I agree but according to May bulletin, there will be retrogression. I am also worried. I called yesterday, they said we have completed first slot for may and we can not guarantee interview in second slot. looks like intentionally they are not scheduling F2A people. most of the IR people who got CC after us already have interview date.

I just called NVC. they said your case was completed on 03/29/2014. then I asked about interview date, he said, First slot for May month has been completed and I can not guarantee you for the second slot for May.

 

Just wanted to share with you guys. I don't understand why he said I can not guarantee for second slot. I want my wife to get interview on May month because in june Visa bulletin dates can retrogress. I am F2A category from New Delhi.

We're not quite in your same position - we maintain homes both in Australia and in the US.  I'm a USC, but thanks to Australia recognizing same-sex partners as "de facto" partners (just like heterosexual unmarried committed couples), I have permanent residency in Oz.

 

It's really great that Australia offers these benefits even when they don't have marriage equality. I always say "thank God for the European Union" because it allowed me to move to Holland with my Austrian husband with no trouble. We basically arrived in the Netherlands, made an appointment with the immigration authorities, showed them our marriage certificate, and that was it!

 

I visited her for a couple of months this year after I was laid off from my job, and we decided that we would finally make our marriage official. At this point we were waiting with baited breath that DOMA would fall in the SCOTUS proceedings, and when we had the news, I cried happy tears - our marriage ceremony that happened at the beginning of this month all the more special. smile.png

 

So, about four of our six years together have all been long distance. When people ask me how long this journey is going to take, they're always so surprised when I say that it's going to take as long as it is, but at this point I'm just relieved that we actually have an end to this journey, now!

 

My husband and I were watching the live results on SCOTUSBlog on the day of the ruling. We were on the phone with each other from our respective desks at work (it was 4pm in Europe). My colleagues knew what was going on, so they let me slack off a bit. smile.png

 

After the ruling I felt like I got married again. We'd been waiting for this moment for so long that we actually couldn't believe it was real. All my friends at work were really supportive, and it was very celebratory. It was a great moment. Now the work begins, but it's worth it!

 

Oh my gosh OP, your story almost made me cry. I am so happy for you both!

Hi, I just wanted to start a thread for people who moved away from the U.S. to be with their spouse because of federal marriage discrimination, and are now finally able to go home because of the demise of DOMA (section 3). This could be a place where we share stories and support each other.

I met my (future) husband in Washington, DC in July 2008. He was interning at the Austrian and French Embassies for the summer and taking English TOEFL prep classes. I was taking Spanish classes at the same language school and we met in the elevator. I thought he was cute, so I offered to help him with his TOEFL test. We ended up spending the entire summer together. He even asked for an extension of his internship (and threw away his return ticket!) just to spend an extra month with me. Saying goodbye after four months of a perfect summer was murder, but we knew there was no choice.
 
We would talk at least three times every day on Skype (for me 6am, noon, and 6pm & for him noon, 6pm, and midnight). We also spent HUNDREDS of dollars/Euro per month texting and making quick calls throughout the day. He would also visit me for a WEEKEND from Austria every 6 or 7 weeks. He had more vacation days than I did being European, plus his family didn't know I was a man, so it was easier for him to come to me. He would land Friday night, and leave Monday morning. I don't know if this hurt or helped, honestly. Constantly being torn away from each other was nothing less than torture.
 
We kept this up for almost a year. It was exhausting at times, and sometimes I wished I could just stay in bed instead of getting on Skype. We'd get on the webcam and both be grumpy (me as 6am and him at midnight), but in the end we never regretted the call. He certainly was exhausted from all of the trans-Atlantic flights I am thoroughly convinced that this constant contact was the only way our long-distance relationship survived.
 
When I told him I was going to Montana to be with my family for Christmas 2008, he surprised me by booking a flight to be with me for a week the day after Christmas! When an Austrian flies all the way to Montana, I knew that he must love me. After that we decided we had no other choice but to spend the rest of our lives together. Since neither of our countries had marriage equality, we decided to move to the Netherlands. We spent six months researching EU immigration rules. We finally got married in New Haven, Connecticut on 01 May 2009.
 
In July 2009 we packed up our respective lives and moved to Holland. Four years later we have a fairly successful life, but we have not put down any roots, and we spent pretty much the whole time saving for the day we could "repatriate" to the United States. Now that day has finally come! We can't wait to start our "real" lives in the U.S.!

i actually did,but got the same answer..its up to the consulate officer,the way i understood it is,,,,,NVC doesn't  look at any assets or bank balance...they only compare your income listed on i864..anything below poverty line gets a check list for joint sponsor,,

 

I have income from my employment in Europe (I'm the American living with my spouse), but it will not continue after I leave Europe with my spouse when he emigrates to the U.S. Should I put my annual earnings on the I-864 and explain in a continuation sheet that it's foreign-earned, or should I put "zero" and risk a check list?

 

I have enough cash savings to meet three times the poverty level without any earnings, so that's not a problem. I just don't want to put that I have no earnings (even though I technically do) if it's going to delay things.

 

Any advice?

We got an email today that NVC has input our case (I registered for email notifications as soon as the case was received from USCIS).  I went to the website indicated for payment of AOS fee and the AOS fee invoice and the DS-261 electronic filing were already there.  I took care of both of them and it says wait 2-3 business days for the fee to change from "in process" to "Paid."

 

I experienced the same thing! We got our NVC email on Friday! I really thought they would ignore my "email notification enrollment" email since we didn't have an NVC case number, but they didn't! I'm really pleased with the way the NVC is working so far.

USCIS received it on 18 July. It looks like petitions from abroad aren't expedited per se, but since they are processed at the NBC itself rather than being transferred to a local office, this saves a bit of time. From that thread you linked to, it appears that around 90 days until NOA2 is average.

Hi! My husband and I have been in the same situation. We were separated for a year, but we couldn't take it, so I moved to the Netherlands with him (thank God for the EU). We've been waiting for DOMA's demise for 4 years. I can finally go home without having to give up my husband!

My wife has just sent off the I-130 (July 28th), so we are just scraping into this month's topic, haha. But, our case is also thanks to the end of section 3 of DOMA, so I'm excited that we can finally get this show on the road!

Unfortunately DCF is no longer available in Holland, however it looks like if both the USC and foreign spouse are abroad, the time between NOA1 and NOA2 is only 2-3 months instead of 5-6 months, even if filing with the lockbox.

Yes, DCF or direct consular filing, is an expedited process compared to applications that are processed through service centers in the US.

I just received my NOA1 in the mail today! My I-130 was sent to the NBC and I have a priority date of July 18, 2013. I'm doing consular processing since both my husband and I live in the Netherlands at the moment.

 

I've heard that I-130's submitted when both the foreign spouse and the U.S. citizen are living abroad are automatically expedited. Does anyone know if this is true?

I can only tell you what we did. We have not received any further checklists in relation to domicile so I'm assuming we're in the clear.

 

To prove domicile, my husband (USC) has been living in Australia for 7 years, we sent following documents to NVC:

 

1) a written explanation, how he came here to start a business, how that business has now been closed down, and that he plans to relocate as soon as my visa is approved

2) legal documents showing business has been closed

3) a copy of Australian visa showing the expiry date in December (cannot be renewed)

4) a copy of our apartment lease here in Sydney expiring in September, with no intention of renewal

5) copies of 3 credit card statements and various term deposit and bank accounts (all in USA) - statements show we have been slowly transferring money from Australia to US

6) a copy of a medical receipt showing my husband gets most of his medical/dental work done in the USA (proving he is retaining a "home" there)

7) a number of letters from various institutions (including insurance) that are going to his parents? house right now in the USA (but are intentioned to him)

8) a copy of travel record that shows that we go to USA at least 2 times a year, and that we maintain very close ties to friends and family

 

Domicile is a very case specific issue. Hope my list gives you some idea how you could potentially prove domicile in your case.

 

There a whole lot of posts on here where people list ideas as well, including lease agreenent with parents/family, quotes from shipment companies, emails to/from real estate agents, communiction from potential schools etc

Since we have been living in Europe for 4 years. we do not have U.S. jobs or a U.S. address. Does anyone have any advice on how we handle the domicile issue for the I-864? Ideally we would like to wait until my husband has the Immigration Visa approved before we leave our European jobs and move. We don't really want to rent or buy a U.S. residence, just to leave it vacant for months while we wait for his visa approval. We have enough cash saved to satisfy the income requirement, but this domicile issue is causing some stress.

 

Do we absolutely need a U.S. address to prove domicile for the I-864? Could I use my parent's address, even though they live in Montana but we intend to settle in Maryland? We don't want to do anything dishonest. Is there some way we could prove a good-faith intention to move without having an address? We certainly have enough emails and text messages where we've talked about how we "can't wait" to move to the U.S. over the years. We just had to wait for DOMA to be overturned.

 

Could we maybe say that the only reason I (the U.S. citizen) left the United States was because I could not sponsor my spouse for U.S. immigration, and now that DOMA is overturned we are doing what we otherwise would have done 4 years ago? Could this maybe prove that my time in Europe was "temporary" pending the end of federal marriage discrimination for immigration purposes?

8. Did you send I-130 package from abroad? Yes
9. Did you include evidence of your residence abroad in the I-130 package? Yes, I included our rental agreements as proof of relationship
10. Did you mention the fact you reside abroad in the cover letter or write a letter describing your current situation and the evolution of your relationship with your spouse (mentioning your residence abroad)? The cover letter listed our address, and I specifically mention that we live together in Europe where it asks for a U.S. address where beneficiary will live.
11. Has your case been "auto-expedited"? How long between NOA1 and NOA2? I don't know. I hope soon!

IMO, Copy of beneficiary full birth certificate (with translation) is actually useful, as 

 

local offices use their own rules for adjudication. 

 

If it was going to CSC or VSC, it's not required (per the I-130 instructions)

but since it's gonna route

lockbox->MSC->local office 

then having that beneficiary birth certificate is useful. 

 

Lots of folk reported RFE or NOIDs because of this, with the casefile at the local office.

Since my husband's birth certification is in German, I sent a color copy of every page of his passport. I've heard this is just as good as a birth certificate. Do you know if this is true?

When looking at my assets for the I-864, will they also take into account mine and my husband's economic viability? We will have about 5 times the poverty limit saved in cash by the time of the interview, plus we both have Master's degrees (my husband has two), we are 31 years old, in good health, and have about 7 to 10 years of working experience each. My husband speaks fluent German, English, and French on top of everything else. I think this makes us a safe bet to be able to find viable employment fairly quickly.

 

Will these facts make a consular officer more comfortable approving the immigration visa without either of us having U.S. jobs at the time, or do they only really care about the numbers?
