That's all they need...the example in the guides. They're only interested you saying that and physically signing it. Nothing you add to the end of that shows proof of an ongoing relationship. You prove later between the time you send the package and have the consulate interview that you're still in a relationship.
Proof of visiting each other, pics, emails, chat logs etc...

Hmmm.

I'm sure you can come to America and marry and return to the Netherlands. Surely the marriage on American soil will be recognized as a legal marriage in your home country. If you have no intention of moving to the U.S there's no point filing for a K-1. Simply file the IR-1 / CR-1 or DCF if you both decide you want to return in the coming years. On a K-1 visa you would need to enter the U.S sometime within a 6 month period after approval and then marry within the 90 day period.

We just got out NOA2 alot quicker than expected....and for that we're so thankful!

I (the beneficiary) have a trip booked for Oct 17 - Nov 21 to go and see Janet. I'd still love to go through with this planned trip and spend some time with her before the interview....and maybe get some of the paperwork done while i'm there.
Have any of you guys done this? Is there a problem in going through with my trip?

Affidavit of Support Question - Re: Letter from Bank Officer

Hi,
Situation

We are at packet 3 stage (woohoo) and have everything required apart from this letter from the bank, my fiance went into a branch (Bank of America) and they would not provide a letter and would only stamp the account print outs. Even refused to initial or sign. We have the tax reurns, letter from employer and payslips. Trish earns well above the 125% - she needs to I am an expensive pet to maintain.

My question is - will the stamped statements be enough ? I have trawled thru forums for a couple of hours and a general vibe I get is that although good the letter is not necessary - of course I wolud come to that conclusion it's the answer I want, LOL. Anyhow was just wanting to gauge anyones experience and/or thoughts.

On another note - had my medical today in Melb - got the full pants down treatment, very thorough inspection carried out !!!

Hey Michael, make sure you have a letter from her employer stating her salary, how long she's been working there etc... it sounds like you probably have all that ready. The bank details, mortgage details, property value are all good if she earns UNDER the 125% . All you need are her tax receipts, W2's and employment letter when she's clear of the minimum requirements.

Not exactly sure about the first question you asked.
For question 2 he'd need to get a letter from work stating his salary and how long he's been working there. W2's and have his tax returns...not sure if one year is enough for tax returns or whether he needs 3 years...i'm sure someone who's been through this stage can help us out there.

I contacted the consulate about this form. Apparently Sydney doesn't need it at all for K1 visas. So you don't have to send it with part 1. I have filled it out already but am keeping it in my records just in case smile.gif

We do not require Part 2, and also please ignore the reference to the DS2000.

Please send us the rest of your documents as soon as possible.

If you are nervous about it, it couldn't hurt to send part 2 as well I'm sure.
I had already filled it out, so I am going to hold onto it if they need it at any point down the track.

I was pleasantly surprised yesterday by an email for the Packet 3 - I wasn't sure it was being delivered like that (and not sure if a hardcopy is coming but I dont think it will be necessary anyway). The packet 3 email came two days after the consulate got the petition from NVC! It's moving fast now.
Now I just have to wait for my medical on Oct 12th...

A quick question to those who've been approved: What is the average time frame from sending in your packet 3 to the interview date? Brian will be here in November and it would be really awesome if he was at the interview with me smile.gif

I think they say it's about 4 weeks to the interview date once packet 3 is returned...so Brian would probrably be there for that!

The NVC told me the same thing when I first called (I think the guy on the phone typed my number in wrong). I called back half an hour later and they told me it was there.

Call back and maybe they'll give you a different answer. Or Like Cindy and Warren said, it might already be on its way to Sydney smile.gif

I'd called a few times and got the same response....however i just called back again now and the woman said it had just been entered into the system.

Phew...i can breathe again now!

Jesse only just got our packet 3 emailed to him (a bit over 2 weeks after approval), I was never even sure what day NVC received/sent it... good to know that Sydney has it now though, I DHL'd my DS-230 to them on Friday and it was delivered yesterday morning.

Did you get a touch the day after your NOA2 like we did which I assume was it being sent to NVC.

Yeah we got a touch on Monday the 21st after it was approved on Friday the 18th. I assumed it was being sent out to NVC on that date. But NVC have no record of it arriving.
The NOA2 hardcopy states 'the above package has been approved and sent to the listed consulate' ..... but obviously they all to to NVC before getting to the consulate. I'm just confused and wish i knew where it was sad.gif

I'm emailing the consulate to see if I have to wait for my medical results to mail packet 3 back, or if I can send it sans medical... I'll let you know what they tell me. I still haven't actually received Packet 3 from them, but then, I'm not 100% sure if that shipment from NVC-Sydney the other day was mine.

One more question regarding immunizations - I guess I will have to ask the doc about this too - I don't think I still have my baby (blue) book, and all of my medical records were burned in a bushfire several years ago (basically everything from birth to age 12), so do you think the doc will be able to sign some sort of affidavit that I am up to date with shots? (although I do know that I need a booster for at least MMR). I'm hoping she has records but I'm not really sure she does.

There's actually a sports network called Setanta Sports which broadcasts the AFL...it was through them that I saw that Geelong game in New York.

I'm a Geelong fan. Funnily, i was in NYC in April and was walking past a bar near Times Square one afternoon and kinda just glanced in there as i was passing and noticed AFL on the tv. It was a Geelong vs Brisbane game played a day or so earlier. I was very impressed. laughing.gif

Hello,

I'd like to ask a question regarding the poverty guidelines for the K-1 visa. My fiancee and I have applied for this visa and are waiting for our NOA2 from the U.S. I understand that when we get to the stage where I (the beneficiary) will be adjusting my status in the U.S my fiancee needs to be earning 125% of the poverty guidelines.
I'm wondering for the I-134 form that i'll send once the Sydney Consulate sends the paperwork, does she at that stage need to be at the 125% level or at the 100% of the poverty guideline until Adjustment of Status?
I ask this because the previous 2 years she has been comfortably over the 125% but this past year she is a few hundred dollars short of the 125% ($18,212) for 2009. My fiancee begins a new job in the coming weeks and will again be moving up towards that 125%.

I'm just wondering if we'll require a sponsor for the I-134 form...because if it's at 100% of the poverty guidelines we'll be fine for that stage of this process without one.
There are no income levels listed on the I-134 instructions. If you could give me some details of what the Sydney Consulate expects for that i'd be extremely grateful.

Dear Sir:

Applicants using the I-134 will need to show that their sponsor's income is 100 percent of federal poverty guidelines.

The 125 percent minimum income requirement, the most recent year's tax return and other requirements only apply when an I-864 is needed.

I do actually have all that info... If I can find it in my inbox I'll repost here but I can't look right now, so you'll have to bear with me. If you want, just email the consulate (there's an email on their website somewhere... if you mail the wrong one they should forward it for you) and they'll probably mail you what they mailed me.

Just wanted to let you know I'm Stateside for the next couple of weeks, had no problem at immigration (they asked me if I was bringing food in? Why would they ask that at immigration?? Then they asked me again at Customs, go figure).
