I don't mean to bother anyone by replying to my own post numerous times, but I really need and would appreciate some help with this question. I have received some answers already, but anyone go through the same situation? If yes, what do you think my chances are of getting the approval.

Here is my question:
I'll try to make it clear and to the point. I have been at my job for the past 3 years or so and my salary is well over the poverty limity. My tax return for 2006 was over the 125% poverty line, but 2007's tax return missed it by $2,500 because I was in Germany visiting my husband and getting married. I have paychecks to prove that had I been there my income would have been well over the limit. Here's my question: Is my I-130 going to get denied because my tax return didn't cut it, or are they going to be able to accept the letter from my employer (and personal employee record, pay stubs, etc.) as proof enough that my income is well above the 125% poverty line. Are they understanding to the fact that I wasn't in the country, but my wages are well above the limit?

Hey Elvis - I know what you mean. I spent many years in Germany. Fluent in the language and I love the country and the people. My husband and I are going to try it out in the USA, for me, I could care less where I live as long as I have him. He wants to try our life together in the USA and if that's something I can help him with, then why not? We both had a wonderful time in Germany and we know that works for us, but I guess you could say he is ready for a change. I am pretty sure I would need a visa to get a job there. I tried already, but because we weren't married, I would've had to apply for a visa. I do love Germany though. smile.gif

Thanks for the reply badspellor - Here's my other problem. I'm 23. I have 1 car (under my name), paying rent to an apartment and a college degree. I have nothing else, really. I just really hope that everything will be enough. I mean, by the time my petition even gets to the NVC, it will be around Nov/Dec and they will be able to see with my paychecks that I am well over the 125% limit.

On I-864, Part 2 is information on the Principle Immigrant, that would be the NON-US citizen (your husband if I read properly. So put his address etc. in Part 2.

On I-864 Part 4 #12 it says Information on the Sponsor, that is the US citizen, you I believe, so you put your US address in this part.
On #13 I put the words "same as mailing" in all the spaces. I know it says "(if different from mailing address) but everyone told me to leave nothing blank, so I didn't smile.gif

Last, look over the wiki on James' shortcuts:

You probably wont need any of the shortcuts. As I am reading on the forums lately the online payment system also lets you print out most of the cover sheets you need.
Still, the wiki gives you information on what forms you need to gather ahead of time, and will reduce your time spent in the nvc process.

Hi Fellow Members,

My case was just recently approved by the CSV and it's on its way to the NVC. I just had a couple questions before the process actually gets started. I haven't received my case number yet, but I am sure I will shortly. This seems to be perfect timing because my husband is coming in 10 days and will be here to sign all the forms. I am pretty sure we will be using James's Shortcut, so I would love to get these questions answered beforehand. Thanks in advanced for the help!

1.) Regarding the DS-3032 - My husband (the beneficiary) can appoint me as his agent, correct? So all information regarding his case will be sent to me and I will just have to worry about obtaining his signature, right?

2.) On the I-864 - Affidavit of Support form (This is probably a horrible question, but I will ask anyway) - For Part II. Information on the principle immigrant... Do I use my husband's address in Germany, or the address at which we intend to live at in the USA. I am confused because I am looking on the example forms and "Jane Doe's" address is a USA one (the same address as "John Doe"). So basically the question is, will I use my husband's address in Germany, or the address I listed in the DS-3032 (my address where we both plan to live at).

I think that's about it for now.

On the G-325A form for my husband, he has his employment listed... however, he has just remembered that he actually started one of the jobs on a different month. Is that going to be a problem if his job start date differs on the DS-230 than what he put on the G-325A? I just don't want to receive an RFE for that. Any help/recommendations would be appreciated.

I understand all the visa and what not, but it fails to answer my question specifically. According to what I have read, he will only need one police certificate recent within the last 6 months. Anyway, I appreciate the help and lets see what the NVC says.

Hi fellow VJ members.....

I have a couple important questions regarding the DS-230 and Police Certificates and I'm hoping you guys can help me out.

Regarding Question #20 on the DS-230: First of all, if my husband lived in different cities of Germany (all in the north), would he have to list each city where he lived from the time he was 16? What if he can't remember exactly?

Secondly: Must he provide police certificates for each city he lived in, or did I read it correctly that it goes by country? So that would mean that he would only need the one police certificate from Germany?

Lastly: On questions 21a. and 21b. I am the US citizen I will not be joining him before of after his arrival to the USA. Would I simply just write none seeing as no one will accompany him to the USA?

I just tried calling the NVC (finally getting through) and my IIN number wasn't available yet. On the other hand though, my case was just entered into the NVC system on May 2nd.... so this could take a little while before I receive and additional information.

This is just a general question regarding the DS-3032. Why would someone already email the NVC when the DS-3032 hasn't been generated? Wouldn't this cause delays because if the paperwork hasn't been generated, then why would you submit the information now? Is it just better off to wait until I receive the message that the forms have been generated before having my beneficiary email the NVC to assign me as the agent.

Also, at this time will I be able to call the NVC to obtain my IIN number?

I was reading through Lotofpatience's NVC flowchart/shortcuts and I read that we need 2 original police certificates. My husband has 1 from the main police station. On the shortcut paper, it says that he needs one from the Passport office. Is that true? 2 police certificates are needed?

Also, if 2 certificates are needed, could anyone specify where a German citizen would obtain the "passport issued" certificate?

Definitely are going to need the waiver if you file within the USA.

The government doesn't mind Mexicans or any other culture here, it's the illegals (from any country) that they have a problem with.

My husband isn't yet pushing himself to learn english because he says, "Maybe if your German wasn't perfect, I would be forced to learn English." He doesn't get the fact that there will be little, to no jobs for him if his English isn't at least conversational. I understand, in order to really learn a language, you should go to where the lanuage is spoken, but if you don't have a backbone of vocabulary, you are going to get slaughtered at first. It's one thing to vacation at the place where the language is spoken, but when you live there, there is een more stress to learn. We have already decided to have a bi-lingual family, when the time is right. I like the fact that I am the only one in my family that can speak German, but I wish for his own sake, my husband would put more into learning English.

I know where you are coming from wanting your spouse to know your language too. My husband doesn't really get to feel 100% apart of the family with the language barrier. I can't leave him alone with them and expect him to have a good time because he doesn't understand a damn thing being said. For that, I become his 24/7 translator. I don't mind it, but like I said, I wish he would take advantage of his time right now and better his English skills. I'm not asking for anything more other than an attempt to better his vocabulary to help him, help himself.
