K-1 Fiance(e) Visa Process & ProceduresNo more sending of the packet 3 to fiance
QUOTE (johnnybgood265 @ Sep 30 2009, 08:07 AM) <{POST_SNAPBACK}>
Does anyone know why the embassy in the philippines does not send out the Forms and Checklist sent to foreign Beneficiary (Fiance/e). (packet 3) anymore ? I called the embassy last night to see if they have recieved our case and they did but i was waiting for them to send something to my fiance. So if you were waiting , dont because they changed this process. This should also be changed on the visa journeys flow chart. Thanks

form what I hear some Embassy send a packet 3 some do not. I guess that is how they save moneyby making you download it and return but the good thing is you can download it early and have everything completed before the embassy get it so this will speed it up.

K-1 Fiance(e) Visa Process & ProceduresShe Reject my Visa
QUOTE (Tom and Judith @ Oct 2 2009, 07:57 AM) <{POST_SNAPBACK}>
Hello every one, This would be Tom without Judy on this post. I have sad news,
Judy has decided not to go to the interview. This comes as a shock to me, but to some of you saw this coming.
Her reason is simple, One of her past boyfriends came back. And to keep it short. Money was involved.
She still wants to be friends. I still do talk to her.
But she is telling me now that I have to wait 2 years before I can file another Petition for someone else.
And for her it's 6 months for someone to file a petition on her behalf......IS THIS TRUE?

My orignal posts were under the name of Hoping2..

Tom

I am not sure sence you didnt get the visa but if you had received the visa you have to wait 2 years or get a waiver. as for the 6 months for her I dont know on that one. do you have someone else in mind already? If not 2 years will go by fast if you are starting over with a new GF. Sorry about the bad new and good luck on the future!

K-1 Fiance(e) Visa Process & ProceduresEasiest way to send money
QUOTE (Gigzapper @ Sep 30 2009, 07:49 AM) <{POST_SNAPBACK}>
After dealing with Western Union and MoneyGram I found they are way too expensive. Go to WalMart (or go online even) and get a WalMart Green Dot card. Get 2 cards - One in the US citizens name (so it's easy to put money on the card (only $3) and one in the foreign Fiancee name. The Finacee can use the ATM (extra $3 per use though) use it like a credit / debit card, pay for Visa fees, medical exam fees and do everything without any fuss. You can get a daily SMS or e-mail with the balance. Once the card arrives in e-mail send to fiance, put money on it by just stopping by WalMart. I found this is a lot cheaper (for the 6 or so months while we're working though the Visa process) and more convenient than using WU or MG.

Hope this helps!

(Just finished medical exam and interview on Oct 8th! Woohoo - almost here!)

Chuck and Rhean

I did the same thing with a bank ATM card. I opened a a different account at my bank and mailed my fience the atm card. now i can transfer money to her account online and she just goes to any Atm to take it out there is a fee for using a out of network TM but it is cheep compaird to WU

K-1 Fiance(e) Visa Process & ProceduresK1 interview this week - Question about filing date vs. engagement date
QUOTE (AdamF @ Sep 8 2009, 09:24 AM) <{POST_SNAPBACK}>
Hi,

I have my K1 interview in London on Friday.

Given the nature of the K1 process, I'm guessing our situation isn't that uncommon. We came to a mutual decision to file the I-129F without a formal proposal happening.

After the I-129F had been filed, I made a "proper" job of proposing the next time we met face to face.

So my question is this,

If I am asked at the interview when we got engaged/I proposed, will it raise any eyebrows if this is after the I-129F filing date, given that it's meant to be a peition for a "fiance"?

Thanks in advance,

Adam

I have the same problem I just told my fiencee to make up a date between the ttime we met and the time we filed so it will not be a red flag to anyone and I never put a engegement date on any paperwork so they can not ? this.

K-1 Fiance(e) Visa Process & ProceduresFile For A K-1 while fiance is still in the US?
QUOTE (Mark_N @ Nov 22 2009, 10:03 PM) <{POST_SNAPBACK}>
Hi all,

I have a bit of a complicated situation, and I was hoping that I could find some answers here that the people at CIS were not very helpful at answering.

My fiance is currently in the United States on an H1-B Visa. She is Korean. At the beginning of December, I will be leaving to Korea, and she will be remaining here to work. I will be in Korea up until around July next year, and will be starting Law School in August in a different state than the one in which we live. Due to current circumstances, we feel it is best to wait before an actual marriage (I need to meet her family first.)

My fiance is not planning on working at her current position until the end of next July (she works in the finance industry, and hates it), but will likely be coming to Korea sometime around next May. We would prefer to get married in Hawaii, because it's halfway for both families.

So, my question is, how do I go about getting my fiance into the country (either after we've married in Korea, or in order to get married in the United States) by August (once she's in Korea in May). Once she comes to Korea, she'll lose her H1-B visa, and so we'll have to file for either a K-1 or a K-3. From what I've read, the K-1 takes less time, but from May - August is only 3 months, which possibly is not enough time to get everything processed. We'd like to get married before I start law school, otherwise I'm going to have to either come back alone and wait for her, or postpone law school for a year and continue to work in Korea, which we don't want.

Can we file a petition for a K-1 visa now in anticipation of her quitting her job and being in Korea in May to finish the process? Or would this be considered fraudulently filing for a visa? Or would there be some restriction on her filing for a K-1 while she already has an H1-B? (Or would USCIS get confused? I called and spoke with them, and the rep kept asking me "Why would she want to file for a k-1 if she already has an H1-B?" and even though I tried to explain the situation, he just could not understand).

Any help here would be greatly appreciated. Please ask any follow up questions.

why not get married now with a JP and then file for a CR-1 and you can have a nice party in HI when the time is right?

K-1 Fiance(e) Visa Process & ProceduresTimeline Standards - dates & updates
QUOTE (thongd4me @ Oct 1 2009, 01:56 AM) <{POST_SNAPBACK}>
timeline.gif

PET PEEVE -
What "Date I-129F NOA1 (Receipt)" means is not the date you receive your NOA1 in the mail,
but the date when the Service Center receives/acts on I-129F form & sends the I-797C receipt
to you.
Timeline instructions (for NOA1) might be amended to say:
"Date printed on I-129F receipt {I-797C (NOA1)}"

In most actions (taking weeks or months), the difference between the date printed on the receipt and the
date you get it in the mail is not that great (days), but in the case of the NOA1 (a step that often takes
two-three days), the resulting stats may be distorted because the mail may take a week or more
to deliver it.

We can celebrate the mail receipt date in our profiles (no harm in that) but for the database it should
be kept simple & consistent since mail delivery times vary. There is only one date when the Service Center
does the job and gets it out the door. That measures the efficiency of the USCIS or Department of State
rather than the USPS.

ALSO -
In giving congratulations, check that the OP has updated his/her timeline.
It's not polite to fellow members to come out there screaming "I did it, I did it"
and not updating your TL (or not even having a TL for your friends to see).

TD4Me

{Next Tuesday in Bangkok by way of Dubai}

hey my pet peeve is that no one writes a review of the embassy after there appointment. To me this would be more helpful to know what questions are ask how hard they are, how long it takes, ect ect. timelines can only help us predict and no one can be sure how long anything will take but reviews can be a great help later to know what things to need or study but i understand after you get your visa at the embassy who wants to go write about it you just want to party!

we don't want to live here anytime soon. she takes care of her mother and teen daughter- couldn't leave them behind. so we won't be needing k-3 and all that for a long time. but i do want her to meet the family here, and have my family enjoy the wedding.

did we screw up getting a k-1 by registering with thai goverment?

yea if you regersterd your marrage in Thailand you can not do a K1 you have to go K3 or I think it is a CR1. some of the others on here can tell you the best way to go

K-1 Fiance(e) Visa Process & Procedureshelp Thai interview in 2 weeks not done yet!

Assuming the interview is approved, won't she be leaving her job? (as in, really soon?) Can't she take a little extra time off for the medical?

Yes and No, She will be leaving her job in May maybe April. After I come there for wedding party. We want to have the visa done so she can return to the US with me. She loves her job and wants to leave on good terms.

Her boss is a little mad at her now because she took a few extra days off for travel at New Years so the less work she has to miss the better. It is not a big deal to miss work but if she can get things done on non working hours it makes her feel better. I just talked to her this morning and she called the Hospital and they said they can do her medical on Saturday. They told her she will need 3 shots, that the medical is about 2000 and shots 7000 so around 10,000 total. She is happy about that and she told her boss that Monday she has to go get the police celerence and will be late coming in not a big problem. I tthink it is all coming together but only time will tell.

I see you have a interview coming up. Good luck!!! Good luck to all of us VJers!!

K-1 Fiance(e) Visa Process & Procedureshelp Thai interview in 2 weeks not done yet!

The police report may be able to be done on the weekend (but you have to contact them and see if they have hours on the weekend).
Whether they expedite it for extra baht has no bearing on WHEN they are open.
Also same for the medical - but it takes a half day minimum so I think they may not be doing that on the weekend,
as only a few doctors are certified to do that.

Good luck

Thanks Thong. Sa called the Police station they dont do it on weekend and they told her it will take 15 days. I think it is like 7 days for the check and then time to mail it to her she will go there First thing Monday and she if she can pick up the completed report or pay extra to speed it along.

The Medical she is going to check into doing it on Saturday so she will not have to miss more work. I dont think this would be a problem if not she can do it Monday after the police thing and just take the day off rather than going in late. I think we should be ok to get it all done in time.

I read somewhere that it take 1 week for the police cert from Thailand. My fiencee called and they told her 3 weeks on the phone, when she went in there today they told her 2 weeks. She explained that she needed it sooner and was told to call the officer in 3 days on his cell. She says that she thinks that he wants money to speed it up, I have no problem with this I lived in Thailand and know how it works but does anyone know how much we should pay for this type of services? Also the police man told her she needed a document from the embassy that said why she needs a police cert. I told her to take in the Packet 3 docs and that the cover letter should work but after he had her read it to him (he dont read english) he said this is not what they need but he took it anyway along with her email that says when her interview is and said call him. I think he did this just so it sounds like he is doing more work under the table. Does anyone have experence with this? I dont mind paying off the police but I dont want to over pay them then they will get gready and ask for more from the next guy!

From what I have read (someone correct me if I'm wrong) You do the medical one day, and then pick up the paperwork the next day. As far as the vaccinations, you will need to get the first series there but dont need to finish them there.

Edit: It would be much better to do as many vaccinations there as possible. They are much cheaper there.

Ok I am the one that did the Jan 2010 update. My fience went to the hospital on a Sat and ask if they could do everything in 1 day so she would not have to miss work to come bcak to pick up doc. this is what they did it took about 8 hrs and cost 10K. I dont know if it was more because it was a Sat or done in 1 day or if they charged her the same price YMMV she did say that it was a little cheaper because she took in her own forms not the hospitals. good luck

If you read the above sentence the 4-8 weeks is from the date the consulate receives your Package from NVC, not from when packet3 is submitted, which yours is about 4 weeks out from when they received it. I went off the data on this site for how long my interview would take to schedule. Most people on the site do update their timelines. If you also read the packet 3 checklist that was signed when returning packet3, it says you have completed all items on the checklist prior to sending in packet3.

here it is from the Embassy website packet 3 instructions.

Although most K visa appointments are scheduled in about
two months, the IV cannot guarantee all interviews will be scheduled that quickly. Each visa category
and case is different, however, and we cannot provide a timeline. Do not contact the IV Unit to ask
when your appointment will be scheduled.

My question is can you turn in your packet 3 before they mail it to you? I can track my app from NVC to the Bangkok embassy and download al the forms before so after the embassy has it can I just send in a completed packet 3 or should I wait for the embassy to mail it to us and then send it in? One more quick ? how long from the time you turn in packet 3 and 4 till the interview? I see different embassy have different times from a few weeks to 5 months so does anyone know how long Bangkok is running now? Thanks for all the help everyone

Hi BC75,

Yes, you can send in Packet 3 stuff as soon as you have your case # and are sure that the embassy has your case. I'll explain how I know this later tonight when I'm not so pressed for time. (I'm actually on my way to the post office to send my baby the I-134 and other doc's she needs to send in packet 3 for us!)

Re: the wait times between sending in packet 3 and your interview date, the most current info I have is not so great. Per usvisa4thai, One woman sent in her packet on November 20 and her interview was scheduled for December 17. This really sucks because earlier in the month people were getting their interviews only 10 or so days after sending in packet 3. I'm still holding out hope that my fiancée gets her interview and visa in time to make it here by Christmas, though.

Good luck and thanks to all that have contributed to this excellent thread!!

Erich

Hey thanks for the info I hope you can make your christmas timeframe I just hope that we can make it thru CSC before christmas maybe NVC would be nice. anyway good luck!!

CA has the writen test in Thai but the translation is off so it may still take a few times to pass they also have it on tape were they read the ? to you so if someone dont read english they can still take the test. Also they told her she could drive on her Thai licence for 1 yr or till she could get a CA licence they have Geico insurance and that was not a problem. I am thinking ahead as I am doing the K1 thing now and my Fiencee is in Thailand she is going to driving school over there it is only 3300Bhat for 20 hrs a lot cheaper than hear and when she comes next year if she need I will just send her to a refresher course or maybe my friend will pay me back and teach her. anyway I hope that helps someone and good luck to all!!!

I have a question, I hope this is the right place to post this. My fiancee lives in Thailand, she just went back about 3 weeks ago. She came here with the work and travel program, we ended up falling in love, and might have a baby on the way. I was wondering what is the quickest way to get her over here to the USA so we can get married? She has been looking into programs but they cost $4,000+ which we won't have for a few months, and then she will have to wait 7-8 months to be approved. I'm looking for the fastest way to get her here, we really really miss eachother, and these long-distance calls are draining my wallet. Right now we have a combined amount of $2,000 that we could drop down on visa applications, and we can quickly save up for the plane ticket. I'd do anything for this girl, please help me! Thank you.

Your options are stay engaged and go for a K1, or get married and go for a CR1. I believe K1 may be a bit faster, but I don't know that for sure, just a hunch. I'd say if your process takes only 5 months from submission to visa in hand, consider yourself lucky.

I can help you with the phone call thing. get vonage it cost 24.99 a month for unlimited US calls and you can add on Thailand and other asian countrys for $10 more a month unlimited. I use about 2000 international min a month to call my fiancee in Thailand

Hi all. I am new hear and have just been reading to get info before I apply for a K1. My girl is in school now and will not be finished till May of next year I am trying to time this so that she will get her visa in June. All of the websites give a wait time of about 6 months maybe 7 but from reading hear it looks a lot longer I was going to apply in December of 09 maybe Nov but do you think that I should apply earlier? I dont want her to get this too early because as I said she will be in school. I am trying to time it so that her school will end I can fly over to BKK for a few weeks we can have a wedding party for her family and then leave together any advice.

Welcome to VJ! Depending on the service center you file with (Vermont is taking about 45 days longer,) you are probably looking at 6 months. Look here:

I am in California so it looks like they are a little faster now. I was just worrired because I see a lot of people on here that have taken 1 yr or more and I would hate to wait now and have to wait on the back side too knowing that I could have done it earlyer. maybe I will apply a little earlier and then we can take our time turning in the packets if need be.

K-1 Fiance(e) Visa Process & ProceduresFiancee's mother had her visitor visa revoked at LAX
I was talking to my fiancee this evening as I always do and I was telling her about the approvals coming from CSC. I have a fairly recent NOA1 so I wasn't really planning on anything happening for awhile because of all the March and April people I would hope are ahead of me. I was touched today, but it was the same message I received back when the acknowledged my IMBRA RFE.

Anyways........

We were talking and she asked me if I thought that our application may come under greater scrutiny because her mother's visa was revoked upon arrival at LAX since she listed her parent's names on her G-325A forms. I'm not 100% sure of the reasons it was revoked but I know a few things. This occurred a week or so after 9/11 and she was flying from Malaysia (a mostly Muslim country) to Los Angeles. She was questioned by Immigration and being the person that she is, probably got a bit indignant at the questioning. She thinks of herself as a very refined Chinese lady and she speaks "proper" English, etc. They kept her for two days in an office with less than nice accomodations, revoked her visa and sent her home. I'm sure she was not treated well, but I can sympathize with the Immigration officials after what had just happened in New York.

So....

My question is....any thoughts on whether her actions will have an effect on our application? If so, where in the process would the delay occur? If I get the NOA2, are we clear?

Thanks so much for your thoughts!

K-1 Fiance(e) Visa Process & ProceduresWHOA......OMG...I got approved too - CSC
Thanks for all the good feelings. I'm still in a bit of a denial about it because I can't believe it. Since I got touched yesterday and it was the same old news I'd heard before I wasn't expecting anything to happen. I figured they just picked up my file to make way for more deserving ones. Then I checked this afternoon and they're telling me it was approved yesterday. Why did they have to delay it a day? Oh well, I'm surely not complaing now.

The great thing is I'm getting on a plane tonight for Kuala Lumpur to see my sweetie. I haven't seen her since Christmas because of some stupid medical thing that prevented me from flying. It will be a very sweet reunion.

:D

K-1 Fiance(e) Visa Process & Proceduresand Photos...
I cut and pasted the digital pictures into a Word document and put small captions under each one describing who was in the picture and when it was taken. I made sure the dates coincided with the dates stamped in my passport. The pictures didn't have any timestamps on them. I arranged them 4 to a page or so, depending on what looked ok and printed them out on a color copy machine on plain white paper. Then I just added those pages to my submission.

Seemed to be ok.
