I called the Paris Embassy this morning and my husbands DCF interview was finally rescheduled for April 24th. I don't have the paper yet, just the info from the lady on the phone. I was hoping it would be earlier that way we wouldn't have to split up the family, but it looks like that is going to be the case. It's not so hard on me as it will be for my husband coming home everyday to an empty house and not hearing the lil guys all excited to see him. But it will only be 2 months which is not so bad for the 3 year old, but he'll miss the first b-day of the youngest.

The good side is we are no longer completely in limbo and know better now what's going on.

All DCF interviews were cancelled because of the new Walsh law (look on the DCF thread it's all explained). I hope they will work it out soon, this is messing it up for everyone.

Hmm, what I'll miss when I move back to SoCal, tartiflette, raclette (though you can buy it on amazon along with the machine) goose liver, cheap health care and free preschool.

What I'm looking forward to, good mexican food, donuts and the beach, watching the sun set over the Pacific listening to the waves, lots of outdoor activities.

Hi I'm Sheigh,

I'm the USC in our couple, my husband is french. We've been married since 1999 and are in the process of doing a DCF, we just got our interview date last week.

We live in the north of the Bouches-du- Rhone and I've been here for over 10 years. We also have 2 lil boys (3yrs and 7mos).

We'll be moving at first into the SoCal region (not L.A., but South Orange County) and staying with my mom a year, the time it takes to get on our feet.

We're a bit nervous about the move though starting over from zero and all. But we'll see...We just bought our plane tickets today, sicne there's four of us we didn't want to risk having to pay too much so we bought them in advance, but it's still more than 1 1/2 mos after the interview, so it should work.

Hi everyone,

I've been following this site for a while now and now that I am going to go through the process, I thought I'd introduce myself.

I'm the USC living in France with my husband and our two boys. We've been married for 7 years and I've been living in France for 11 years. We've decide to return to SoCal and go through the DCF process.

We're planning on going to the Paris embassy in about three weeks to give them our petition and would like to know what time we need to get there (in line) to be sure to we get in (I know they start letting in now at 12:00 pm.) We're coming up from province (PACA) and would not like to miss our chance, on top of that I have to leave my 3 month and 2 1/2 year old for the first time for this trip and I really don't want to have to try this more than once (going to paris).

I need to fly to Manila to be with my son for his visa interview and I also have the extension letter on hand. So, there shouldn't be a problem then for me to reenter as long as I have the copy of the letter on hand?

Even my dl is expired. The Sacramento office had issued me a 30 day extension and with the budget cuts in the capitol, the woman at DMV said that there are only 2 people handling cases like mine - those people who are in between their removal of conditions and receipt of their permanent green card.

I need to get my ticket soon and am happy to see that there should be no problem for me to reenter the country smile.gif

For next year, we'll be filing together - I realized that later on when my business started going down - the recession doesn't help any.

I filed for my removal of conditions in May 2008 and in Oct, I received a notice requesting additional information - primarily financial information like bank statements, leases, etc - as well as affidavits from at least 2 people who know us.

While assembling the paperwork, I just noticed that my husband has filed single the last two years. I've filed "married filing separate" for the last two years (I have my own business) and since he had a family friend who's done his taxes for 10 years now, I always assumed he had done the same, and hubby did say that he had filed "married filing separately".

Anyway, I need to get all the requirements by Dec 9, and DH has filed the amended tax return form to correct the filing status. I don't know when we can receive a response or confirmation from IRS, but if it's not before Dec 9, what can we do?

I think they go by date of receipt. I had to send in additional documents for my Removal of Conditions by Dec 9 and I sent it Next Day Express Mail on the 8th, guaranteed delivery by noon of the 9th, and then I received my approval on the 12th.

By going certified mail, he went the slowest route possible. Spending the $16 for express mail next day air was the best $16 that I ever spent in my life smile.gif Unfortunately now, to reopen the case, he may need to spend more money on a lawyer, submit forms all over again, or burn the phone lines trying to find a senator who can help him.

I had the same problem with my DL as well. My conditional expired in June and I submitted the NOA with all the requirements. I then received a letter saying that I had not sent sufficient evidence. I ended up calling DMV in Sacramento (I'm in L.A.) and the woman sent me an temporary 60 day renewal of my DL, and requested that I resend the required evidence of my legal stay here (the extension letter and copy of front and back of my GC, even though expired).

60 days passed and nothing. I called again and she was suprised, however she did say that because people within that 1-year extension pending removal weren't as plentiful as the rest of applicants, there were only 2 people assigned to that department, considering that in less than a year when conditions are successfully removed, we'd be back anyway armed with our new cards. I don't know if what she said was true or not, but in a way it makes sense - but is no excuse for them (workers at your local DMV) to feign ignorance to the point that you have to drive 110 miles just to get that stamp in your passport.

I sent the requirements yet again but didn't get anything at all. In the meantime, in my wallet I'd carry a copy of the extension and my GC and my expired DL - just in case. By the time I was about to call them again, my removal was successful and I got my card in the mail three days ago smile.gif

I received the same letter in October requesting for additional information like the one you indicated, financial information, lease, mortgage, bank, bills, etc. including affidavits from two people who know us stating how they know us, etc.

As for utility bills, you can actually have her name added to the account. And she can add your name to the utility bill as well. In the case of the cell phone bill, if she has her own phone under your plan, her name can be in statement corresponding to activity under her phone number (this works for Sprint and ATTWireless, as I recall).

As for car insurance, even though it may belong to her parents' the fact that you or her are driving probably means that you guys can be added as additional drivers on the coverage.

As for the joint bank account, it's time to get one even though you each have your own accounts. I have my own business so I have to have a separate account while my hubby has had his account for years and also shares savings accounts with his parents, BUT we opened a joint account and use it occasionally. This came in handy when it was time to submit additional information because they want to see that there is a joint account that gets some use. they don't even care about the balance in it. I submitted copies of statements ranging from 2006, 2007 and 2008 - one statement per year which showed that the account is active and even though the balance which was high in 2006 ended up in 2 digits by Dec 2008, it didn't matter.

Another thing you can do is get insurance, doesn't matter if its term or full life insurance. Term is usually the most inexpensive and you can research that online or your credit union may even offer it. having each other as the beneficiary on the insurance plan is a good form of evidence that you are a couple as well.

Don't send in pictures all over again - they didn't ask for it. Send in updated tax returns or the actual tax transcripts from the IRS which you can order over the phone for free and receive within 10 days. Send in the joint lease of your apartment, utility bills that include both your names (add the other to the account as stated above), copy of car insurance from parents with you and her included under additional insured (if possible), and affidavits.

You don't need to write a letter to them and even have parents sign it. have the parents make out the affidavits instead. I found three people who wrote affidavits which confirmed their knowledge of us as a couple. Two were my friends back when I was single (our friends now), and one from his mother. Make sure that they type in the affidavit verbiage at the bottom where the notary needs to sign and notarize which will make it easy for everyone concerned. You can find examples online.

Hope this helps! I received my notice for additional evidence sometime in october and sent in the evidence one day before the deadline via second day express mail on 12/8. On 12/12 they approved my Removal of conditions and today I received my green card smile.gif

Thank you for that clear reply! It's pretty difficult to be the "fly on the wall" regarding my friend's situation, but right now, his mom just told me that she had petitioned him back in 1996 under "unmarried son/daughter over 21" and was wondering if he should go ahead and file for divorce and then file for his visa under the B2 classification based on his mother's approved peititon for him back in 1996. I did check online for visa availability and they're currently processing visas for those approved on Feb 1998, which means he falls under that category.

He's still having major problems and it's escalated to the point that she's running really high bills for expenses incurred with the guy she's seeing and he feels trapped that he has to pay all that while waiting for the second interview. I was wondering if filing for divorce and then using his mother's approved petition would be better instead?

I received my 10-year GC this month (woohoo!) so this question is not for me, but for a friend who just told me about his situation today.

He has been married since 2004 to a USC and is in the process of removing conditions. Today he received the letter from INS saying that his interview will be scheduled at a future date.

His problem is that his USC spouse has been seeing someone else and is even abroad visiting him. He thought that she was visiting friends but from reviewing phone records and FB, he's found out that she's now back with her ex-boyfriend. She's returning in January.

Now he's wondering what he should do. She has been running all their joint cc's to the max and has also been demanding he pay for everything, and a bit more as she doesn't work anymore. He's pretty confused as to what to do, and with the pending interview, what should he do?

They've been struggling with the marriage for a while now - but he thinks filing for divorce would be a bad move considering that their interview is coming up. I don't especially want to recommend divorce (I only hear one side) but would like to see what others here would suggest, or if any of you have been in a similar situation and what did you do?

I made a COVER LETTER accompanying my removal of condition forms and on it, I made a list of the copies of evidence I had included IN ORDER as they were arranged in the packet. On the upper right hand portion of all copies of evidence, I also wrote down the case number and name.

In our cover letter, I included my alien registration number, case number and the list of the evidence I had attached, in this case, the list looked like this:

Attached, you will find:
  • Copies of FRONT and BACK of green card of APPLICANT
  • Copies of PETITIONER'S DL - in this case, my husband who is the US Citizen
  • Lease documents of the house we're renting, with both of our names on it.
  • Financial records - checking and savings account statements - I included statements ranging from the time we first opened the account to current
  • TAX RETURNS showing joint filing (filing joint or separately, doesn't matter, as long as it says "married")
  • Insurance policies stating spouse as beneficiary
  • Joint utility bills showing both our names
  • Medical insurance cards
  • Car insurance cards
  • Photos of our church wedding, vacations abroad, and family gatherings
  • Receipts of our airline trips abroad
  • NOTARIZED AFFIDAVITS from 2 people who have known us since the time of our marriage (I didn't include this the first time but did send it when they asked for it the second time - but just showing you as an example - plus, it's better to include this anyway and save yourself the stress)

I did use a 2-hole punch to punch out the center top part and added a fastener to keep them together.
I didn't use any yellow markers at all. For the photos, I scanned them into my pc and then arranged them in a WORD document which included a description at the bottom of each photo as to who were in the photo, when it was taken and the event - though I wasn't that detailed - just mostly who and what the event was with date indicated as mo/da/yr

Hello all, after much procrastination I am trying to get my K1 packet together and I have a few questions.
This is a great site and I'm getting alot of helpful information.

- I have all her G-325 info, but I'm unsure if it is neccessary to list her employment info if it is limited
and was paid under the table?(waitress). She's only 21 and her work history doesn't go back 5 years.
Do I need to list that she was a high school student for some of that period? She is currently a
part-time student and not working. Would you recommend listing "None" for work history?

- I recently heard of the changes from Homeland Security regarding the fiance visa and the delay it
has caused many people. I heard they are releasing a new I-129 form this month. Does anyone
know if it has been released yet? and if not, should I wait for this new form before submitting?

That sucks!

I can't believe they can deny your petition based on how many people were in a photo or attended the engagement party, especially since I'm sure in some cases they didn't have one.

I guess I'll eventually find out though because our ceremony was very small. I do think having one would be essential in the eyes of any traditional vietnamese.

I'm in the process of submitting packet 3 and need some help from you experienced VJs.

I had the I-134 notarized with originals of my supporting documents.
-bank letter
-pay stubs
-employer letter
-tax returns for last 3 years
-stock statements
-etc.

I've read over a few other posts on this topic that were helpful but still
have these concerns:

Do I mail in a ceritified copy of my I-134 and supporting documents with pack 3 or the original?
If I make copies, do I have certify each supporting document? or just the I-134?

Can your 401k count under stocks, bonds on the I-134?

Any other tips or help is appreciated.
I'll be heading over to VN in a couple days.

I was beginning to think they might have lost her paperwork. We mailed it in on March 8th.

My fiancee just got approved and we also had a wedding ceremony for her family prior to the K1 interview.(see my timeline)
During her interview, they only asked her about the engagement ceremony and only asked to see pictures of it also.
Even though we had tons of pics of our wedding and my other trips?

I have to agree with Chuck and Kevin.
Although for me, having a little piece of mind just in case something did go wrong was why I went with Marc.
He did inform me of some evidence they may have requested that I didn't initially provide but I basically did all the
paperwork myself. As it turned out, they never asked to see that evidence but every case is different.

Man, it sounds like they do whatever they feel like over there. Since I'm just starting this process, it looks like it would be a plus to hire someone like Marc Ellis.

I fell for you 3AD, sounds like you have a pretty solid case.

Hi! Congrats!!! Thats great news.
I had a few quick Qs for you..
1. Did he submit all the forms( ds156 etc) at local VFS office, if yes, what did he take to the interview ? What abt proof of ongoing relatiosnship etc..
2. Where and when did he submit the medical interview stuff?
3.Have you guys planned a wedding? Did the consulate ask him that? What to answer if the consulate asks if you guys have set a wedding date...?
4. Same Qs as above for the intended date of travel? The consulate says not to buy tickets/make travel arrangements etc? What did you do?

:D Our interview on lucky Friday the 13th was successful!! YEA! :dance: :dance:

First of all, we had requested (TWICE) a Telugu translator because my guy speaks only broken English. They replied twice saying “Okay, you are most welcome”. But there was no translator there at the interview available to him. All the questions were asked in English and my guy had to make do with short answers in English sprinkled with a bit of Telugu. He said the questions were easy so anyone knowing even a small amount of English will do fine. Note on Chennai consulate: they reply to emails IMMEDIATELY but they are not always helpful. <_<

My guy showed up at 6:30 AM for 9 AM interview, he was like 4th in line and they let in lines at about 7:45 AM. It ended up he was the VERY LAST one they interviewed. He said he was alone in the room by the time they called his name. He came out of the Consulate finally at 1:30 PM. A 7-hour mostly waiting ordeal. Note to others: come at 7:45 AM not earlier; when you come has nothing to do with when you are interviewed. :no:

Inside the Consulate they took his index fingerprint and had him do the I-promise-all-statements-will-be-true swearing in.

They asked only seven questions:

1. Who is your petitioner?
2. How did you meet?
3. How long have you known each other?
4. What city and state is she living in?
5. What is she doing there?
6. If you don’t know English well, how will you stay in USA?
7. Do your parents agree to the marriage?

At the end they told him, “OK, your visa is approved. You can pick up your passport at VFS office tonight.” Later he went to the VFS office but they said it was not ready yet, he could pick it up on Monday. Because he had train reservation to leave Chennai and go to his home in Hyderabad on Saturday (it was Friday the 13th, remember), they said they would send it by mail on Monday and it would take 3 days to arrive to him.

When he was at the VFS office, they complained that the Demand Draft for visa fees was drawn at State Bank of India. They said it should have been drawn on HSBC bank. Actually on the Chennai Consulate website it says it can be drawn on “ANY national or international bank,” and they accepted it fine at the Consulate. But the VFS office just complained when they saw his receipt. However they did NOT ask him to redo it. Note to others: get your Demand Draft visa fees drawn on HSBC bank. :yes:

Another point on the Police Clearance Certificate (PCC): his permanent residence is in Kotananduru village in East Godavari District, but closest passport office is in Visakhapatnam city in Visakhapatnam district, so he got his passport there. He got a PCC from Visakhapatnam and from his village. He has lived in Hyderabad for nearly two years now, but couldn’t get a PCC from there as he had no proof of residence (all official documents, ration card, bank account etc., are in the address of his permanent home). IT WAS NO PROBLEM AND NO ONE ASKED FOR HYDERABAD PCC. No one even questioned why the passport was from a city & district where he did not reside. B)

All in all it was a LONG Visa journey but praise God it’s over now. We will wait for the passport to arrive then get the plane ticket. Whooohooo! :D (Yah I'm already studying for AOS haha! :blush:)

K-1 Fiance(e) Visa Process & ProceduresTourist Visa before the interview
Hi People,
I have somewhat of a special condition..Please help me as its a little confusing
I am a doctor in India and my fiance is in US( he is a doc as well) We got our NOA1 on 11-10-06 and now waiting for NOA2 ( california)
I have been to US once 2yrs ago on a tourist visa.
Now I have to take an exam in Los Angeles (for my MD degree) and that can be done only before May 15th. Getting a Visa for that exam is very easy to get from India ( as every doctor who wishes to practice here has to take it).
I applied for a tourist visa in August 06 for this test and I even interviewed, but the pre-requisite for taking this test in US is if you have cleared another one( in India), So I was told to pass my earlier test( in India) and take the Visa for the US exam when the results came, they gave me a yellow ticket, which means that i just show up at the consulate without appointment and I'll be given an interview.
Then 3 months after this I filed for the K1. Before the fiance thing happened (I was planning to come here in April), but now with a K1 in the process, I fear that if I goto the consulate asking for a tourist visa, they will refuse and I will lose the fees for the test -$ 1500.
what do I do?
Goto Embassy and risk the visa and hope this doesnt delay my K1 or just say goodbye to the $ 1500 and take the test when I come to US ( God knows when!!)
To all the people here , do you think with the current timelines my NOA2 might come by february? How long does it take after the NOA2 to get the interview...seems like its approx 3-4mos.
Please help...

Hello,
We have just been approved for our NOA2 (Nov filer). My fiance has to take a test in USA on April18, should she apply for a tourist visa? I dont think her interview will happen before end june.
Very confused, as if she applies for a tourist visa, will it hinder the progress or even halt the process for the K1?
