IR-1 / CR-1 Spouse Visa Process & ProceduresI-865 and AR-11 Question.... HELP!
I posted this question twice, to try and target a larger audience and hopefully find and answer to my question.

So, as the sponsor, I am fully aware that I need to file the I-865 form within 30 days of moving into my new apartment.

This is my question: My husband just received his visa on August 13, 2008. For his projected residence, I used my old address, I didn't have my new apartment at the time of filing. Do I still need to file an AR-11 for my husband even though he isn't here yet and hasn't had a change of address within the United States, or do I still need to file it because they are assuming that he is going to be living my old place of residence that I listed at the time of filing? Lastly, do I wait until he is in the United States to file this change of address, or do I fill it out now? He won't be here until mid September. He doesn't have his A# yet and that is needed to fill out the AR-11. I'm confused

Any help regarding this topic would be greatly appreciated.

Best,

Przy

IR-1 / CR-1 Spouse Visa Process & Proceduresnotarization
I-864 does not require a nortarization because you are signing under purgery. If there is an I-864A involved, that must be notarized. Simply having a co-sponsor that fills out an I-864 also does not require notarization. In addition to all that, I have never heard of any letter that needs notarization for the I-864. My case was a bit different and I explained why I didn't make the 125% poverty lines and it was perfect and to the point. Our petition was approved.

Hey everyone,

I just moved into a new apartment and my husband, who is not here, has received his visa. The purpose of the I-865 is to inform the USCIS of my new address change because I am the sponsor for my husband. Here are my questions: The form asks for my husband's alien number. This is not listed in the passport, or is it? I looked at the passport and couldn't find it anywhere on their. Would I write N/A because this number isn't available? When exactly is the alien number available? Also, I read somewhere that as the sponsor, I was allowed to submit the I-865 per Email. Is that true?

Thanks in advanced for your help.

Przy

I think you have put the cart before the horse. Once your husband arrives, then you can file for Adjustment of Status (AOS) to enable him to get a green card. The AOS requires entirely new evidence from you as his sponsor. That is also the time to file for an EAD (work permit) for him. Within 1-2 weeks, you will receive a Notice of Arrival (NOA) which provides his Alien Number for the first time. The USCIS doesn't need to know right away what your new address might be.

I appreciate you taking the time to reply, but you misunderstood my case. I suppose I should have given more information. My husband doesn't need to do AOS. He already is going to have a 2 year conditional permanent resident visa upon entering the US. We filed the I-130, not the I-129. My question is only pertaining to the I-865, regarding my change of address. The only connection to that form and my immigrant husband is the fact that they want to have an Alien Number. I suppose if the number isn't available yet, then an N/A answer would apply at this time. The USCIS gives you 30 days to submit this form. By the time my husband arrives in the US, the 30 days will be up (I moved into my new place on the 19th of August).

Hey Vjers,

I just called my hubby and got all the details about his interview in Frankfurt this morning....

The arrival: He arrived at the embassy at 6:45am and they were let into the embassy at 7:30am. He showed his interview letter, passport and walked through security with the copies of documents I sent to him.

Inside: He had to talk to 3 different individuals at the consulate. The first lady gathered the payment for shipping his visa to him. It was 4,00EUR for that. He had to write his name on the envelope and then she took his passport. The second lady was a real sweetheart he said. This lady looked through his paperwork and verified that everything was correct. There was only one issue that was cleared up and that was my income. I didn't have 125% to the poverty line and she asked my husband about that and he cleared up the fact that I was in Germany with him and couldn't make money there. She said, it wasn't a problem because if you added the months I was away from the USA, I would have been above the 125% line. After that, there were no issues whatsoever and my hubby signed the Part 2 of the DS-230 and his fingerprints taken. The third person was a nice gentleman who asked all the questions in German.

Questions asked:
What is the petitioner's name?
How did you meet?
When did you marry?
How old is your wife?

That was about it. The gentleman then asked to see photos. My husband left the photoalbum in the car!!! So, my hubby said that the photos were in the car and the gentleman said it wasn't a problem. He had enough proof and said, "Congrats, your visa was approved and will be mailed to you within a week."

All in all, it took 2 hours. He went in at 7:30 and was out at 10:30. The drive to Frankfurt took longer than the whole process (4 1/2 hours!!!!).

If anyone has any additional questions about the experience, just ask!

Mr. and Mrs. Przy

Hi and CONGRATULATIONSSSS,..!!!!!!

I just want to ask you what kind of documentations yours husband had on interview?,..I ask because my wife's interview coming soon so we want to be prepared for interview,...make sure that we have everything,....Thanks and good luck,..!!!!!!!

Thanks Goxi.

I provided him with copies from the I-130, G-325A, I-864, DS-230 and our email copy of the DS-3032. Pretty much I just duplicated the packets I sent out to the California Service Center and the National Visa Center. I had made copies of all the packets and all the supporting documentation needed. In addition to that, he had his interview appointment letter, his passport, his 2 passport pictures and a photoalbum. His medical exam results were faxed automatically to the consulate after his medical appointment that took place on August 4.

While we were well-prepared, the consulate didn't ask to see any documentation and photos were not needed. My husband was asked a couple questions and that was it. Frankfurt has been known to be a pleasant embassy and our experience can validate that. I don't know how it will be for your embassy, but I wish you luck. Just make sure bring along the copies of the documentation you already sent in, in case something got lost. Make sure you have your supporting evidence like pictures, plane tickets and such. That's about it.

Let me know if you still have any questions.

Thanks for answering my question,...That was enough for me,pretty much I have all documentations ready for interview I made all copies of documentation I already send, except those plane tickets, but I think I can find them to,....

And yes one more question about medical exam,...When needs to be done,I know that needs to be done before interview but when one week before or so,.?? Is there rule for that when medical exam needs to be done or ,...?
Thanks again and good luck

Hey Goxi - My husband had his medical on August 4 and his interview on August 13. Everything worked out perfectly. You want to make sure 1) You are able to get an appointment with the consulate doctor in time before your interview and 2) That you can either pick up the results to bring to the embassy, or check to see if the doctor can send the results to the embassy. Usually the medical exams are good for up to 6 months. The main rule regarding medical exams is that is HAS to be done by a consulate doctor. It can't just be any doctor. Other than that... your spouse could go in for medical now, if she wanted. Have he phone ahead and see how things work there. Usually the results are sent to the embassy automatically.

Good luck. smile.gif

Thanks przy again that was helpfull.....Same thing in my country medical exam has to be done by embassy doctor and there is two of them in my country and you have to call them to schedule appoitment for medical exam,..and I don't know yet for the results of medical exam maybe they send to embassy automaticaly or you have in yor hand on interview,..I am going to find out about that,...
I just though that there is some limit when medical exam has to be done some amount of time before interview,...anyway NVC gave me a phone number of embassy and I am going to call them tomorrow and ask them some information and questions,....operator from NVC told me if I have any kind of question I can call embassy and ask them,...
Thanks again and good luck,......

Good luck with that then. Take care.

All in all, it took 2 hours. He went in at 7:30 and was out at 10:30. The drive to Frankfurt took longer than the whole process (4 1/2 hours!!!!).

If anyone has any additional questions about the experience, just ask!

It took you 6 months just to get NOA1!?I mean people receive their approvals in 6 months.I hope you won't have to wait much longer.Have you called them?

I know it's crazy right. We haven't called them yet after receiving the NOA1. You think we should?

Absolutely. It doesn't hurt to call and see what's going on with your petition.

Good luck,

Przy
