Yes for me its January 21st. Therefore another two months. The funny thing is I have Global Entry Pass too which I included a copy of in my application. That means I cleared many of the checks they are looking for, so I don't understand why the delay.

This letter might address your concerns: I am not sure what the response from the DOS is regarding this letter. I do know that the US Government is required to respond to letters such as this from Congress within a timely manner. Maybe an email or phone call might help in finding out what they are doing?

Actually this could be a valid concern fwo reasons"

 

1. The American CO is not the only point of contact for your Ghanian {partner)...before he or she gets to the CO, usually there are local visa personnel that check the docs eg DS-160 etc....not sure..though the confirmation page says nothing.

2. When he or she is being interviewed for the K1 or the Spouse Visa, the waiting applicants could be nearby and over hear...You could ask for a private room perhaps?

 

Any comments from anyone else?

When we filed our petition in August we were so excited. We kept looking at average NOA2 times and we were like "if everything goes smoothly we should be getting it around this time."

So that time frame has finally came and in the mail we get something from CSC! Sweet NOA2 right?

Wrong. Big disappointment with a big fat RFE. I was sad and sad to tell the fiance. They requested more evidence that we have met in that time frame. So we gather everything that we could, even the same stuff from the initial petition, and turned it in. Few days later it finally came :) . So do not worry about an RFE. In our experience it usually means a NOA2 is coming up.

Thanks..the only thing I cna think about is she got refused four times last year for a B2 visa to visit me in the USA. She put on the visitor application I was a friend.which was friends with benefits LOL. Then in December we got engaged and January I submitted the paperwork. Reason for B2 refusal? She didnt make enough money to travel/visit the USA LOL...so she increased her bank balance..same refusal...maybe they want to know why she wanted to visit me so badly?

An RFE is a Request for Evidence. You either made a mistake on a form, or did not include supporting documentation that is required. You will receive an I-797 Notice of Action form in the mail. It will explain what they need from you. You have to wait for the letter. You cannot get information as to what the RFE is about over the phone.
 

Thanks. I sent a whole bunch of supporting docs like airline tickets, photos, letters from relatives/friends, letter of intent from both of us, chat logs on whatsup viber etc...it was an 1.5 inches thick..I cannot imagine what else they would want....yikes!!

I too got a RFE on the USCIS Website. When I call to get an update they say they mailed me an I-797 form and asked for an RFE for initial evidence. What does this mean?

Just know that you have to get married within 90 days of his entry to the US on the K-1The letter

The letter of intent by mistake omitted the words 'within 90 days'. I got the RFE. They received the corrected paperwork on July 31st...nothing since then. What are they doing with the application? Does anyone know?

Hello, I note there was no more postings on this topic.

I do have some more information for same sex couples regarding the embassy interview but basically you are treated the same was as a hetero couple with one exception. In countries where gay marriage is illegal or hostile, the consular officer meets in a private room with your fiance. Reason being is people around could hear the interview Q and A. It is an American person doing the interview.

 

I am not sure what is on the confirmation page for the DS-160 Print out which is usually collected by a local secretary etc with the passport and maybe given a number. Anyone can help?

 

PS: If you are still applying, YES either New York/MA or the entire NorthEast (except NJ and PA) have marriage.

I think brining too many shots and papers enought to show you cut down an entire forest is not worth it. Gets unwieldy and the CO could get annoyed if one is fumbling around looking for documents etc. best thing is to be targeted. Perhaps a few shots...say 10, maybe 10 pages of various dates of chat logs, phone itemizations etc would be better. After all it is a story and a consistent one is what they are looking for

Hope this helps you. This VJ site has been a godsend to be honest!!. Got the approval though it took darn long!! 6 months at TSC. I included just printed out colour pictures on 8.5 by 11inch printer paper. The attorney photocopied them on black and white..about 10 in total with dates and places..thats it really.

Front load the application as much as possible, so that when you fiancé goes for the Embassy interview its all set...airline boarding passes, hotel receipts, restaurants with credit card bills, letters from friends/relatves etc

Hello, im just a newbie here and me and my fiance were looking for some advices about k1 visa and someone on facebook told about this site. Me and my fiance from Georgia are planning to hire lawyer and she said it will cost 5k dollars, what she said that she can assure that she can really help us in k1 visa, is that the real cost of hiring lawyer or it will cost more? i know its kinda same topic from everyone and maybe repeatedly discussed but we really need some of your advices. My hubby said it will cost overall 10k dollars just to fix the visa including hiring lawyers and some papers needed. And we are 5months in relationship and met once for only two weeks ,coz he can only have a vacation for 2 weeks acc. to his job. Is it ok the length of time of relationships in visa? And can anyone put the step by step process of k1 visa here. thanks so much to your help of there is.god bless

We hired a lawyer. It is expensive indeed...but the most important part (if there is such a thing) is the petition of the US Citizen. The lawyer front loaded the application. That is key for you since you have just met for two weeks...(do you think that is enough?). I would include chat logs, phone calls, photos while you two were together, write a letter of intent (both of you have to), any letters from friends/family supporting the relationship.

 

The third phase when you are in the USA you can save some money and do yourslelf. but 5K sounds like a lot to me.

It was exactly six months for the RFE from NOA1, then its now been over a week since they received the paperwork for the RFE Reply. Silly omission of three words from the letter of Intent.

Well My NOA1 is January 28th and I got a response today..it was for an RFE which is concerning to me. I cannot imagine what they would want more....it said Request for Initial Evidence....the application was over an inch thick with letters of support, affidavit of intent on both parties, photos, boarding passes, chat logs etc etc....this is a complete mystery to me

Its been 8 days since receipt for the RFE by the TSC...no reply yet.

 

I called the Senator's Office and was told they got a reply from TSC to wait 4-6 weeks...LOL...this RFE was for omission of three words in the letter of intent..thats it
