letter and my 4 last pay stubs and i have my tax transcripts for the last 4 years.

I also do have a savings account but i only have about 1500 not more than that for now. So will all this be enough? Could someone from Ecuador who has gone through this process write to me please. As well as anyone else! :-)

I cannot answer how long it will take to get to your town but hopefully i could help with the other questions.

* The affidavit must be completed by the petitioner (It's his ability to support you that they care about.)
* The affidavit should be taken to the interview. Do not send it anywhere.
* The affidavit must be notirized by a US Notary.
* You will need a co-sponsor if the petitioner does not have income or assets over the 125% poverty line. (Look up the poverty line)
* If your fiance (the petitioner) is mighty close to the 125% poverty line i would suggest getting a co-sponsor to cover your bases.
* Your fiance (the petitioner) needs to show as evidence 2 to 3 options from the following list for the affidavit:
- Employer letter (Must be on Company letterhead)
- Tax transcripts for last 3 years (you could get these free from IRS)
- Last 3 to 4 paystubs
- Statement from bank stating deposits made in last year and balance
*If your fiance (the petitioner) needs to get a co-sponsor he still needs to fill an affidavit with evidence along with another affidavit from co-sponsor along with his evidence (same as listed above.)

The + sign simply means that there is more information than displayed but obviously that is no good for printing the form. What i would do in this situation is try to make it fit by abbreviating.

I used paper clips and paper clamps because my paperwork was too thick for paper clips. Really it does not matter as long as they could quickly disassemble the documents. They don't want things like staples. Really the most complete information given to you has been the first post reply that you got to this post.

I agree with Eric and Teresa! My fiancee already had a visitor's visa and we filed for a K1 in november 2007. Well we wanted to see each other agai nand i had already gone there at the end of november so i could not afford to come here again with my job and all on the line. So we decided to take the risk. Yes there is a risk that your fiancee could get denied at point of entry but that is a risk every single person runs. As long as she could show ties to her country she should be fine. I would suggest you buy a round ticket for a 2 to 3 week period and if you would like her to stay longer than you simply call the airline and postpone her flight. Only makes sure that she does not over stay past what her I-94 states as her limit to in the country. sometimes it's a month or 3 month... who knows but DO NOT GO PAST THAT DATE!!!

By the way my fiancee was not asked many questions. she only gave the response to those questions and that was it. Even if your fiancee was to get denied at the point of entry it should have no bearing on your K1 visa process, so don't worry.

This is quite normal. The NVC normally takes about 2 to 4 weeks to process new approved case and to forward it to the consulate in the beneficiary's country. Now the time between the consulate sending a notice to your fiancee will all depend on the processing times of that consulate. Once the NVC fowards the case to the consulate there is a way to track your package approximately using a trick which you will find in this forum. The NVC uses only DHL to send all documents.

...I would say yes because, in both cases there was no illegal intent. So, yes people legitimately adjust status from tourist visas fairly often.

The OP's question was more like...

We want to get married next summer. Can my girlfriend/boyfriend just use their tourist visa, come over and marry me and then adjust status?

...to which I would answer, "HELL NO!"

This is probably the best answer i've seen that answers the question. Although the wait seems painful it is the lawful way to go in this case since they already know that they want to get married. As far as the fiancee visiting while the fiance visa (K1) is pending... well as long as they have a valid tourist visa and DO NOT over stay their time given at the port of entry it should not be problem.....

NOTE: With every entry to the US a tourist runs the risk of not been allowed to enter the US but if they see that you are honest and you are trying to do everything legit then there should not be a problem.

Si, man -- no need to SWAMP the USCIS people, but include enough so that when the consulate receives your package, the consulate cannot ignore your "validity" of relationship.

You can leave out everything of this nature from your I-129F filing, but there is no guarantee that your consulate will even allow you to present "validity of relationship" when your fiance(e) shows up for the interview.



Well said TBoneTX..... if you send the information you are guaranteeing that someone will at least have it.... if your fiancee takes it to their interview, the interviewer may be having a bad day and decide not to even look at any further evidence.... give it to them now! I sent as much information as i could sent.... i sent about 64 pictures, copies of passport and airline tickets, copies of letter and emails we wrote to each other, records of phone call history. This way i covered all my bases and was able to prove both that we had met in the last two years and that we had an ongoing relationship....

By sending as much information now you also facilitate the interview process for your fiancee because you give them as much evidence as possible. The only downside to this is that it means you have to make sure that all dates and pictures and all evidence coincides with the story you are giving them which it should if you are being honest from the beginning.
