Hey guys.

My question is regarding a change of employment... my fiancee (petitioner) has recently changed employment and taken up working for her sister as her nanny. My fiancee is payed every two weeks by check. Now, she takes out 15% of that money and puts it aside for when she has to file taxes (I don't quite understand the process over there for this, but she's going to be paying taxes and doing it all legally).
So for the I-134 form how would this be shown? She won't be able to show pay stubs or get a letter on work stationary since there is none. The previous job she still does one day a week, so she can show details of that job alright, but our main concern is showing details of her new job.

Question 35 asks me to list all previous visits to the U.S. Next week i'm making another trip and i wondered if that should be included on the form...i know i'll be sending the form to the consulate before this visit, but i'm curious if they check this out and see that i'm either currently in the U.S or at the interview will question me about this visit i'm making and why it wasn't included. hey guys,

For our I-134 form the sponsors salary is around $20,000 which is a little above the 100% requirement used for the Sydney consulate. However the current balance of the bank account is pretty low, and i wondered if it was worth me (beneficiary) depositing some of my money into that account to boost that up for the form? Considering i'll probably be putting my money into that account anyway once i move over to the U.S...... i was wondering if this would be acceptable or do you consider it not such a good idea?

For the self harm question...were you ever hospitalized or did you receive treatment? Obviously no one is going to tell you to lie...and you shouldn't. Explaining that to the doctor might be the best case.

I emailed the Sydney Consulate and they responded:

Dear Sir:

Applicants using the I-134 will need to show that their sponsor's income is 100 percent of federal poverty guidelines.

I'm a little hazy on something regarding the poverty guidelines for the K-1.

I've been researching this a bit and have a question about when exactly the 125% ($18,212 for 2 people) comes into play.
reading here: U.S Department of State website It states:

Should K-1 fiancé(e) visa applicants use the I-864 or the I-134?

Since fiancé(e)s are nonimmigrant visa applicants, they should use the I-134. They will need to submit an I-864 to U.S. Citizenship and Immigration Services (USCIS) when they adjust status to conditional immigrant in the United States after they are married.

Do the same income requirements apply to all immigrant visa applicants even if they use the I-134?

No. The 125 percent minimum income requirement, the most recent year's tax return and other requirements only apply when an I-864 is needed. Applicants using the I-134 will need to show that their sponsor's income is 100 percent of federal poverty guidelines as required under Section 212(a)(4) of the INA.

So if a petitioner is under the 125% required at the time of the consulate interview, but will be above that number when the AOS, how does that come into play?
Is it likely the consulate would deny the petition at the interview if the petitioner is slightly under the 125%? The I-134 doesn't exactly specify that you need to have a certain amount of money. It just asks for details of the sponsor and their promise to make sure you don't become a public charge.
So is the I-134 only relevant for that period before AOS? If so, then the petitioner only needs to show that they earn AT the poverty guideline rather than above, correct?
It seems the I-864 is the major form regarding the financial situation and the I-134 just the pinky swear....
I'm just a little confused on this.

Hey Miss Natalie.

I've been checking DHL shipments to Sydney as well....We received our NOA2 on the 18th, a few days after you. I'll call the NVC tonight and see if they have it. I'm hoping they've received it and it's been sent already too!

There have been a few shipments since the 22nd to Sydney.

1. Sent 9/23 - Arrived in Sydney 9.13am this morning. - 4lb package.
2. Sent 9/24 - Arrived in Sydney 9.12am this morning. - 1lb package.
3. Sent 9/25 - Arrived in Sydney 12.35...currently with a courier - 7lb package.

Gahhh AP sucks.

AP = Additional Processing.

Random packages get sent into AP. So instead of spending 3-4 days at NVC it spends 3-5 weeks there.

Average time between NOA2 and NVC receive is 7 days. Considering the NOA2 date was a Friday i guess it's not too far out of that range. I'll just keep checking over the next couple of days and hope!

You probably are already aware, but here is how to check the NVC....

When you get your NOA2 approval... call the NVC (I called after 4 days) using the number 603-334-0700, waited quite a while and then finally selected 5 which says speak to an operator or rep something like that. Gave them the EAC#####... number, they asked for beneficiary's name, dob, my name, dob and then told me the package is getting sent out today. Then they gave me my case number that will be used at the consultate (b/c we go through London it starts with LND). Have a great weekend. smile.gif


Great....i might call NVC when they open up today and see what's happening. We were approved on the 18th...touched again on the Monday 21st...so hoping that was the package being sent to NVC. Nothing in the mail yet, but i'll find out what's happening.... hopefully we're like you and the package is on the way to Sydney!

I love Philly international terminal, it's tiny! Security check in 5mns top (versus 2 freaking hours at Paris...)

The other day I stumbled on a old plane ticket, I never noticed before that the POE agent wrote places I should go see on it.

I haven't been to Philly airport yet...so far i've come in from JFK and Newark... POE will be LAX though.
We'll be living somewhere around Abington, PA. How about you guys?

Every now and then I go to the USCIS website and look up our case status thinking that our file was randomly picked and there is a note saying an RFE is on the way or it has been approved but just the same NOA1 date. Not sure why I do it. The other part of my brain then says, seriously think December. But I think I like the drama - it is like a little game show.
